ENGINEERING DESIGN AGREEMENT BETWEEN THE CITY OF HUNTINGTON BEACH AND OTT ENGINEERING, INC. FOR LARGE WATER SERVICE RECONSTRUCTION (CC-760) THIS AGREEMENT, made and entered into this /7 t`_, day of Cd U , 1989, by and between the CITY OF HUNTINGTON BEACH, a municipal corporation of the State of California, hereinafter referred to as "CITY, " and OTT ENGINEERING, INC. , a California corporation, hereinafter referred to as "CONTRACTOR. " WHEREAS, CITY desires to engage the services of an engineering design contractor to prepare plans, specifications and cost estimates for reconstruction of large domestic water and fire services at various locations in the City of Huntington Beach; and CONTRACTOR has been selected to perform said services, NOW, THEREFORE, it is agreed by CITY and CONTRACTOR as follows : 1 . WORK STATEMENT CONTRACTOR shall provide all services as described in CITY' S "Request for Proposal, " dated May 25, 1989, and CONTRACTOR' S "Professional Services Proposal" dated June 23 , 1989 , (hereinafter collectively referred to as Exhibit "A" ) , which is attached hereto and incorporated into this Agreement by this reference. Said services shall sometimes hereinafter be referred to as "PROJECT. " CONTRACTOR hereby designates C. Stephen Bucknam, Jr . who shall represent it and be its sole contact and agent in all consultations with CITY during the performance of this Agreement . -1- 2 . CITY STAFF ASSISTANCE CITY shall assign a staff coordinator to work directly with CONTRACTOR in the performance of this Agreement . 3 . TIME OF PERFORMANCE Time is of the essence of this Agreement. The services of the CONTRACTOR are to commence as soon as practicable after the execution of this Agreement and all tasks specified in Exhibit "A" shall be completed no later than four (4) months from the date of this Agreement . These times may be extended with the written permission of the CITY. The time for performance of the tasks identified in Exhibit "A" are generally to be as shown in the Scope of Services on the Work Program/Project Schedule. This schedule may be amended to benefit the PROJECT if mutually agreed by the CITY and CONTRACTOR. 4 . COMPENSATION In consideration of the performance of the engineering services described in Section 1 above, CITY agrees to pay CONTRACTOR a fee of Thirty-six Thousand One Hundred Ninety-two and no/100 Dollars ($36, 192 . 00) . 5 . EXTRA WORK In the event of authorization, in writing by the CITY, of changes from the work described in Exhibit "A" , or for other written permission authorizing additional work not contemplated herein, additional compensation shall be allowed for such Extra Work, so long as the prior written approval of CITY is obtained. 6 . METHOD OF PAYMENT A. CONTRACTOR shall be entitled to progress payments -2- toward the fixed fee set forth in Section 4 herein in accordance with the progress and payment schedules set forth in Exhibit A" . B. Delivery of work product : A copy of every technical memo and report prepared by CONTRACTOR shall be submitted to the CITY to demonstrate progress toward completion of tasks . In the event CITY rejects or has comments on any such product, CITY shall identify specific requirements for satisfactory completion. Any such product which has not been formally accepted or rejected by CITY shall be deemed accepted. C. The CONTRACTOR shall submit to the CITY an invoice for each progress payment due. Such invoice shall : 1) Reference this Agreement; 2) Describe the services performed; 3) Show the total amount of the payment due; 4) Include a certification by a principal member of the CONTRACTOR' S firm that the work has been performed in accordance with the provisions of this Agreement; and 5) For all payments include an estimate of the percentage of work completed. Upon submission of any such invoice, if CITY is satisfied that CONTRACTOR is making satisfactory progress toward completion of tasks in accordance with this Agreement, CITY shall promptly approve the invoice, in which event payment shall be made within thirty (30) days ' of receipt of the invoice by CITY. Such approval shall not be unreasonably withheld. If the CITY does not approve an invoice, CITY shall notify CONTRACTOR in writing of the -3- ( 1 reasons for non-approval, within seven (7) calendar days of receipt of the invoice, and the schedule of performance set forth in Exhibit "A" shall be suspended until the parties agree that past performance by CONTRACTOR is in, or has been brought into compliance, or until this Agreement is terminated pursuant to Section 12 hereof . D. Any billings for extra work or additional services authorized by the CITY shall be invoiced separately to the CITY. Such invoice shall contain all of the information required under paragraph 6C, and in addition shall list the hours expended and hourly rate charged for such time. Such invoices shall be approved by CITY if the work performed is in accordance with the extra work or additional services requested, and if CITY is satisfied that the statement of hours worked and costs incurred is accurate. Such approval shall not be unreasonably withheld. Any dispute between the parties concerning payment of such an invoice shall be treated as separate and apart from the ongoing performance of the remainder of this Agreement . 7. DISPOSITION OF PLANS, ESTIMATES AND OTHER DOCUMENTS CONTRACTOR agrees that all materials prepared hereunder, including all original drawings, designs, reports , both field and office notes, calculations, maps and other documents, shall be turned over to CITY upon termination of this Agreement or upon PROJECT completion, whichever shall occur first . In the event this Agreement is terminated, said materials may be used by CITY in the completion of PROJECT or as it otherwise sees fit . Title to said materials shall pass to the CITY upon payment of fees -4- ( 1 determined to be earned by CONTRACTOR to the point of termination or completion of the PROJECT, whichever is applicable. CONTRACTOR shall be entitled to retain copies of all data prepared hereunder . 8 . INDEMNIFICATION AND HOLD HARMLESS CONTRACTOR hereby agrees to indemnify and hold and save harmless CITY, its officers and employees from any and all liability, including any claim of liability and any and all losses or costs arising out of the negligent performance of this agreement by CONTRACTOR, its officers or employees . 9 . WORKERS' COMPENSATION CONTRACTOR shall comply with all of the provisions of the Workers ' Compensation Insurance and Safety Acts of the State of California, the applicable provisions of Division 4 and 5 of the California Labor Code and all amendments thereto; and all similar state or federal acts or laws applicable; and shall indemnify, defend and hold harmless CITY from and against all claims, demands, payments, suits, actions, proceedings and judgments of every nature and description, including attorney' s fees and costs presented, brought or recovered against CITY, for or on account of any liability under any of said acts which may be incurred by reason of any work to be performed by CONTRACTOR under this Agreement. CONTRACTOR shall obtain and furnish evidence to CITY of maintenance of statutory workers ' compensation insurance and employers ' liability in an amount of not less than $100, 000 bodily injury by accident, each occurrence, $100, 000 bodily injury by disease, each employee, and $250, 000 bodily injury by disease, policy limit . -5- 10 . INSURANCE In addition to the workers ' compensation insurance and CONTRACTOR' S covenant to indemnify CITY, CONTRACTOR shall obtain and furnish to CITY the following