SECTION I. WORK STATEMENT

SECTION 2. DISPOSITION OF PLANS, ESTIMATFS AND OTHER

CONSULTANT shall comply with all of the provisions of the

from and against all claims, demands, payments, suits, actions,
prOceedl.nTs and judgments of every nature and description, includ--
ir%, attorneys fees and costs, presented, brouSbt or recoveved

SECTION 5. INSURANCE
3 CONSULTANT agrees to furnish to CITY evidence of a Dclicy

formed hereunder, a general liability insurance policy in which

z, SECTION 10. TERMINATION OF CONTRACT
All work stall be done in a good and workmanlike manner. r

wl'h or without cause, and whether or not project is full* cots-
plete. Any termination hereof, and any special instructions here-
under from CITY shall be made through the Director of Public Works,
and in writing, which may be delivered in person to CONSULTAM
or through the Unite6 States Postal Service. In the eventthis
agreement is canceller?, all drawings, designs, specifications and
appurtenant data may be used by :CITY without additional cost to
CITY. Should CITY decide to terminate this ax eement fnr any
rRa ion, CONSULTANT shall be entit"Ied to payment , on an riourly
basis in accordance with the rate schedule herein, for work com-
nleted prior to written notification.

The City of:Huntington Beach is solicitit:g proposals from qualified landscape architects
to prepare plans for the development of t4 City's proposed Ble f Top Pare. Bluff Top
Park is located on the ocean side of Pacific CoasL Highway bps:, een Ninth Street and
Goldenwest Street. A conceptual schematic of which has been prellmLiary anproved by
the State Department of Parks and Beaches is attached for your :.-se. The park provides a
landscape setting adjacent to one of the most scenic beach areas in Orange County, a
regional bicycle lane and energy producing facilities.
Preliminary cast estimates based on current prices irdicate it uAll require approximately
$500,000 to construct the proposed park. Currently, there is approximately$200,000
available from various spumes to begin Mork an the, park with future funding and sources
uncertain. Tie scope of work for which proposals are being solicited 'includes the
following items:
1„ Preparation of a mgster plan for the proposed park including ldewification of
landscape materials, furniture, walkways, lighting, etc.

Services Commission and City Council to obtain approval.
3. Preparation of a design report recommending phases for implementation based

n STATEMFNT OF ISSUE:
A conceptual plan for Phase One levelopment of the Bolsa Chica State Beach
bluff landscaping project (be teen 9th Street and Goldenwest Street)
has been completed by Presburger and Associates as authorized by the
City Council at the February 16, 1982 regular meeting. in order for
the consultant to proceed with the working drawings, the Phase One
de-elopment plan needs to be approved by Council.
RECOMMENDATION
Approve the conceptual plan and authorize the landscape architect,
Roger Presburger, to complete: the final, drawings and specifications
for the Blufftop Landscape Plan. No additional funds are necessary for
completion of this task.
ANALY'S I S:
On February 16, 1982, the City Council selected the firm or Presburger
and Associates, Incorporated to prepare conceptual plans and final
drawings for the development of the Blufftop landscaping in Bolsa
Chica State Beach adjacent to Pacific Coast Highway between 9th and
Goldenwest Streets.
The State of California Park and Recreation Department, Chevron Oil,
Aminoil, the County of Orange and. City staff established criteria
for the development of improvement plans.
The conceptual plan for Phase One of improving the bluffs along
Pacific Coast Highway is limited to landscaping, protective guard
rails along the bluff line, park benches and walkways. Later phases
include provi ions for additional beach, accessways and on-site park-
ing. Preliminary cost estimates for Phase One are as follows:
Estimated cost of Phase One: 311,776.00
Funds available to date: 112,675.57
Subtotal: 199,100.43

A motion was made by Mandic, seconded by MacAllister, to authorize staff to ;
negotiate with the Ocean View School District for a trade of property and the
necessary appraisal of said properties. The motion carried by the followingp .

