BOARDING FACILITY IN 'HUNTINGTON HARBOUR THIS AGREEMENT is made and entered into this cA Otte, day Of 101 , 1988 , by and between the CITY OF HUNTINGTON BEACH , a municipal corporation of the State of California , hereinafter referred to as "CITY" , and RMG ENGINEERING , INC . , a California corporation , hereinafter referred to as "CONTRACTOR" . WHEREAS , CITY and CONTRACTOR are parties to that certain contract , dated November 18 , 1985 , entitled "Engineering Services Agreement Between the City of Huntington Beach and RMG Engineering , Inc . for Design, of Parking Lot and Boat Boarding Facility in Huntington Harbour ; " and Since the execution of the original contract , CITY has requested additional work from CONTRACTOR and CONTRACTOR has performed such work ; and CITY and CONTRACTOR wish to amend the original contract to reflect the extra work to be Performed by CONTRACTOR and the additional compensation to be paid in consideration thereof by CITY to CONTRACTOR, NOW, THEREFORE , it is agreed by and between CITY and CONTRACTOR as follows : 1 . ADDITIONAL WORK CONTRACTOR shall provide to CITY such additional services as described in the letter from CONTRACTOR to CITY , dated July 30 , 1986; the letter from CITY to CONTRACTOR, dated August 19 , 1986 ; the invoice from CONTRACTOR to CITY dated January 31 , 1988 ; and the letter from CONTRACTOR to CITY dated April 6 , 1988 , hereinafter collectively referred to as Exh;.bit "A" and incorporated herein by this reference . i . ADDITIONAL COMPENSATION In consideration of the additional engineering services described in Section 1 above, CITY agrees to pay CONTRACTOR the additional sum of Three Thousand Seven Hundred Five and no/100 Dollars ; *3 , 705 .00 ) . The .additional sum shalt be added to the _1� 1 original sum of Twenty Six Thousand One Hundred and no/100 Dollars ( $261,100 .00 ) for anew total contract amount of Twenty Nine Thousand Eight Hundred Five and no/100 Dollars ($29 , 805 .00 ) . 3 . REAFFIRMATION Except as specif:.cally modified herein, all other terms and conditions of the Agreement shall remain in full force and effect . Environmental permits could not be obtained for channel filling, therefore, project had to be down- scaled. Original plans Bann specifications required the removal $2,520.00 of 7,5a00 cubic yard as of channel bottom material directly adjacent to boat dockinq facility. On Aucprst 19, 1985, the Citv Council approved Resolution No. 5552; thereby► accepting the grant, ani authorized staff to solicit proposals from engineering firms for design on the facility. Pursuant to Chapter 3.03 "Professional Services" of the Mainicipal Code, proposals were solicited from t.j alified engineering J. firms tD pry pare the constn,ction drawings. Such policy shall provide coverage at least as broad as that provided in the Standard Form approved by the National Bureau of Casualty Underwriters together with such endorsements as are required to cover the risks Involved. The Contractor shall arrange for the policies to be so conditioned as to cover the performance of "Extra Work", should such work become necessary. Prior to the commencement of work under. the contract, evidence of insurance shall be furnished on a. form provided by the City (see Attachment B), and no other form will be accepted. In addition, the Contractor shall furnish evidence of a commitment by the insurance company to notify the City of the expiration or cancellation of any of the insurance policies required hereunder not less than 30 days before arry change in coverage, expiration or cancellation is effective. The Contractor shall also show proof of Workers' Compensation coverage or a valid certificate of self-insurance. 7-5.1 Permits and Licenses Except as otherwise specified in the Special Provisions, the Contractor shall procure all permits and licenses; pay all charges and fees and give all notices necessary and,incident to the due and lawful prosecution of the work. These permits and licenses shall be obtained in sufficient time to prevent delays to the work. In the event that the agency has obtained permits, licenses or other authorizations applicable to the work, the Contractor. shall comply with the provisions of said permits, licenses and other authorizations. Engineer, the Contractor shall furnish and operate a sea-loading motor sweeper with spray nozzle at least once each working day to Iceep paved areas acceptably clean whenever construction, Including restoration is incompl%te. 7-8.5.1 Use of City Water System The Contractor shall make arrangements with the City of N.:,tingtor, Beach Water Department for requirements, location of source and payment prior to the taking of any water from the City system. 7-8.7 Noise: Control If the construction site is located adjacent to a reridential area, the Contractor shall take all necessary steps to limit the amount of noise emitting from construction equipment used In addition, working hours shall be :-estricted to between the hours of 7:00 AM to 6-00 PM. 7-8.8 Flow and Accept ante of Water Storm, surface and possibly ground or other water may be encountered at various times and locations hiring the work. Such waters may interfere with the Contractor's operations and may cause damage to adjacent or dowrmt re tm private and/or public property by flooding or lateral erosion if not prvcr rly controlled by the Contractor and the Contractor acknowledges that his bi _ ias prepared accordingly. The Contractor, by submitting a bid, assumes all of .raid ri sk. Drainage of water from existing catch basins shall be maintained at all times. Any detour which will last longer than three calendar days shall be delineated by removing the existing striping and legends on the pavement by sandblasting and placing new striping and legends as may be appropriate to accommodate the detour. Upon 'completion of the work and the restoration of the road surface to its final condition, the detour striping shall be removed by sandblasting by the Cont.-actor an4 the original striping replaced. Cost for removal and replacement of detour striping shall be included in the other items bid for the work and no additional compensation will be allowed therefor. The Contractor's attention is specifically directed to F SMC Section 12.24, "blaming Lights - Barricades", pertaining to the use of barricades and lights in excavation areas. Flashing barricades will be allowed as a substitute for 'lights" as described in that section. 7A0. 1.2 Safety-Precautions, Tire Contractor shall provide for and maintain provisions for public traffic through the construction area at all times. Potholing utilities. 9-3.2.1 Progress Payments The City shall,, once in each month, cause an estimrite in writing to be made by the Engineer of the total amount of work done tend the .acceptable materials furnished and delivered by the Contractor to the job site and not used as of the time of such estimate end the value thereof. The City shall retain money In the amount of ten percent (! 0% ) of the progress payment unless approval .of Engineer for greater percent of such estimated value .'of the work. done Is obtained. The City shall retain money in the amount of fifty percent (50%) of k. the value of the materials so estimated to have been furnished and delivered and unused, provided the materials were fabricated specifically for the project. No payment will be made for standard stock items that have not been incorporated in the work. The City shall monthly pay to the Contractor while performing the work, the progress payment balance, after deducting therefrom ell previous payments and all Burns to be kept or retained undrr the provisions of the contract. No estimate or payment shall be required to be made when in the judgment of the Engineer, the work is not procr.eding in accordance with the provisions of the contractor when in his judgment the total value of the wark done since the last estimate amounts to less than three hundred dollars ($300). At the request and expense of the contractor, substitution of securities for any monies withheld by the City to insure performance under the contract shall be permitted in accordance with provisions of the California Government Cade, Section 4590. 9.3.2.2 Final PaXment The Engineer shall, efter completion of the contract, make a final estimate of the amount of work done thereunder and the value of such work, and the City of Hintington Beach shall pay the entire sum found to be due after deducting therefrom all previous payments and all amounts to be kept and all amounts to be retained under the provisions of the contract. All prior partial estimates and payments shall be subject td correction in the final estimates and payment. The final payment shall not be due and payable until aftet the expiration of thirty-five (35) days from the date of recording a Notice of Completion. It is mutually agreed between the parties W the contract that no certificate given or paymer-4s made under the contract, except the final certificate of final payment, shall be evidence of the performance of the contract, either wholly or in part, against any claim of the party of the first part, and no payment.shall be construed to be an acceptance of any defective work or unacceptable materials. —14— f Section 10 Prop 'Sal- Repulte`ments I0-1 Examination of Plans, Stsndatti Specifications,- Special Provisions and Site of Work The'bidder shall examine carefully the site of the,.work contemplated and the proposal, plans, sQecifications,and contract forms therefore. It will be assumed that the bidder has investigated and is satisfied as to the general and local ccr cfi tions to be encountered; as to the character, quality and quantities of the work to be performed and materials to be furnished; as to the character of equipment and facilities needed p7eliminary to and during the prosecution of the Work; and as to the requirements of these apecif icatlons. It is mutually agreed that submission of a proposal shall: be cor-% idered prime facie evidence L•hat tte bidder has made such examination. No verbal agreement or conversation with any officer, agent or employee of the City either before or after the execution of this contract shall effect or modify any of the terms or obligations herein contained. 