STATEMENT OF ISSUE:
It is necessary to amend the contract with Ron Yeo, Architect, Inc. for the cost of
additional work required by the City during the design development of the pier buildings
and the construction drawing phases for the life guard tower and public restrooms.
RECOMMENDED ACTION:
Approve Amendment No. 4 to the contract with Ron Yeo, Architect, Inc. in the amount of
$13,500 for services rendered that are outside the conditions of the present agreement.
ANALYSIS:
The City contracted with Ron Yeo, Architect, Inc. to assist the Pier Design Committee in
developing the five pier buildings through the design development stage, to provide the
construction drawings for the life guard tower and public restrooms and to provide
architectural support services during the bidding and construction phases for the tower and
restrooms.
During the development of the design for the restaurant, the architect was directed to
coordinate the building layout with the anticipated tenant, Ruby's Restaurant. Additional
meetings were required of the architect with the tenant and Health Department to settle
issues relating to the design. The number of meetings required to finalize the design
development stage for all the buildings also exceeded those anticipated in the existing
agreement. The architect's fee for these additional meetings is $5,000.
A design modification to the stairways for the life guard tower was required by the City
Building Department and Community Services requiring several additional meetings and
additional work by the architect to make revisions to the completed plans. The architect's
fee for this work is $8,500.
The remaining services yet to be performed by the architect on the present agreement are
for support services during the bidding and construction of tower and the restrooms.
These fees are included in the existing agreement.

THIS AMENDMENT NO. 4 is entered into this / day
of , 1993, by and between the CITY OF HUNTINGTON
BEACH, hereinafter referred to as "CITY, " and RON YEO, FAIA
ARCHITECT, INC. , hereinafter referred to as "CONTRACTOR. "
WHEREAS, since the original agreement dated February 21,
1989, and Amendments 1, 2 and 3 , it has been determined by the
parties that additional work and payments therefor are required
to complete the project.
NOW, THEREFORE, IT IS AGREED by and between CITY and
CONTRACTOR that paragraphs 1 (WORK STATEMENT) and 4
(COMPENSATION) are amended by adding the following:
1. Work Statement is amended to add the services described
in Exhibit "E, " which is attached hereto and incorporated into
this Amendment No . 4 by this reference.
2 . Compensation shall be further increased by' an amount
not to exceed Thirteen Thousand Five Hundred Dollars ($13, 500) .
This amount is to be added to the amended agreement cost of One
Hundred Forty-Three Thousand, Three Hundred Dollars ($143,300)
for a total amended project cost of One Hundred Fifty Six
Thousand, Eight Hundred Dollars ($156, 800) .

3 . Except as specifically modified herein, all other terms
and conditions of the Agreement shall remain in full force and
effect.
IN WITNESS WHEREOF the parties hereto have executed this
Amendment No . 4 as of the date hereinabove set forth.
