DECLARATION; AND 'PURPOSE OF CONIGRESS 14 The Congress found and declared that the high incidence of crime 15 in the United States is detrimental 'Co the genE .1 welfare rf th_ nation and fs 16 citizens; and that criminal justice efforts must be better coordinated, intensified, 17 and made more effective and equitable at all levels of government. 18 Congress found that: 19 1 . Juvenile delinquency constitutes a growing threat to the 20 national welfare requiring irrr.ediate and comprehensive action 21 by the Federal Government to reduce and prevent delinquency 22 by developing and implementing effective programs to improve 23 the quality of juvenile justice in the United States. 24 2. The victims of crime should be made a more integral part of 25 the criminal justice system. 26 3. There is an urgent need to encourage basic and applied research, 27 to gather and disseminate accurate and comprehensive justice 28 1 statistics, and to evaluate methods of preventing and reducing 2 crime. 3 4. Crime is essentially a State and local and community problem 4 that must b( dealt with by State and local governments. 5 a. The financial and technical resources of the Federal Government should be made available to support such State and local and 7 community-based efforts. A 6. The financial and technical resources of the Federal Government 9 should be utilized by applying such resources to State and local 10 efforts to address selected probl2ms of fundamental importance 11 to the criminal justice system. 12 7. The role of the private security industry in the prevention 13 and control of criminal activities is important ar.d encourages 14 improved cooperation and coordination between public law i5 enforcement agencies and the private security industry. 16 8. The future welfare of the fla-t-ion and the well-being of its 17 citizens depend on the establishment and maintenance of viable 18 and effective justice systems which require: 19 a. systematic and sustained action by Federal , State ane 20 local governments ; 21 b. greater continuity in the scope and level of Federal assistance; 23 and 23 c. continuing efforts at all levels of government to streamline 24 programs and upgrade the functioning of agencies responsible 25 for planning, i -tplementing and evaluating efforts to improve 26 justice systems . 27 The declared pclicy of the Congress is to aid State and local 1 28 III/ 2 1 governments in strengthening and improving their systems of criminal and juvenile 2 justice by providing financial and technical assistance with maximum certainty and 3 minimum delay and to: 4 1 . Authorize funds for the benefit of States and units of general 5 local government to be used to strengthen their criminal justice 6 and juvenile justice systems. 7 2. Develop and fund new methods .°ra programs to enhance the effectiveness g of criminal 9 justice agencies. 9 3. Support the development of city, county, and statewide priorities 10 and programs to meet the problems confronting the justice system. 11 4. Reduce court congestion and trial delay. 12 5. Support community anticrime efforts. 13 6. Improve and modernize the correctional stem. 14 7. Support victim-witness assistance efforts. 15 8. Encourage the undertaking of innovative projects of recogniZed 16 importance and effectiveness. 1.7 9. Encourage the development of basic and applied research directed 18 toward the improvement of civil , criminal , and ,juvenile justice 19 systems and new methods for the prevention and reduction of crime 20 and the detection, apprehension, and rehabilitation of criminals 21 and delinquents. 22 10. Encourage the collection and analysis of statistical information 23 concerning crime , ,juvenile delinquency, civil disputes , and the 24 operation of justice systems. 25 11 . Support manpower devf- oprent and training efforts. 26 12. Provide for a financial assistance program to the families of 27 public safety officers killed in the line of duty. 28 3 fy 1 13. Support. total resource oriented approaches to the problems 2 of courts and the criminal and juvenile justice system. 3 14. Encourage programs to educate the public 'ire the areas of .I civil , criminal , and juvenile law and justice system operation. 5 The policy of the Congress is that the Federal assistance made 6 available s►iall not be utilized to reduce the amount of State and local financial 7 support for criminal justice activities below the level of such support prior to 8 tFle availability of such assistance. 