Parking Plan Project Statement of Issue,Funding Source,Recommended Action,Alternative Action(s),Analysis,Environmental Status,Attachment(s) Statement of Issue: As part of the Fifth Street Parking Plan construction, which has now been completed, three driveways were closed to provide more parking and to improve traffic flow. Owners of two of the properties and one business owner have signed agreements regarding the driveway closures. In order to formalize the agreements approval by the City Council/Redevelopment Agency is needed_ Funding Source: NIA Recommended Action: City Council/Redevelopment Agency Action: Motion to: 1. Approve Driveway Closure Consent Agreement with Richard S. Thorpe, individually and DBA Pristine Motorsports-, and 2- Approve Driveway Closure Consent Agreement with James M. Briggs and Nora T- Briggs Individually and as Trustees of the James and Nora Briggs Family Trusty and 3 Approve Driveway Closure Agreement with Mike All and Aida Ali and as Trustees of the Mike Ali and Aida All Revocable Trust-, and 4. Authorize the Mayor/Chairperson and the City/Agency Clerk to execute all three agreements. Alternative Action(s): Do not execute the Driveway Closure Consent Agreements- Analysis: The Fifth Street Parking Plan called for closure of three driveways (225,301, and 317 Fifth St_) in order to provide more parking and to provide for safer traffic flow The project has been completed and the driveways have been closed. The business and property owners at 225 Fifth Street have signed the Driveway Closure Agreement and the property owners at 301 Fifth Street have also signed. The property owner at 317 Fifth Street has not signed the agreement. The City Attorney provided an opinion, which stated that a closure of the driveway at 317 Fifth Street could legally be done because the property has access to the public street system via a rear alley. This information was communicated to the owner at 317 Fifth Street. The owner did not agree with the City's position and declined to execute the agreement. THORPE, INDIVIDUALLY AND DBA PRISTINE MOTOR SPORTS (FIFTH STREET PARKING PLAN PROJECT) THIS AGREEMENT ("Agreement"), dated this 18th day of___December , 2000, (the "effective date"), by and hetween the CITY OF HUNTINGTON BEACH, a municipal corporation ("CITY"), the REDEVELOPMENT AGENCY OF THE CITY OF HUNTINGTON BEACH, a public body, corporate and politic of the State of California ("AGENCY'*). and RICHARD S. THORPE, individually and doing business as Pristine Motor Sports ("LESSEE."). more particularly as follows: WHEREAS, CITY and AGENCY arc presently in the process of planning and implementing their Fifth Street Parking Plan Project ("Project"), which project pertains to Fifth Street, between Orange Avenue and Walnut Avenue, in downtown Huntington Beach; The purposes of the Project arc to provide for more on-street pubic parking places and spaces; for street resurfacing; and for new curb, gutter, sidewalk and landscaping. The Project will also improve pedestrian and vehicle access and circulation within the Project's two-block area. The Project will be totally funded by AGENCY at no cost to property owners; and LESSEE is the lessee of, and the operator of a business situated on, the real property (APN 024-146-06) located at 225 Fifth Street (the "Property"), which Property lies within the boundaries of the Project; which Property is more specifically shown on Exhibit A attached hereto; and which Property is more specifically described in that certain Individual Quitclaim Deed, recorded on July 10, 1996 (Document No. 19960351479); and LESSEL•'s Property contains a driveway which provides a means of ingress and egress to Fifth Street from the Property. LESSEE authorizes, allows and permits CITY and AGENCY, and their employees, agents and representatives, at such time or times to be chosen by CITY and AGENCY but no later than ____ -_ 1t D) days after the effective date of this Agreement, to remove and eliminate, at their own cost and expense, the Driveway. LESSEE, as used in this Agreement, includes Richard S. Thorpe, acting both jointly and severally, as well as his heirs, assigns, transferees and successors-in-interest. 2. In the area formerly occupied by the Driveway, CITY and AGENCY, through their employees, agents and representatives, shall, at their own cost and expense, construct a sidewalk and curb, and match the newly constructed curb and sidewalk to the existing curb and sidewalk on each side of the area formerly occupied by the Driveway. 3. LESSEE additionally authorizes CITY and AGENCY, and their employees, agents and representatives. in connection with the activities described in Paragraphs 1 and 2 hereinabove, to temporarily enter and occupy a five (5) foot area on the Property immediately abutting and parallel to the sidewalk and the Driveway(the "Occupation Area"), in order to store construction equipment andlor piles of dirt, concrete or construction debris. This right-of- entry and occupation shall be temporary in nature and shall automatically expire when CITY and AGENCY have completed their removal of the Driveway and construction of a sidewalk and curb in its place. No later than completion of the new sidewalk and curb, CITY and AGENCY, at their own cost and expense, shall remove any dirt, concrete and construction debris from the Occupation Area and shall restore the Occupation Area to its original condition. 4. LESSEE in connection with any or all of CITY's and AGENCY's activities as described in Paragraphs 1-3 of this Agreement, freely and voluntarily waives his right to seek (*,,,":d,.. ..,Tk pc'R':,x) 2 any form or type of compensation from either CITY or AGENCY, regardless of the legal theory or theories advanced. 5. LESSEE acknowledges that, after CITY and AGENCY have completed their activities under Paragraphs 1-3 of this Agreement, LESSEE's property has the following access to CITY's public street system: use of a publicly-owned alley situated at the rear of the Property which accesses either Olive Avenue on Walnut Avenue. 6. CITY and AGENCY shall indemnify, defend and hold LESSEE harmless from any third party liability, damage, claims, costs, actions, or suits which arise from or are related, either directly or indirectly, to any of CITY's and AGENCY's activities as set forth in Paragraphs 1-3 of this Agreement. 7. Should any suit or legal proceeding be brought by any party to enforce and/or construe this Agreement, each party to this Agreement shall bear their own attorneys' fees and court costs.
