Subiect:
Approve and authorize execution of an Amendment to a Memorandum of Understanding with
the Orange County Transportation Authority and the cities of Fountain Valley and Costa Mesa
to extend the deadline for completion of street improvements associated with the potential
removal of the Garfield/Gisler crossing of the Santa Ana River
Statement of Issue:
The Cities of Fountain Valley, Costa Mesa and Huntington Beach entered into a Memorandum of
Understand (MOU) in 2006 to pursue certain street improvements and operational goals on our
respective local streets that would potentially make the future connection of Garfield Avenue and
Gisler Avenue across the Santa Ana River unnecessary and allow for the permanent deletion of the
roadway from the Master Plan of Arterial Highways. Due to the extended period of time it took to
begin and complete the Interstate 405 Freeway project and to allow for additional time for each
agency to pursue completion of individual efforts, an amendment to the agreement is needed to
extend the current December 2020 completion deadline.
Financial Impact:
Extension of the agreement does not result in the commitment by the City to pursue any new
improvements not previously identified in the current MOU. Additional funding may be needed from
various funds to complete potential projects or demonstrate the additional capacity is no longer
needed. Appropriation for additional funding requirements will be requested as needed. Funding for
improvements is expected to be provided through grant funding, traffic impact fee and other
appropriate local roadway funding (e.g. Gas Tax) and identified through the annual Capital
Improvement Program process.
Recommended Action:
Approve and authorize the Mayor to execute "Amendment No. 1 to Memorandum of Understanding C

Alternative Action(s):
Provide recommended changes to the proposed Memorandum of Understanding to pursue with
OCTA, Costa Mesa and Fountain Valley.
Analysis:
The cities of Huntington Beach, Costa Mesa and Fountain Valley entered into a cooperative
Memorandum of Understanding with OCTA in 2006 to address ongoing concerns about the future
connection of Garfield Avenue east, across the Santa Ana River to Gisler Avenue in Costa Mesa.
This connection has been depicted on the County Master Plan of Arterial Highways (MPAH) for many
years and had been used to model projections of long term traffic conditions in the area. In 2006, the
Cities of Costa Mesa and Huntington Beach expressed their desire to have the bridge removed from
the MPAH due to the anticipated community impacts the connection would have in both cities.
Fountain Valley expressed their concern over any deletion from the MPAH because the impacts of
not having the bridge in the future would significantly, and disproportionately impact roadways in
Fountain Valley. A detailed study was undertaken at the time by OCTA to fully evaluate whether there
were suitable, effective roadway network options that could be pursued to offset the need for the
Garfield-Gisler Bridge. A group of improvements were identified that were expected to provide
sufficient future roadway capacity to offset the loss of the Garfield-Gisler Bridge.
The MOU set goals for completing the various improvements by the different agencies and set a
target completion date of the end of the calendar year 2020. It also created an interim designation
for the Garfield-Gisler connection called a "right-of-way reserve" status. With this status, all parties
agreed to assume that the bridge would not be built during the evaluation of all project traffic impacts
and planning of all roadway improvements (future analyses). None of the Cities have fully completed
the improvements in their jurisdictions at this time. The Interstate 405 freeway project was also
expected to be completed by the end of 2020 back in 2006. Since the project took longer to develop
than expected and evolved over time, we will not know the true effects/benefits of the project until the
expected completion date in 2023. Therefore, OCTA proposed an extending the deadline for
completion of city efforts to 2025. The agreement was developed with input from staff from each
agency and agreed to bring the agreement to each City Council for approval.
Staff from each of the agencies are presenting the same version of the Amendment to their
respective City Councils for action. Should any City request a modification to the language during
the final stage of the process, it is likely that each City will need to reconsider the new version for
approval. At the time of this writing, Fountain Valley has already approved the proposed language
and Costa Mesa is expected to process the agreement in January or February 2020.

12 22nd day of April 2020 (Effective Date), entered into among the Orange County
13 Transportation Authority ('OCTA:'), and the.cities of Fountain Valley, Costa Mesa and.Huntington Beach,

("Cities").
15 WITNESSETH:
16 WHEREAS, by MOU C-6-0834 executed on December 12, 2006, OCTA and Cities entered into a
17 contract describing the specific duties and responsibilities of each party with respect to supporting the
1$ actions consistent with the Garfield-Gisler ad-hoc Policy Advisory Committee's :consensus
19 recommendation on June 15,2006, and each of the parties to the MOU agreed to support the designation
20 of the Garfield-Gisler Bridge as a"Right-of-Way Reserve" corridor on the Orange County Master Plan of
21 Arterial Highways (MPAH) and, within their respective General Plans/Long Range Plans, implement the
22 Smart Street and Bride Widening Strategy A (Strategy A improvements within their jurisdictions and