10 2 Proposal Form All Proposals must be made upcxn blank forms to be obtained from the office of the Director of Public Works at the Civic Center, Huntington Beach, California. The Bidder shall submit his Proposal on the form furnished him. Proposals submitted on forms other than the one issued to the Bidder will be disregarded. All Proposals must give the prices proposed both in words and nu -nbem, of which words will prevail over numbers, and must be signed by the Bidder v lth Ns address and telephone number. If the Proposal is made by sn individual, firm or partnership, name, post office address and tdephone number must be shown. General Description of Work TFe work to be 'done, in general , consists of: construction of a parking lot and boat dock including dredging, earthwork for parking lot, asphalt concrete pavement, concrete curb and gutter and sidewalk, rip rap shore protection, prestressed concrete guide piles, floating dock, aluninum gangway; fire hydrant, baffle box drainage structure and outlet pipe, and striping. B. Additions to Standard Specifications 300-1 . 2 PRESERVATION OF PROPERTY f The contractor shall protect in place (as possible) any shrub, 'bush, or tree adjacent to or directly threatened by intended construction. Should removal seem necessary, the Contractor shall first contact the Engineer so that a qualified inspector can judge its possible protection, salvage, and/or relocation. 300-1 . 3. 1 REMOVAL AND DISPOSAL OF MATERIALS ( GENERAL) No burning will be permitted. 300-1 . 3. 1 (a) HAULING OF MATERIALS In order to protect the City streets from deterioration due to hauling of materials, the contractor shall submit (prior to pre-job meeting) for approval, a proposed route for the hauling of materials for disposa ) . Upon approval , the Contractor shall strictly adhere to that route only, unless written permission is obtained to change the route. 300-2. 6. 1 DISPOSAL SITE Any nonorganic material removed from the project site, asphalt, concrete, etc. , may be disposed of at no cost at the City 's landfill operation located at Gothard Street and Taloert Avenue. Dredged material removed from the channel shall not be transported to a disposal site until the City oetermines that the material is sufficiently dry. The Contractor shall be responsible to obtain from the City a Permission to Dump form and shall provide his drivers with proper identification to be presented at the landfill operation. 300-2. 9 PAYMENT FOR SURPLUS MATERIAL Payment for excess material such as broken asphalt, aggregate Dase, broken concrete, clean soil, F.tc. , shall be included in the clearing and grubbing item. 301-2 UNTREATED BASE MATERIALS Section 1 . Materials Untreated base materials shall meet the requirements of Section 400 and these Special Provisions . In-lieu of the second sentence of Section 200-2 . 4 . 1 . at least 65 percent , by weight , of the material retained on ' the No . 4 ©ieve sball be crushed particles as determined by Test Method No . California 205 . Evaluation of gradation and sand equivalent test results shall conform to the provisions of Subsections 4400-.1 . 4 . The gradation and sand equivalent requirements of Subsections 200-2 . 3 , 200-2 . 4 , 200-2 . 5 , and 200--2 . 6 shall be the moving average requirements . Individual test requirements for gradation and sand equivalent shall be as determined by the EMA-Materials Lab . Section II . General Provisions Add to Subsection 301 . 2 . 1 , "General" , the following : Untreated base material for pavement , cross gutters , spandrels , and similar types of improvements , shall be constructed of material as specified herein. The material grading shall be either Coarse or Fine as specified in Subsection 200-2 . 4 . 2 , "Grading" , of the Standard Specifications , at the option of the Contractor . Changes from one grading to another shall not be made during the progress of the work , unless permitted by the Engineer . Revise Subsection 301-2 . 2 , "Spreading" , as follows : Delete the last two sentences in paragraph 2 and add the following : At the time untreated base material is spread , it may have a moisture content sufficient to obtain the required compaction. Such moisture shall be uniformly distributed throughout the material . Tailgate spreading by dump trucks will not be permitted except for spot dumping and in areas not readily accessible to spreading equipment . 302-5 ASPHALT CONCRETE Section I . Materials Asphalt concrete shall meet the requirements of Section 400 and these Special Provisions . 19 Coarse aggregate shall consist of material of which at least 75% by weight shall . be crushed particles in lieu of the requirements of Section 400--4 . 2 . 3 . The viscosity grade of paving asphalt shall be AR 4000 . The. ..exact proportions of aggregate a}nd the amount 'of; asphalt binder for each type of mixture shall be regulated as directed by the_ Engineer . However, _ as a general 'guideline, the required asphalt content for asphalt concrete mix designs will be as follows : R :.y,5:... rterial Highways 3/4 " ( III-B-2 ) Base Course 5 . 4% 1/2" ( III-C-3 ) Surface Course 5 . 8% :.c= ;:u Non-Arterial Streets �/4 " ( III-B-3 ) Base Course 5 . 7% 1/12" ( III-C-3 ) Ease & Surface Course 6 . 0% The sand equivalent and Stabilometer--Value ( 5-Value) requirements of Subsection 400•-4 . 3 shall be the moving average requirements . Individual test requirements for sand equivalent and S-Value ' shall be as determined by the EMA-Materials Lab , Section II General Provisions Add to Subsection 302-5 . 3 , "General" , the following : If the finished surface of the asphalt concrete does not meet the specified surface tolerances , it shall be brought within tolerances by either ( 1 ) abrasive grinding ( followed by fog seal coat on the areas which have been ground) , ( 2 ) placing an overlay of asphalt concrete , or ( 3 ) removal and replacement . The method shall be selected by the Engineer . Delete Subsection 302-5 . 2 , "Prime Coat" ,' and substitute the following: When specified , a prime coat consisting of Grade MC--250 liquid asphalt shall , be applied to the surface of the prepared base or subbase prior to placing asphalt concrete at a rate between 0 . 10 and 0 . 25 gallon per square yard . Modify Subsection 302-5 . 3 , "Tack Coat" as follows : A tack coat of SS-lh type emulsified asphalt ,where stipulated on the plans and specifications or required by the Engineer , shall be applied in accordance with Subsection 302-5 . 3 . AR 1000 paving asphalt may be used only when approved by the Engineer . AR 1000 paving asphalt , when approved , shall be spread in accordance with provisions of Section 203-1 . 20 Add to Subsection 302-5 . 4 , "Distribution and Spreading" , the following : Asphalt concrete shall be spread and compacted with a self.- propelled asphalt paving machine capable,, of spreading and .vibrating a width of 12 feet , or by other .equipment rAlth prior approval of the Engineer . Tarpaulins shall be used to cover all loads when directr:ci by the Engineer . The top layer of asphalt concrete .shall not exceed 0 . 10-foot in compacted thickness . Each lane of the top layer, once commenced , shall be placed without interruption. All screed extensions for paving machines shall be provided with a tamper , roller Gr other suitable compacting devices . Add to Subsection 302-5 . 5 , "Rolling" , the following: Three-wheeled rollers as specified in Subsection 302-5 . 5 . 1 shall not be permitted . Pneumatic rollers shall he required on lower layers only. Initial breakdown compaction shall consist of a minimum of three ( 3 ) coverages of a layer of asphalt mixture . A pass shall be a movement of a roller in both directions over the same path . A coverage shall consist of as many passes as are necessary to cover the entire width being paved . Overlap without displacement of material in accordance with good rolling practice , shall be considered to be part of the coverage being made and not part of a subsequent coverage . Each coverage shall be completed before subsequent coverages are started . The final or surface layer of asphalt concrete shall not be : laced until all on-site improvements have been completed, Including all grading , and until all unacceptable concrete Is removed and replaced at the direction of the Engineer . Modify Subsection 302-5 . 8 "Measurement and Payment" as follows : Payment for asphalt concrete shall also include prime coat , tack coat and seal coat as required . All striping to be removed shall be sandblasted . 310--5 . 6 . 4 PAVEMENT MARKINGS , STANDARDS All pavement markings shall conform to the standards of the applicable portions of the State of California, Department of Transportation Maintenance Manual , Chapter XVI , "Pavement De- lineation" as amended . 310-5 . 8 . 1 PAVEMENT MARKERS Pavement markers shall conform zo the provision in Sect on 85 , "Pavement Markers" , of the State Standard Specifications and these Special Provisions . Pavement Markers shall be placed to the line established by the Engineer , which will consist of temporary painted line , one for each 'direction of travel . All additional work necessary to establish satisfactory lines for markers shall be performed by the Contractor , including correction of minor irregularities In the line established by * the Engineer . . 310-5 . 8 . 2 REMOVE RAISED ?AVEMENT MARKERS Existing pavement markers , when no longer required for traffic lane delineation as directed by the Engineers shall be removed and disposed of prior to capping . During the removal of ceramic type pavement markers , screens or 23 other pro tective. devices shall be furnished to contain any fragments as provided for in Section 7-1 . 