The City Clerk presented a communlca;zion from the Director of Developmea.` Cer-
vices regarding 'he development of Blufftop Park on the Balsa Chica State Beach
between Goldenweit and Ninth Streets.
A motion was made by Mandic, secondec. by MacAllister, to accept the proposal
from Presburger and Associates to prepare phased design plans for 8lufftop Park
development, for an amount not to exceed $18,503; to authorize the use of $50,000
of Park Acquisition and Development funds; $18,500 to retain the architect and
$31 ,500 to increase the funds available 'For park landscaping and improvement,
Following discussion, the motion was aaiended to limit the expenditure to $18,500
at this time.
Following discussion, Councilman MacAllister„ withdrew his second, Councilman
Mandic withdrew his motion;
A moti,)n was made by Mandic, seconded by MacAllister, to accept the proposal
from Presburger and Associates to prepare phased design plans for Blufftop Park
development, for an amount not to exceed $18,500; to authorize the use of $50,000
of Park Acquisition and Development funds; 518,500 to retain the architect and
$31,500 to increase the funds available for park landscaping and improvement.
The motion carried by the following roll call vote:

ANATYSIS:
The most important item in Phase Two of the Bluff Top Landscape Project is stabil-
izing the existing bluff fare (i.e., slopes of eleven to fifteen feet in height) between.
Eleventh and Guldenwest Streets. Portions of the slope areas are presently protected by
retaining walls of wood or concrete; however, the sreater portion of the bluff face is
bare and: without any protection. Subsequently, the bluff face continues to erode away
during rains. This continual, erosion of soil, along the bluff face, will ultimately
jeopardize the recently a.nstall-d safety railing and landscape improvements.
The bluff foss can be stabilized by cribbing it with interlocking reirtforcea conCz ete
components (see Lvhibit A) or shooting the sloped surfaces with a special mixture of
concrete (sue Exhibit B) The preliminary cost of either method totals $250,000.00.
On August 3, 1983, the City received an additional. $567,000 in Cxm.,nity Developentr
Block Grant ems. Of this amount, $250,000 was set aside for the stabilization of the
bluffs.

On February 15, 1982, the City Council selected the firm of Presburger and Associates,

RECCs ITNDATION:
Authorize the Mayor and City Clerx to execute the atta '.ed architectual service agree-
ment with the firm of Presburger and Associates, Incorporated.
ANALYSIS:
Pursuant to Chapter 3.03 "Professional Services" of the Municipal Code, requests for
proposals regarding the Bluff Top Park were distributed to architectural firms listed
in the City's Professional Roster.
Based on -the contents of the proposals received, the farm of Presburger and Associates,
r Incorporated was recommended to the City Council.
On February 15, 1982, the City Council approved staff's recommendation and authorized the
preparation of an. appropriate contractual documnt. A contract, prepared by the City

STATEMENT OF ISSUE:
The landscaping, of the Blufftop Park on the Bolsa Chica State Beach � .
between Goldenwest a.id Ninth Streets will be a highly visible part of
the overall project to improve the City's bluff area. Landscaping
of the Park is planned to include the planting of trees, shrubs, and
ground cover, as well as soil preparation and the installation of an
irrigation system. To ensure orderly development of the Park, �t is
desirable that a landscape architect be retained to formulate phased
design plans for park landscaping and facilities. RAquests for pro-
posals have been issued. Park Acquisition and Development Funds from
the City are needed to retain the architect and can be used to augment
the nearly $80,00v raised in the recently completed Blufftop Park fund
raising drive.
RECOMMENDATION:
Accept the proposal from Presburger and Associates to prepare phased
design plans for Blufftop Park development, for -an amount not to ex-
coed $18,500. authorize use of $50,000 of Park Acquisition and De-
velopment funds; $18,500 to retain the architect and $31,500 to in-
crease the funds available for Park landscaping and improvG�tent.
ANALYSIS
Several improvements have occurred or are already funded for the new
Blufftop Park. Lust year, the .bike trail along the .bluffs was com-
pleted as one of the first steps -in improving and cleaning up the area.
This year, the unsightly oil pipelines that run on the face and along
the top of the bluffs will be removed or buried. Five accessways to
the beach between. Coldenwest and plinth Streets have been funded by a
Coastal, Conservancy grant, and construction will begin in March.
As part of the overall project to clean up and improve the bluffs, land-
scaping of the Blufftop Park will play an important role. A total of
app.roXi:mately $80,000 was raised as part of Aminoills challenge grant...
This overwhelming response to the challenge grant is indicative of the
strong community support for this project. A landscape architect
should be retained to develop an overall, phased concept plan for the
: ufftop Park