6 "3. Cities agree that all Strategy A Improvements shall be completed by.2025 consistent with
7 the approach and goals identified in Attachment A of the MOU, If the cities of Costa Mesa and Huntington
8 Beach do not complete their portions of Strategy A improvements by end of calendar year 2025, then.the
9 Garfield-Gisler Bridge will automatically be re-instated on the MPAH as a planned facility. If the City of

10 This Memorandum of Understanding (MOU) is entered into among the Orange County
11 Transportation Authority,hereinafter referred to as the OCTA,and the Cities of Fountain Valley, Costa
12 Mesa and Huntington Beach, hereinafter referred to as Cities.
13 Consistent with the Garfield-Gisler ad-hoc Policy Advisory Committee's consensus
14 recommendation on June 15, 2006,each of the partiesto this MOU agrees to support the designation
15 of the Garfield-Gisler Bridge as a"Right-of-Way Reserve'"corridoron the Orange County Master Plan
16 of Arterial Highways(MPAH)and,within their respective General Plans/Long Range Plans,implement
17 the Smart Street and Bridge Widening Strategy A (Strategy A) improvements within their jurisdictions
18 and ensure that buildout of the Garfield-Gisler Bridge is not assumed for land use planning or traffic
19 analysis purposes. This MOU describes the specific duties and responsibilities of each party with
20 respect to supporting these actions.
21 This document establishes obligations on all parties and constitutes an exchange of promises.

23 Recital
24
25 The Right-of-Way Reserve classification allows local jurisdictions considering deletion of a planned MPAH facility
to request OCTA to redesignate the adopted facility as a"Right of Way Reserve"corridorfor a specific length of
26 time in orderto assess the actual need for it.If OCTA agrees to re-designate the subject facility as a"Right-of-Way
Reserve" corridor on the MPAH, then all appropriate City General Plan Circulation Elements shall be revised to
reflect such re-designation. During the"reserve"period,the right-of-way shall be preserved however,the planned

1 The parties acknowledge that this MOU requires that certain actions be taken with regard to amending
2 the general plans and capital improvement programs of the parties hereto and that the parties hereto
3 cannot predetermine those actions that are the subject of public hearings.Nevertheless,the parties
4 agree that the benefits of this M OU are dependent on such actions and therefore com mit to conducting
5 said hearings within 6 months of the effective date of this agreement. If such action is not taken within
6 said time line, the benefits of this agreement shall not be available to the parties unless all parties
7 consent to an extension or other arrangement.
8 Section 1. MPAH and General Plan/Long Range Plan_Designations
9 1.1 OCTA Responsibilities
10 1.1.1 Amend Master Plan of Arterial Highways
11 After the cities have amended their General Plans, OCTA shall amend the MPAH to re-designate the
12 Garfield-Gisler Bridge, and the eastbound and westbound approaches thereto, as a "Right-of-Way
13 Reserve"corridor.Consistent with the MPAH's original concept forthe Garfield-Gisler Bridge,the right-
14 of-way reservation shall be for a secondary arterial highway in Costa Mesa and a primary arterial in
15 Fountain Valley and Huntington Beach.
16 1 1 2 Amend Oranqe County Long Range Transportation Plan
17 After the MPAH has been amended and during the next update to the Orange County Long Range
18 Transportation Plan(LRTP),OCTA shall ensure that the Garfield-Gisler Bridge,and the eastbound and
19 westbound approaches thereto,are reflected as a"Right-of-Way Reserve"corridor in the LRTP.
20 1.2 Cities' Responsibilities
21 1.2.1 Amend General Plans
22 The Cities shall pursue amendment of their General Plan Circulation Elements to reflect that the
23 Garfield- Gisler Bridge and the eastbound and westbound approaches thereto have been designated
24 as a"Right-of-Way Reserve"corridor in the MPAH.Consistent with the M PAH's original concept for the
25 Garfield-Gisler Bridge,the City of Costa Mesa's General Plan shall reserve right-of-way for a secondary
26
street shall not be considered as mitigation for development planning purposes. At the end of the designated