09, "Public Safetgw.- of the CalTrans Standard Specifications. All fragments. resulting from the removal of pavement markers shall be removed from the pavement surface before the lane or lanes are opened to public traffic. _22-6 LABORATORY Testing:. shall be performed by the O. C.E.M.A. Material Laboratory. , C Items of Work Not Covered in the standard Specifications FLOATING DOCK SYSTEM - 1 GENERAL A. This Section is for the fabrication and installation of the floating Idock system. This system shall be complete and include pontoons, decking, framing, mooring cleats, and bumper strips. b. All work shall conform to the shop drawings approved by the Engineer. Construction details, finishing details and colors of the completed floating dock system shall be consistent throughcut. c. Dock system which is proposed shall be furnished by a firm having a minimum of five (5) years experience in the manufacturing and installation of similar type units. d. The dock system including all components of the system shall be designed for a twenty year life expectancy. Each component shall carry an unconditional warranty for two (2) years after project acceptance. 2 SUBMITTALS Prior to the start of construction or fabrication,' the Contractor shall submit shop drawings for review and approval by the Engineer and the State Department of Boating and Waterways. 24 t. 3 MATERIALS a. The roller material shall be ultra high molecular weigght plastic with a solid stainless steel Type 304 anxle and supported by galvanized steel mounting bracket. e. Mooring Cleats Mooring cleats shall be galvanized cast iron and shall be equal to Henderson marine Supply Item 504 , Heavy Ship Cleat. Sizes are indicated on the plans. 26 4 . INSTALL'ATION a. Decking ehall 'be a continuous non-skid surface . b. All bolts with nuts bearing upon timber shall have malleable iron washers . C . Floating;`docks shall be designed ,to withstand a minimum live load of 20 pounds per square foot . * Freeboard shall not. exceed 20 inches nor be less than 8 inches under any loading conditions . Also, at no time shall any . framing , . member come in contact with water under design loading conditions . d. Floating docks. shall be 'designed to withstand wind, wave , current and impact loading that may reasonably be expected to occur during the life of the structure as a result of the docks location or exposure . C . Where 'the dock must support a gangway, special atten- tlon„must be given to insure that adequate floatation is provided to support the dead and live loads of both the float and the gangway. 5 . MEASUREMENT AND PAYMENT The floating dock shall be paid for at the unit price per square foot of deck area ; including fillet areas . ALUMINUM GANGWAY 1 GENERAL a . Work for the fabrication and installation of the gangways shall conform to applicable requirements of Section 304 , METAL FABRICATION AND CONSTRUCTION of Standard Specifications . b. Shop drawings and calculations shall be submitted and approved by Engineer prior to fabrication or Installation . 2 MATERIALS a . Structural members : Framing shall be fabricated of 6061-T6 aluminum alloy structural shapes conforming to ASTM ' s B 205 , B 221 and B 308 . b. Cleats : Cleats shall be fabricated of 6061-T6 aluminum alloy bars conforming to ASTM B 221 . Each cleat shall 27 II J be 114 inch x I inch for the full width of the gangway and installed at 12" on center. c. Handrail : Handrail shall be fabricated of 6061-T6 aluminum pipe and tubing conforming to ASTM B 429. d. Hinge 'Bearing Plates and Apron: The hinge bearing plates and apron components shall be completely fabricated from 6061-T6 aluminum alloy conforming to ASTM 's B2091 B 221 and B308. e. Fasteners: All bolts, screws, nuts and washers shall be manufactured from either 2024-T4 or 6061-T6 aluminum alloy conforming to ASTM B 209. f. Wheels: Gangway wheels shall have an aluminum wheel with sealed roller bearings and a polyurethane thread. The wheel shall be sized to withstand the design loads. g. Wood: Wood shall be stress-rated Pacific Coast Douglas Fir, Structural No. IS4S. Timber shall be identified by the grade mark of WCLB. Fabrication of timbers shall be as complete as practicable before preservation treatment . Preservative treat timber in accordance wit!: AitiPB LP-44 with pentachlorophenol ( type A) mixture to a minimum retention of 0. 5 pcf. Marking of treated wood not required but treated shall provide certification of material used and retention rate. h. Field cuts and holes shall be treated in accordance wi to AWPA M-4 . 1 . Shop drawings shall be submitted and approved by Engineer prior to fabrication or installation. 3 CONSTRUCTION a. General : Aluminum gangways shall be Hallsten Supply Co. , Sacramento, CA or equal . b. All welding required in the fabrication of these gangways shall comply with the provisions of the Structural Welding Code: Aluminum ANSI-SWS D 1 . 2 (latest edition) . All aluminum gangways shall be subject to testing according to the above specifications. The Engineer has the right to test any gangway or part of gangway he determines necessary to insure that it meets the requirements of the specifications. All welding procedures snail be submitted to the Engineer and approved by him in 28 writing prior to use on the gangways. Gangways shall be fabricated only by certified welders, and welder certifications shall be submitted to the Engineer prior to start of fabrications. All inspection and testing required by the Engineer on aluminum gangways will be `paid for by the contractor. The 'costs of welding procedure approvals and welder certifications will be paid for by the welding contractors. is is recommended that Industrial Testing International Inc. Direct contact between aluminum and dissimilar metals and concrete surfaces shall not be permitted. Dielectric fiber gaskets and/or sleeves shall be used to isolate the aluminum from these materials. d. Handrails snail be provided on both sides of gangway, with heights of 42 " minimum or 45 : maximum. e. The minimum walkway clearance of the gangway, inside of the handrails, shall be four (4 ) feet. 28-A f . The handrail shall be designed to. prevent . a nine inch sphere from being passed through any opening . g. The . gangway: shall support a uniform live load of 40 pounds per square foot . h. The completed gangway ,.shall have a uniform finlsh._ ..and all . exposed surfaces and welds shall be ground smooth. After fabrication, the 'gangway shall receive . , the following paint system using Dunn-Edwards ( or equal ) materials and instructions : Pretreatment - Vinyl wash pretreatment 42-36 . 1st Coat - Zinc Chromate Primer 42-6 Yellow, applied within 4 hours after vinyl wash to a minimum wet film thickness of 2 . 7 mils . 2nd Coat - Loc Kote 42-23 , applied to a minimaum wet film thickness of 3 . 2 mils . 3rd Coat - Endurasheen, semi-gloss. enamel , 39 - series , applied to a minimum wet film thickness of 3 . 2 mils . Color of final coat to match ALCOA Duranodic 322 medium bronze . 4 MEASUREMENT AND PAYMENT The gangway shall be paid for at a lump sum price . DREDGING 1 GENERAL This work consists. of furnishing all labor , equipment , materials , and incidentals necessary for completing the dredging work in accordance with the Drawings and Specifications . 2 BUOYS AND RANGES The contractor shall furnish , place and maintain all buoys , markers , and ranges necessary for the proper control of dredging operations . The Engineer will establish the base line and one or more reference points for the Contractor to use in setting buoys , markers and ranges . The Contractor shall give at .least two working days notice in writing when requiring the services of the Engineer in establishing the base line . 29 t 3 LIGHTS The Contractor shall .keepuproper lighting between sunset and sunrise on all 1luating equipment , upon all ranges; and ottiu.r markers, and upon all buoys which, are `of such size and at,. _ such ",. .. ,. locations as to ends*rger or obstruct navigation. The Contractor shall. be responsible for all -damage resulting from negligence or failure in this ,respect . If , and when. work is 'performed at .nht ig , the Contractor shall maintain lighting on. or, about the equipment as may required for the proper performance and inspection of the Work. 4 INTERFERENCE WITH NAVIGATION The City will not undertaketo keep the harbor, channels or berths ,1 ree from vessels or other -obstructions . The Contractor shall so cord - work_ as not to Interfere with navigation or . wSth the berthing of ships , and shall keep the channels open. - to navigation. , All dredge equipment must be provided with proper signals , and no floating equipment shall be left in any ,channel or harbor without competent personnel aboard to maintain all navigation signals . 5 PIPE LINES AND CABLES The Contractor shall exercise every precaution to prevent the displacement , injury or obstruction of any marine cables , wires carrying electric currents , or water , gas , oil , sewer , or other pipes or conduits either submerged or above water , in the area of operations , and will be held responsible and shall satisfy all claims arising for any damage thereto as a result of his operations . The Contractor shall thoroughly review all records of submerged utilities in the area of operations . The City will make available to the Contractor its record of submerged utilities , but cannot guarantee the conditions existing . 6 SALVAGED ARTICLES OF VALUE The City, at its option, may claim any or all articles of value located at or recovered in dredging . Should an article be claimed by the City, the cost of recovering same will . be determined by the Engineer , and the amount thus established will be paid to the Contractor as Extra Work. 7 OBSTRUCTIONS If wrecks , logs , snags or other objects and obstructions are encountered within the limits of the dredging prescribed herein, the Contractor . shall remove the same and dispose of them at the Contractor ' s expense . 