9 II. ELIGIBLE JURISDICTI0N 10 A. The Law Enforcement Assistance Administration may provide financial 11 assistance to an eligible jurisdiction to enable it to carry out all 12 or a substantial part of a program or project. An eligible jurisdiction 13 shall be any combination of units of local government which has a 14 population of one hundred thousand or more persons on the basis of the 15 most satisfactory current data available on a nationwide basis to the 16 Law Enforcement Assistance Administration. A combination as applied to 17 units of local government means any grouping or joining together of such 18 States or units for the purpose of preparing, developing, or imolemrintina 19 a criminal or juvenile justice program or project. 20 B. The County of Orange and the cities signatory to this contract rio declare 21 themselves to be an eligible jurisdi<:tion within the meaning rif 22 section 402, a, 4 of Public Lahr 96-157 and join together fo•• the purpose 23 of preparing, developing, or implementing criminal and juvenile justice 24 � plans, applications , programs , projects , and such other functions as 25 defined in Section IV of this contract. 26 C. The County of Orange and the signatory cities do designate the Criminal 27 Justice Council to carry out the provisions of the Justice t.Sys tem ., 28 4 { 1 1 lfi�prav rerlt�'Act of' 1979�on behalf o'f the'County�-and=�theld =ne 2 signatory cities. Membership, categories , and appointing authorities 3 of the Criminal Justice Council shall continue as constituted on 4 the effective date of this contract. CRIMINAL JUSTICE COUNCIL 9 h. Total membership shall not exceed t-venty-nine members and shall consist of: 10 1 . Fifteen Orange County locally elected officials : 11 a. Two members of the County Board or Supervisors 12 b. Cline City Councilmen 13 c. One Superior Court Judge 14 d. One Municipal Court Judge 15 e. One District Attorney 16 f. One Sheriff 17 2. No more than six non-elected representatives of the Criminal Justice 18 System: 19 a. The County Probation Officer 20 b. Two Chiefs of Police 21 c. Three representatives from .the follar-ing County Departments : 22 1 ) Public Defender 23 2) Marshal 24 3) General Services Agency 1 5 4) County Administrative Office � i 20 , 5) Human Services Agency 27 3. Two City Managers 28 5 � 1 1 4. Six public members who shall be representatives of citizens , 2 professional and community organizations. 3 B. Members shall be chosen for the Council as follows : 4 1 . Five members shall be chosen by the Board of Supervisors to include: 5 a. Two members of the Board of Supervisors 0 b'. Three members from County Departments 2. Nine City Councilmen to include at least one elected representative 8 from each of the five supervisorial districts shall be nominated `l by the cities and appointed by the Orange Cou:rty Division of the 10 League of California Cities. Such terms shall not exceed that 11 Councilman 's term of office in his respective city. 12 3. The two City Managers shall be nominated by the City hlanagers ' ed by the Orange County Divis � , of the 13 Association and appoint A.4 League of California Cities. neither shall represent the same city 15 as the two Chiefs of police appointed. 16 4. The Chiefs of Police shall be nominated by the Chiefs ' of Police 17 and Sheriff' s Association and appointed by the Orange County Division 18 of the League of California Cities . The Chiefs of Police appointed 19 ;hall not represent the same city as the two City illanagers appointed. 20 5. The Municipal Court Judge shall be chosen by the r,unicipal Court 21 Judges of Orange County. yy 22 b. Public members shall be appointed by the Council and shall be 25 selected from representatives of neighborhood and com,r,uni ty 26 based organizations. , 27 a. All Representatives to the Council not designated by office or term 8 shall serve for a term of three years unless otherwise provided. 9 9. Notice of amendments to the Cour.cil ' s membership provisions except 10 as set forth in II C shall be sent to the signatories of this contract 11 thirty(30) days prior to adoption by the Council . Should ten percent 12 (lOn) of those receivinq notice protest, a majority of the parties 13 will have to approve the proposed ar:endme.its. Protests shall be 14 in writing and shall be filed with the Secretary of the :ouncil 15 ten(10) days prior to the next regularly scheduled meeting. 1.6 C. Vacancies 1'; 1 . In the event a vacancy (removal from the area served , death, removal 18 from classification, appointment, resignation, etc. ) on the Council 19 occurs , the Council shall request the appointment of a replacement 20 by the appropriate appointing body. A., The Council shall consider three absences in a row, unexcused by the 22 Chairperson of the body involved from scheduled greetings of the Council 23 or of the Cornittee(s ) to which a merrbe.- is appointed, to be a tender 2'• of resignation from the Council which will be accepted or rejected 25 by the Council at the next regular meeting. 26 0. Officers and their duties 27 1 . The Council shall have as elected, officers a Chairperson and a 28 //// 7 ! I Vice-Chairperson. 