HOPKINS, PE, DIRECTOR vF BLIC W R SUBJECT: Adopt Resolution Requesting CTFP Fund Allocation for Garfield Avenue Widening Project, CC-1250 Statement of Issue,Funding Source,Recommended Action,Alternative Action(s),Analysis,Environmental Status,Attachment(s) Statement of Issue: A resolution is required to request the Orange County Transportation Authority (OCTA) allocate funds through the Combined Transportation Funding Program (CTFP) for the initial 90% reimbursement of funds related to the Garfield Avenue Widening Project, CC-1250. Funding Source: The reimbursement amount is $531,000 and represents 90% of eligible project expenditures from OCTA funds. When received, these funds would be credited to the Traffic Impact Fund Account No. 20600206.46450. The balance of the grant in the approximate amount of$59,000 will be reimbursed upon completion of the project. Recommended Action: Motion to: Adopt Resolution No. 2009-04 1 a Resolution of the City Council of the City of Huntington Beach Requesting the Orange County Transportation Authority to Allocate Combined Transportation Program Funds for the Garfield Avenue Widening at Delaware Street, Project Number 00-HBCH-GMA-3080. Alternative Action(s): Deny adoption of the resolution. This action may result in the project being found ineligible for reimbursement. REQUEST FOR CITY COUNCIL ACTION MEETING DATE: 1/5/2009 DEPARTMENT- ID NUMBER: PW 09-02 Analysis: The City of Huntington Beach has been allocated funding from the Orange County Transportation Authority (OCTA) for improvements along Garfield Avenue at Delaware Street. The project includes street widening, construction of concrete curb and gutter, sidewalk, curb access ramps, a center median, drainage, traffic signal relocation, and associated street improvements. On August 20, 2007, the City Council awarded the construction contract for the project in the amount of $805,926.50. Adopting the resolution allows the City to recover approximately $531,000, which represents 90% of the eligible OCTA funds prior to completion of the project. The remaining 10% of the eligible reimbursement will be requested after the City's acceptance of the improvements. The grants are from the Combined Transportation Funding Program (CTFP), through the Growth Management Area (GMA) funds. Right-of-way acquisition expenditures for the project were approximately $1.6 million. OCTA does not require the adoption of a resolution for right-of-way reimbursement, after expenditures have been documented. The City has invoiced and has received $540,000 for this component of the grant. Public Works Commission Action: Not required. Strategic Plan Goal: 1-1 Improve the City's plan for funding and completing infrastructure needs, and develop strategies for resolving crucial infrastructure problems to preserve the physical foundation of the community and enable the community's value to grow. C-1 Improve transportation through a variety of means including improving traffic flow, synchronizing traffic signals, traffic calming, and alternative transportation methods such as bike and walking paths. Environmental Status: The project is categorically exempt pursuant to Class 1, Section 15301(c) of CEQA. WHEREAS, the Orange County Transportation Authority approved a Combined Transportation Funding Program(CTFP)for fiscal years 2005/06; and The program includes $590,000 for construction in fiscal year 2005/00' for a Growth Management Area program widening project on Garfield Avenue at Delaware Street; and The City of Huntington Beach has adopted a General Plan Circulation Element which does not preclude implementation of the MPAH within its jurisdiction, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach as follows: To request the Orange County Transportation Authority allocate $531,000 of CTFP funds from the Growth Management Area program for construction of said project to the City. This request is in conformance with the CTFP allocation process and does not exceed ninety (90) percent of the programmed amount or ninety (90) percent of the construction contract. That the City agrees to fund its share of the improvement costs of the above indicated fiscal years and any additional costs over the identified programmed amount. That the City has awarded the construction contract for the project on August 20, 2007 for$805,926.50. That the City of Huntington Beach has: 1) designed the project improvements, and 2) completed required preparatory work in accordance with the standards required by the City and other affected jurisdictions involved with said project. That the remaining ten (10) percent in CTFP funds will be transferred to the City of Huntington Beach when construction is completed and a Final Report on the project is accepted by the Orange County Transportation Authority. The City of Huntington Beach 08-1887/28582 1 Resolution NO. 2009-04 agrees to submit the final report to the Orange County Transportation Authority within one hundred twenty(120) days after the City's acceptance of the improvements.
