Huntington Beach Recreational Trails Phase II shall be located at: Newland Street: Garfield to Pacific Coast Highaay - 3.0 miles Graham Street: North of Edinger to McFadden - .5 miles Gothard Street: Mc:'adden to Edinger - .5 McFadden Avenue: Graham to Gothard - 2.0 2. The parities hereto agree that the cost of construction of the bicycle trail shall be equally divided between the CITY and the COUNTY, the CITY to pay over the entire period of the project fifty percent (500) of this cost, or eighteen thousand eight hundred dollars ($18,800), or a lesser amount, if the CITY's cost of construction after the date of agreement is decreased. CITY shall be responsible for the cast of design overhead, as well. as operation and maintenance; such costs are not included ir. joint funding. Payment by the COUNTY, based on actual expenditures, shall be made upon tender of CITY invoice and itemized documentation of construction costs to COLTIITY and ;ipprnval by the County* Administrative Office. 3. CITY's source of funds for its share of project costs ($18,800) shall be gat to:: funds. 4. G. CITY agrees that construction costs only shall be included in joint fui:iing. CITY further agrees that a final engineeri.ny estimate shal.l be submitted to COUNTY prior to bc!ginning work on this project. 7. CITY acknowledges that the funds being provide] by COUNT' are funds received by the County of Orange pursuant to the: State and Local Fiscal Assistance Act of 1972, Public Law 92-512, and that expenditures of these funds must be in accordance with said Lace and regulations issued by agencies of the federal government. CITY further acknowledges that when such funds are used on any construction project for which twenty-five percent (25%) or more of the costs are paid out of revenue funds, prevailing wages must be paid in accordance with the Davis Bacon Act, as amended, 40 U.S.C. 276a-27Ga-7, and that labor standards as specified by the secretary of Labor must be complied with. CITY agrecs that if subsequently determined that said funds were not expended in compliance with the federal laws and regulations, CITY will refund to COUNTY such sums which were improperly expended. 8. 1,o parson shall, on the grounds of race, color, national origiii, or sev., be e}:eluded from participation in, be denied the benefits of, or be subjected to discrimination under, any program or activity funded in whole or in part with funds made available under this contract. 9. CITY agrees the bicycle trail constructed under this program must be retained for recreation purposes in perpetuity, along with a level of operation and maintenance adequate to insure the maximum utilization of the Project by the public for recreation purposes and that the use oz the property shall be granted to all residents of the COUNTY on the same conditions that residents of CITY use the property and that if the property ceases to be used for said purpose CITY shall repay to COUNTY the SUMS contributed by th,. COUNTY hereunder. Casners Memorial Aquatics Facility to increase the School District's share of construction costs, as recommended by the County Administrative Officer in his letter dated November 4, 1975.