30 8 'DREDGING PROCEDURE Dredging . shall be carried to lines and depths as _ indicated on,; the Dra wings and . .as directed by the Engineer. The Engineer may- chhnge the lines and . depth at his option, "provided such changes do not ,involve delays to the Contractor nor materially increase the cost of the work. When :dredging adjacent to existing wharf structures, marine ways,, dolphins, breakwaters, rip rapped slopes, etc. , is undertaken, due caution shall be 'exercised so as not to overdredge in., the .immediate vicinity .,:,and endanger the structures. The Contractor will. be held responsible for any damage to existing slopes and adjacent structures where side slope material or other material outside . of the prescribed limits for dredging is removed or disturbed as a result 'of his operations. '9 DISPOSAL All dredged material is intended to be hauled off at the Contractors expense to a site approved 'by the Engineer. 10 FINAL SURVEY AND REMOVAL OF EQUIPMENT As soon as practicable after the completion of the dredging work, a final survey will be made over the entire area dredged. Should any shoals, humps or other lack of contract depth be disclosed by the final survey, the contractor will be required to remove them by dragging the bottom, or by dredging. Upon completion of the work, the Contractor shall remove at once all equipment, including buoys, ranges and pipe lines, etc. , used in the work. Any streets and property including disposal areas, used in connection with any dredging operations. shall be cleared of all obstructions and left in as good condition as previous to its occupancy or use. 11 MEASUREMENT AND PAYMENT Dredging shall be paid for at the unit p::ice per cubic yard of material removed. Quantities of dredged material shall be determined by taking soundings before and after dredging, plotting the soundings as cross-sections, calculating the average end area of cross sections and multiplying the average end area by the distance between cross sections. Material dredged below the lowest pay line for dredging as shown on the drawings will be deducted from dredge pay quantities. 31 1 J SILT CURTAIN 1 GENERAL a. California . The purpose of our, study was. to evaluate the general soil and foundation conditions at: the project site and provide recommendations to aid in the preparation of project plans and specifications. Proposed Construction Present =, plans call for the construction of a paved parking lot, boat dock, and restroon: facility. The project will also include dredging of the channel bottom in the vicinity of the boat dock, and construction of shore slope protection. Sco've of Study Our investigation included subsurface exploration, soil sampling, laboratory testing, engineering analyses , development _ of design recommendations and preparation of this report. The scope of our study included performance of the following tasks : Reconnoiter site and layout test boring locations. . . . Drill one deep test boring and five shallow borings within the perimeter of the proposed site . . . . Evaluate types , locations and engineering character- istics of substrata earth materials . . . . Evaluate factors affecting .he design of the proposed structures , including total and differential settlement. . . . Develop recommendations pertaining to structural design parameters for the most feasible methods of foundation support, including allowable bearing capacities and resistance to lateral loads . . . . Present comments and: recommendations for foundation installation. Subsurface Expioration The field investigation was completed in December, 1985, and consisted of site reconnaissance and drilling of exploratory test boirings . The f ield subsurface exploration consisted of drilling one test boring to a depth of 25 feet and five shallow borings to .a 'depth 'of 3 feet . Details pertaining to the drilling operations are presented on the Test Boring Logs in Appendix A on pages A-1 and A-2 . Ap"proximate test boring locations are shown on the Location of Test Boring Plan, page A--3 . Both bulk and relatively undisturbed samples of representa- tive soil types were obtained from the test borings .for laboratory testing and examination. The in-place samples were obtained by driving a 2 . 5-inch I . D. ring sampler with a 140-pound weight dropping about 30-inches . A standard penetration test was also conducted using a standard penetration sampler driven with a 140-pound hammer dropping 30 inches in conformance with ASTM Test Designation D1586-67 . The drilling and sampling operations were performed under the direct supervision of a geotechnical engineer, who also to"gged the test borings and prepared the samples for the subsequent laboratory testing and examination. Test hole eleva- tions were surveyed relative to a sewer manhole located near the project site . Soil Ttstins Earth ' materials were visually classified in the field according . to the Unified Soil Classification System by careful examinat-ion of the samples . A description of this classification system is presented at the front of Appendix "A. SITE CONDITIONS Surfag:e Conditions The proposed ,site is currently a vacant lot located north of Warner .-Avenue on the east side of the Huntington Harbour Channel . Ho improvements were noted within the project area . Significant erosion 'of the shore slope was observed during our field exploration. Subsurface Conditions The earth materials encountered in the exploratory test borings `consisted of clayey silt, clayey sand, and fine to coarse sand. Approximately four feet of fill , composed of silty clay and sandy silt, was encountered in the vicinity of Test Hole B-1 . Groundwater Conditions The groundwater level was measured at a depth of seven feet below existing grade in Test Hole B-1 immediately after drilling was completed. It should be anticipated that groundwater levels could change with flucuations in local rainfall and changes in the harbor channel water level . CONCLUSIONS AND RECOMMENDATIONS Footings Conventional spread or continuous footings may be used to support , lightly loaded structures at this project. Footings should be supported on firm native soil or approved compacted fill . A portion of the passive earth pressure acting `on the sides of footings may also be utilized. The allowable static horizontal load resistance for footings may be taken as 0 . 35 times the applied vertical pressure or load. The allowable horizontal p.issive earth pressure against undisturbed native soil or properly compacted fill is 165 psf per foot of depth of embedment below the lowest adjacent ground or slab surface. If the footing base sliding and passive side resistance are combined, the passive lateral resistance should be reduced 50 percent . For purposes of design, the allowable static lateral load resistance may be increased 50 percent for short-term loading including static plus seismic or wind. Concrete Slabs The - expansion potential of the clayey subgrade soil will necessitate minimum slab reinforcement equivalent to 93 bars spaced at 30-inch centers in both directions . In addition, the building slabs should be tied to exterior grade beams , continuous footings , 'or -wall panels by means of #3 bars spaced to coincide with the slab reinforcement . The membrane should be covered with at least two inches of moist (not saturated) sand ' to aid in concrete cure . Corrosion .Metallic Corrosion - Laboratory test performed can fouridat .on soils indicate that a severe corrosive environment may exist for metal conduit . Consequently, it is recommended that a corrosion specialist . be consulted regarding material types and/or design protection for piping systems to ensure against leakage . Concrete Corrosion - Laboratory tests indicate a low concen- tration of soluble sulphates in the native foundation soils . However, as structures will be exposed to a marine environment it is recommended that ,Type II, cement be used in concrete at this site . . It is recommended that the construction considerations include: ( 1) as low a water/cement ratio as workable : (2 ) good density; and (3 ) proper curing. Slope Stability and Setbacks The.: shore slope bantering the Huntington Harbour Channel should be constructed at a gradient no steeper than 1 . 5 horizontal to 1 . 0 vertical . Permanent erosion protection should be , installed along. the entire face of the slope . Protection should consist of angular rock revetment or concrete lining and should , extend. from the top. of slope to a minimum depth of five feet - below , 'the dredge line. Drainage Surface drainage control is essential to promoting a more uniform annual soil moisture , and thereby minimizing expansive soil volume changes . Positive drainage of surface water away from the structure is very important. Each step of the grading should be approved in a specific area by the soil engineer and , where required , by the applicable governmental agencies before proceeding with subsequent work. 1 . Prior to the star of grading , all vegetation, trash or surface obstructions should be removed and disposed off-site. 2 . Subsequent to clean-up operations and prior to initial grading, a reasc-table search should be made for subsurface obstructions :end/or possible loose soils , unapproved fill , or detrimental soil types . This search should be conducted by the contractor with advice fron the under the observations of the geoteChnical engineer. PART 3 CONSTRUCTION METHODS °Y A-I GENERAL DESCRIPTION OF WORK The work to be- done, in general consist of: providing irrigation and plant layout working drawings , earthwork, installing irrigation service enclosure , providing power for the automatic ir- rigation controller, a complete automatic opexa- tional irrigation system, complete landscape installation including relocation ,,. plantin`g and of guying of existing palms , importing sand and Class A topsoil and soil preparation, installing shrubs and ground cover and performing all plant estab- lishment `period work and furnishing all labor , materials , tools , equipment and incidentals necessary to perform the said work. All. work shall be completed to the satisfaction of the Engineer . B. ADDITIONS TO STANDARD SPECIFICATIONS 300-•8 EARTHWORK 300-8 . 