HomeMy WebLinkAboutOFFICE OF EMERGENCY SERVICES - 1978-05-30(0, r S 10 T E O F C A L I F O R N T A O F F I C E O F E M E R G E N C Y S E R V I C E S EXTENSION OF AGREEMENT THIS AGREEMENT, made and entered into this 30th day of May , 19 7_1 by and between the State of California, acting by and through its duly appointed, qualified, and acting Director of the Office of Emergency Services, hereinafter called STATE, and the HUNT114GTON BEACH FIRE DEPARTMENT - through its duly appointed, qualified, and Acting Officers, hereinafter called TRANSFEREE. W I T N E S S E T H: WHEREAS, under Agreement dated May 30a 1275, , STATE transferred possession of OES PUmper No. 127 . along with certain equipment to TRANSFEREE for a period of jxtio sears _, commencing June 30. 1976 and ending ,tune 30. 1978 , for a consideration set forth therein; and WHEREAS, it is the desire of the parties hereto to extend the term of said agreement for an additional two-year period upon the same terms and conditions; NOW, THEREFORE, it is mutually agreed as follows: 1. The paragraph of said agreement relating to term is hereby amended to provide that the commencement date shall be June 30, and the expiration date shall be June 301 1980__ 2. All other terms and conditions of said agreement shall rei.::: in unchanged and in full force and effect during the extension period provided for herein. HALL I.A. # 002 INDEMNIFICATION AGREEMENT In consideration of being permitted to use International Van Pelt 1968, Model V-0206, Triple Combination Fumper as a part of a program under the direction of the City of Huntington Beach's Fire Department, the city r-f Huntington 3each hereby releases the State or California and all of its employees and officers, of any responsibility or liability caused by the City of Huntington Beach, its officers and employees and associated with the use of OES Engine 127 by the City of Huntington Beach's Fire Department. The City of Huntington Beach further agrees to hol:i harmless, defend, and indemnify State of California, its officers and employees from any and all claims, known or unknown, injuries, damages, losses, causes of uct�:on and demands which are caused by the City of Huntington Beach, its officers and employees and resulting from or it any manner arising out of or in connection with the use of OES Engine 127 facilities by the Huntington Beach Fire Department. The City of Huntington Beach hereby c1-4sclaims any liability, and refuses to hold harmless, defend and indemnity State of California for any acts or emissions to act by State of California, its officers and employees in connection with the City's use of OES Engine 127. The City of Huntington Beach is self insured L-o $1,000,000.00 0 0 and indemnifies State of California to that amount by this agree- ment and the accompanying Cert.ricate of Self Insurance.