insurance policies covering the PROJECT: A. General Liability Insurance. A policy of general public liability insurance, including motor vehicle coverage. Said policy shall indemnify CONTRACTOR, its officers, agents and employees, while acting within the scope of their duties, against any and all claims of arising out of or in connection with the PROJECT, and shall provide coverage in not less than the following amount: combined single limit bodily injury and damage, including g g products/completed operations liability and blanket contractual liability, of $1, 000, 000 per occurrence. If coverage is provided under a form which includes a designated general aggregate limit, the aggregate limit must be no less than $1, 000, 000 . Said policy shall name CITY, its officers, and employees as Additional Insureds, and shall specifically provide that any other insurance coverage which may be applicable to the PROJECT shall be deemed excess coverage and that CONTRACTOR' S insurance shall be primary. B. Professional Liability Insurance. CONTRACTOR shall acquire a professional liability insurance policy covering the work performed by it -6- hereunder. Said policy shall provide coverage for CONTRACTOR' S professional liability in an amount not less than $500, 000 per claim. A claims made policy shall be acceptable. 11. CERTIFICATES OF INSURANCE; ADDITIONAL INSURED ENDORSEMENTS Prior to commencing performance of the work hereunder, CONTRACTOR shall furnish to CITY certificates of insurance subject to approval of the City Attorney evidencing the foregoing insurance coverages as required by Sections 9 and 10 herein; said certificates shall provide the name and policy number of each carrier and policy, and shall state that the policy is currently in force and shall promise to provide that such policies will not be cancelled or modified without thirty (30) days prior written notice to CITY. CONTRACTOR shall maintain the foregoing insurance coverages in force until the work under this Agreement is fully completed and accepted by CITY. The requirement for carrying the foregoing insurance coverages hall not derogate from the provisions for indemnification of CITY BY CONTRACTOR under Section 8 of this Agreement. CITY or its representative shall at all times have the right to demand the original or a copy of all said policies of insurance. CONTRACTOR shall pay, in a prompt and timely manner, the premiums on all insurance hereinabove required. A separate copy of the additional insured endorsement to each of CONTRACTOR'S insurance policies, naming the CITY, its officers and employees as Additional Insureds shall be provided to the City Attorney for approval prior to any payment hereunder. -7- 12 . INDEPENDENT CONTRACTOR CONTRACTOR is, and shall be, acting at all times in the performance of this Agreement as an independent contractor . CONTRACTOR shall secure at its expense, and be responsible for any and all payments of all taxes, social security, state disability insurance compensation, unemployment compensation and other payroll deductions for CONTRACTOR and its officers, agents and employees and all business licenses, if any, in connection with the services to be performed hereunder. 13 . TERMINATION OF AGREEMENT All work required hereunder shall be performed in a good and workmanlike manner. CITY may terminate CONTRACTOR' S services hereunder at any time with or without cause, and whether or not PROJECT is fully complete. Any termination of this Agreement by CITY shall be made in writing through the City Engineer, notice of which shall be delivered to CONTRACTOR as provided in Section 16 herein. 14 . ASSIGNMENT AND SUBCONTRACTING This Agreement is a personal service contract and the supervisory work hereunder shall not be delegated by CONTRACTOR to any other person or entity without the consent of CITY. 15 . COPYRIGHTS/PATENTS CONTRACTOR shall not apply for a patent or copyright on any item or material produced as a result of this Agreement, as set forth in 41 CFR 1-9 . 1. 16 . CITY EMPLOYEES AND OFFICIALS CONTRACTOR shall employ no CITY official nor any regular CITY employee in the work performed pursuant to this Agreement. -8- No officer or employee of CITY shall have any financial interest in this Agreement in violation of California Government Code Sections 1090 et seq. 17 . NOTICES Any notices or special instructions required to be given in writing under this Agreement shall be given either by personal delivery to CONTRACTOR' S agent (as designated in Section 1 hereinabove) or to CITY' S Director of Public Works, as the situation shall warrant, or by enclosing the same in a sealed envelope, postage prepaid, and depositing the same in the United States Postal Services, addressed as follows : TO CITY: TO CONTRACTOR: Mr. Louis Sandoval Ott Engineering, Inc. RECOMMENDATION: 1. Approve the plans and specifications and authorize the Director of Public Works to solicit bids for construction. 2. Approve the attached contract subject to award of contract to Council approved lowest responsible bidder. ANALYSIS: On July 17, 1989, the City Council selected the firm of OTT Engineering, Incorporated to prepare the plans and specifications for the reconstruction of large water services. The final drawings are complete and staff has reviewed and approved the documents; therefore, the Director of Public Works requests Council approval of the plans and specifications and authorization to solicit bids for construction. FUNDING SOURCE: Funds in the amount of$250,000.00 are available for this project in Large Meter Improvements Account E-EW-PW-921-06-39-00. E ONLY CITY FUNDED CONSTRUCTION CONTRACT BETWEEN THE CITY OF HUNTINGTON BEACH'AND FOR LARGE WATER SERVICE RECONSTRUCTION THIS AGREEMENT is made and entered into on this day of , 1990 , by and between the CITY OF HUNTINGTON BEACH, a municipal corporation of the State of California, hereinafter referred to as "CITY, " and , a California corporation, hereinafter referred to as "CONTRACTOR. " WHEREAS, CITY has solicited bids for a public works project, hereinafter referred to as "PROJECT, " more fully described as large water service reconstruction in the City of Huntington Beach; and CONTRACTOR has been selected and is to perform said work, NOW, THEREFORE, in ,consideration of the promises and agreements hereinafter made and exchanged, the parties covenant and agree as follows : 1 . STATEMENT OF WORK; ACCEPTANCE OF RISK CONTRACTOR shall furnish, at its own expense, all labor, plans, tools, equipment, supplies, transportation, utilities and all other items, services and facilities necessary to complete and construct the PROJECT in a good and workmanlike manner . CONTRACTOR agrees to assume the risk of all loss or damage arising out of the nature of the PROJECT, during its progress or prior to acceptance, from the action of the elements , from any unforeseen difficulties which may arise or be encountered in the prosecution of work, and for all other risks of any description connected with the work, including, but not limited to, all expenses incurred by or in consequence of the suspension or discontinuance of work, except such as are herein expressly stipulated to be borne by CITY, and for well and faithfully completing the work within the C-1'- SAMPLE ONLY stipulated time and in the manner shown and described in this Agreement, and in accordance with the requirements of CITY under them for the compensation set forth in the accepted bid proposal . However, the total compensation to be paid is to be computed on the basis of the units of work as it is actually performed, in accordance with the stipulated prices named in the Bid Sheet(s) . 