2 General Plans shall reserve right-of-way for a primary arterial highway within the Garfield-Gisler
3 corridor. Cities shall endeavor to complete the General Plan amendment process within 6 months of
4 final adoption of this MOU.
5 Section 2.Reasonable Progress Toward Implementing Strategy A Improvements
6 2.1 OCTA Responsibilities
7 2.1.1 OCTA Responsibilities for Strategy A Improvements
8 To ensure reasonable progress toward implementation of Strategy A improvements, OCTA shall:
9 a. Make funding for implementation of the Strategy A improvements,as defined in the Circulation
10 Feasibility Study and Cost Estimate forthe Garfield-Gisler Crossing Overthe Santa Ana River
11 (LSA, June 2006), available to the Cities through the Combined Transportation Funding
12 Programs(CTFP).A list of the improvements included in Strategy A is provided as Attachment
13 A hereto.
14 b. Utilize the renewed Measure M Signal Synchronization Program and other CTFP programs as
15 funding sources for implementation of the roadway improvements included in Strategy A.
16 2.2 Cities' Responsibilities
17 2.2.1 Cities' Responsibilities for Strategy A Improvements
18 To ensure reasonable progress toward implementation of Strategy A improvements,the Cities shall:
19 a. Include Strategy A improvements, as defined in the Circulation Feasibility Study and Cost
20 Estimate forthe Garfield-Gisler Crossing Over the Santa Ana River(LSA,June 2006), in their
21 Capital Improvement Programs.All projects that emanate from Strategy shall be considered
22 multi-jurisdictional projects and shall, therefore, be eligible for additional points in OCTA's
23 project prioritization process underthe CTFP.A list of the improvements included in Strategy A
24 is provided as Attachment A hereto.

2 b. Make applications to OCTA for CTFP funding to implement Strategy A improvements. Such
3 applications shall be supported by local match commitments consistent with the
4 requirements of the CTFP programs from which funds are being requested.
5 1. Cities agree to make Strategy A projects a priority for available GMA or other
6 interregional funding programs.
7 c. Implement Strategy A improvements as expeditiously as possible.
8 1. Cities agree to initiate Smart Street improvements on Harbor, Brookhurst, Adams and
9 Fairview by the end of calendar year 2010. For purposes of this MOU, Smart Street
10 improvements are defined as synchronization of traffic signals, removal of on-street
11 parking and re-striping within existing right-of-way.
12 2. Cities agree to make reasonable progress on the Capital Projects by 2015, subject to
13 funding availability. "Reasonable progress" shall be defined as inclusion of noted
14 projects in Capital Improvement Programs (CIPs), preparation of preliminary plans,
15 environmental studies, etc. For the purposes of this MOU, Capital Projects are defined
16 as construction of bus turnouts, consolidation of driveways, construction of turn-pockets,
17 street widening or bridge widening.
18 3. Cities agree that all Strategy A improvements shall be completed by 2020. If the Cities of
19 Costa Mesa , and Huntington Beach do not complete their portions of Strategy A
20 improvements by end of calendar year 2020, then the Garfield-Gisler Bridge will
21 automatically be re-instated on the MPAH as a planned facility. If the City of Fountain Valley
22 has not completed the Strategy A improvements in their city, the Garfield-Gisler Bridge will
23 remain designated "Right of Way Reserve"corridor until all improvements are completed.

7 modeling activities.
8 b. OCTA shall ensure that implementation of the Strategy A program of projects is assum ed in its
9 transportation planning, modeling,and analysis activities.
10 3.2 Cities' Responsibilities
11 3.2.1 Land Use Planning
12 The Cities shall ensure that buildout of the Garfield-Gisler Bridge, and the eastbound and westbound
13 approaches thereto, is not assumed in any of its land use planning activities.
14 3.2.2 Transportation Planning and Traffic Analysis
15 The Cities shall ensure that buildout of the Garfield-Gisler Bridge, and the eastbound and westbound
16 approaches thereto, is not assumed in any of its transportation planning, traffic modeling, or traffic
17 analysis activities.
18 Section 4.Compliance Monitoring and Reporting
19 4.1 OCTA Responsibilities
20 4 1 1 OCTA Responsibilities for Monitoring&Reporting City Compliance
21 a. OCTA shall monitor the Cities'com pliance with the provisions of this MOU every two years
22 through the M PAH Certification Review Process to ensure that the Cities are complying fully
23 with the provisions of this agreement and making reasonable progress toward implementation
24 of the Strategy A improvements. Progress reports shall be presented to the OCTA Board of
25 Directors and the Cities every two years,at the conclusion of the review process.

2 b. Upon completion of all the Strategy A improvements, and consistent with OCTA guidance for
3 MPAH Right-of-Way Reserve corridors, OCTA in coordination with the cities shall re-evaluate
4 traffic levels of service in the project study area to determine whether to delete, continue the
5 reserve,or re-instate the Garfield-Gisler Bridge onto the MPAH as a planned facility.
6 4.2 Cities'Responsibilities
7 4.2.1 Cities Responsibilities for Reporting Compliance
8 The Cities shall provide progress reports to OCTA every two years through the MPAH Certification
9 Review Process as a means of communicating that the provisions included herein are being
10 implemented fully and expeditiously and that reasonable progress is being made toward
11 implementation of the Strategy A improvements.