2 a. The Chairperson shall head trte Council. 3 b. The Dice-Chairperson shall perform the duties of the Chairperson 4 in his absence and perform any duties that the Chairperson may 5 requi re. 6 c. T:ie Secretary shall be appointed by the Chairperson to keep 7 all records, prepare the agenda for each meeting, and sign 8 official documents when directed by the Council to do so, and 9 shall serve at the pleasure of the Council , The Executive 10 Officer may act as Secretary. ti 11 2. Election of officers to the Council shall be held annually during y 12 the regular June meeting. 13 a. The Chairperson shall appoint a three-member nominating committee 14 at the regular April meeting vihich shall submit nominees for the 15 Council rembers and officers in writing for mailing to Council 16 members at the June meeting. 17 b. The officers shall be elected by a ma o city of the votes of those 18 Council mrenbers present. 19I c. All officers shall be elected for a term of one year and shall serve 20 until their successors are elected. They shall begin their terms 21 of office at the close of the annual June meeting. 2 d. Any vacated office of Chairperson or ` Ice-Chairperson small be 23 filled at the next regular Council meeting by nominations from the 24 floor and a majority of the votes of those Council members present. 25 e. In the event of the absence of both officers , the quorum of rr.embe rs 26 present shall elect a Chairperson pro lempore to preside over the 27 meeting. Tire Council shall serve as the criminal and juvenile justice planning 7 and advisory board for all participants arithin the eligible jurisdiction , 8 and shall be responsible for the performance of all duties and activities 9 required by the Justice System Improvement Act of 1979 in accordance with 10 guidelines and directives issued by the Law Enforcement assistance Adminis•- 1I tration , and, where applicable , by the State Council . These duties and 12 activities include , but are not limited to: 13 1 . Analyze criminal and juvenile justice problems within the eligible 14 jurisdiction. 15 2. Identify criminal and juvenile justice needs . 16 3. Develop recommended priorities , based on the analysis and on input 17 from affected criminal and juvenile justice agencies , for review by 18 chief executives of participants within the eligible jurisdiction. 19 4. Develop a three-year application setting forth criminal and juvenile 20 justice programs (1 ) designed to address approved priority needs , ana 21 (2) designed to raet. the objectives of the Part D Program (Sur,narized 22 in Section IV B, below). 28 5. Prepare grant applications which comply with alr State and Federal 24 requirements. Grant applications shall include , among other items : 25 a. Analysis of crimie and system problems . 26 b. Performance goals and priorities, 2i c. Program descriptions . 28 /!// -• 10 1 d. Procedures for fund accounting, auditing, monitoring, and evaluation. 2 e. Procedures for data collection and preparation of reports. 3 f. Various required assurances and certifications . 4 6. Assist program personnel in the development and implementation of 5 programs . , . 7. Perform monitoring and evaluation of programs. Collect and analyze 7 required program data. Assist program personnel in the solution of 8 operational problems. 9 8. Prepare performance reports on program activities , and impact of 10 program activities on Part D and program objectives . 11 9. Maintain fiscal control , proper management, and efficient disbur_.erient 12 of grant funds. 13 10. Review grant applications and amendments and prepare advisory reports. 14 11 . Perform analysis and implement procedures to ensure adequate allocation 15 of funds to courts , ccrrections , etc. 16 12.. Set up procedures to ensure compliance with Fede; ' equi rements for 17 participation of citizens , and neighbor;iood and ccrrmunity organizations. .. 18 13. Prepare grunt applications for Part E and Part F funds , as required by 19 participants within the eligible jurisdiction. 20 14. Prepare appeals , and follow up as required. 21 15. Coordinate local criminal and J uvenile justice activities , in accordance 22 with the needs of participants within the eligible jurisdiction. 23 16. Perform liaison with Federal , State, and local officials , including, 24 but not limited to dissemination of information , interpretation of 25 guidelines and directives , resolution of problems relating to -the 26 Program, and development of cooperative effort . 27 17. Advise chief executives of participants within the eligible jurisdiction 28 I ( f 1 on all matters relating to the operation of the Law Enforcement Assistance 2 Administration Program within the jurisdiction. 