Wilson, City Admin PREPARED BY: Patrick McIntosh, Fire Chie SUBJECT: APPROVE AGREEMENT REGARDING FIRE PLAN REVIEW AND INSPECTION SERVICES FOR THE BRIGHTWATER RESIDENTIAL DEVELOPMENT Statement of Issue, Funding Source, Recommended Action, Alternative Action(s), Analysis, Environmental Status, Attachment(s) Statement of Issue: In September 2008, the City of Huntington Beach annexed the land upon which the Brightwater residential development is being constructed. As a result of this annexation, it is necessary for the city to assume responsibility for all fire plan review and inspection services. The attached agreement with the Orange County Fire Authority and Signal Landmark identifies the scope of these services. Funding Source: Not applicable. Recommended Action: Motion to: Approve: implementation agreement by and among the city of Huntington Beach, the Orange County Fire Authority, and Signal Landmark regarding fire plan review and inspection services to Brightwater. Alternative Action(s): Do not approve the agreement and direct staff accordingly. REQUEST FOR CITYCOUNCIL ACTION MEETING DATE: 3/15/2010 DEPARTMENT ID NUMBER: FD 10-006 Analysis: The Brightwater residential development being constructed is scheduled for 349 homes at completion. This development is located in the northern portion of Huntington Beach. The land where the development is located was initially an unincorporated area under the jurisdiction of the County of Orange. In September 2008, the City of Huntington Beach annexed this area. Prior to annexation, the Orange County Fire Authority had responsibility for fire plan review and inspection services for any homes constructed. Since the residential development was annexed, it is necessary for the Huntington Beach Fire Department to assume fire plan review and inspection services for the remaining homes scheduled to be built. These services consist of activities related to fire sprinklers and methane barriers. With both services, a plan check review will be performed, with subsequent field inspections. In all cases, proper installation of fire sprinklers and methane barriers will be confirmed, as required by the Huntington Beach Fire Code and applicable city specifications. The Huntington Beach Fire Department determined that the scope of fire plan review and inspection services would not impact current staffing capacity or service delivery. All plan check and inspection revenue will be credited to the city's general fund. The attached agreement (Attachment 1) with the Orange County Fire Authority and Signal Landmark provides for implementation of these plan check and inspection services. Attachment(s): 1. 1Implementation agreement by and among the city of Huntington Beach, the Orange County Fire Authority, and Signal Landmark reaardina fire plan review and inspection services to Briqhtwater. -2- 3/1/2010 3:16 PM IMPLEMENTATION AGREEMENT BY AND AMONG THE CITY OF HUNTINGTON BEACH, THE ORANGE COUNTY FIRE AUTHORITY, AND SIGNAL LANDMARK REGARDING FIRE PLAN REVIEW AND INSPECTION SERVICES TO BRIGHTWATER THIS IMPLEMENTATION AGREEMENT ("Agreement') is made and entered into on 2010, by and between the CITY OF HUNTINGTON BEACH, a California municipal corporation ("City"), the ORANGE COUNTY FIRE AUTHORITY, a Joint Powers Agency ("OCFA"), and SIGNAL LANDMARK, a California corporation ("Developer"). The foregoing parties may sometimes hereinafter be referred to as "the Parties." WHEREAS, the OCFA and the City provide fire, rescue and emergency medical services, including basic and advanced life support service, as well as emergency related services within their respective jurisdictions; and The City has annexed approximately 105.3 acres of property commonly known as the Brightwater Development Project ("Project') which is described in Exhibit A and depicted in Exhibit B and is owned by Developer (with the exception of units previsously sold); and City and OCFA have approved that certain "Assignment of Secured Fire Protection Agreement (Signal-Landmark-TT15460)" dated September 28, 2006, whereby the duties and obligations of the secured fire protection agreement between OCFA and Developer, was assigned to the City; and On December 17, 2007, City approved that certain "Cooperative Agreement by and Among the County of Orange, the City of Huntington Beach, Signal Landmark, and the Orange County Local Agency Formation Commission Regarding Annexation of Unincorporated Real 669918.1 Property Commonly Known as the Brightwater Development Project" (the "Cooperative Agreement"); and Among other things, the Cooperative Agreement provides in Section 3.6 thereof as follows: "OCFA. Subject to the separate agreement between City and OCFA, OCFA shall provide all pre -construction, construction, inspection and fire related development services including, without limitation, methane mitigation, oil well mitigation, pre -construction consultation, plan check, inspections, and post — construction certificates; as applicable, but in accordance with California Building & Fire Standards/Codes with local amendments. Following the date on which a Unit, Common Area, and Public Improvements are Fully Improved and Annexed, City shall assume all such services and functions, including Implementing Approval