your records.

Dear Council Members:
At the November 1, 1976 meeting the City Council
approved the purchase of proper-<.y from Ms. Pietrzak
for street improvements at the northwest corner of
Bolsa Chiea and Pearce Street. Ms. Pietrzak accepted
the terms as outlined in my letter and has signed the
attached contract prepared by the City Attorney's
office.
It is recommended that the City Council approve
the contract and authorize the Mayor and City Clerk
to execute same.

CONTRACT FOR THE SALE OF LAND
Roxanne Pietrzak, a single woman, of 417 Ocean Avenue,
Apartment 3, Seal Beach, California, 90740, herein called "Seller,"
agrees to sell to the City of Huntington Beach, a municipal
corporation, in Orange County, California, herein called "Buyer,"
and Buyer agrees to ptrchase from Seller the real property,
herein called "said property;" in the city of Huntington Beach,
Orange County, California, described as follows:
Lots 143, 144, 145 and 146 of Tract 187 as
shown on a map recorded in Book 12, page 30,
Miscellaneous Maps, Records of Orange County,
on the following terms and conditions:
The purchase price for said property shall be the sum
of Twenty Thousand Dollars ($20,000), payable by Buyer to Seller
as follows :
The sum of Twenty Thousand Dollars ($20,000) on execution
of this Contract, less prorated real property taxes levied or
assessed against said property as shown on the latest available
tax bills, receipt of which is hereby acknowledged by Seller.
Buyers obligation to purchase said property purouant
to this Contract is conditioned on the cony ance to Buyer of
good and marketable title to said property, as evidenced by a
standard form C.L.T.A. title insurance policy the full amount

located in Huntington Beach, California, subject only to such

liens, encumbrances, clouds, or conditions as may be approved in
writing by Buyer. The full cost of securing the title insurance
policy shall be paid by Seller. The cost of recording the grant
deed required to convey title to said property to Buyer shall be
paid by Buyer.
Should any litigation be commenced between the parties
hereto concerning said property, this Contract, or the rights and
duties of either in relation thereto, the party, Buyer or Seller,
prevailing in such litigation shall be enti"pled, in addition to
such other relief as may be granted, to a reasonable sum as and
for his attorneys fees in such litigation which shall be determined
by the court in such litigation or in a separate action brought
for that purpose.
This instrument contains the entire agreement between
Buyer and Seller respecting said property, and any agreement or
representation respecting said property or the duties of either
Buyer or Seller in relation thereto not expressly set forth in
this instrument is null and void.