3 18. Perform other activities as requested or required by the chief executives 4 of participants within the eligible jurisdiction; provided, however, 5 that such activities do not conflict with the Council ' s duties and 6 responsibilities under the Act. . . ... . 7 B. The primary function of the Council shall be to assist local government 8 participants within the eligible jurisdiction to prepare , develop, and 9 implement programs which meet the objectives of the Part D Program, as 10 specified in Section 401 (a ) of the Act. 11 Section 401 (a) authorizes grants of Part D funds to units of local government 12 or combinations thereof, to carry out specific programs which are of proven 13 effectiveness , have a record of proven success , or which offer a high 1 14 probability of improving the functioning of the criminal and juvenile justice 15 system. Such programs include , and are 'limited to those which have as their 10 purpose: 17 1 . Establishing or expanding community and neighborhood programs that enable 18 citizens to undertake initiatives to deal with crime and delinquency. 19 2. Improving and strengthening law enforcement agencies , as measured by 20 arrest rates , incidence rates , victimization rates , the number of reported 21 crii;es , clearance rates , the number of patrol or investigative hours per 22 uniformed officer, or any other appropriate objective measure. 23 3. Improving the police utilization of community resources through support 24 o` joi.•t police-corranunity projects designed to prevent or control 25 neighborhood crime. 20 4. Disrupting illicit corn:erce in stolen goods and property and training 271 of special investigative and prosecuting personnel , and the development 28 //// 12 L I of systems for collecting, storing, and disseminating information rebating to 2 the control of organized crime. 3 5. Combating arson. 4 6. Developing investigations and prosecutions of white collar crime, organized 5 crime, public corruption related offenses , and fraud against the government. 6 7. Reducing the time between arrest or, indictment and disposition of trial . � 7 8. Implementing court reforms. 8 9. Increasing the use and development of alternatives to the prosecution of 9 selected offenders. 10 10. Increasing the development and use of alternatives to pretrial detention 11 that assure return to court and a minimiza'.:ion of the 12 risk of danger. 13 11 . Increasing the rate at which prosecutors obtain convictions against 14 habitual , nonstatus offenders. 15 12. Developing and implementing programs which provide assistance to victims ,. 16 wirnesse; , and jurors , including restitution by the offender, programs 17 encouraging victim and witness participation in the criminal justice 18 system, and programs designed to prevent retribution against or 19 intimidation of witnesses by persons charged with or convicted of r ' 20 crimes. 21I 13. Providing competent defense counsel fogy- indigent and eligible low- income 22 persons accused of criminal offenses. 23 14. Developing projects to identify and meet the needs of drug dependent 24 offenders , 25 15. Increasing the availability and use of alternatives to maximum-security 26 confinement of convicted offenders who pose no threat to public i i 27 safety. 28 13 k 1 16. Reducing the rates of violence among inmates in places of 2 detention and confinement. 3 17. Improving conditions of detention and confinement in adult 4 and juvenile correctional institutions , as measured by the 5 number of such institutions administering programs meeting 6 , .. accepted standards. 7 18. Training criminal justice personnel in programs meeting standards y 8 recognized by the Director of the Office of Justice Assistance , 9 Research, and Statistics. 10 19. Revision and recodification by States and units of local 11 government of criminal statutes , rules , and procedures and 12 revision of statutes , rules and regulations governing State 13 and local criminal and juvenile justice agencies. 14 20. Coordinating the various components of the criminal and 15 juvenile justice system to improve the overall operation of 16 the system, establishing crin:nal justice information systems , 17 � and supporting and training of criminal and juvenile justice 18 personnel . 19 21 . Developing statistical and evaluative systems in States and 20 units of local government which assist the measurement of 21 indicators in each of the Areas described in paragraphs (1 ) 22 through (20) . 23 22. Encouraging the development of pilot and demonstration orojects 24 for prison industry programs at the State level with p.r•ticular 25 emphasis on involvfng private sector enterprise either as a 26 direct participant in such programs , or as purchasers of goods 27 . produced through such programs , and aimed at making inmates 28 /��r 14 1� self-sufficient, to the extent practicable, in a realistic working r ?. environment. r 3 23. Any other program which is of proven effectiveness , has a record 41 of proven success , or which offers a high probability of improving 5 the functioning of the criminal and juvenile justice system. 