On November 11, 1975, the Board of Supervisors approved the agree-
ment between the County of Orange and the City of Huntington Beach
for the construction of bike trails from Revenue Sharina funds.

City of Huntington Beach, a municipal corporation, hereinafter referred to as "City" and
the COUNTY OF ORANGE, a division of the: State. of California, hereinafter rf:;e:rred to a:,
"COUNTY".
WITNESSETH
WHEREAS, COUNTY has agreed'to share some of its general revenue sharing funds with the
City of Hianti.ngton Beach for she purpose of constructing a bicycle trail;
NOW, THEREFORE, FOR AND IN CONSIDERATION OF VIE MUTUAL PROMISES, COVENANTS AND CO'eMITIONS
HEREINAFTER SET FORTH, ".71E PARTIES HERETO AGREE AS FOLLOWS:
1. Huntington Beach Recreational Trails Phase II shall be located at:
Newland Street: Garfield to Pacific Coast Highway - 3.0 miles
Graham Street: North of Edinger to McFadden - .5 miles
Gothard Street: McFadden to Edinger - .5
McFadden Avenue: Graham to Gothard

2. The parties hbreto agree that the cast of construction of the bicycle trail shall be
equally divided between the CITY and the COUNTY, the CITY to pay over the entire period
of the project fifty percent (501) of this cost, or eighteen thousand eight hundred dollars
($18,800) , or a lessar amount, if the CITY's cost of. construction after the date of
agrees:int is decreased. CITY shall be responsible For the cost of design overhead, as.
well as operation and maintenance; such costs are not included in joint funding. Payment
by the COUNTY, based on actual expenditures, shall be made upon tender of CITY invoice
and itemized documentation of construction costs to COUNTY and approval by the County
Administrative Office.
3. CITY's source of funds for its share of proiect costs ($18,600) shall be gas tax fundn.
.4. For purpose of this agreement all funds to be received under this contract shall he
disbursed or encumbered on or before June 30, 1975.
5. CITY shall maintain accounting records and other evidence pertainit,r3 to cost:; incurred

.. 6. , CITY agrees that construction costs only shall be incl.ud ud in joint fundinej. CITY
further agrees that a final engincerinq ;!stir,,;itc shall be submitted to COUNTY Prior
to beginning work on this project.
7. 'CITY acknowledges that the funds being provided by COMITY are funds received by the
jaunty of Orange pursuant to the State and Local Fiscal. Assistance Act of 1972,
Public Law 92-512, and that expenditures of these funds must he in accordance with
said Law and regulations issued by agencies of the fedcra: government. CITY further
acknowledges that when such funds are used on any construction pr3ject for which
twenty-five percent (25%) or more of the costs are paid out of revenue funds, prevailing
wages must be paid in accordance with the Davis Bacon Act, as amended, 40 U.S.C.
276a-276a--7, and that labor standards as specified by the Secretary of Labor must be
complied with. CITY agrees that if subsequently deterr.ined that said funds we»e not
expended in-a-npliance with the federal laws and regulations, CITY will refund to COUt ;Y
such sums which were improperly expended.
8. No person shall, on the grounds of race, color, national origin, or =ev, be excluded
from participation in, be denied the benefits of, or be subjected to discrim-,'nation
under, any program or activity funded in whole or in part with funds made available
under this contract.
9. CITY agrees the bicycle trail constructed under this program must be retain&& for
recreation purposes in perpetuity, along with a level of nFreration and maint,:!nance
adequate to insure the maximum utilization of the project by thu public for recreation
purposes and that the use of the property shall be granted to all residents of the
COIRITY on the same conditions that residents of CITY use the property and that if the
property ceases to be used for said purroae CITY shall rep4y to CGIN-47 the summs
contributed by the COUNTY hereunder.

On motion of Supervisor Clark, duly seconded and unanimously
carried, the Chairman and the Clerk are authorized to sign Amendment to
Ag.reement between.the County of Orange and the Saddleback Valley Unified
School District, dated November 11, 1975, for the Ronald W. Caspers
Memorial Aquatics Facility to increase the School District's share of
construction costs, as recommended by the County Administrative Officer
in his letter dated November 4, 1975.

AND OPEN SPACE ACQUISITION OF WEST ORANGE PARK CITY OF
ORANGE
On Motion of Supervisor Clark, duly (seconded and unanimously
carried, the Chairman and the Clerk are authorized to sign the Revised
Agreement bet:-reen the County of Orange and the City of Orange, dated
November 11, 1975, providing for the purchase of Uest Orange Park in
installment payments with final payment on or before danuar-f 31, 19783
as reco:rm.ended by the County Administrative Officer in his letter dated
November 4, 1975.