2 Introduction
3 Through its General Plan Circulation Element, each of the cities within the Garfield/Gisler Bridge
4 Crossing Study Area has established traffic level of service (LOS) D or better as representative of
5 acceptable operating conditions on roadways within its jurisdiction. The Garfield/Gisler Study Area
6 currently experiences significant traffic delay at several locations. In addition, the OCTAM model
7 predicts that several intersections in the project study area will operate below LOS D in the Year 2030 if
8 no improvements are made. To help the cities achieve and/or maintain LOS D operations, where
9 feasible,throughout the project study area,Smart Street and Bridge Widening Strategy A includes a list
10 of improvements to offset the traffic impacts associated with projected growth in traffic volumes. That
11 program of projects is presented below.
12 One of the key concepts included in the "Consensus MOU2" is that each of the cities within the
13 Garfield/Gisler Bridge Crossing Study Area will make"reasonable progress"toward implementing the
14 improvements included in Smart Street and Bridge Widening Strategy A. The intent of this concept is

18 It should be noted that although the Smart Street and Bridge Widening Strategy A program of projects
19 is specific, it is not meant to be prescriptive. If a city is able to identify an alternative traffic flow
20 improvement which meets the overall objective of achieving and/or maintaining LOS D at any location
21 within the study area,then that improvement shall be considered an acceptable alternative and shall be
22 implemented as a substitute solution to the original recommendation.

Statement of Issue: The Orange County Transportation Authority(OCTA) has completed a
process to perform preliminary engineering and supplemental environmental analyses of the
potential Garfield Avenue/Gisler Avenue bridge over. the Santa Ana River. OCTA is
requesting that each participating agency execute a Memorandum of Understanding (MOU)
to change the Garfield-Gisler bridge to a right-of-way reserve status and implement a
program of improvements to offset the need for the bridge.
Funding Source: Staff resources to fulfill the MOU obligations can 'be provided within
typical duties of the Public Works Department. Projects contained within the MOU will
require separate funding analysis and authorization from the City Council in future-year
Capital Improvement Programs.
Recommended Action Motion to:
Approve and authorize the Mayor to execute the Memorandum of Understanding among
Cities of Costa Mesa, Fountain Valley and Huntington Beach and the Orange County
Transportation Authority regarding Agency responsibilities for implementing the consensus
recommendation for the Garfield Avenue-Gisler Avenue Bridge Crossing over the Santa Ana

Analysis: The Orange County Transportation Authority (OCTA) Master Plan of Arterial
Highways (MPAH) currently designates two future crossings over the Santa Ana River
affecting the Cities of Huntington Beach, Costa Mesa, Fountain Valley and Newport Beach.
These crossings are located at Garfield Avenue/Gisler Avenue and at Banning Avenue/19tn
Street. For more than 10 years, the Cities of Costa Mesa and Huntington Beach have
expressed concern for the potential impacts of these future crossings and have actively
pursued their deletion from the MPAH'. The City of Huntington Beach has adopted several
City Council resolutions over the past 10 years confirming this position and has included
specific policies in the General Plan. Past Council actions on the Santa Ana River Crossing
(SARX) are on file with the City Clerk.
The affected cities and OCTA have previously undertaken a cooperative study process to
complete an environmental evaluation of the potential deletion of the two bridges from the
MPAH. A final draft environmental impact report (EIR) for the bridge removals was
completed in April 2002. However,'due to opposition from the Cities of Fountain Valley and
Newport Beach, OCTA did not attempt to certify the EIR. Since that time, the City,of
Fountain Valley successfully obtained funding through OCTA grant programs to conduct a
preliminary engineering and environmental analysis of the Garfield/Gisler bridge. OCTA
approved the funding of this effort with the condition that the study also evaluates alternatives
to constructing the bridge.
The feasibility study,effort began in the summer of 2005.' The process included participation
from each of the affected agencies through the establishment of a Policy Advisory Committee
(elected officials), City Managers Committee and Technical Advisory Committee (technical
staff) to review and guide the study effort, and review policy recommendations. The City of
Huntington Beach, along with each of the participating agencies, took an active role in each
of the committees throughout the process.
The study yielded two key results affecting the future status ofthe bridge. First, the study
showed that construction of the bridge would be feasible from an engineering perspective
and it was reasonable to conclude that significant adverse environmental impacts could be
mitigated. Total costs for the bridge and initial mitigation was estimated at $65 to $82 million.
The study also concluded that 'a group of other roadway system improvements could` be
nearly as effective in meeting future transportation needs without the Garfield/Gisler bridge.
This package of street improvements, referenced as Strategy A, ` has an estimated
implementation cost of $36 million. The expected benefits of the Strategy A improvements
and the obvious cost difference when compared to the bridge construction alternative led the
study groups to a proposed'solution that replaces the bridge with the improvement strategy.
Not all of the Policy Committee members agreed the study presented conclusive evidence
that the Strategy A improvement package would fully offset the need for the bridge and
objected to the deletion of the bridge ;at this time. As a result, a compromise solution was
developed that is'presented in detail in attached:Memorandum of Understanding (MOU).