6 V. COUNCIL STAFF, 7 A. Staff to the Council will be employees of the County of Orange for the 8 purpose of recruitment, classification , merit system, salaries and 9 benefits , and retirement. Staff will be subject to the County' s rules 10 end regulations contained within the Salary and Personnel Resolutions 11 and will be subject to the conditions of the Memorandum of understanding 12 between the County of Orange and employee' s organizations. Staff super- 13 vision and -direction shall rest with the Criminal justice Council . 14 B. The Executive Officer shall be appointed by the Council subject to the 15 approval of the Board of Supervisors and in accordance with adopted 16 County merit system regulations . The Executive Officer may be removed 17 for a good cause by a rr%,jority vote of all members of the Council only 18 after a specific list of charges has been drawn up and to which responses 19 have been made. 20 C. The Executive Officer may appoint additional staff consistent with County 21 personnel practices and procedures and within adapted budnet limitations . 22 D. The Executive Officer is designated as property custodian of the Council . 23 Every officer or employee authorized to receive , account for, or expend 24 any funds shall file a bond in the sum of S10,000.00. This requirement 25 may be met by one or more blanket bonds. 26 V1. STAFF PROGRAM FUNCTIONS 27 A. Data Collection, Analysis and Certification. The staff of the Criminal 28 llll 15 f t wt.• I Justice Council shall collect and analyze the foliowing data as required 2 by the Act: 3 1 . an analysis of the crime problems and criminal justice reeds within .f the County Area and a description of the services including a specific ,5 statement of how the programs or projects are expected to advance 8 , -the objectives of the Justice System Improvement Act; 7 2. an indication of hog•; the programs relate to other similar State or 8 local programs directed at the same or similar problems ; 9 3. an assurance that following the first fiscal year covered by an 10 application and each fiscal year thereafter, the Cririnal Justice Council 11 shall submit to the Law Enforcement Assistance Administration 12 "(i ) a performance report concerning the project activities carried out; 13 "0 0 ' an a. sessment by the Criminal Justice Council of the impact of 14 those activities on the objectives identified in the Criminal 15 Justice Council ' s statement; 16 4, a certification that Federal funds made available under this Act 17 will not be used to supplant local funds , but will be used 18 to increase the amounts of such funds that would, in the absence 19 of Federal funds , be made available for criminal justice activities ; 20 5. an assurance that there is an adequate share of funds for courts , 21 prosecution, and defense programis ; 22 b. a provision for fund accounting, auditing, monitoring, and such 23 evaluation procedures as may be necessary to keep such records 24 as the Law Enforcement Assistance administration shall prescribe 25 to assure fiscal control , proper manauement, and efficient disburse- 26 ment of funds received under this title; 27 - 7. a provision for the maintenance of such data and information 16 1 and for the submission of such reports in such form, at such 2 times , arid containing such data and information as the Law Enforcement 3 Assistance Administration may reasonably require to administer 4 other provisions cf .the Act; 5 8. a certification that its programs meet all the requirements of 6 the Act, that all the information contained in the application 7 is correct, *hat there has been appropriate coordination with 8 affected agencies, and that the applicant will comply %•,,ith all 9 provisions of this act and all other applicable Federal laws . 10 Such certification shall be exr. :uteri by the Chairperson or other 1i officers of the applicant qualified under regulations promulgated 12 by the Laai Enforcement Assistance Administration; 13 9. provide citizens and neighborhood cortlunity organizations an 14 opportunity to consider and cormant on priorities set forth in 15 the application or amendments ; 16 10. provide for full and adequate participation of units of local 17 government in the performance of the analysis and the establishment 18 of priorities required; 19 :1 . provide an opportunity for all affected criminal and juvenile 20 justice agencies to consider and coritment on the proposed programs [ 21 to be set forth ir, the application or amendments. 