2 . ACCEPTANCE OF CONDITIONS OF WORK; PLANS AND SPECIFICATIONS CONTRACTOR acknowledges that it is fully familiar with all the terms , conditions and obligations of this Agreement and the Contract Documents (at hereinafter defined) , the location of 'the job site, and the conditions under which the work is_ to be performed, and that it enters into tills Agreement based upon its investigation of all such matters and is relying in no way upon any opinions or representations of CITY. It is agreed that the Contract Documents are incorporated into this Agreement by this reference, with the same force and effect as if the -same were set forth at length herein, and that CONTRACTOR and its subcontractors, if any, shall be bound by said Contract Documents insofar as they relate in part or in any way, directly or indirectly, to the work covered by this Agreement . "Contract Documents" as defined herein mean and include: A. This Agreement; B . Bonds covering the work herein agreed, upon; C. The CITY' S standard Plans and Specifications and special contractual provisions, including those on file in theoffice of the Director of Public Works of CITY and adopted by the City Council of CITY, and any revisions , amendments or addenda thereto; C-2- SAMPLE ONLY D . The 1988 edition of Standard Specifications for Public Works Construction, published by Builder ' s News, Inc . , 3055 Overland Avenue, Los ,Angeles, California 90034 , and all amendments thereto, written and promulgated by the Southern California chapter of the American Public Works Association and the Southern California District Associated General Contractors of the California Joint Cooperative Committee; E. Bid documents including the Notice Inviting Bids , the Special Instructions to Bidders and the Contractor ' s Proposal (attached hereto as Exhibit "A" ) ; F. Thee particular plans , specifications , special provisions and addenda applicable to the PROJECT. Anything mentioned in the Specifications and not indicated in the Plans or indicated in the Plans and not mentioned in the Specifications, shall be of like effect as if indicated and mentioned in both. In case of discrepancy between any plans, specifications , special provisions , or addenda, the matter shall be immediately submitted by CONTRACTOR to the Department of Public Works of CITY (hereinafter referred to as "DPW" ) , without whose decision said discrepancy shall not be adjusted by CONTRACTOR, save bnly at its own risk and expense. Should there be any conflict between the terms of this Agreement and the bid or proposal of CONTRACTOR, then this Agreement shall control and nothing herein shall be considered as an acceptance of the terms of said bid or proposal which is in conflict herewith. 3 . COMPENSATION CITY agrees to pay and CONTRACTOR agrees to accept as full compensation for the faithful performance of this Agreement, subject to any additions or deductions made under the provisions of this C-3- SAMFL-EONLY Agreement or the Contract Documents , a sum of ($ ) , as set forth in the Contract Documents, to be paid as provided for in Sections 1, 6 , 13 and 14 herein. 4 . COMMENCEMENT OF PROJECT CONTRACTOR agrees to commence the PROJECT within ten (10) working days after notice to proceed is issued and shall diligently prosecute PROJECT to completion within ( ) consecutive calendar days from the day the "Notice to Proceed" is issued by Department of Public Works , excluding delays provided for in Section 11 herein. 5 . TIME OF THE ESSENCE The parties hereto recognize and agree that time is of the essence in the performance, of this Agreement and each and every provision of the Contract Documents . CONTRACTOR shall prepare and obtain approval as required by the Contract Documents for all shop drawings, details and samples, and do all other things necessary and incidental to the prosecution of its work in conformance with the progress schedule set forth in the Contract Documents . CONTRACTOR shall coordinate its work with the work of all other contractors , subcontractors and CITY forces working on the PROJECT, in a manner that will facilitate the efficient completion of the PROJECT and in accordance with Section 4 herein. CITY shall have complete control of the premises on which the work is to be performed and shall have the right to decide the time and order in which the various portions of the work shall be performed and the priority of the work of other contractors, subcontractors and CITY forces and, in general, all matters concerning the timely and orderly conduct of the work of CONTRACTOR on the premises . C-4- SAMPLE ONLY 6 . CHANGES CONTRACTOR shall adhere strictly to the plans and specifications set forth in the Contract Documents unless a change therefrom is authorized in writing by the DPW. CONTRACTOR agrees to make any and all changes, furnish materials and perform all work necessary within the scope of the PROJECT as the DPW may require in writing . Under no condition shall CONTRACTOR make any changes without the written order of the DPW, and CITY shall not pay any extra charges made by CONTRACTOR that have not been agreed upon in writing by the DPW. When directed Ito change the work, CONTRACTOR shall submit immediately to the DPW a written cost proposal reflecting the effect of the change. Should the DPW not agree to such cost proposal, the work shall be performed according to the changes ordered in writing by the DPW and the proper cost thereof shall be negotiated by the parties upon cost and pricing data submitted by the CONTRACTOR; thereupon, CITY will promptly issue an adjusted change order to CONTRACTOR and the contract price will be adjusted upward or downward accordingly. 7 . NOTICE TO PROCEED No work, services, material, or equipment shall be performed or furnished under this Agreement unless and until a Notice to Proceed has been given to the CONTRACTOR by CITY. CITY does not warrant that the work site will be available on the date- the Notice to Proceed is issued. In event of a delay in commencement of the work due to unavailability of the job site, for any reason, relief to the CONTRACTOR shall be limited to a time extension equal to the delay due to such unavailability. C-5- SAMPLE ONLY 8 . BONDS CONTRACTOR shall, prior to entering upon the performance of this Agreement, furnish the following bonds approved by the City Attorney: One in the. amount of one hundred percent of the contract price to guarantee the CONTRACTOR' S faithful performance of the work and to warrant such performance for a period of one (1) year after CITY' S acceptance thereof, and one in the amount of fifty percent (50%) of the contract price to guarantee payment of all claims for labor and materials furnished. 9 . WARRANTIES The CONTRACTOR' unconditionally guarantees all work done under this Agreement including, but not limited to, any workmanship, installation, fabrication,' material or structural facilities constructed. CONTRACTOR, within ten (10) days after notice by CITY of any defect in the work, shall have the option to make appropriate repairs or replace the defective item or items . Upon expiration of such ten (10) day period, CITY may then make appropriate repair or replacement at CONTRACTOR' S risk and expense . 