The main points of the MOU are as follows:
■ All affected agencies are signatories to the MOU.
■ The bridge would be placed in a "right-of-way reserve corridor" status assuming
appropriate actions by each individual city to amend their General Plans and OCTA
amending the MPAH.
■ All parties agree to perform future transportation and land use planning assuming the
bridge would not be constructed at any time in the future.
■ All parties agree to take appropriate steps to pursue funding and implement all of the
improvements identified in Strategy A by 2020. Funding of these improvements is not
guaranteed by OCTA or any of the individual cities. Specifically, the agreement does
not require the City to commit General Fund resources to these projects in the
absence of any other outside funding sources, such as the extension of Measure M.
■ If Huntington Beach or Costa Mesa fails to complete improvements within their
respective cities, the bridge would be reclassified as a planned roadway in 2021.
■ If Fountain Valley fails to complete improvements within their city, the bridge would
remain in the right-of-way reserve status.
• Following completion of the improvements, a follow-up study will be performed to
evaluate the effectiveness of the improvements in offsetting the need for the bridge.
Appropriate action to either delete the bridge or reinstate it will be taken based on the
results of the study.
The "right-of-way reserve corridor" status is a special street designation that acknowledges
that the bridge may someday be reinstated as a planned roadway. However, it would
prevent any agency from pursuing construction of the bridge until the status is returned to
planned. It also prevents any agency from allowing development to occur in the area of the
bridge that would preclude the -bridge from being built. For example, Huntington Beach
would need to continue to ensure that the ultimate right-of-way from Garfield be retained to
allow for the potential future roadway. The Policy Committee unanimously endorsed the
compromise solution and.the elements of the MOU. Staff believes the MOU offers at least a
step towards final resolution of this issue, though this does not fully address the City
Council's'previously stated goals and policies regarding the bridge.

10 This Memorandum of Understanding (MOU) is entered into among the Orange County
11 Transportation Authority, hereinafter referred to as the OCTA, and the Cities of Fountain Valley, Costa
12 Mesa and Huntington Beach, hereinafter referred to as Cities.
13 Consistent with the Garfield-Gisler ad-hoc Policy Advisory Committee's consensus
14 recommendation on June 15, 2006, each of the parties to this MOU agrees to support the designation
15 of the Garfield-Gisler Bridge as a "Right-of-Way Reserve"'corridor on the Orange County Master Plan
16 of Arterial Highways (MPAH) and, within their respective General Plans/Long Range Plans, implement
17 the Smart Street and Bridge Widening Strategy A (Strategy A) improvements within their jurisdictions
18 and ensure that buildout of the Garfield-Gisler Bridge is not assumed for land use planning or traffic
19 analysis purposes. This MOU describes the specific duties and responsibilities of each party with
20 respect to supporting these actions.
21 This document establishes obligations on all parties and constitutes an exchange of promises.

24 ' The Right-of-Way Reserve classification allows local jurisdictions considering deletion of a planned MPAH facility
to request OCTA to re-designate the adopted facility as a "Right of Way Reserve" corridor for a specific length of
25 time in order to assess the actual need for it. If OCTA agrees to re-designate the subject facility as a"Right-of-Way
Reserve" corridor on the MPAH, then all appropriate City General Plan Circulation Elements shall be revised to
26 reflect such re-designation. During the"reserve" period, the right-of-way shall be preserved however,the planned
street shall not be considered as mitigation for development planning purposes. At the end of the designated
period, a final decision shall be made regarding reinstatement or deletion of the street on the MPAH.