22 B. Staff shall have the responsibility of notifying all potential grantees , J P 23 and assisting in developing the projects. Staff shall held public / 24 neighborhood hearings on those projects affecting those neighborhoods. 1 25 Staff shall prepare a complete application with copies sent to each 26 political entity within the County of Orange. � 27 C. Any problem in a project indicated by an audit or monitoring visit will 6 be worked on by staff and the grantee , until the problem is corrected. 7 E. Staff will assure compliance with all Federal guidelines as promulgated 8 by the Law Enforcement Assistance I-Aministration 9 F. Additional Duties: Any additional duties regarding the Executive Officer 10 as may be set out in the By-Laws or as directed by the Criminal Justice 11 Council shall be carried out by the Executive Officer. 12 V I I, POWERS OF THE COUNCIL 33 1 . The Council shall have no power to exercise any of the police powers 14 of any of the signatory agencies . 15 2. All federal grants shall be awarded to the Entitlement Jurisdiction, who 16 shall in turn make the awards to grantees approved by the Criminal 17 Justice Council . No monies shall be released v;ithout an award statement 18 approved by the Criminal Justice Council . 19 '. The Board of Supervisors shall execute contracts for programs between the 20 Criminal Justice Council and local agencies in the amounts and for the 21 purpose specified by the Criminal Justice Council . The County shall 22 have full authority to determine the amounts and purposes of grants 23 to be made to county agencies %:ho are under the control and direction 2� of the Board of Supervis^rs. Each city shall have full authority to 25 drter,nine the amounts and purposes of grants to be made to their city 26 agencies who are under the control and direction of the tit" Council . 27 4. The Criminal Justice Council shall have the authority to levy a surcharge I c I1 I against those agencies receiving a grant award from the Council . 2 Such surcharge shall be used as matching funds for planning and 3 administration funds. Under no condition shall the surchagge 4 be considered part of the grant award. I 5 5. The Cr mo nal Justice Council shall nave the authority to terminate G � a 'grant award for good cause provided that the grant recipient shall 7 ' be properly noticed and a full hearing scheduled. 8 �� 5. The Criminal Justice Council shall have the authority to establish a general policies for match requirements to be met by local agencies 10 who apply for funding. Such policies shall be adopted by the Council to each contracting memi5er at least 11 only after full notice is given 12 thirty days in advance of any Criminal Justice Council action. 13 7. The Criminal Justice Council shall present to each contracting party 14 an accounting and report by January lst of each year of all funds 15 received and disbursed during the previous Federal fiscal year. 1G V III . COUNTY OF ORANGE 17 A. The County shall , as an in-kind contribution, provide the services 18 of the Auditor-Controller, County Treasurer, County Counsel , Purchasing, 19 Personnel , and provide adequate facilities for Council and Staff. 20 B. The Criminal Justice Council and Staff shall be included as an 21 additional insured under the County' s comprehensive liability policy 22 with the same coverage and limits of liability applicable to County. 23 County' s in-;rind insurance coverage shall be subject to annual approval 24 by its Board of Supervisors prior to July 1 of each Fiscal Year. 25 C. County shall make vehicles available from its motor pool and shall 26 bill Council scheduled mileage rates as set by the County. The 27 ++ Council shall reiwburse the County as billed. Use of said vehicles 2.5 I 19 .y rI < < J 1 will riot be considered part of County's in-kind contribution. 2 D. The County Treasurer' s Office shall be the depositary of all 3 Council funds and said County Treasurer shall be their custodian. 4 E. The County Auditor-Controller shall be the Auditor-Controller of 5 she Council . G F. The services of the County Treasurer and Auditor-Controller shall 7 be part of the County' s in-kind contribution, the cost of %r,hich 8 shall not be charged to the Council . The Criminal Justice Council 9 shall maintain appropriate books , records , accounts , and files 10 showing all receipts and disbursements of funds. The County shall 11 be reimbursed for all project. ur program audits performed by the 12 Auditor-Controller at rates established by the Audi tor-Control ler-. 13 IX. SPECIAL CONDITIONS I t 14 A. LIABILITY 15 The tort liability of the Council , its members and all officers and s 1 16 employees of Vie Council shall be controlled by the provisions of ! 17 Division 3.6 of Title 1 of the Government Code of the State of California. i t 18 B.