be built with funds available now and would also set future project pri-
orities to be implemented as further funds become available It is "
desirable that these plans be completed as soon as possible Thus,
the hiring of an architect to draft them is recommended. Park Acquisi-
tion and Development funds can be used to retain this arc"Zitect.
These funds can also be used to make further landscaping and improve-
ment of the Park possible. The funds raised to date for Park landscap-
ing will allow soil preparation and ache construction of an irrigation '
system necessary for the planting of trees any shrubs. To f7. i1y develop
the Park, however, additional funds are necessary for gradi,� , the
planting of ground cover, and the purchase of tables, benches, and other
facilities such as drinking fountains. (See attached report. ) It is
appropriate that Park Acquisition and Development funds are used for
this purpose, since the Blufftop Park will be a significant recreational
resource for City residents. ,
Even with these monies, funding for ]rater improvements is not now avail-
able. However, staff is currently investigating ct-her funding sources
to complete the Park project.
ALTERNATIVE ACTIONS:
1. Do not accept bid from architect. Concept plans for the Park can
be developed by City staff. This will require staff time and may
result in delay of other City projects or of Park landscaping.
2. -110 not authorize Park Acquisition and Development fuiLds to be used
for the hi.ring of the architect. The scope of the bark landscaping
will be reduced, and implementation of P,-rk landscaping plans may
be delayed.
3. Pay for the architect out of Turk Acqu. 7,ition and Development funds

For years, the Huntington Beach coastline northwest of Ninth Street
has been characterized b barren, eroding bluffs scarred with old
y g
oil pipelines, broken glass, and litter_. In many ways, the image of
the entire City is associated with this "front door". The Blufftop
Park between Goldenwest and Ninth Streets will be the most visible of
gzveral projects initiated by the City to improve the bluff area.
Although the bluffs are actually part of the Bolsa Chica. State Beach, ' *`.
the State Department of Parks and Recreation has indicated that it
will make no improvements '_o the area until the oil uses there phase
out. Because it is now known that the oil uses will continue for ten
to twenty more years, this stand: was not acceptable to the City.
Thus, the City, with the aaproval of the Department of Parks and Rec-
reation, has engaged in an improvement project for the area. Lasts°,
year, the bike trail along the blufftops was completed, and already
enjoys a great deal of. use. Removal of the oil pipelines along the
bluffs, required of Aminoil and Chevron by City ordinance, has begun
and will be completed this year. Funding for the construction of
five accessways to the be 7h has been obtained through a Coastal Con-
servancy grant. The overwhelming response to the City's recent
z Blufftop Park fund raising drive is strong indication that improvement
of the bluffs is a priority for residents of the City.
The City Attorney's Office has indicated that use of Park Acquisition
and Development, funds For the Blufftop Park is acceptable. It is
recagnended. that $50,000 from this fund be used for development of the
Park. Of -the $50,000, $ 18, 500 will be necessary to retain an architect
to prepare phased design plans for the Park. These plans well ensure that
all funds ultimately available for Park development can be fully utilized
in a systematic manner. Because it is desirable that the plans be
completed as soon as possible, it is recommended that the architect be
retained with Park Acquisition and Development funds. The remaining
$ 31,500 can be used to make further landscaping and improvement of the
Park possible. The $80,O00 raised to date for Park landscaping will
allow soil preparation and the construction of an irrigation system
necessary for the planting of trees and shrubs. Full development of
the Park, however, will include grading, the planting of ground cover, and
the purchase of tables, benches, and other facilities such as drinking
fountains. The attached budget shows that full development of the Park
will total $265,000. The use. of $50,000 from Park Acquisition and Devel-
opment funds, in addition to the $80,000 already raised, will greatly
aid in realizing completion of the Blufftop Park. Even with these monies,
more funding for later improvements will be needed. Staff is currently
investigating other funding sources to complete the Park project.
A general concept plan for the Park, including the proposed la^�t-capinq
has beers approved by the State Department of Parks and Recreation. The
State, has indicated its' willingness to maintain the Park concept
presented here. Another option would be for the City to maintain the
.Park. In this instance, maintenance would likely be of a higher caliber,
but would probably require City funding to supplem^nt that from the State.
At this time, staff recommends the installation of low-maintenance
landscaping and improvements and State maintenance of them.

