The disputes involve Interpretations and applicability of certain portions of said contract , and whether the city has granted authority to the architect to commence cartaiii pro- fes6ional services in accordance with tome and conditions of the contract . It is the city 's contention that no authority was given -to the architect to commence work under Article 16 of the contract . 2 . LIBRARY WINOS (Phases ) 11 & III - (Paragraph 1 . 1 ) . The 1.11ty is contesting the percentage completion of design de;relopment phase drawings of two abandoned i/ings of the ME�in library . LIBRARY SITE MOVE - ( Paragraph 1. 3 . 5) . It is the city ' s contention that the library eite move was Initiated by the architect and not authorized by the owner, thus an ad- ditional service fee under Paragraph 1 . 3 -5 cannot be charged to the city . The attached Architec- tural Construction Cooxdinator ' s Agreement prepared by the City Attorney ' s Office has been reviewed and executed by Mr. Elwood on April 30 , 1974 . The terms of the Agreement include an extension for six months at. the original $3 , 500 fee per month, the subsequent two months at $1 , 750 per month , and a final period of two mon-�hs at $875 per month . These gradu- ated fees are based upon the anticipation that as finishing work progresses , less frequent visits and meetings will be required. In. the event that additional tillie is required due to strikes , lockouts , or other labor dis - putes , the above mentioned payment schedule will be suspended and Mr. Elwood } will be pain $30 per Dour for services acti:ally performed during the strike i period. Upon termination of the strike , the pre-strike payment schedule shall then resume. The compensations for standard architectural reimburs- ' ables will remain_ the same throughout this extension. The Library is presently 40% complete . All plans and clarification draw- ings have been updated and cross referenced.. Effective lines Of communi- cations have been developed between Yr. Elwood, the architect , the contrar.tort' the subcOTItractors and the City which have proved vital to solving the day to day problems . Early summer is going to arrive with several union union contracts ready for renerral and careful supervision is going to be necessary in order that any strike delays are held to an absolute minimum. . Concera for the expense of this contract extension should be minimized by the frxesight of completing this approaching $ 3 million project coupled with the thought that delay beyond the predetermined necessary completion date of February 15 , 1975 , will cost $800 per day to cover the bone? interest, RECOMMENDATION : If the City Council agrees with the tt!rm�,- of this extension , it is recont- mended that the Council execute -the Agreement . Discussions and negotiations on this particular arbitration matter has consumed 1 a considerable amount of time during the past few weeks . After having conferred witli Mr . Neutra on several different occasions { and after having ermined the various reports , maps , documents T and other material which he had in his possession conce'rni.rg his claims for payment , it was ipy ccrisidered judgment that a + settlement in 'the amount of $26 , 683 was justified in the interest of resolving the dispute without the necessity of resorting to 4 arbitration .
