JEFFREY - 1976-03-22 CONTRACT OF SALE THIS AGREEMENT, made and entered into this 22nd day of March, 1976 by and between ROBERT JEFFREY, herein- after called "SELLER," and CITY Or HUNTINGTON BEACH, herein after called "BUYER," W I T N E S S E T H: 1. The SELLER transferred and delivered to BUYER on Nove•nber 10, 1975, the following described aniw-l: One German Shepard dog, named "Nik, " approximately f ..ve years of age, predominately white in dolor with black ears, muzzle and saddle. 2. BUYER hereby ag'cees ;o pay One Dollar ($i.00) for the dog and undertakes to ac.:ept the dog in accordance with the terms of tnis- contract. 3. It is agreea that identification shall not be deemed to have been mane until both BUYER and SELLER have agreed that the dog in quc_:.i,r -a to be, appropriated to the performance of the contract with BUYER. 4. BT7YER shall pay for the dog at the time when and at the place where the dog is received by him. 5. The dog shall be deemed received by BUYER when delivered to 'iim at Huntington Beach Police 1Mpartment, 2000 Main Street, Huntington Beach, Cal-ifor^ia 9264.8. 6. SELLER FURVIEF warrants that at the time of the sign- ing of this contract, he neither knows or has reason to know of 1. r, the existence of any outstanding title or claim of title hostile to his richts to the dog. 9, BUYER shall have the right to examine the dog on arrival, and within five (5) business days after such delivery, he must give notice to SELLER of a:iy claim for damages on acacounr- of the health or condition of the dog, and must specify the basis of his claim in detail. Failure of BUYER to comply with these rules shall constitute irresrocable acceptance of subject dog. 10. BUYER agrees that if SELLER terminates his current assignment as a Y,-9 .Handier with the Huntington Beach Police Depart- ment for any reason, SELLER shall have the right to re-purchase the dog for One Dollar ($1,00) as long as such right to re-purchase is exercised within thirty (30) days of the termination of SELLER'S employment.