1 GRADING OPERATIONS Finished surfaces in all casee . shall conform to the lines , grades , cross sections and dimensions shown on .the drawings . Such deviationP from the original drawings and working drawings , as may be required by the exigencies of construction , will in all cases be determined by the Engineer and authorized in writing . Finished grades shall be well compacted , reason- ably smooth and conform to the drawings , insuring positive drainage , free of abrupt grade Ichanges , irregularities , water pockets or discontinuities in surface level . All areas to receive ground cover and Raphio- lipsis shall be "ripped 12" deep minimum with ripper teeth 12" O.C. in two passes and from opposite directions with 6" off set ( in narrow areas only) in areas of sufficient size, rip- ' ping shall be in crossing pattern to each other. Prior to ripping , agricultural gypsum shall be spread at the rate 'of 200 pounds per 3.000 square feet . All unsuitable material shall be brought to the surface such as concrete , wood , pipe, tar, A.C. , etc6 and removed from site. A-14 Adequate drainage; shall be provided throughout the progress of the work so .that storm-, water will be diiposed of without =damage. to. the project ,or adjacent properties . Any -such damage shall be repaired at the Contractor ' s expense . No .f nish arscling shall be done when the moisture content of the soil is so great that excessive compaction will occur , nor when it is no dry that dust will form in the air or the clods will not break readily . All finish grading shall be 'completed prior to planting operations . Prior toycompletion of finish grading , all rocks roots or other foreign material one ( 1 ) inch or larger in any dimension and weeds shall be removed from the top two ( 2 ) inches of the finish grade . Finished grade adjacent to paved areas and curbs shall be one ( 1 ) inch below the finished surface for groundcover areas . 300-8 . 2 EXCAVATION The Contractor shall make sufficient excavation to construct all of the work shown on the drawings or apecified herein , and shall abide by the Construc- tion Safety Orders issued by the Division of Industrial Safety of the State of California . Excavations shall be to the dimensions and eleva - tions indicated on the drawings , or as specified in these specifications. Bottom of excavations shall be level , free from loose material , and to the required levels in undisturbed earth . All excavations shall be kept free from standing water. The Contractor shall assume all responsibility for pumping or draining that may be necessary in carrying on the work. The Contractor shall comply with State of Calif- ornia Labor Code Section 6705 . Acceptable excavated material shall be transported to and placed in fill areas within the limits of work. Unsatisfactory material encountered within the limits of work done shall be excavated below grade . and replaced with satisfactory material as requested by the Engineer. A-15 As .approved by the Engineer, *distribute satisfac- tory excavated subsoil obtained from grading operations for planting areas* 300-003 COMPACTED FILL Graded material shall not be left in loose layerq but shall be compacted in than layers . Fill material shall be composed of satisfactory excavated material or approved import Class A topsoil per Subsection 212-1. 1 . 2 . The import soil shall ,be evenly spread in uniform continuous horizontal layers not more than 3 inches deep of uncompacted thickness . After fist layer is spread, the import shall be mixed to a depth of 6 inches until the import soil is uni- formly blended with the native subgrade. Each uncompacted layer shall be moistened or distribution within three ( 3 ) percent of optimum moisture content . Compaction shall be performed by suitable mech- anical .equipment as approved by the Engineer . Each lift and the upper six ( 6 ) inches of natural soils shall be compacted to at least 85% of max- imum density obtainable in areas designated for planting . Each layer of fill shall be sufficiently roughened after compaction to ensure bonding to the succeed- ing layer . • Bring fills to suitable elevation above required grade to allow for shrinkage and settlement . 300-8 . 4 BACKFILL Trenches and areas adjacent to fo6tingn and found- ations shall not be backfilled until the work is inspected and approved by the Engineer. Excavated material , approved for backfilling , shall be free from large clods , stones and other objectionable materials , exceeding three ( 3 ) inches in diameter ; and deposited in layers not greater than six ( 6 ) inches , brought to .within three ( 3 ) percent of optimum moisture content and compacted fill as specified herein . Prior to planting operations , trenches shall be at the A-16 V cotpacted finish grade ( see Subsection 308-2 . 2 ) . Trenches , thit settle below grade shall be reopened to a depth required for proper compaction, re- filled and compacted to indicated surface eleva- tion allowing for shrinkage and settlement. 308 LANDSCAPE AND IRRIGATION INSTALLATION - a= 308-1 GENERAL Contractor shall provide all labor, materials and equipment necessary to furni$h and install all planting materials and related materials as speci- fied herein , including , but not limited to, soil atiendments , fertilizers and conditioners , itaport soil znd sand and hole excavation , backfill :nix , soil preparation for groundcover areas , relocation of City owned palm trees , planting shrubs , ground- cover and palm trees , guying palms , mulching and clean up operations and plant establishment work. Contractor shall provide and plant the following : Fifty ( 50 ) 5 gallon Raphiolepis ' Springtime ' at 4 ' O.C. in a 'double row 3 feet back of existing Warner Avenue sidewalk starting 6 feet from pro- posed curbs , on each side of driveway . Thirty ( 30 ) shall be planted on the east side and twenty ( 20 ) on the west side . Fifty--five ( 55 ) 5 gallon Raphiolepis ' Springtime ' at 4 ' O.C . in a minimum of a double row along existing block wall at east property at narrowest portion between wall and proposed parking lot. All areas below Raphiolepis and tree well areas shall be planted with Gazania ' Sunrise Yellow' at 12" O.C. and 6" from shrubs , walks , curbs and walls . Nineteen ( 19 ) 5 gallon Melaleuca nesophylla at 10 ' O.C. in a single row 5 feet from and parallel to the existing block wall at east property line . Row to start approximately 35 feet back of exist-- ing Warner Avenue sidewalk. Row to end approx- imately 180 feet north of sidewalk . Nine ( 9 ) 5 gallon Melaleuca nesophylla at 10 feet O.C. in a single row 5 feet from and parallel to existing block wall at east property line. Row to start approximately 15 feet from proposed sidewalk at north end of project and end approx- imately 60 feet south of proposed sidewalk. Serious weed pests blackberry, un anted rhizomatous grasses , .( i.e.utO sedge or,, bitid weed ) shall be„ sprayed with Roundup, as manLfac- tured by Monsanto Co. , or approved equal , at the rate of five ( 5 ) quarts. per acre and left in-.place for , seven '( 7 ) ca'lendar days . Application shall be as recommended by manufactiure' r . As .deteimined by the Engineer, a second application 'of Roundup shall be Made seven (7 ) 'days after the first • app,111cation. With both applications , areas spray- edT;s,hall remain unratered for a minumum of forty- eight ( 48 ) hours . Dead weeds shall,, be removed seven ( 7 ) ;calendar days after second application and dxapo©ed of off-site . 308-2 . 3 . 2 FERTILIZING AND CONDITIONING PROCEDURES Prior to cultivating organic soil amendment shall be spread 2" deep over the entire areas to be planted with groundcover and Raphiolepsis and 15 lbs . of agricultural gypsum, 15 lbs . of 12-12-12 commerical fertilizer , 100 lbs . of agricultural gypsum, 15 lbs . of soil sulfer per 1000 S.F. shall be broadcast evenly over the areas to be planted to ( 4 ) nine inches of soil by suitable equipment operated at approximate right angles in at least two ( 2 ) directions . These procedures shall extend 12" beyond the groundcover areas . Prior to spreading organic soil amendment, soil penetrant ( Pent-A-Vate ) at the rate of 20 gal . per acre shall be sprayed over all planting areas. 308-4 PLANTING Stake plant locations and secure approval from the Engineer before excavating pits , making necessary adjustments as requested by the Engineer. . Exca- vated pits shall have vertical and roughened sides a minimum of twice the diameter of the root ball to 'permit handling without injury or breakage of the roots or root ball . ( 1 ) Pits shall be the depth of the container plus six ( 6 ) inches . ( 2 ) Pits shall be square for boxed materials; circular for container material . ( 3 ) Bottom six ( 6 ) inches of backfill shall be watered and compacted before planting. A-18 Y' BAckfi11 as follows shall be machine -mixed and approved by the Engineer prior to incorporation in planting pits : 6 part of volume On-site coil 4 `parts of volume Nitrol ized Sawdust 1 lb. per CY of mix 12-12-12 Commercial fertilizer 2 lbs . per CY of mix Soil Sulpher UnBui tab 1e soil encountered in excavation shall be dispaeed of off-site and approved import soil shall be provided. Spacing 'of rooted ground cover shall be as indi- cated on the drawing's . Containers shall be opened and removed in such a manner that the plant root ball is not injured . Set plants in center of pits , in vertical position so that crown of plant will be level with finish grade . All shrubs shall be planted per Standard Plan 702 unless otherwise noted herein . Melaleucas shall be set in basing six ( 6 ) inches deep and the bottom shall be level with surround- ing finished grade , Finished grade for treewells shall be 4" below concrete . After all planting operations are completed and prior to mulch placement ' Sulflan ' or ' Ronstar ' shall be applied at the manufacturer ' s recommend- ation in all areas . After all planting operations and herbicide appli- cations are completed, wood chip mulch shall be spread evenly 2" deep over the entire basin bottoms . 