10 . INDEPENDENT CONTRACTOR It is understood and agreed that the CONTRACTOR is , and shall be, acting at all times hereunder as an independent contractor and not as an employee of CITY. CONTRACTOR shall secure, at its expense, and be responsible for any and all payment of income tax, social security, state disability insurance compensation) unemployment compensation and other payroll deductions for CONTRACTOR and its officers , agents and employees , and all business licenses , if any, in connection with the PROJECT. l C-6- S11 . LIQUIDATED DAMAGES/DELAYS AMPLE ONLY It is agreed by the parties hereto that in case the total work called for hereunder is not in all parts and requirements finished or completed within the number of calendar days as set forth in Section 4 herein, damage will be sustained by CITY; and that it is , and would be, impractical and extremely difficult to ascertain and determine the actual damage which CITY would sustain in the event of and by reason of such delay; it is , therefore, agreed that CONTRACTOR will pay to CITY, as liquidated damages and not as a penalty, the sum of Dollars ($ ) per day foreach and every working day' s delay in completing the work in excess of the number of working/calendar days set forth in Section 4 herein, which sum represents a reasonable endeavor by the parties hereto to estimate a fair compensation for the foreseeable losses CITY would sustain in the event of and by reason of such delay; and CONTRACTOR agrees to pay said damages herein provided, and further agrees that CITY may deduct the amount thereof from any monies ' due or that may become due to CONTRACTOR hereunder . CONTRACTOR will be granted an' extension of time and will not be assessed damages for any portion of the delay in completion of the work due to unforeseeable causes beyond the control and without the fault or negligence of CONTRACTOR, including , but not restricted to, acts of God or of the public enemy, fire, floods , epidemics , quarantine restrictions , strikes, unsuitable weather, or delays of subcontractors due to such causes . CONTRACTOR shall, within fifteen (15) days from the beginning of any such delay (unless the DPW shall grant a further period of time prior to the date of final settlement of the Agreement) , notify C-7- SAMPLE ONLY the DPW in writing of the cause of the delay and CITY shall extend the time for completing the work if, in its judgment, the findings of fact thereon justify the delay; and the decision of the DPW shall be conclusive on the parties hereto . Should CONTRACTOR be delayed in the prosecution or completion of the work by the act, neglect or default of CITY, or should CONTRACTOR be delayed waiting for materials required by this Agreement to be furnished by CITY, or by damage caused by fire or other casualty at the job site for which CONTRACTOR is not responsible, or by the combined action of the workers, in nowise caused by or resulting from default or collusion on the part of CONTRACTOR, or in the event of a lockout by CITY, then the time herein fixed for the completion of the work shall be extended by the number of days the CONTRACTOR has thus been delayed, but no allowance or extension shall be made; unless a claim therefor is presented in writing to CITY within fifteen (15) days of the commencement of such delay. No claims for additional compensation or damages for delays, irrespective of the cause thereof , and including without limitation . the furnishing of material by CITY of delays by other contractors or subcontractors, will be allowed and said extension of time for completion shall be the sole remedy of CONTRACTOR. 12 . DIFFERING SITE CONDITIONS (1) Notice The CONTRACTOR shall promptly, and before such conditions are disturbed, notify the DPW in writing of : (a) Subsurface or latent physical conditions at the job site differing materially from those indicated in this Agreement or the Contract Documents ; or, C -8- SAMPLEONLY (b) Unknown physical conditions at the job site, of an unusual nature, differing materially from those ordinarily encountered and generally recognized as inherent to work of the character to be performed under this Agreement . The DPW shall promptly investigate the conditions and if it finds that such conditions do materially so differ and cause an increase or decrease in the time required for performance of any part of the work under this Agreement, whether or not changed as a result of such conditions, an equitable adjustment shall be made and the Agreement modified in writing accordingly; (2) Time Extension No claim of the CONTRACTOR under this Section shall be allowed unless the CONTRACTOR has given the notice required hereunder, provided, however, the time prescribed therefor may be extended by CITY. 13 . VARIATIONS IN ESTIMATED .OUANTITIES The quantities listed in the bid schedule will not govern final payment . Payment to the CONTRACTOR will be made only for the actual quantities of contract items used in construction of the PROJECT, in accordance with the plans and specifications . Upon completion of the PROJECT, if the actual quantities used are either more than or less than the quantities listed in the bid schedule, the bid price shall prevail subject to the provisions of this Section. The DPW may, at its sole discretion, when warranted by the facts and circumstances , order an equitable adjustment, upwards or downwards, in payment to the CONTRACTOR where the actual quantities used in construction of the PROJECT are in variation to the quantities listed in the bid schedule. No claim by CONTRACTOR for an equitable adjustment in price or time for completion shall be allowed if asserted after final payment under this Agreement . If C -9- SAMPLE ONLY the quantity variation is such as to cause an increase in the time necessary for completion, the DPW shall ascertain the facts and circumstances and make such adjustment for extending the completion date as in its judgment the findings warrant . 14 . PROGRESS PAYMENTS Each month the DPW will make an estimate in writing of the work performed by CONTRACTOR and the value thereof . From each progress estimate, ten percent (10%) will be deducted and retained by CITY and the remainder, less the amount of all previous payments since commencement of the work, will be paid to CONTRACTOR. When CONTRACTOR has, in the judgment of the DPW, faithfully executed fifty percent (50%) or more of the value of the work as determined from the bid schedule, and if the DPW finds that satisfactory progress has been and is being made, the CONTRACTOR may be paid such sum as will bring the payments of each month up to one hundred percent (100%) of the value of the work completed since the commencement of the PROJECT, as determined by DPW, less all previous payments and less all previous retained amounts . The final payment, if unencumbered, or any part thereof unencumbered, shall be made - thirty-five (35) days after the acceptance of the work and the filing of a Notice of Completion by CITY. Payments shall be made on demands drawn in the manner required by law, each payment to be accompanied by a certificate signed by the DPW, affirming that the work for which payment is demanded has been performed in' accordance with the terms of the Agreement and that the amount stated in the certificate is due under the terms of the Agreement . Partial payments on the contract price shall not be considered as an acceptance of any part of the work. C-10- yPLE ONLY 15 . WITHHELD CONTRACT FUNDS, SUBSTITUTION OF SECURITIES At the request and expense of CONTRACTOR, who shall retain beneficial ownership ,and receive interest, if any thereon, CITY shall permit the substitution and deposit therewith of securities equivalent to the amount of any monies withheld by CITY to ensure performance under Section 13 of this Agreement . 