authority and OCFA approval authority, for any Unit, Common Areas, and Public Improvements when that Unit, Common Areas, and/or Public Improvements becomes Fully Improved and Annexed and the City is in possession of records that enable the City to provide planning and building permit services for that area. The County shall notify the City, in writing, within ten (10) days after the County has determined that any Unit, Common Areas, and/or Public Improvements, is Fully Improved and Annexed;" and City and OCFA desire to implement the foregoing portion of the Cooperative Agreement by entering into a separate agreement (as referred to therein) that sets forth the duties and obligations of each Party regarding pre -construction, construction, inspection, and fire -related development services (the "Fire Development Services") to the Project, NOW, THEREFORE, the Parties do hereby agree as follows: 1. PURPOSE AND INTENT. The purpose of this Agreement is to facilitate a smooth and efficient transition of responsibility for Fire Development Services from OCFA to City in a way that provides efficiency and continuity for the fire and life safety elements designed into the Project. 2. DUTIES. Following adoption of this Agreement, OCFA shall continue to provide Fire Development Services for the following portions of the Project: 669918.1 Lots 34 thru 40 of Tract 17032; Lots 46, 47, 54, 55 of Tract 17034; Lots 34, 75, 76, 78 of Tract 17076; and Lots 20, 64, 65 of Tract 17033. City shall provide Fire Development Services for all other portions of the Project. Developer shall pay City's usual and customary fees for the Fire Development Services to be provided by City pursuant to this Agreement. 3. SPECIFIC PROJECT ELEMENTS. A. Infrastructure. For purposes of this Agreement, roadways, fire lane markings, gated entries, public water supply systems and similar Project elements are all considered Project Infrastructure. Infrastructure elements that are substantially completed and capable of performing their intended purpose shall be subject to inspection and approval by City. Project Infrastructure design elements will meet criteria established in the Fire Master Plan approved by OCFA. B. Fuel Modification. For purposes of this Agreement, fuel modification shall include all elements of the fuel modification plan that pertain to vegetation management intended to protect the development from wildfire. Fuel modification installation has been completed. Final inspection of the fuel modification will be accomplished jointly by OCFA and City at a mutually convenient time to be established by City after consultation with the Developer. C. Methane Miti ag tion. To date, methane mitigation plans have not been reviewed by OCFA. Henceforth, all methane mitigation will be subject to City's methane mitigation standards and review. City's preliminary review has revealed that there are a total of 9 669918.1 (nine) oil wells located within the Project area. Three of the oil wells are within a 100 foot radius of fifteen (15) projected homes. Such homes require a methane barrier per Huntington Beach City Specification #429. The following is a list of the three oil wells and the respective Parcel(s) they affect: 1. Aera Energy LLC (North Bolsa #152) API # 05902635 Tract #17033, Lot: 63. Note: Construction has commenced on Lot 63 and it will not be subject to City's methane mitigation standards and review. 2. Aera Energy LLC (North Bolsa #143-M) API # 05902633 Tract #17076, Lots: 88, 89, 90, 91, 92, 93 Total of six (6) lots 3. Chevron USA "Torrance #1" API # 05904215 Tract #17076, Lots: 8, 9,11, 12, 13,18,19, 20 Total of eight (8) lots. Methane mitigation elements will be subject to review and approval by City for each of the above -referenced parcels as noted herein. D. Residential Fire Sprinklers. OCFA will continue to provide inspections of those lots identified in Section 2 above regarding compliance with OCFA Residential Fire Sprinkler requirements. The City may, at its sole discretion, require plans to be resubmitted for City review of all other lots in the Project not identified in Section 2. 4. RECORDS. All records pertaining to the Project will be copied and provided to City for its use. Records will be provided to City within 30 days of the approval of this Agreement. 5. TECHNICAL ASSISTANCE. OCFA will provide technical assistance to City upon request. Technical assistance will include clarification of the intent pertaining to design and construction features of the Project affecting fire and life safety. OCFA will make reasonable efforts to be responsive to requests based upon workloads. 660918.1 6. COORDINATION OF PLAN REVIEW AND INSPECTIONS. Pursuant to the terms of the Cooperative Agreement, the County of Orange ("County") remains as the permitting authority for the Project until otherwise provided by the Cooperative Agreement. City will coordinate its Fire Development Services with the County. 7. NOTICES. IMMUNITIES. By entering into this Agreement, neither City nor OCFA waives any of the immunities provided under state or federal law. 9. CONSULTATION WITH COUNTY; REVIEW APPROVAL AND CONSENT BY DEVELOPER. The Parties agree that they will consult with the County of Orange during the implementation of this Agreement.
