Statement of Issue: t,•, . 1 A The City of Irvine has offered to exchange $3,225,200 in Gas Tax Funds for fi4,069,000 in City or f Huntington Beach Federal Aid Urban Funds. `' "' ' : Recommendation: Approve the Agreement for Assignment of Federal Aid Urban (FAU) Funds and authorize %'r,' the !Mayer to execute the agreement on behalf of the city. Analysis: ' ' i i• At the November 16, 1987 Council meeting, the City Council authorized the Director of Public Works to negotiate an agreement between the Orange County Transportation a ' Commission, the L�ty of Irvine and the City of Huntington Beach to exchange City of Huntington Reach FAU funds for City of Irvine gasoline tax funds. Ai Project Project Back round: `• In 1984, the City of Huntington Beach applied for and was awarded FAU funds for the � widening of Goldenwest Street between Rio Vista Avenue and Pacific Coast Highway. j Federal Aid Urban Funds are administered through CALTRANS and the Federal Highway f Administration. Because of the rigorous National Environmental Protection Act (NEPA) 1 requirements, EIR documents for FAU projects must be very detailed and are subject to review at bath state and federal levels prior to being released for qeneral comment. Th.! I review period may take several years, particularly if there are any actual or potential 1 archeological ur historical sites, wetland or wildlife areas, adjacent structures, i underground uti:ities, rights-nf-way to be acquired, or the possibility of any hazardous I materials in the project area. City Experience with FAU Proincts: NEPA (National Environmental Protection Agency) procedures are very rigoroua and because they are administered by bureaucrats from outside the local area, simple issues become insurmountable prohlerns. As an example, the city just recently completed a draft EIR for L' a Warner Avenue Widening FaU Project. The cost of the original contrart for the EIR was $30,889 and the consultant begar, work on the document in April, 1963. Although the city's share of the project is ► '`r �r,, only 12.6% and has riven only $55 000 in the 4 year Period, the total bill to the taxpayer :! �' ;'�`f,'�` � `�� {•has still rl.an by $440,000. r t 1�' The Goldenwest EIR process is starting to look the same. On May 22 1986 the EIR v process began with a $30,000 contract. After an initia! submittal of a draft to CALTRANS in June, 1987, it became obvious that we had oarely tapped the surface. The COUncil approved an amended contract ($16,000) in August, to do an archeological dig and r` "'`yr"`' a $40,000 contract amendment is pending for preliminary engineering to enable the EIR consultant to determine the project effect on "every blade of grass". It appears that we may also he one of the first agencies to fall under the rtew federal hazardous site policy . a:F. , : . r�;:"r� �`• :+ since the road widening is adjacent to oil fields. No one can tell us what obstacles this new policy may create. The ,tare rt-view personnel are estimating another 1 I/2 years to ': �:+.�i ,.,•' complete the EIR process and an additional 1 1 2 years to acquire riqhts-of-way. w 't. Pro and Cons of Brokering FA1J Dollars: iThe benefit to the City of Huntington Beach in swapping FAU dollars for gasoline tax s�' '•: dollars is the reduction in State and Federal processing time. The benefit to the City of Irvine is in obtaining FAU dollars at a discounted rate. In this case, Irvine is offeri, q us 8UV in gas tax dcliars for each dollar of our FAU money. Irvine has already completed the envirenmenta; processing on their project and is ready to proceed with construction. caw r The Goldenwest Street Widening Project is estimated at about $4.7 million including ` design, right-of-way, construction and construction engineering. The FAU share is about i $4.1 million. Possible savings or benefits resulting from brokering FAU dollars: 1. We could bid the project two years earlier. if we used gas tax funds, the CEQA process could be substituted for the NEPA process crid CALTRANS anJ the FHWA would not have to review EIR, ��/�'! acquisition or pl,nns. 2. We could invest the money receiveu from Irvine at a rate exceeding the inflation rote j by 3-4%. Costs of construction have been increasing about 2-3% a year for the past three years. A one year 17D is over 7%. In two years, we could earn up to $250,01`10. 3. We could negotiate R/1W purchase and maybe get some dedications rather than follow cumbersome fe„seral requlntions and buy it cnly at appraised prices.