308-4 . 5 . 1 PALM TREE PLANTING Palm trees to be relocated are located on the north side of Palm Avenue between 17th Street and Goldenwest Street . Before any excavation work is begun Underground Alert shall be contacted to determine exact loca- tion of any underground utilities that may be located within the parkway areas . A-19 .s' Contractor shall dig out twelve ( 12 ) existing "palm trees locati"d in parkway. areas in the location referenced above and ,tranaport them to the ei:te and plant per these,.Bpecifications in proposed treewells and in, other project site locations as .. ,. directed by the Engineer. Palms in existing tree- wells are not to be removed. After palms have. been removed the excavations shall be backfilled to grade existing surrounding with Class A import soil and compacted to 85% . All debris and rubbish shall be scemoved and dis�po©ed of at a legal duup, site. Area shall be . left in a neat an swept condition. Airy barracading required shall be per the City Standard Specifications and as required by the Engineer. Root ball shall be a minimum of 24"x24"diameter . The plant hole shall be a minimum of 121 all around the sides of the root ball . The bottom of the plant hole shall be excavated 18" deeper than the root ball . Backfill below root ball shall be seven ( 7 ) parts sand and three ( 3 ) parts Class A soil , watered and compacted before palm trees are planted . Sand shall conform to the requirements for Port- land Cement Concrete as specified in Subsection 201-1 . 2 . 1 . Palms after planting shall be as perpendicular to. finished grade s possible . Palm fronds (shall be tied before digging with hemp twine and shall remain tied until directed by the Engineer to remove the ties . Backfill for palms around the sides of the root ball shall be machine-mixed and approved by the Engineer prior to incorporation in plant pits as follows : 6 parts by volume Class 'A' topsoil 4 parts by volume organic amendment 1 pound 12-12-12 Commercial fertilizer per C. Y. of mix 10 pounds agricultural gypsum per C .Y. of mix 2 pounds iron sulfate per C. Y . of mix After initial watering care shall be exercised by the Contractor to avoid overwatering the palms . 308-4 .7 GROUNDCOVER PLANTING A-20 All areas .not planted'`with shrubs shall be :;planted With `cuttings of .Carpobrotus edulis at.,,_18" _ O.C. and 3 feet from . ahruba and other groundcover, curbs , walla and paved surfaces .,.. Carpobrotus cut- tinga may betaken from City. right-or-way as directed by the Engineer at no charge to -the Contractor. No ground cover shall be planted between the Melaleuca shrubs . Carpobrotus edulis cuttings shall be ten ( 10 ) inches or more in length and shall not be rooted. Cuttings shall be insect and disease free tip cut- .tin_gs from, healthy vigorous and strong growing plants . Mature. or brown colored etem ,growths or cuttings which have been trimmed will not be ac- ceptei3 . Cuttings shall be left to 'dry (harden- off ) not less than two ( 2 ) but not more than five ( 5 ) days before planting . After soil preparation operations are completed as specified elsewhere in these specifications , cut- tings shall be planted in neat , straight rows parallel to the adjacent curb or sidewalk. Cut- tings in adjacent rows to the first row shall be staggered to each other . Cuttings shall be planted to such a depth that not less than 2 nodes -are covered with soil . The basal end of Carpo- brotus cuttings shall not be less than 4 inches below the surface of the soil . No Carpobrotus cuttings shall be planted in soil that does not contain sufficient moisture at an average depth of 2 inches below the surface to promote vigorous root development on such cuttings and sustain their growth and development . 308-4 . 9 . 5 WATERING Not more than one hour shall elapse from the time any ground cover is planted until it has been watered . Several consecutive waterings may be necessary to thoroughly saturate the soil around each plant . After initial watering , Corpobrotus cuttings shall be watered only to keep the cuttings barely snoist at a depth of 2 inches . All other plants shall be watered as often and in sufficient amount as conditions may require to keep the soil and plant roots moist during the life of the contract . Should delays be encountered in obtaining power to the controller, the Contractor shall still be re- A-21 sponeible for watering all plant materials as specified herein. Palms and,.., shrubs . shaI l be watered im"mediat'el'y after planting. ,Water. a 411 be applied until the backfil�l ioil �around and below the roots or ball of earth around the roots of each plant is thoroughly saturated. 1 308-5 IRRIGATION SYSTEM INSTALLATION 308-5 . 1 GENERAL Contractor shall provide all labor, materials, and equipment necessary to furnish and install the ir- rigation system as specified herein, including but not limited to irrigation materials and related appurtenances , excavation and backfill of pipe trenches , record drawings , guarantees . permits and licenses , testing and inspections and clean-up operations . Contractor shall provide a minimum of head to head coverage for all spray heads . Spray heads shall be a minimum of 6" from curbs and sidewalks . Gazania areas shall be watered by shrub spray pop-up heads as specified herein. A minimum of two shrub spray pop-up heads shall be provided per treewell . Melaleucas shall be watered by one bubbler head per plant location as specified here- in. Carpobrotus areas shall be watered by using pop-up rotary stream spray heads as specified here in . all spray heads shall be installed per Stan- dard Plan 701 E. Bubbler heads shall be installed per Standard Plan 701 D. Mixing of head types on the same valve will not be perriitted . Quick couplers shall be provided at a minimum of 100 feet along the main supply line . A quick coupler shall be provided no less than 50 feet from the farthest planted area of the parking lot . A gate valve shall be provided immediately after the backflow preventer and mid-way in the main supply line . A master control valve shall be provided between the backflow preventer and the water meter . Line sizes shall be of sufficient size to provide the necessary operating pressure required at the head as recommended by the manufacturer of the type head installed. Line velocity shall not A-22 exceed 5 feet per second . Static pressure 'of 75 PSI at the point of. con- nection shall be used as a criteria for the design of the system. In no case shall any sprinkler circuit controlled by a single valve lose more than .25 PSI between the point of connection and the sprinkler heads controlled by that valve . Backflow preventer shall be installed 3 feet from existing block wall approximatel;: 40 feet from back of Warner Avenue sidewalk and per Standard Plan 701 . Final location shall be determined by the Engineer . Contractor shall provide a 2" capped stub--out for future use between the gate valve and backflow preventer . Contractor shall be responsible for making the necessary applications required by Southern .Calif- ornia Edison Company and the City of Huntington Beach Water Division for providing water and power at the locations as indicated in these specifica- tions and to install name per City codes . Contractor shall be required to request all neces- sary inspections from the appropriate agency for approval of utility installations . Electrical contractor must be at the site for electrical inspections . After Southern California Edison Company and the City inspectors have finalized the work, the Con- tractor shall notify the Engineer immediately so the Engineer can make the necessary arrangements for energizing the electrical meter . The automatic controller shall be energized prior to the beginning of the Plant Establishment Period . The Contractor shall coordinate the installation of all irrigation materials with the construction of site amenities and planting , as indicated on the drawings . All work on the irrigation system, including hydrostatic and coverage tests , operational tests and the backfilling and compaction of trenches shall be performed prig to planting operations . Coets. incurred dve :to any adjustments. for coverage x .,, including,'those requested by the Engineer, rela-. tive:, to the location of irrigation heads as shown on the drawings, shall be the responsibility of the Contractor. 308-5 . 