PENALTY FOR FAILURE TO PAY WHEN DUE ( 6 . 2815) �• 7 If money payable to LESSOR as a uon0ition of this Agreement is not y paid when due , a penalty of six. percent (6h ) of the amount clue and 8 unpaid shall be added to the amount d,je and the total sun shall become immediately due and payable to LESSOR . A further penalty of six percent 9 (6%) of the amount due and unpaid , including previously assessed penal- ties , shall be added for each month that said amount remains unpaid . t' ;• 10 7 . LESSOR CONSTRUCTION ( 7 . 191 i;) . It is specifically understood and agreed by the parties hereto that 12 LESSOR will recuire the use of the Demised Premises for LESSOR proposed ecnstruction of parking facilities for Sunset Leach . 13 i. Upon ter. (10 ) days writter. notice from the Dirc -�tor of iiarbors , Beaches 14 and Parks LESSEE shall vacate the Demised Premises . LESSEE may reoccupy the Demised Premises upon notice from said Director that construction 15 has been completed . 16 LESSEE shall not be responsible for rental payments during; the period of LESSOR ' S use of the Derr'sed Premises . I1AI11TENANCE ( 7 . 19111 ) 27 All im rovements within the Demised Premises shall remain the property of LESSOR during the Agreement term. LESSOR shall have no obligation 28 to LESSEE for the condition of the improvements or for the condition of the Devised P;er.:ises . 29 LESSEE further agrees to keep the Demised Premises free and clear of 30 rubbish , debris , and litter at all tires . 31 11. TEE-0,1IiATION ( 8. 1311a) 32 This Agreement may be terminated by the Director of Harbors , Heache_: , and Parks or by LESSEE by glvinF; thirty ( 30 ) days written notice of the f .f ri t' 4+ y•. i 1 intention to so terminate . Termination by the Director of Harbors , Beaches , and Parks shall b4 manifested by a letter from the Department 2 of Heal Property Services , County of Orange . Upon termination, LESSEE shall be entitled to a refund of the unused portion of the 3 yearly rental based on a One Dollar ( $1) per day rental . 4 12. BILLBOARDS AND SIGNS (8. 131S) 2 LESSEE agrees not to construct , maintain, or allow upon the Demised 3 Premises any billboards or signs except those approved in writing; in advance by the Director of Harbors , Beaches , and Parks . 4 �. 2. UNLAWFUL USE (6 . 281S ) 5 LESSEE agrees no improvements shall be erected, placed upon , operated nor 6 maintained within the Demised Premises , nor any business conducted or rgrried on therein or therefrom in violation of the terms of this Agree- � 7 ment, or of any regulation, order of law, statute, bylaw, or ordinance . of a governmental agency having jurisdiction . 8 r. 3. DISPOSITION OF PERSONAL PROPERTY ABAND014ED BY LESSEE ( 8. 131S) 9 If LESSEE abandons the Demised Premises or is dispossessed thereof by 1.0 process of law or otherwise, title to any personal property belonging to LESSEE and left on the Demised Premises five (5) days after such 11 abandonment or dispossession shall be deemed to have been transferred Ys to LESSOR. LESSOR shall have the right to remove and to dispose of 12 such property without liability therefor to LESSEE or to any person claiming under LESSEE and shall have no need to account therefor. 13 ! 4 . DEFAULT 114 TEMS OF THE AGPEEMENT BY LESSEE ( 8 . 30111) 14 Should LESSEE default in the performance of any covenant , condition, or 15 agreement contained in this Agreement , and such default is not corrected within a reasonable time after LESSEE receives written notice of default 16 from the Director of Harbors , Beaches , and Parks , said Director may terminate this Agreement , Said termination shall be manifested by a 17 letter from the Department of Real Property Services , County of Orange . All rights of LESSEE and those who claim under LESSEE, steaming from 18 1 this Agreement , shall end at the time of such termination . 19 5. COSTS OF SUSTAINING AN ACTION FOR BREACH OR DEFAULT (6 . 281S ) 20 In the event either LESSOR or LESSEE commences legal action against the other claiming a br!pach or default of this Agreement , the prevailing 21 party in such litigation shall be entitled to recover from the other costs of sustaining such action , including reasonable attorney fees , 22 as may be fixed by the Court . 23 6.