16 . AFFIDAVITS OF SATISFACTION OF CLAIMS After the completion of the work contemplated by this Agreement, CONTRACTOR shall file with the DPW its affidavit stating that all workers and persons employed, all firms supplying materials and all subcontractor's upon PROJECT have been paid in full and that there are no claims outstanding against PROJECT for either labor or material, except certain items, if any, to be set forth in an affidavit covering disputed claims, or items in connection with Notices to Withhold which have been filed under the provisions of the statutes of the State of California . 17 . WAIVER OF CLAIMS The acceptance br CONTRACTOR of the payment of the final certificate shall constitute a waiver of all claims against CITY under or arising out of this Agreement . 18 . INDEMNIFICATION, DEFENSE, HOLD HARMLESS CONTRACTOR hereby agrees to protect, defend, indemnify and hold and save harmless CITY, its officers, and employees against any and all liability, claims, judgments , costs and demands „ however caused, including those resulting from death or injury to CONTRACTOR ' S employees and damage to CONTRACTOR ' S property, arising directly or indirectly out of the obligations or operations herein undertaken by CONTRACTOR, including those arising from the passive concurrent negligence of CITY, but save and except those which arise C -11- SAMPLSNLV out of the active concurrent negligence, sole negligence, or the sole willful misconduct of CITY. CONTRACTOR will conduct all defense at its sole cost and expense . CITY shall be reimbursed by CONTRACTOR for all costs or attorney' s fees incurred by CITY in enforcing this obligation. 19 . WORKERS ' COMPENSATION INSURANCE Pursuant to California Labor Code §1861, CONTRACTOR acknowledges awareness of Section 3700 et seq. of said code, which requires every employer to be insured against liability for workers ' compensation; CONTRACTOR covenants that it will comply with such provisions prior to commencing performance of the work hereunder . CONTRACTOR shall maintain such Workers ' Compensation Insurance in an amount of ,not less than One Hundred Thousand Dollars ($100, 000) bodily injury by accident, each occurrence, One Hundred Thousand Dollars ($100 , 000) bodily injury by disease, each employee, and Two Hundred Fifty Thousand Dollars ($250 , 000) bodily injury by disease, policy limit, at all times incident hereto, in forms and underwritten by insurance companies satisfactory to CITY. CONTRACTOR shall require all subcontractors to provide such Workers ' Compensation Insurance for all of the subcontractors ' employees . CONTRACTOR shall furnish to CITY a certificate of waiver of subrogation under the terms of the Workers ' Compensation Insurance and CONTRACTOR shall similarly require all subcontractors to waive subrogation. 20 . INSURANCE CONTRACTOR shall carry at all times incident hereto, on all operations to be performed hereunder, general liability insurance, including coverage for bodily injury, property damage, products/completed operations , and blanket contractual liability. C -12- WE AR , } L Said insurance shall also include automotive bodily injury and property damage liability insurance. All insurance shall be underwritten by insurance companies in forms satisfactory to CITY for all operations, subcontract work, contractual obligations , product or completed operations and all owned vehicles and non-owned vehicles . Said insurance shall name the CITY, its officers, agents and employees and all public agencies as determined by the CITY as Additional Insureds . CONTRACTOR shall subscribe for and maintain said insurance policies in full force and effect during the life of this Agreement, in an amount of not less than One Million Dollars ($1, 000, 000) combined' single limit coverage . If coverage is provided under a form which includes a designated general aggregate limit, such limit shall be no less than One Million Dollars ($1, 000 , 000) . In the event of aggregate coverage, CONTRACTOR shall immediately notify CITY of any known depletion of limits . CONTRACTOR shall require its insurer to waive its subrogation rights against CITY and agrees to provide certificates evidencing the same. 21 . CERTIFICATES OF INSURANCE; ADDITIONAL INSURED ENDORSEMENT Prior to commencing performance of the work -hereunder , CONTRACTOR shall furnish to CITY certificates of insurance subject to approval of the City Attorney evidencing the foregoing insurance coverages as required by Sections 19 and 20 herein; said certificates shall provide the name and policy number of . each carrier and policy, and shall state that the policy is currently in force and shall promise to provide that such policies will not be cancelled without thirty (30) days prior written notice to CITY. CONTRACTOR shall maintain the foregoing insurance coverages in force until the work under this Agreement is fully completed and accepted C-13- by CITY. SAMPLE ;ONLY The requirement for carrying the foregoing insurance shall not derogate from the provisions for indemnification of CITY by CONTRACTOR under Section 18 of this Agreement . CITY or its representative shall at all times have the right to demand the original or a copy of all said policies of insurance . CONTRACTOR shall pay, in a prompt and timely manner, the premiums on allinsurance hereinabove required. A separate copy of the additional insured endorsement to each of CONTRACTOR' S insurance policies , naming the CITY, its officers and employees as Additional Insureds shall be provided to the_ City Attorney for approval prior to any payment hereunder . 22 . DEFAULT AND TERMINATION If CONTRACTOR fails' or refuses to prosecute the work hereunder with diligence, or fails to complete the work within the time specified, or is adjudged a bankrupt or makes an assignment for the benefit of creditors or becomes insolvent, or violates any provision of this Agreement or the Contract Documents , CITY may give notice in writing of its intention to terminate this Agreement . Unless the violation is cured within ten (10) days after such Notice of Intention has been served on CONTRACTOR, CITY may, without prejudice to any other remedy it may have, terminate this Agreement upon the expiration of that time . Upon such default by CONTRACTOR, CITY may elect not to terminate this Agreement; in such event CITY may make good the def•itiency in which the default consists and deduct the resulting costs from the progress payments then or to become due to CONTRACTOR. C-14- SAMPLE ONLY 23 . DISPOSITION OF PLANS, ESTIMATES AND OTHER DOCUMENTS CONTRACTOR agrees that upon completion of the work to be performed hereunder, or upon earlier termination of this Agreement, all original plans , specifications, drawings, reports , calculations, maps and other documents pertaining to this Agreement shall be delivered to CITY and become its sole property at no further cost . 24 . NON-ASSIGNABILITY CONTRACTOR shall not sell , assign, transfer, convey or encumber this Agreement, or any part hereof , or any right or duty created herein, without the prior written consent of CITY and the surety. 25 . ' CITY EMPLOYEES AND OFFICIALS CONTRACTOR shall employ no CITY official nor any regular CITY employee in the work performed pursuant to this Agreement . No officer or employee of CITY shall have any financial interest in this Agreement in violation of California Government Code Sections 1090 et seq. 26 . STOP NOTICES: RECOVERY OF ADMINISTRATIVE COSTS CITY shall be entitled to recover from CONTRACTOR its reasonable administrative and attorney' s fees , costs and necessary disbursements arising out of the processing of said Stop Notices, Notices to Withhold, or any similar legal document necessary to the prosecution of such action. Said obligation shall be provided for in the labor and materials payment bond required of CONTRACTOR. CITY may charge an administrative fee of One-Hundred Dollars ($100) for every Stop Notice filed in excess of two, regardless of whether or not CITY is named in an action. CITY may set off any unreimbursed cost or expense so incurred against any sum or sums owed by CITY to CONTRACTOR under this Agreement . C-15- 27 . IMMIGRATION SAMPLc ONLY CONTRACTOR shall be responsible for full compliance with the immigration and naturalization laws of the United States and shall, in particular , comply with the provisions of 8 U.S .C. §1324a regarding employment verification. 