This Supplemental. Agreement No. 3 is made and entered into

WHEREAS, CITY and CONTRACTOR have heretofore entered into
an agreement for the provision of certain self-insurance services

THIS AGREEMENT, entered into this day of
197$, by and between. City of Huntington Beach,

Kautz & Co. , a California corporation, hereinafter called
"CONTRACTOR," for certain services as outlined herein in

WHEREAS, CITY has undertaken to self-insure; and,
WHEREAS, CONTRACTOR is engaged in the supet ision and
administration of programs of self-insurance, �

CONT'RACTCR agrees to provide complete ad,yu tment
services on each accident or incident which is or
may, be the subject of a liability claim. Such er
vices shall include:
A. The maintenance or a claim Nile on each potential
or actual claim reported to CONTRACTOR.
B. Whenever its i.nvesti,gation results in a determina-
tion that CITY has sustained a liability to a
third party, CONTRACTOR :shall process any such
cla:tn or potential claim for settlement in accord-

ANALYSIS
Bias for Liability Administration Set-,,ices were received in May 19822 for the Fiscal
Year 1982/83. They were not awarded due to ongoing review of methods & procedures
responsibilities for various 'self-insured programs within the city. This study is
now being finalized by consultant Rod Sackett.. In the interim Kautz has continued
to perform the Liability Claim Administrative duties and they should be paid for
their services.

satisfactory for the past 3 1/2 years.

THE LIABILITY LASTS OF THE STATE OF CALIFORNIA

WHEREAS, the city desires to uneer-take to self-insure its x
liability under the lags of the State of California, and
City desires to employ a service agent to perform certain
services In connection with the duties and responsibilities of
the city as a pelf-insurer,
NOW., THEREFORE, BE IT RESOLVER by the City Council of the
City of Huntington Beach that the Mayor and City Clerk are hereby

HUTINGTON BEACH ESTABLISHING A CLAIMS REVIEW
COMMIES AND ADMINISTRATIVE PROCEDURES FOR THE '
PURPOSE OF AUTHORIZING ADJUSTMENT AND SETTL'EMNT
OF CLAIMS
WHEREAS, the City of Hpnti ngton. Beach has become partially

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Huntington Beach as follows :
SECTION 1. There is hereby eetabl.izhed a, claims review

three members, to wit,
1) City Administrawor, who shall be chairman

City Attorney; or their appointed representatives
SECTION 2 4ben It is determined that the City Is partially
or fully liable by reason of an incident or accident resulting

shall have the authority to enter into a settlement agreement to
aettla the calm up to the amount of Fifty Thousand Dollars

SECTION 3. The claims review committee may, at its dis-
cretion, delegate to the claims adjuster the authority to enter
g. into settlement agreements on claims that do not exceed an
amount to be determined by the committee, but in no instance

This authority may be suspe►.ded at any time by the committee.
SECTION 4. The City shall deposit the sum of "Alen Thousand
Dollars ($10,OOC) as a minimum balance in a bank of City's
choice for a claim, payment account which the claimer adjuster
will draw against for the independent zettlement of claims not to �
exceed give Thousand Dollars ($5,000) per occurrence or as other-
wise authorized by the claims review committee.
SECTION 5. On proposed settlement or cla,imr, In which the