1 Recital
2 The parties acknowledge that this MOU requires that certain actions be taken with regard to amending
3 the general plans and capital improvement programs of the parties hereto and that the parties hereto
4 cannot predetermine those actions that are the subject of public hearings. Nevertheless, the parties
5 agree that the benefits of this MOU are dependent on such actions and therefore commit to conducting
6 said hearings within 6 months of the effective date of this agreement. If such action is not taken within
7 said time line, the benefits of this agreement shall not be available to the parties unless all parties
8 consent to an extension or other arrangement.
9 Section 1. MPAH and General Plan/Long Range Plan Designations
10 1.1 OCTA Responsibilities
11 1.1.1 Amend Master Plan of Arterial Highways
12 After the cities have amended their General Plans, OCTA shall amend the MPAH to re-designate the
13 Garfield-Gisler Bridge, and the eastbound and westbound approaches thereto, as a "Right-of-Way
14 Reserve" corridor. Consistent with the MPAH's original concept for the Garfield-Gisler Bridge, the right-
15 of-way reservation shall be for a secondary arterial highway in Costa Mesa and a primary arterial in
16 Fountain Valley and Huntington Beach:
17 1.1.2 Amend Orange County Long Range Transportation Plan
18 After the MPAH has been amended and during the next update to the Orange County Long Range
19 Transportation Plan (LRTP), OCTA shall ensure that the Garfield-Gisler Bridge, and the eastbound and
20 westbound approaches thereto,are reflected as a"Right-of-Way Reserve" corridor in the LRTP.
21 1.2 Cities' Responsibilities
22 1.2.1 Amend General Plans
23 The Cities shall pursue amendment of their General Plan Circulation Elements to reflect that the
24 Garfield- Gisler Bridge and the eastbound and westbound approaches thereto have been designated
25 as a "Right-of-Way Reserve" corridor in the MPAH.Consistent with the MPAH's original concept for the
26 Garfield-Gisler Bridge, the City of Costa Mesa's General Plan shall reserve right-of-way for a secondary

4 final adoption of this MOU.
5 Section 2. Reasonable Progress Toward Implementing Strategy A Improvements
6 2.1 OCTA Responsibilities
7 2.1.1 OCTA Responsibilities for Strategy A Improvements
8 To ensure reasonable progress toward implementation of Strategy A improvements, OCTA shall:
9 a. Make funding for implementation of the Strategy A improvements, as defined in the Circulation
10 Feasibility Study and Cost Estimate for the Garfield-Gisler Crossing Over the Santa Ana River
11 (LSA, June 2006), available to the Cities through the Combined Transportation Funding
12 Programs (CTFP). A list of the improvements included in Strategy A is provided as Attachment
13 A hereto.
14 b. Utilize the renewed Measure M Signal Synchronization Program and other CTFP programs as
15 funding sources for implementation of the roadway improvements included in Strategy A.
16 2.2 Cities' Responsibilities
17 2.2.1 Cities' Responsibilities for Strategy A Improvements
18 To ensure reasonable progress toward implementation ofStrategy A improvements, the Cities shall:
19 a. Include Strategy A improvements, as defined in the Circulation Feasibility Study and Cost
20 Estimate for the Garfield-Gisler Crossing Over the Santa Ana River(LSA, June 2006), in their
21 Capital Improvement Programs. All projects that emanate from Strategy A shall be considered
22 multi jurisdictional projects and shall, therefore, be eligible for additional points in OCTA's
23 project prioritization process under the CTFP. A list of the improvements included in Strategy A
24 is provided as Attachment A hereto.

1 b. Make applications to OCTA for CTFP funding to implement Strategy A improvements. Such
-2 applications shall be supported by local match commitments consistent with the
3 requirements of the CTFP programs from which funds are being requested.
4 1. Cities agree to make Strategy A projects a priority for available GMA or other
5 interregional funding programs.
6 c. Implement Strategy A improvements as expeditiously as possible.
7 1. Cities agree to initiate Smart Street improvements on Harbor, Brookhurst, Adams and
8 Fairview by the end of calendar year 2010. For purposes of this MOU, Smart Street
9 improvements are defined as synchronization of traffic signals, removal of on-street
10 parking and re-striping within existing right-of-way.
11 2. Cities agree to make reasonable progress on the Capital Projects by 2015, subject to
12 funding availability. "Reasonable progress" shall be defined as inclusion of noted
13 projects in Capital Improvement Programs (CIPs), preparation of preliminary plans,
14 environmental studies, etc. For the purposes of this MOU, Capital Projects are defined
15 as construction of bus turnouts, consolidation of driveways, construction of turn-pockets,
16 street widening or bridge widening.
17 3. Cities agree that all Strategy A improvements shall be completed by 2020. If the Cities of
18 Costa Mesa and Huntington Beach do not complete their portions of Strategy A
19 improvements by end of calendar year 2020, then the Garfield-Gisler Bridge will
20 automatically be re-instated on the MPAH as a planned facility. If the City of Fountain Valley
21 has not completed the Strategy A improvements in their city, the Garfield-Gisler Bridge will
22 remain designated "Right of Way Reserve" corridor until all improvements are completed.