Dear Mr. Tindall:
We have read with great j )terest your request for landscape architec-
tural services for ,the Bluff Top Park, and we respectfully submit
this proposal in hopes that our firm will have the opportunity of
working on this unique design project.
THE CHALLENGE
The Bluff Trip Park site currently provides two distinct recreation
functions:
I. A causeway of Licycle, roller skating, ,7oupina and walking
traffic parallel to the beach, and
2. An entrance, or "gateway" to the beach for traffic perpen-
dicular to the beach.
The resulting inter( `noling of surfers and cyclists, bathers and
joggers presents not so much a conflict as a vitality - a dynamic
scene of people moving through this space for whatever l r isure-.time
activity they have in mind. The primary use of this Park, there-
fore, is transitory: it provides an area for peoples to n;ove through,
either alone its length or across its width, Similar "cross-use"
situations are observed .at rather beach cities (Santa Monica, Venice-,
Manhattan beach) but no other example has the added significance of
acting as a "gateway" to the beach and the City itself, Feepina in

We should bear in mind that the site, in its current state, functions ftM.i
adequately as a transitory park. The only elements missing are rest
stops and associated furnishings. All effort toward improvement
should be focused on one common goal: making this park site look '
like a recreational, rather than an industrial, park. "

propose to undertake this project as follows:

sent to State Parks and Recreation Department and Coastal
Commission for their comments.

plan for the remaining lands in Calabasas Park, Calabasas, Calif- fist
ornia. This project will place over 1, 000 homes on 2, 000 + acres
of ecologically sensitive terrain. This new private community ':
will incorporate hiking and uridle trails, park areas and sensitive
ecological preserves along with the normal amenities we have come
to expect in a well planned residential community.
Our design staff has been purposely kept small to effectively main-
tain the personal relationship and interaction required by collabo-
rative problem solving. At the present time, the Presburger & 1
Associates staff is made up of one principal, three licensed land•-
scape architects, two landscape designers and three staff people. '

Impact Report is hereby submitted relative to the prcposed retention of a landscape
architect for $20,000, with an additional $30,000 pegged for other unspecified
contractual landscaping expenses at Blufftop Park. It has been suggested by the
requesting department that an appropriation of $50,000 would be adequate for financing
the total landscaping effort - although funding for future improvements necessary
to complete the park project are not now available.
Adequate monlec are available in the Park Acquisition and Development Fund that may
be used for e is purpose. An affirmative response by the City Council will reduce

hiring of a landscape architect to prepare concept plans for the Blufftop Park,
Staff has received bids from three firms to perform this work and will finalize
the choice among them by ec, ly next week. At that time, the RCA can be com-
pleted indicating the recommended firm and their proposal. In order to
expedite the Blufftop Park project, we would request that this item be placed
on the agenda for the 16th, and that the final version of the RCA and the pro-
posal of the selected firm he forwarded to you early next week to be distributed