28 . RECOMMENDATION: 1. Approve the selection of Ott Engineering Company, Incorporated to prepare plans, specifications and cost estimates for the subject project. 2. Authorize the Mayor and City Clerk to execute the attached consultant agreement with Ott Engineering for a fee not to exceed $36,192.00. 3. Authorize transfer of $36,192.00 from the Water Reserve Fund balance into Account No. 921639. ANALYSIS: Repair parts for large water services are not stocked or manufactured. The 8" and 10" domestic water meters are in need of repair to maintain the high revenues these services generate. Proposals were received from Ott Engineering, The Keith Companies, Boyle Engineering and Hall and Foreman, Incorporated. The staff reviewed the proposals and Ott Engineering was selected to provide the engineering services. On July 1, 1989, all remaining monies in the 1988-89 water budget were transferred into reserves. The engineering design work for this project was budgeted in the 1988-89 budget, but delays have caused the project to fall behind in schedule. In order to properly pay for these engineering services, $36,192.00 will need to be reappropriated into the 1989-90 water budget. FUNDING SOURCE: Water Reserve Fund $36,192.00. PROJECT EXPERIENCE OTT Engineering, Inc. has completed numerous domestic water and fire service designs, including both new service and reconstruction of existing water lines. These assignments have encompassed all aspects of pre-design and design, including utility and right-of-way research, coordination, and verification; topographic base mapping; development of design criteria and conceptual design; generation of construction drawings and documentation; permitting and final design acceptance; and construction management and as-built drawings. In addition, our project team consists of senior engineering personnel who have individually designed numerous domestic water and fire service facilities. Mr. C. Stephen Bucknam, Jr. , P.E. , Principal-in-Charge, directed the installation of meters for several industrial and commercial projects during his tenure with the City of Santa Ana. Mr. James E. McClanahan, P.E. , Project Manager, designed several large meter installations for pump stations in the area prior to joining OTT. Sandoval (213) 945-8214 DESCRIPTION: OTT provided project management, complete engineering design, and construction bidding assistance for a dual, 250-hp pump station for the City of Whittier. The project will provide 5400 gpm of capacity to the City' s water system replacing two 40 year old pumping units. Also included was the relocation and replacement of the motor control center, new meters and I and C equipment. PROJECT: Newport Beach Water Supply Analysis & Master Plan Review/Update CLIENT: City of Newport Beach 3300 Newport Blvd./P.O. Box 1768 Newport Beach, CA 92658-8915 CONTACT: Bob Dixon (714) 644-3011 DESCRIPTION: OTT is currently under contract reviewing reports of records relative to water supply for the Irvine downcoast area; performing hydraulic analysis to verify supply adequacy from the existing city water system; _ and preparing a letter report summarizing the findings. OTT is performing a thorough concept review with City staff to identify the capacity of the existing water supply system and to define the scope of the required Master Plan update. Compiling all basic system information and data needed to prepare an updated Water Master Plan, including: reviewing and evaluating all existing past reports and studies; collecting operational records and information, including information on historical water consumption, operational and delivery costs and maintenance problems; collecting population and development projections; 1 collecting all facilities data related to the water system, including size and location of all pipelines, pumps, wells, reservoirs, pressure regulators, and existing topography. OTT is using this information to formulate a water system model utilizing the software program FAAST, marketed by GCN Hydronet, Inc. The model was calibrated to accurately represent the actual operation capacity of the water system and a summarizing technical memorandum was prepared. PROJECT: Town of Fort Jones Water System Appraisal CLIENT: Town of Fort Jones P.O. Box 40 Fort Jones, CA 96032 CONTACT: Ken Smith, Mayor (916) 468-2694 DESCRIPTION: OTT prepared an appraisal of the existing water system located in the town of Fort Jones. The town was considering the potential purchase of the system from a private utility company that owned and operated the system. The appraisal report compiled an inven- tory of system components, determined deficiencies, and computed a fair market value of the system. As part of the project, leak tests were performed, equipment was tested, and all past system records were thoroughly reviewed and summarized. The system was analyzed three years later to provide the Town with budgetary recommendations for final purchase of the system. The report included prioritized improvements and estimated capital and annual costs for these improvements. PROJECT: South Tahoe Water System Analysis CLIENT: Culp/Wesner/Culp P.O. The water system, consisting of approximately 250 nodes, 320 pipes, 6 reservoirs, and about 12 groundwater and booster pumps, was modeled dynamically. 2 I PROJECT: City of Whittier Water Master Plan CLIENT: City of Whittier 13230 East Penn Street Whittier, CA 90602 CONTACT: Louis F. The primary water source for the system is groundwater which must supply 8,850 acre-feet per year. The system is served by eight wells, the largest of which produces an average of 2 , 300 gpm. The system also has twelve storage tanks and five booster pump stations. For this master plan, OTT evaluated the complete water system. Projected population growth and future water supply and system needs. OTT developed and investigated system alternatives and made recommendations for a prioritized capital improvement program. In addition, OTT prepared a system inventory video and managed the development of a computer network model. The computer model was made available to the City as a planning tool. PROJECT: City of Tustin Water Main Replacement Design CLIENT: City of Tustin 300 Centalia Way Tustin, CA 92680 CONTACT: Ronald E. Wolford DESCRIPTION: OTT prepared plans and specifications and cost estimates for several thousand feet of distribution water main replacement on arterial and local streets. Project included coordination efforts with other utility agencies such as Edison Company, Southern California Gas and the Telephone Company. OTT provided consultation during construction. The estimated construction value of the project is $170, 000. At the request of the client, OTT accelerated its efforts to meet client budgetary deadlines. 