JONES II, Director of Public Work P 'SUBJECT: Authorize the Public Works Director to Sign etter of Approval to Hang Banners on Beach Blvd., Edinger to Adams Statement of Issue,Funding Source,Recommended Action,Alternative Action(s),Analysis,Environmental Status,Attachment(s) Statement of Issue: City Council action is needed to authorize the Public Works Director to sign the Southern California Edison (SCE) letter regarding the use of SCE streetlight poles for banners. The City of Huntington Beach has requested permission from SCE to use streetlight poles to hang banners to decorate Beach Boulevard from Edinger Avenue to Adams Avenue. SCE provided a letter granting permission with the condition that the City sign a letter agreeing to five conditions detailed in their letter of August 2, 1997, which is attached. Funding Source: None as a result of this action. Recommended Action: MOTION TO: .Authorize the Public Works Director to sign the SCE letter dated August 25, 1997 regarding the use of SCE street light poles for decorative banners. Alternative Action(s): Deny authorization for the Public Works Director to sign the SCE letter. i R IQUEST FOR COUNCIL ACTIO MEETING DATE: 10/6/97 DEPARTMENT ID NUMBER: ED97-43 Analysis: The City of Huntington Beach has been working with the Huntington Beach Auto Dealers Association on a decorative banner program on Beach Boulevard from Edinger to Adams Avenue. The Auto Dealers have agreed to purchase banners and hardware. The City agreed to provide the installation by Public Works personnel. In order for this program to be implemented, approvals from SCE, the City and the CalTrans District 12 are needed. CalTrans will only accept an encroachment permit request that includes approvals from SCE and the City. SCE approval requires that the City sign a letter agreeing to their conditions, which are listed in the attached SCE letter dated August 25, 1997. The City signed a similar letter in 1995 for banners located in other parts of the City. The City Attorney has approved the letter agreement as to form. The Southern California Edison Company shall be held harmless and indemnified against all loss, expense;claims, actions;cause of action,damages, cost or liabilities, Including court costs and attomey fees, for injuries to or death of any person(s) including employees, agents and contractors of Edison,arising out of or resulting in any manner whatsoever from the attachment, Installation, maintenance and/or removal of banners and assemblies on Edison-owned street light poles. 2. It is understood and agreed that should a street light pole be crushed, cracked, deformed or damaged in any other way by the attachment of such material,the City will reimburse Edison for any expenses for corrective action required including, but not limited to,the replacement of the street light pole. 3. It is agreed that said special occasion banners and assemblies shall be approved by the Southern California Edison Company prior to attachment or Installation, and shall be installed and maintained by the City in a good,safe and workmanlike manner and in compliance with all applicable laws,rules, regulations,ordinances,and decrees of all lawable laws, regulations, ordinances, and decrees of all lawfully constituted federal, state,county, or city legislative bodies,administrative agencies,or tribunals pertaining thereto,including General Order No.95 of the Public Utilities Commission of the State of California, and the California Occupational Safety and Health Act. 4. It is also understood and agreed that the special occasion banners and assemblies,while being displayed,shall dear any overhead street lighting conductor by a minimum of ten (10)feet and the traveled roadway by fifteen(15)feet, with a maximum size of 3X6 for each banner. r U3/y7 WBll 07:32 FAX 8002 4265 CSD G01 RX 390B Q003 Mr.Mike Uberuaga August 25, 1997 Page 2 5. The City agrees to remove all such special occasion banners by November 1 1998. Should the City fail to remove such material by the specified date,the City hereby authorizes Edison to remove such material and agrees to reimburse Edison for such removal and storage costs. It is agreed that the BrackettBand portion will remain on these poles for future approved use. This authorization is granted to attach special occasion banners on a temporary basis from November 1, 1997 to November 1, 1998, to Edison-owned street light poles upon receipt by the Edison Company of one copy of this letter signed by a duly authorized official of the City of Huntington Beach.