2 QUALITY ASSURANCE All local and state laws , rules and regulations governing or relating 'to any portion of the irrigation system are hereby incorporated into the and. made a part of these .specifications . Nothing contained in these specifications shall be con- s_trued to conflict with a`ny. of the aforementioned rules , regulation's, or requirements . However , when these specifications call for or describe. material workmanship or construction of a better quality , higher standard or larger size than is required by the above rules , regulations Or requirements , these specifications and the drawings shall take precedence . In the event any equipment or methods indicated on the drawings or specified herein conflict with applicable regulations , Contractor shall notify the Engineer in writing prior to installation . Costs for replacement of such , incurred due to the failure tc give such notification, shall be the Contractor'' s responsibility. Due to the scale of the drawings , it is not pos- sible to indicate all offsets, fittings , sleeves , etc . which may be required . Contractor shall carefully investigate the structural and finished conditions affecting the work and install a complete irrigation system within the intent of the drawings and specifications , furnishing such • fittings as may be required . Manufacturers ' specifications and detailed draw- ings shall be followed in cases where the manufac- turers of equipment used in this Contract furnish installation methods not shown in the drawings and specified herein . All materials shall be of new stock and of brands and types noted on the drawings and as specified herein, or approved equal . Approval of any items alternates or substitutes indicates only that the product apparently meets the specifications as indicated on the drawings and herein on the basis A-24 of the information or samples submitted. PVC solvent--weld joints shall be made in accord- ance with, ASTM D-2855 Pipe shall not be exposed to water,. for twenty-four ( 24 ) hours after solvent- weld joints are completed. Trenches shall be of open vertical construction to appropriate depths as indicated on the drawings and specified. herein . PVC pipe shall be laid on a uniform compacted grade, free of rocks or. sharp- edged objects , and snaked from side to side in the trench to allow for expansion and contraction. Teflon tape shall be used on all threaded PVC to PVC, and Ion all threaded PVC to metal joints . Light wrench pressure is all that is required . Brass pipe and fittings shall be ' assembled using Teflon dope, applied to the male threads only . Concrete thrust blocks shall be installed on all pressure main lines wherever there is a direction- al change or as specified by the manufacturer ' s recommendations . 308-5 . 3 SLEEVING Irrigation lines and control wiring shall be installed under paving in separate PVC Schedule 40 sleeves . Sleeves shall be installed with the coverage depths as specified herein . Piping under existing pavement may be installed by jacking , boring or hydraulic driving , except that no hydraulic driving wil ). be permitted under asphaltic concrete pavement . Where cutting or breaking of existing pavement is necessary, obtain permission from the Engineer before cutting or breaking pavement and then make all necessary repairs and replacements to the approval of the Engineer, and at not additional cost to the City . 308-5 . 4 LINE CLEARANCE AND COVERAGE All lines shall have a minimum horizontal clear- ance of six ( 6 ) inches from each other and from lines of other trades . Parallel lines shall not be installed directly over one another . Provide the following minimum coverages for : Pressure mainline 18" Non-pressure lateral lines 12" A-25 Control wiring 18" Where lines "occur under paved areas for vehicular traffic, these coverage depths shall be considered below subgrade . Pilot wires shall be a different color for each valve . Common wires shall be white. Wire shall be buried a minimum of ejjhteen ( 18 ) inches in depth and whenever possible. shall occupy the same trench; bundled and secured to irrigation pipelines at ten- ( 10 ) foot intervals with plastic electrical tape , providing sufficient slack for expansion and contraction. An expansion curl shall be provided within three ( 3 ) feet of each wire connection and .c' hange 'of direction , and at least every one-hundred ( 100 ) feet of . wire length on longer runs . Expansion curler shall be formed by wrapping at least fifteen ( 15 ) turns of wire around a one-half ( 1/2 ) inch outside diameter pipe , then withdrawing the pipe . All splices shall be made with Scotch--Lok #3576 Co:inector Sealing Packs , . Rain Bird Pen-Tite wire connector, or approved equal . Use one ( 1 ) splice per connector sealing pack . Wire splices shall be located in pull boxes . Without prior approval of the Engineer , field splices between the controller and remote control valves will not be permitted . 308-5 . 5 ADJUSTING AND TESTING THE SYSTEM After completion of pipeline assembly , prior to installation of terminal fittings , entire system shall be thoroughly flushed to remove dirt , scale or other deleterious material . Irrigation heads shall be installed only after flushing of the system has been accomplished to the complete sat- isfaction of the Engineer . Contractor shall th--n furnish all equipment, materials and labor to conduct pipeline pressure tests , coverage tests and operational teats . All tests shall be made in the presence of the Engineer , prior to planting operations . Trenches shall not be backfilled until the pipeline Ares- sure tests have been performed to the satisfaction of the Engineer. With open ends capped , test pressure supply lines A-26 for six ( 6 ) hourn at 125 PSI . Center load PVC pipe with . a small amount of backfill to prevent arching and slipping under pressure. Coverge test, shall demonstrate that each .station area is balanced to provide uniform and adequate coverage. Operational tests shall demonstrate the perform- ance and operation of all components of ,the con- troller system. Remote control valves shall be properly, balanced , heads adjusted for coverage and system shall be workable, clean and efficient . Contractor shall be responsible for correcting any portions of ,the work that are not properly installed and retesting until installation has been accepted by the Engineer . 3.08-5 . 7 BACKFILLING Backfilling shall be in accordance with Section 300-8 , Earthwork. .Trenches located under areas where paving or con- crete will be installed shall be backfilled with a six ( 6 ) inch layer of sand below the pipe and three ( 3 ) inches above the pipe , and compacted in accordance with Section 300-8 , Earthwork . 308-5 . 8 MATERIALS TO BE FURNISHED Contractor shall furnish the City the following materials at the end of construction , prior to the end of the Plant - Establishment Period. One ( 1 ) set of special tools required for remov- ing disassembling and adjusting each type of sprinkler and valve supplied on the project . One ( 1 ) quick coupler keys and matching hoof! swivels for each quick coupler valve installed . One ( 1 ) set each approved as-built and record drawings. 308-5 . 9 AS-BUILT AND RECORD DRAWINGS As-built and record drawings shall be prepared in accordance with these specifications in Section 2-5 . 4 . Dimension from two ( 2 ) permanent points of ref- erence (buildings , monuments , sidewalks , curbs , A-27 pa,vement ) of the location of the following items . (1 ) Point 'of connection to existing water lines . .( 2 ) Gate valves. ( 3 ) Routing of irrigation. pressure lines (dimensions , maximum 25 ' along route ) . (4 ) Remote contidl valves . . ( 5 ) Routing of control valves and wires . ( 6 ) Quick coupling valves . ( 7 ) Other related equipment as requested by the Engineer. Locations shown,.on as-built drawings shall be kept day to day as the project is being installed. 308-6 . 1 . 7 GUARANTEE Relocated palms along with all .o'her ' installed plant materials shall be guaranteed as specified in Section 2-4 . 2 of the Specifications . Replacement palms shall be the same variety and same brown trunk height as the replaced palm. Re- -placement palms shall be '°rom a . source as approved by the _ Engineer and shall . � from within 30 miles from the coast. The root ba. l shall . be the mini- mum size as specified herein . ?eplanting shall conform to Section 308-4 . :, 1 of these Spec- ifications . 308-8 MEASUREMENT AND PAYMENT Measurement for payment `purposes shall 'be accordance with Subsection 9-1 . The lump suiu or unit prices net forth in the Contract Documc ` s shall include full compensation for ,furnishing al labor , materials , tools and equipment and .perform- ing all' work necessary to complete the landscape and irrigation installation work and to maintain the landscape and irrigation work during the plant establishment and as described in the Contract Documents . FOR DESIGN OF PARKING LOT AND BOAT 'BOARDING FACILITY IN HUNTINGTON HARBOUR 44. THIS AGREEMENT is made and entered into on this day of r 1985 , by and between the CITY OF HUNTINGTON BEACH, a municipal corporation of the State of California, hereinafter referred to as "CITY, " and RMG ENGINEERING, INC. , a California corporation, hereinafter referred to as "CONTRACTOR. " WHEREAS , CITY desires to engage the services of an enqineer to design and provide plans and specifications for a parking lot and boat boarding facility in the Huntington Barbour Channel adjacent to Warner Avenue , in the City of Huntington Beach, California; and, CONTRAcrOR has been selected and is to perform said services , 14011, THEREFORE, it is agreed by CITY and CONTRACTOR as follows : 1. WORD STATEMENT CONTRACTOR shall provide all engineering services as described in the Request for Prow sal an;' Statement of Qualifications (hereinafter referred to as Exhibit "A" ) , which is incorporated into this agreement by this reference . Said services shall sometimes hereinafter be referred to as "FF.OJECT. " CONTRACTOR hereby designates JOHN K. MANDRELL, who shall represent it and be its sole contact and agent in all consultations with CITY during the performance of this Agreement . 2 . CITY STAR' ASSISTANCE CITY shall assign a staff coordinator to work d-.rectly with CONTRACTOR in the prosecution of this Agreement. � l) w 3. TIME OF PERFORMANCE Time is, of the essence of this. Agreement. The services of the CONTRACTOR are to commence as soon as practicable after the execution of this Agreement aiid all tasks specified in Exhibit "A" shall be completed 'no later than six ( 6) months from the date of this Agreement. These times may be extended with the written permission of the CITY. The time for performance of the tasks identified in Exhibit "A" are generally to be as shown in the Scope of Services on the Work Program/Project Schedule . This schedule may be amended to benefit the PROJECT if mutually agreed by the CITY and CONTRACTOR. 