3 le- PROJECT: Shasta Dam Area Public Utility District Water Treatment Design CLIENT: Shasta Dam Area Public Utility District P.O. The project is located adjacent to Shasta Dam in Northern California. It is a cooperative effort between the District and the U. S . Bureau of Reclamation. The water treatment includes flocculation, clarification, and filtration designed around an advanced high tech compact premanufactured system. Other project components include storage and site improvements, as well as backwash storage and pump station facilities. PROJECT: Shasta Dam Area Public Utility District Water Distribution System Computer Analysis CLIENT: Shasta Dam Area Public Utility District P.O. Box 777 Central Valley, CA 96019 CONTACT: John Pedri (916) 275-8827 DESCRIPTION: OTT set up a computer model of the District's water distribution system on an IBM PC computer using the Kentucky Pipe Network Analysis (KYPIPE) . Using the model, an analysis of existing and future storage was conducted. Analysis included investigation of methods of operation necessary to equalize storage and provide for fire storage. Existing and future pressure/flow conditions were also modeled. Analysis included: o Determination of existing pressure zones/flow patterns at Maximum Daily Demand (MDD) and Maximum Hour Demand (MHD) . o Evaluation of pipeline sizes and network operation. o Recommendations for improvements necessary to meet existing demands. 4 Assist the. District to analyze future conditions and recommend improvements necessary to meet future demands. OTT then completed a 25-year master plan which evaluated current system requirements and provided a prioritized Capital Improvement Program. PROJECT: Keswick Community Services District Water System Design CLIENT: Keswick Community Services District P.O. 2130 Shasta, CA 96087 CONTACT: Philip Bracken (916) 246-1677 DESCRIPTION: OTT conducted predesign, design and construction management phases for a 43, 000 gallon steel reservoir, valve vaults, and supply/return piping. OTT was also retained by the Keswick Community Services District to design and prepare specifications for a water filtration system for their domestic water supply. The filtration system includes filtration, storage ponds, chlorination facilities, and distribution piping. OTT prepared final bid documents for the filtration facilities, including advertising and awarding the contract. PROJECT: Grindstone Water System Design CLIENT: Modoc Lassen Indian Housing P.O. PROJECT: 1985-86 Anchorage Water Master Plan Update CLIENT: Municipality of Anchorage 3000 Arctic Blvd. Anchorage, AK 99503 CONTACT: Lou Bonito (907) 562-2766 -- 1 DESCRIPTION: OTT prepared a water master plan for the Municipality of Anchorage. The study area included the Anchorage Bowl , Eagle River, and the northern communities. AWWU' s computer program WATSIM was used to model the existing system and proposed future additions to the 8 water distribution network. Population forecasts were developed for the year 2020 using ,-,housing data provided by the Community Planning Department. The, plan includes water distribution lines, storage reservoirs, wells, and water supply facilities. Public involvement activities included development of a slide presentation on declining South Anchorage water resources which was presented to the Alaska Water Resources Board; creation of a second slide show highlighting the plan's findings, which was presented to the Anchorage Assembly, Planning and Zoning Commission, and the general public. PROJECT: Kaktovik Water Supply Project Analysis and Design Development CLIENT: North Slope Boroigh P.O. Box 69 F, Barrow, AK 99723. CONTACT: David Wozniak (907) 562-3984 , DESCRIPTION: OTT prepared a Project Analysis Report (PAR) to determine water supply alternatives and recommended improvements for the City of Kaktovik. -- Upon completion of this report, OTT prepared the schematic, then final design of the recommended improvements. Components include a new raw water intake system, new raw water intake system, new raw water pumps, 2 , 300 linear feet of 6-inch HDPE transmission main, increased mixed media and granulated activated carbon filtration, a new 1. 5 mg treated water storage tank, and new plant plumbing to accommodate these improvements. OTT will also perform construction engineering and inspection services for this project. PROJECT: Eklutna Water Project ' CLIENT: Municipality of Anchorage 3000 Arctic Blvd. , Anchorage, AK 9.9503 CONTACT: Charley L. Bryant (907) 279-2461 DESCRIPTION: , OTT provided predesign, design, public involvement, utility coordination, environmental work, right-of-way acquisition, detailed technical review of plans and specifications, and construction management for Eklutna Water Project. The Eklutna Water Project will provide 70 mgd of treated water to Anchorage and the vicinity from Eklutna Lake, through a 48-inch to 54-inch ', reinforced concrete pipeline, approximately 30 miles long. The 9 project also includes a 70 mgd water treatment plant, over a mile of 6-foot-diameter lake diversion tunnel, a 15 MG buried storage tank, and two energy recovery stations. PROJECT: Zodiak Manor Water System Design CLIENT: Municipality of Anchorage 3000 Arctic Blvd. Anchorage, AK 99503 CONTACT: Don Baxter (907) 264-4111 DESCRIPTION: OTT planned and designed a community pressure water system. This included: evaluation of the water supply; and design of 24-inch and 8-inch ductile iron distribution lines, tie-in to existing production well, and a pressure reducing vault which incorporated plans for connection to future transmission line. OTT coordinated easements between the utility and the Municipal Parks and Recreation Department. Met with homeowners' association to explain the project and discuss ways to facilitate the project and reduce costs, 60 to 65 percent of which would be assumed by homeowners; and assisted in formation of the Water Improvement District. PROJECT: Marathon Water Supply/Hydropower CLIENT: City of Seward P.O. Box 167 Seward, AK 99664 CONTACT: Daryl Schaefermeyer (907) 224-5205 DESCRIPTION: OTT performed feasibility analysis, hydrologic studies, and site reconnaissance work leading' to the design of a 250 kw combined hydroelectric/water supply project in Seward, Alaska. Performed full design and prepared contract documents for project, which included a concrete diversion dam, 12-inch supply pipe, 250 facilities, powerhouse, and connection to existing water system. Provided construction observation services. Project supplies low- cost hydroelectric energy to the Seward General Hospital while providing the primary source of water for the city of Seward. Project also included design of plumbing alternatives to utilize excess power to provide heating for the hospital. Project was completed ahead of schedule, in less than 2-1/2 years from the first study to startup. 10 II. STATEMENT OF UNDERSTANDING We are pleased to propose our engineering services for the reconstruction of ten large water meter assemblies located as follows: 1. 5301 Bolsa Ave. ; McDonnell Douglas; 10" domestic services (includes 2 assemblies) . 2. 15871 Springdale; Marina High School; 8" domestic and fire service. 3 . 21400 Magnolia Street; Edison High School; 8" domestic and fire service. 4. 15744 Golden West Street; Golden West College; 8" domestic and fire service (includes 2 assemblies) . 5. 8482 Mariners Cove; condominiums; 8" domestic and fire service. 6. 735 14th Street; Smith School; 3" domestic and fire service. 7. 16206 La Paz Circle; Villa Yorba Apts. ; 6" domestic service. 8. 