1 Introduction
2 Through its General Plan Circulation Element, each of the cities within the Garfield/Gisler Bridge
3 Crossing Study Area has established traffic level of service (LOS) D or better as representative of
4 acceptable operating conditions on roadways within its jurisdiction. The Garfield/Gisler Study Area
5 currently experiences significant traffic delay at several locations. In addition, the OCTAM model
6 predicts that several intersections in the project study area will operate below LOS D in the Year 2030 if
7 no improvements are made. To help the cities achieve and/or maintain LOS D operations, where
8 feasible,throughout the project study area, Smart Street and Bridge Widening Strategy A includes a list
9 of improvements to offset the traffic impacts associated with projected growth in traffic volumes. That
10 program of projects is presented below,
11 One of the key concepts included in the "Consensus MOU2 is that each of the cities within the
12 Garfield/Gisler Bridge Crossing Study Area will make "reasonable progress toward implementing the
13 improvements included in Smart Street and Bridge Widening Strategy A. The intent of this concept is
14 that the cities will, individually and collectively, make reasonable efforts to implement the proposed
15 improvement(s) before traffic levels of service fall below the cities' LOS D standard at any of the
16 locations included in the Smart Street and Bridge Widening Strategy A program of projects.
17 It should be noted that although the Smart Street and Bridge Widening Strategy A program of projects
18 is specific, it is not meant to be prescriptive. If a city is able to identify an alternative traffic flow
19 improvement which meets the overall objective of achieving and/or maintaining LOS D at any location
20 within the study area, then that improvement shall be considered an acceptable alternative and shall be
21 implemented as a substitute solution to the original recommendation.

This Memorandum of Understanding (MOU) is entered into among the Orange County
Transportation Authority, hereinafter referred to as the 9&A, and the Cities of Fountain Valley,
Costa Mesa and Huntington Beach, hereinafter referre to as Cities.
Recital
Consistent with the Garfield-Gisler ad-hocl/Policy Advisory Committee's consensus
recommendation on June 15, 2006, each of the parties to this MOU agrees to support the
designation of the Garfield-Gisler Bridge as -V"Right-of-Way Reserve'" corridor on the Orange
County Master Plan of Arterial Highway
�f (MPAH) and, within their respective General
Plans/Long Range Plans, implement thq Smart Street and Bridge Widening Strategy A
(Strategy A) improvements within t;fr
tir jurisdictions' and ensure that buildout of the
Garfield-Gisler Bridge is not assumed land use planning or traffic analysis purposes. This
MOU describes the specific duties and responsibilities of each party with respect to supporting
these actions.
The parties acknowledge that this^MOU requires that certain actions be taken with regard to
amending the general plans and capital improvement programs of the parties hereto and that
the parties hereto cannot predermine those actions that are the subject of public hearings.
Nevertheless, the parties agree that the benefits of this-MOU are dependent on such actions
and therefore commit to con%lot
acting said hearings within 6 months of the effective date of this
agreement. If such action is taken within said time line, the benefits of this agreement shall
not be available to the partis unless all parties consent to an extension or other arrangement.
This document establishes obligations on all parties, and constitutes an exchange of
promises. `
Section — MPAH and General Plan/Long Range Plan Designations
1.1 OCTA Responsibilities
' The Right-of-Way Reserve classification allows local jurisdictions considering deletion of a planned
MPAH facility t request OCTA to re-designate the adopted facility as a "Right of Way Reserve" corridor
for a specific length of time in order to assess the actual need for it. If OCTA agrees to re-designate the
subject facility/as a "Right-of-Way Reserve" corridor on the MPAH, then all appropriate City General Plan
Circulation Elements shall be revised to reflect such re-designation. During the "reserve period, the right-
of-way shall' be preserved however, the planned street shall` not be considered as mitigation for
developmerSt planning purposes. At the end of the designated period, a final decision shall be made'
regarding reinstatement or deletion of the street on the MPAH.

1.1.1 Amend Master Plan of Arterial Highways
After the cities have amended their General Plans, OCTA shall amen the MPAH to re-
designate the Garfield-Gisler Bridge, and the eastbound and westbounja roaches thereto, as
a "Right-of-Way Reserve" corridor. Consistent with the MPAH's oal concept for the
Garfield-Gisler Bridge, the right-of-way reservation shall be for a secoy arterial highway in
Costa Mesa and a primary arterial in Fountain Valley and Huntington Beach.
1.1.2 Amend Orange County Long Range Transportation Plan ' r�
After the MPAH has been amended and during the next update to the Orange County Long
Range Transportation Plan (LRTP), OCTA shall ensure that the Garfield-Gisler Bridge, and the
eastbound and westbound approaches thereto, are reflected as a "Right-of-Way Reserve"
corridor in the LRTP.
1.2 Cities' Responsibilities
1.2.1 Amend General Plans
The Cities shall pursue amendment of their General Plan Circulation Elements to reflect that
the Garfield Gisler Bridge and the eastbound and westbound approaches thereto have been
designated as a "Right-of-Way Reserve" corror in the MPAH. Consistent with the MPAH's
original concept for the Garfield-Gisler Bridge, the City of Costa Mesa's General Plan shall
reserve'right-of-way for a secondary arterial,fiighway within the Garfield-Gisler corridor and the
Fountain Valley and Huntington Beach General Plans shall reserve right-of-way for a primary
arterial highway within the Garfield-Gisler corridor. Cities shall endeavor to complete the
General Plan amendment process with i�6 months of final adoption of this MOU.
Section 2. Reasonable Progress Toward Implementing Strategy A Improvements
2.1 OCTA Responsibilities
2.1.1 OCTA Responsibilities for Strategy A Improvements

