HomeMy WebLinkAboutRecreation Land Planners, Inc. - 1974-06-18 (3) Jt � 1 s CONTRACT FOR ' f ARCHITECTURAL SERVICES r THIS AGREEMENT, by and between the CITY OF HUNTINGTON } BEACH, a municipal corporation of the State of California, hereinafter called CITY, and RECREATION LAND PLANNERS, INC . , �y hereinafter called ARCHITECT, W I T N E S S E T H: WHEREAS , CITY proposes to construct the following Neigh- 5 i= borhood and Community Parks : Pleasant View, Robinwood, Terry, Newland, Park Huntington, and Marina and Golden West College; ARCHITECT is a landscape architectural firm, the principal ' members of which are duly registered under the laws of the State of California, and the Director of Public Works is the representative of the CITY, NOW THEREFORE, IT IS MUTUALLY AGREED between the 'parties . hereto that : 1 . ARCHITECT shall prepare and furnish to CITY, complete and ready for use , all necessary studies , sketches , schematics , estima4.es , working drawings and specifications ; shall check shop drawings , cats alog cuts , material lists as submitted by the construction contractor; shall furnish consultation and advice as requested by CITY during construction, including supervision and evaluation of specified tests as further defined herein (but not including the day-to-day supervision of the . i Y � 6/7/7 1 . JG : k 1. tk t construction work) , and shall furnish all other architectural services , including without limitation those specified herein- after 'and required for the six ( 6) parks listed hereinabove, having an estimated construction cost of $636 , 000 . 00 , and more specifically set forth in Exhibit "A" entitled "Scope of Work to be Accomplished, " attached hereto and made a part hereof. ARCHITECT agrees to design facilities which can be constructed within the amount hereinabove set forth . The project design, including utilities , plumbing, electrical, paving and planting, shall conform to all applicable CITY code -requirements . ARCHITECT shall also conform to the technical instructions as issued by the Director of Public Works . If, after receipt of competitive bids , it is found that a construction contract cannot be awarded within ten percent ( lo%) of the aforementioned estimated construction cost , ARCHITECT will, as a part of this agreement , and at no additional cost to CITY, perform such redesign, re-estimating, and other services as may, in the opinion of the Director of Public Works , be - required to produce a usable facility within the estimated construction cost . In connection with the foregoing, ARCHITECT shall be obligated to perform such additional services at no increase in contract price only when CITY has received com- petitive bids within two (2 ) months from the date of final approval of plans and specifications . 2 . All drawings , designs , specifications , and other 2 . 3:ncidental 'architectural and engineering work or materials furnished hereunder shall be and remain the property of CITY , except that said drawings , etc . cannot be used for other parks . 3 . ARCHITECT shall, if necessary, visit the site and shall hold such conferences with representatives of CITY and take such other action as may be necessary to obtain the data upon which to develop the design showing the contemplate: project in accordance with the .following: 4 . As an architectural design requirement , CITY will provide as-built topographic maps , engineering street improve- ment plans , and complete soil analysis of the existing sites . (a) Schematic Design Phase : The schematic design ..phase shall include conference with CITY departments concerned and -preparation of schematic sketches based upon the CITY ' s program for the function and scope of the project . It will include a scope of estimate of cost . This phase shall be sub- mitted to the Director of Public Works for signature approval within forty-five ( 45) calendar days from the date of this agreement . (b ) Design Development Phase : Upon approval of the schematic design phase, the ARCHITECT shall complete the design development phase to include the development of design, site plans , elevations and other drawings with outline speci- fications covering the project , and Including materials and equipment as are. necessary to integrate the design, explain 3 . the p'rojebt fully, and enable a preliminary estimate of con- structL621 cost . This phase shall be submitted to the Director of PubLi c t-lorks for signature approval within sixty (60 ) days 'aftey approval of the schematic design. ARCHITECT shall change the design development plans for the project to the extent necessary to meet the requirements of the Director of Public Works. Af't er approval by signature of the Director, the ARCHIVECT shall furnish necessary prints of the approved design development plans to the Director as specified in Exhibit "A . " ri (c) The Construction Documents Phase : After approval of the design development phase plans and estimates , ARCHITECT srai 1 proceed with the preparation of complete working drawings and specifications as required by the Director of Public Vc)rks for the construction of said project . An original and five ( 5) copies of the working drawings , specifications , and estimates shall be delivered to the Director of Public Works -Within ninety ( 90) days after approval of the design development phase . After working drawings and specifications have beers approved by CITY, as indicated by the signature thereon of the Director, ARCHITECT shall furnish sets of prints of the approved working drawings and sets of the approved specifications as may be required by the Director as per .Exhibit " A . " 4 . . 1 5 . Upon 'approval of final plans, ARCHITECT shall deliver to CITY one (1 ) set of tracings , in such medium and on such materials as may be required by the Director of Public works , suitable for blueprinting showing complete approved construction requirements . Such tracings as are delivered shall be signed i by , the Director as an indication of approval thereof and shall become and remain the property of CITY . 