6700 Warner Avenue; Oakwood Apts. ; 6" domestic service. As we envision the project, each of the service installations will be shown on a separate 24" x 36" mylar and will include an area layout (approximately 1"=5 ' ) , a water vault top plan, sectional plan and one or two sectional elevations plus specific details as necessary, for a total of ten (10) sheets. In addition, our team will provide a title or cover sheet and a location plan 'showing all the service locations on one or two sheets. Furthermore, at least one general detail sheet will probably be needed to show details not included in the City Standards. Thus we envision not less than 12 sheets to illustrate our design work. We intend to lend our advice and expertise to the City staff in such a manner that they will be assisted in developing their design standards for large meter installations. III. SCOPE OF WORK & SCHEDULE 1. OTT Engineering will investigate, measure, survey and coordinate with City staff or consultants, field work necessary to prepare final contract documents for bidding and construction. We will coordinate and survey potholing. The physical potholing is to be done by City forces or City-hired contractors. Soil testing is not included in the services offered by this proposal. 2 . Should other utilities be involved and need to be considered and addressed we will do the coordination and notifications as necessary. 3 . We anticipate that field work will take approximately 30 calendar days and the design work will require 60 calendar days. This time frame is dependent upon the City's time required to perform potholing, establish design standards and perform the 10%, 50% and 75% reviews. 4. Permits for agencies other than Huntington Beach do not appear to be necessary. Should they be required, the securing of such permits is included in this proposal. 5. We are committed to meeting with and availing ourselves to City staff prior to and during the design of this project as necessary to insure the City' s intent is conveyed in the contract documents. Design criteria is to be established prior to 10% of design completion. 6. We will assist the City during advertisement, shop drawing review, and change order review and will meet with City staff as necessary during pre-job review and construction. 7. We will provide the City with one set of mylar reproducible "record" drawings prepared by OTT with information furnished by the City's inspector(s) . 8. We will provide . 40 sets of City-approved contract drawings (prints of 2 'x3 ' original drawings) and 40 sets of bid documents prior to bidding. 9. We will provide a detailed construction cost estimate for each of the installations. r SCHEDULE We agree to the following schedule to perform the work outlined herein: A. If selected for this contract, OTT will be happy to negotiate a revised schedule with the City of Huntington Beach. • IV. PERSONNEL Mr. C. Stephen Bucknam, Jr. , P.E. , Principal-in-Charge, is our Regional Manager and a corporate Vice President with over 21 years of professional experience. He is a former City Engineer of the City of Pacifica; Director of Design and Construction for the City of Newport Beach; and Director of Construction for the Mission Viejo Company where he managed the construction of water systems for 4, 000 dwelling units. Most recently, he served as Manager of the Utilities Agency for the City of ,Santa Ana. In this role, he directed and managed the design and installation of several large meters ranging from 4" to 10" for a variety of industrial and commercial projects as well as numerous water main replacements, pump stations, wells, storage tanks, operations facilities, and utility connections. His responsibilities have included interagency coordination, environmental and governmental funding, planning and design direction, quality control, and budgeting and scheduling of projects. Since joining OTT Engineering, Mr. Bucknam has managed such water supply assignments as improvements to a 5400-gpm pump station for the City of Whittier, including two 12" meters; replacement of water distribution mains, residential hydrants and connections for the City of Tustin; and domestic water and fire service design for several Orange County commercial developments. He is also a member of the California Chamber of Commerce Water Resources Committee, as well as the Association of California Water Agencies and the American Water Works Association. Mr. James E. McClanahan, P.E. , Project Manager, brings to our team over thirty years of water and sewer engineering experience. His responsibilities on this assignment would include overall project budgeting, scheduling, and progress monitoring, as well as client communications. Mr. McClanahan's recent experience includes the design of numerous transmission and distribution lines ranging from 8 inches to 18 inches in diameter. He has also designed a wide range of pump stations, wells, water treatment plants, storage reservoirs, and water line extensions throughout the Western United States. Recent projects of note include project management for the design of a 13-cfs meter installation for a pump station for the Irvine Ranch Water District; design of a 30-cfs meter installation for the Santa Margarita Water District; and design of numerous meters, pump stations, and related facilities, as well as hundreds of miles of water lines throughout the States of Missouri, Kansas and Oklahoma. In addition, Mr. McClanahan offers specialized training in a wide variety of fields, including computer programming, water supply engineering, contract law, and various other engineering-related areas. I Mr. Matthew Poeske, Assistant Engineer for this assignment, is a former municipal designer and analyst, and has extensive experience in construction documentation, management, and inspection. His background includes such responsibilities as water and sewer master planning, municipal facility inventorying and appraising, improvements design and cost estimating, and field inspection and verification. While with the City of Santa Ana, he assisted in developing the community's multi-million dollar water master plan, as well as designing many of the improvements encompassed in this master plan. Since joining OTT Engineering, he has provided design, cost estimates, and specifications for a variety of municipal public works projects including the design of thousands of feet of water main replacements for the City of Tustin, and the development of plans and specifications for wells, pump stations, and other water distribution facilities throughout Southern California. Mr. Craig L. Harris, Field Information Coordinator for this assignment, brings in-depth construction and field inspection experience to our team. Most recently, he served as District Inspector for Moulton Niguel Water District, responsible for the inspection of water and sewer construction work for tracts and major transmission lines. In this position, he also released homes for occupancy, and performed construction and general inspection duties. He also served as Utilities Engineering Aide to the City of Santa Ana, where he worked under Mr. Bucknam. In this position, he developed and established construction schedules for improvement projects; made design and drafting changes to water and sewer system atlas maps. He also served as the Inspector of various reservoir and tank projects, and reviewed submitted plans, calculated fees, ' and issued permits. His responsibilities required extensive coordination with planning, building, public works, and other City agencies. All of OTT Engineering's local personnel, and a majority of our nationwide staff, have direct water agency experience and have managed multidiscipline projects. Our firm' s insight into the needs of the public sector enables us to provide responsive and accurate studies, project reports, master plans, and designs.