To ensure reasonable prop ess toward implementation of Strategy A improvements, OCTA
shall:

a. Make funding fori'implementation of the Strategy A improvements, as defined in the
Circulation Feasibility Study and Cost Estimate for the Garfield-Gisler Crossing Over the.
Santa Ana River (LSA,_June 2006), available to the Cities through the Combined
Transportation Funding Programs,,,,(CTFP). A list of the improvements included in
Strategy A is provided as Attachment A hereto.

b. Utilize the renewed Measure M Signal Synchronization Program and other CTFP
programs as funding sources for implementation of the roadway improvements included
in Strategy,.

2.2 Cities' Responsibilities
2.2.1 Cities' Responsibilities for Strategy A Improvements
To ensure reasonable progress toward implementation of Strategy A improvements, the Cities
shall:

a. Include Strategy A improvements, as defined in the Circulation Feasibility Study and
Cost Estimate for the Garfield-Gisler Crossing Over the Santa Ana River (LSA, June
2006), in their Capital Improvement Programs, All projects thdt emanate from Strategy A
shall be considered multi-jurisdictional projects and shalt, therefore, be eligible for
additional points in OCTA's project prioritization process under the CTFP. A list of the
improvements included in Strategy A is provided as Attaphment A hereto.
b. Make applications to OCTA for CTFP funding to implement Strategy A improvements.
Such applications shall be supported by local match commitments consistent with the
requirements of the CTFP programs from which funds are being requested:
1. Cities agree to make Strategy A projects` a priority for available GMA or other
interregional funding programs.
c. Implement Strategy`A improvements as expeditiously as possible.
1. Cities agree to initiate Smart Street`Vimprovements on Harbor, Brookhurst, .Adams
and Fairview by the end of calendar year 2010. for purposes of this MOU, Smart
Street improvements are defined as synchronization of traffic signals, removal of
on-street parking and re-stripinOvithin existing right-of-way.
2. Cities agree to make reasonp'ble progress on the Capital Projects by 2015, subject
to funding availability. "Reasonable progress" shall be defined as inclusion of noted
projects in Capital lmprove`ment Programs (CIPs), preparation of preliminary plans,
environmental studies, etc. For the purposes of this MOU, Capital Projects are
defined as construction,,of bus turnouts, consolidation of driveways, construction of
turn-pockets, street widening or bridge widening.

3. Cities agree that all,,�Strategy A improvements shall be completed by 2020. if the
Cities of Costa Mesa and Huntington Beach do not complete their portions of
Strategy A improu ments by end of calendar year 2020, then the Garfield-Gisler
Bridge will automatically be re-instated on the MPAH as a planned facility. If the City
of Fountain Valley has not completed the Strategy A improvements in their city, the
Garfield-Gisler yBridge will remain designated "Right of Way Reserve" corridor until
all improvements are completed.

modeling, or traffic analysis activities
Section 4. Compliance Monitoring and Reporting
4.1 OCTA Responsibilities
4.1.1 OCTA Responsibilities for Monitoring & Reporting City Compliance
a. OCTA shall monitor the Cities' compliance with the provisions of this MOU every two
years through thl' MPAH Certification Review Process to ensure that the Cities are
complying fully ith the provisions of this agreement and making reasonable progress
toward impler`entation of the Strategy A improvements. Progress reports shall :be
presented to,.,�the. OCTA Board of Directors and the Cities every two years, .at the
- conclusion of the review process.
b. Upon completion of all the Strategy A improvements, and consistent with OCTA
guidance for MPAH Right-of-Way Reserve corridors, OCTA in coordination with the
cities shall re-evaluate traffic levels of service in the project study area to determine
whether, o delete, continue the reserve, or re-instate the Garfield-Gisler Bridge onto the
MPAH as,a planned facility.

4.2 Cities' Responsibilities
4.2.1 Cities Responsibilities for Reporting Compliance

The Cities shall provide, progress reports to OCTA every two years/through the MPAH -
Certification Review Process as a means of communicating that the provisions included herein
