ments for all shop drawings , details, ,ambles , and do all other
things necessary .and incidental to the prosecution of his work in
conformance with thr- ;aid I}rngro!'c gch1-dul#3 . He shall coordinate
the work covered by this with that of all. -,,her c0n-
tractors , 4ubc.Ontract.orti anti of tht, CITY , in a manner that will
facilitate the efficient ct�mploti (`)n of t.ht! project and to accord-
a-ice with sectir..n 3 herein . CITY shall havv complett, control. of
the premises nn which the work is tr) he performed and shall have

5. CHANGES
CONTRACTOR hereby oyrees t.n make any and all changes ,
furnish materials and perform work ris directed in writing by the
DrW when such changes .are within the scope of work of this acree-
meat . Otherwise , CONTRACTOR shall adhere strictly to the Plants and

7. BONDS
CONTRACTOR shall , prior to ent-oring upon) the performance
of this contract, furnish approved by the City Attorne.- : one
in the amount of one hundred percent ( 100% ) of the contract price
to guarantee the CONTRACTOR ' S faithful performance of the work and

to warrant such port ormance for a perif)d of. one ( 1 ) year after
CITY ' S acceptance thereof ; and cent, in tho amount of fifty percent
( 50% ) of the coritracL price to guarantee payment. of all claim-, for
labor and materials rurnished .
9 . WARRANTIES
The CONTRACTOR uncond i L iona 1 1 y guarantees a 11 work done

workmanship, instaIIation , fabrication , maLerial or sLvuct:ural
fac: i lities constructed . CONTRACTOR , within to-n ( I ) days after

9 . INDEPENDENT CONTRACTOR

10 . LIQUIDATED DAMAGES

work called for hereunder in all parts and requirements is not

should CONTRACTOR be delayed waiting for materials , if said mater-
ials are required by this contract to be furnished by CITY, or by
damage caused by fire or other casualty for which CONTRACTOR is not
responsible , or by the combined ,action of the workmen , in nowise
caused by or resu 1 t i ng from default or collusion on the part_ of
CONTRACTOR, in the event of 3 1 -.ckout by CITY , then the time herein
fixed for the completion of the work: shall he extended the number
or days the CONTRACTOR has thus been delayed , but ro allowance or
extension shall he made unless ,a claim therefor is presented in
writing to CITY within fifteen ( 15 ) days of the commencement of
such delay.

11 . DIFFERING SITE CONDITIONS
( 1 ) Notice The contractor shall promptt f , and

STATEMENT OF ISSUE:
Pursuant to City Council approval. of September 6 , 1983 , bids were received
on November 8 , 1983 for the construction of street and landscape improve-
ments on Garfield Avenue from ,Main Street to 396 feet easterly.
RECOMMENDATION:
Approve the Tow bid submitted by R. J . Noble Co . and authorize the Mayor
and City Clerk to execute an appropriate contract in the amount of
$30 ,754 . 70 .
ANALYSIS:
On September 6 , 1983 , the City Council approved the plans and specifications
for the construction of street and landscape improvements on the south
side of Garfield Avenue from .Main Street to 395 feet easterly and authorized
staff to advertise for construction bids . Bids , as summarized below, were
received an3 opened on November 8 , 1983.

Plans and specifications , together with proposal form , may be obtained at
the office of the Director of Public Works , City Hall , Huntington Beach ,

No bid will be received unless it is made on a blank form furnished by
the Director of Public Works . The special attention of prospective
bidders is called to the proposal requirements , setforth in the specifi -
cations , for full directions as to the bidding .
The foregoing quantities are approximate only , being given as a basis
for the comparison of bids , and the city of Huntington Beach does not-
express or by implications agree that the actual amount of work will
correspond therewith but reserves the right to incTease or decrease the
amount of any class or portion of the work , as may be deemed necessary
or expedient by the Director of Public Works ,

been issued by the City of Huntington Beach .
Each bid shall be made out on a form to be obtained at the office of
the Director of Public Works , Development Wing , 2000 Main Street ,
Huntington Beach , California ; and shall be sealed and filed with the
City Clerk at the Civic Center , Second Floor Administration Building ,
2000 Main Street , Huntington Beach , California , on or before 10 : 00 A . M.
of and shall be opened by a committee
composed- of-the City Clerk ,, Hy City Attorney and Director of Public
Works or their authorized representative and the results of said bidding