4 . COMPENSATION In consideration of the performance of the enginperinc services described in Section 1 above, CITY agrees to pay CONTRACTOR a fee of Twenty-Six Thousand, One-Hundred Dollars ( t26, 100.00 ) . 5. EXTRA FORK In the event of authorization, in writing by the CITY, of changes from the work described in Exhibit "A" , of for other written permission authorizing additional work not contemplated herein, additional compensation shall be allowed for such Extra Work, so long as the prior written approval of CITY is obtained . 6 . METHOD OF PAYMENT A. CONTRACTOR shall be entitled to progress pay- merits toward the fixed fee set forth in Section 4 herein in accordance with the progress and payment schedules set forth in Exhibit A" . H. Delivery of work product : A copy of every technical memo and report prepared by CONTRACTOR shall be submitted to the CITY to demonstrate progress toward completion of tasks. In the event CITY rejects or has com- ments on any such product, CITY shall identify ( 2 , 3 1 specific requirements for satisfactory completion.. Any such product which has not been formally accepted or rejected by CITY shall be deemed accepted . C. The CONTRACTOR shall submit to the CITY 6n invoice for each progress payment due . Such invoice shall : 1) Reference this Agreement; 2) Describe the services performed ; 3 ) Show the total amount of the payment due; 4 ) Include a certification by a principal member of the CONTRACTOR' S firm that the work has been performed in accor-- dance with the provisions of this Agreement; and , 5 ) For all payments include an estimate of the percentage of work completed . Upon submission of any such invoice , if CITY is satisfied that CONTRACTOR is making satisfactory progress toward completion of tasks in accordance with this Agreement , CITY shall promptly approve the invoice , in which event payment shall be made within thirty ( 34) days ' of receipt of the invoice by CITY. Such approval shall not be unreasonably withheld . If the CITY does not approve an invoice, CITY shall notify CONTRACTOR in writing of the reasons for non-approval , within seven ( 7 ) calendar days of receipt of the invoice, and the schedule of performance set forth in Exhibit "A" shall be suspended until. the parties agree that past performance by CONTRACTOR is in, or has been brought into compliance , or until this Agreement is terminated pursuant to Section 12 hereof. D. Any billings for extra work or additional services authorized by the CITY shall be invoiced separately to the CITY. Such invoice ( 3 ) shall ' cont~ain all of the information required under paragraph 6C, and in addition shall list the hours expended and hourly rate charged for such time . Such invoices shall be approved by CITY if the work performed is in accordance with the extra work or additional services requested, and if CITY is satisfied that the statement of hours worked and costs incurred is accurate . Such approval shall not be unreasonably withheld . Any dispute between the parties concerning payment of such an invoice shall be treated as separate and apart from the ongoing performmance of the remainder of this Agreement . 7 . DISPOSITION OF PLANS, ESTIMATES AND OTHER DOCUMENTS CONTRACTOR agrees that all materials prepared here-- under, including all original drawings, designs , reports, both field and office notes , calculations, maps and other documents , shall be turned over to CITY upon termination of this Aareement or upon PROJECT completion, whichever shall occur first . In the event this Agreement is terminated , said materials may be used by CITY in the completion of PROJEM or as it otherwise sees fit . Title to said materials shall pass to the CITE` upon payment of fees determined to be earned by CONTRACTOR to the point of termi- nation or completion of the PROJECT , whichever is applicable. CONTRACTOR shall be entitled to retain copies of all data prepared hereunder . 8. INDEMNIFICATION, DEFENSE, HOLD FIARMLESS CONTRACTOR hereby agrees to defend , indemnify and hold harmless. CITY, its officers , agents and employees , from and against any and all liability, damages, costs, losses, clasins and expenses , 'however caused, resulting directly or indirectly from or connected with CONTRACTOR ' S negligent acts, willful misconduct or negligent performance of this Agreement ( including, but not limited ( 4 ) to such liability, costs, damage, loss, claim, or expense arising from the death or injury to an agent or employee of CONTRACTOR, subcontractor , if any, or CITY, or damage. to the property of CONTRACTOR, sub,--ontractor, if any, or CITY, or the property of any agent, or employee of CONTRACTOR, subcontractor, if any, or CITY) , regardless of the passive or active negligence of CITY, except Where such liability, damages, costs, losses, claims or expenses are caused by the sole negligence or willful misconduct of CITY or any of its agents or employees including negligent omissions or commissions of CITY, its agents or employees , in connection with the general supervision or direction of the work to be performed hereunder . :9 . WORKERS ' COMPENSATIO14 CONTRACTOR shall comply with all of the provisions of the Workers ' Compensation Insurance and Safety AcL•s of the State of California , the applicable provisions of Division 4 and 5 of the California Labor Code and all amendments thereto; and all similar state or federal acts or laws applicable ; and shall indem- nify, defend and hold harmless CITY from and against all claims , demands , payments , suits , actions , proceedings and judgments of • every nature and description, including attorney ' s fees and costs presented, brought o. recovered against CITY, for or on account of any liability under any of said acts which may he incurred by reason of any work to be performed by CONTRACTOR ender this Agreement . 10. INSURANCE In addition to the Workers ' Compensation Insurance and CONTRACTOR' S covenant to indemnify CITY, CONTRACTOR shall obtain and furnish to CITY the following insurance policies covering the PROJECT : A. General Liability Insurance. A policy of general public liability insurance , including motor vehicle coverage . Said policy shall indemnify CONTRACTOR, its officers , agents and ( 5 ) t employees , while acting within the scope `of their `duties , against any and all claims 'of arising out of or in corinecticin with the 'PROJECT, acid shall provide coverage in not less than the following amount. combined single limit bodily injury or property damage of , $300, OOO per occurrence . Said policy shall name ^ITY, its officers and employees as Additional Insureds and shall specifically provide that any other insurance coverage which may be applicable to the PROJECT shall be deemed excess coverage and that CONTRACTOR' S insurance shall be primary. B. Errors and Omissions Insurance . CONTRACTOR shall acquire an errors and omissions insurance policy covering the work performed by it here- under . Said policy shall provide coverage for CONTRACTOR' S errors and omissions in an amount of not less than $250, 000 . Certificates of Insurance for said policies shall be approved in writing by the City Attorney prior to the commencement of any work hereunder . All Certificates of Insurance (and the policies of insurance or endorsements thereof) shall provide that any such Certificates and policies shall not be cancelled or modified without thirty ( 30 ) days ' prior written notice to CITY. R 11 . INDEPENDENT CONTRACTOR CONTRACTOR is , and shall be , acting at all times in the performance of this Agreement as an independent contracL•or . CONTRACTOR shall secure at its expense, and be responsible for any and all payments of all taxes , social securi::y, state disability insurance compensation, unemployment compensation and other pay- roll deductions for CONTRACTOR and its officers , agents and employees and all business licenses , if any, in connection with the services to be performed hereunder . (6 ) 12 . TERMINATION OF AGREEMENT All work required hereunder shall be performed in a !good aid workmanlike manner . CITY may terminate CONTRACTOR' S services hereunder at any time with or witout cause, and whether or not PROJECT is fully complete . Any termination of this Agree- ment by CITY shal'1 be made in writing through the City Engineer, notice of which shall be delivered to CONTRACTOR as provided in jSection 16 herein. 13 . ASSIGNMENT AND SUBCONTRACTING This Agreement is a personal service contract and the supervisory work hereunder shall not be delegated by CONTRV",,0_ R to arhy other person or entity without the consent of CITY. 14. COPYRIGHTS/PATENTS CONTRACTOR shall not apply for a patent or copyright on any item or material produced as a result of this Agreement, as set forth in 41 CFR 1-9 . 1 . 15 . CITY' EMPLOYEES AND OFFICIALS CONTRACTOR shall employ no CITY official nor any regular CITY employee in the work performed pursuant to this Agreement. In accordance with California Government Code Sections 1090 et seq. , but subject to the exceptions therein set forth, no CITY official or employee shall be financially interested in nor derive any financial benefit , either directly or indirectly, from this Agreement. 16 . NOTICES Any notices or special instructions required to be given in writing under this Agreement shall be given either by personal delivery to CONTRACTOR' S agent (as designated in Section 1 hereinabove) or to CITY' S Director of Public Works , as the 'situation shall warrant, or by e'nclosi.ng the same in a sealed envelope , postage prepaid , and depositing the same in the United States Postal Services, addressed as follows : ( 7 ) r., TO.