6 . ARCHITECT shall perform and provide all necessary i architectural services of every kind in connection with the studies , designs and the preparation of drawings and specifications , but said services shall not , unless otherwise stipulated, in- clude surveys , special engineering studies caused by abnormal or special conditions , soil tests , or supervision of construction i work executed from the drawings and specifications , provided, however, that ARCHITECT shall furnish upon request and without t additional compensation, such amplifications and explanations and attend such conferences as may, in the opinion of the Director of Public works , be necessary to clarify the intent of the drawings and specifications and shall afford the benefit, of his advice on questions that may arise in connection with the construction of the project 7 . ARCHITECT shall, w-ithout additional fee , correct or revise the drawings and specificati.riis if the Director of Public Works finds that such revision is necessary to correct errors or deficiencies for which ARCHITECT is responsible , a f 5 • 8 . 'All services to be rendered hereunder shall be subject to the direction and approval of the Director of Public Works . Approval by said Director of draw�:ngs , designs , specifications and other incidental architectural work or materials furnished hereunder shall not in any way relieve ARCHITECT of responsibility for the technical adequacy of the work. 9 . ARCHITECT ' s fees for the aforementioned architectural services shall be computed at 7 . 4 percent of the actual construction cost . The estimatAd construction cost for the six (b ) parks listed hereinabove is set forth in Paragraph 1 of this contract . 10 . The cost for the work, including the fees and reim- bursement items , will be billed by ARCHITECT to CITY monthly in proportion to the work accomplished and to the extent that the reimbursable items are incurred, said bills to be submitted to the Director of Public Works for his approval before payment may be made by CITY Finance Director. Such bills will be pay- .:able upon receipt and approval , provided that payment of the basic fee shall not exceed the following percentages of the total at the following stages of work: Design : ( a) Schematic Design Phase 25% (b ) Design Development Phase 35% (c ) Construction Documents Phase 85% 6 . (d) Upcn :award `of construction contract. or not more '. .. an ninety (90) days after (c ) , whichever o e curs first 9 0% (e ) Upon completion of construction 100% 11 . ARCHITECT will keep accurate accounting records of i time and expenditures , which records will be available for inspection by CITY at reasonable times . 12 . CITY may , at any time, by written order of the Director of Public Works, make any changes in the services to be performed hereunder. If such changes cause an increase in the cost of doing the work under this agreement or in the time required for its performance, an adjustment shall be made based on the direct cost to ARCHITECT plus reasonable overhead costs and the contract shall be modified in writing accordingly . Any claim for adjustment under this clause must be made in writing to the Director of Public Works within thirty (30 ) days from the `date the change is ordered ,, provided, however, said Director, if he determines the facts justify such action, may receive and consider, and adjust any such claim asserted at any time prior to the date of final settlement of the contract . 13 . Wherever herein the action of the Director of Public r Works is required, a representative of said Director, designated in writing, may act on his behalf. 14 . CITY may cancel this agreement upon written notice 7 . to ,the ARCHITECT and, shall thereafter be liable for fees and costs accrued to "date of the receipt of notice by ARCHITECT but 'not to exceed the maximum set forth in Paragraph 9 herein- - ... above , and for no other fees or costs . EXHIBIT A SCOPE OF WORK TO BE ACCOMPLISHED Pleasant View, Robinwood, Terry, Newland, Park Huntington. and Marina PARKS LANDSCAPE ARCHITECTURAL SERVICE I . General . Furnish complete schematic , preliminary , final design and contract documents , including plans and specifications for subject projects . The work shall include, but not be limited to, the following: A. Land use study that will consider design criteria, p ark theme and character. B . Spatial relationships and grouped activity areas . r C . Access , circulation, parking and pedestrian systems . D . Operational planning to accommodate ease of maintenance . E. Provision of all consulting services , including utilities , irrigation and topography incorporation . II . Cost Limitations . Design the parks and ancillary structures to a cost limitation of: A. PLEASANT VIEW $ 21, 000 . B . ROBINWOOD $ 31, 500 . C . TERRY $ 105000 . D . NEWLAND $ 63000 . E . PARK HUNTINGTON $ 52, 500 . F. MARINA AND GOLDEN WEST COLLEGE$ 36320000 III . Project Description and Scope . A. The six projects will generally follow the "neighborhood and community park" concept as expressed in the City ' s Master Plan of Parks , Open Space , Schools , and Recreation. Facilities and design should include , but not be limited to, contouring, curbing, automatic irrigation system, turf, fifteen-gallon trees , shrubs , walks , play areas , lighting, drinking fountains , group picnic shelter, softball diamonds , and areas for picnic tables , braziers , and play equipment . B . The schematic and design development phases will determine the requirements of the project through preliminary studies , sketches , drawings and estimates . C . The construction document phase will include, but not be limited to , the following plans and documents : 1 . ' Plans and Specifications (a) Grading and drainage plan (b; Layout and site plan ( r,) Planting plan ( d) Irrigation plan (e ) Construction details ( f) Specifications ( g) Cost estimate and time schedule 2 . 2 . General Documents ( a) Bid documents (b ) Invitation to bid (c ) Instructions to bidders (d) Bid proposal form (e ) General conditions ( f) Special conditions IV. Standards . Work shall be in accordance with requirements of the City Department of Public Works and applicable build- ing codes . V. Approvals . Design will be coordinated with the Department of Public Works , Recreation and Parks Department, and City Administrator ' s office securing approvals at the time of submission of the design development stage . VI . Progress Report . Submit a progress report every month during the term of the contract indicating ;;he percentage of completion and brief description of the work accomplished to the Director of Public Works for signature approval . VII . Reproduction . Printing and reproduction requirements are as follows : h . Schematics : Two ( 2 ) sets of plans . B . Design Development : Two ( 2 ) sets of plans , outline specifications and cost estimates . C . Final Submittal : Seven ( 7 ) sets of plans and specifications . • 3 , i r t. r Any other special reproduction , photography , special presentation materials , such as models , renderings , etc . , shall not be provided unless otherwise stipulated .
