By my signature hereunder, as Contractor, I cer'-ify that I am aware of the provisions of Section 3700 of the Labor Code width require every employer to be insured against liability for workmen's compensation or to undertake self-insurance in accordance with the provisions of that code, and I will conmpl.v with such provisions before commencing the performance of the work of this contract. Contractor further agrees that said payment by City shall include all payments for all loss or damage arising out of the nature of the work aforesaid, or from: the action of the elements, or from any unforeseen difficulties or obstructions which may arise or be encountered in the prosecution of the work until its acceptance by the City, and for all risks of every description connected with the work; also for all expenses incurred by or in consequence of the suspension or discontinuance of work and for well and faithfully completing the work, and the whole thereof, in the manner and according to the plans and specifica- tions, and the requirements of the Engineer under them. It has now become apparent that the old City Hall building should be demolished and that the present Is probably the best time to bring this project to completion. A. Reasons why subject building should be demolished: 1 . It has been apparent for a number of years that the subject building was in the dangerous building category as defined by City ordinance. This was re- affirmed in January, 1973 by our own building department and the City was Informed at that time that the problem should be solved Immediately ( See attached memorandum) . 2. It was previously estimated that the project would cost in the neighborhood of $45 - 50,000 to accomplish. This was based on estimates provided by an established demolition contractor. Because of the present economic condition it would appear that the present is the best time to proceed with demolition. This has been amply demonstrated by the bids received - low bid being $4,780.00. 3. Exposure to liability continues to exist merely by the City permitting the building to stand. There have been several occasions where the building has been broken into and, in at least one instance, an attempt was made to set fire to the building. 4. Because of the "dangerous building" situation it would not be feasible to re- occupy the building. 5. Police patrol , replacement, of barricades, and periodic building checks by Public Works personnel would be eliminated thus reducing any relative costs. '• David D. Attached are copies of some correspondence from me on this subject from January and July of 1973. Visual Inspection of the building very clearly shows that there are some serious structural deficiencies. Substantial settlement has occurred and the interior of the building contains a variety of cracks as a result. Early in 1973 the floor was opened up and It was apparent that the ground had either settled or been washed away from under a number of the Interior supports. In view of the above, the building is, In my opinion, very clearly a dangerous building as defined In our Dangerous Building Code. A qualified architect should also be asked to review for cultural significance. Additional Information: 1. An economic study should be conducted to determine if it is feasible to rehabilitate this building for safe occupancy, with the intent of leasing the premises. 2. .
