WHEREAS, "CITY" has acquired property for park purposes in the vicinity of tuntingbon and Yorktown, and development will. not take place immediately, and WHEREAS a single family residence is located on a portio1 of the property, and the "CITY" is desirous of renting said re!iidenc:e on a month to month basis until improvement cf tie park project can comme. cce; NOW THEREFORE parties hereby agree as follows : 1. DESCRIPTION OF PREMISES: CITY hereby rents under terms and conditions set forth herein a single family_ residence located at 2118 Huntington Street , to TENANT and TENANT accepts premises. TERM: The term of this lease shall be month to month. 3. RENT: Monthly rental shall be $425.00 dt_e and pay- able in advance on the first day of each month. If rent is not paid on or before the 10th of each ,month a 1.0 % penalty -5hall be applicable. City will pay any possessory -nterest tax assessed,- 4 SECURITY DEPOSI' S: TE14ANTS shall, pay the first and last months rent upon execution of this lease. In addition thereto, TENANT'S skull pay the sum or $200 00 as a security deposit for the p�xformance of the conditions of this lease. If at any time during t'. e term hereof, TENANT fails to perform any of the conditions the Lease, or causes damage to the premiserm or fails to leave the dwelling in a reasonably clean condition upon termination, then CITY may appropriate and apply any port,on of the security necessary to make the repairs or clean the premises. J OC:prh 2,/28/7g 1. 5. MAINTENANCE; TENANT shall maintain premises including landscaping in good condition. If TENANT fails to maintain the ' premises. CITY, may at its option, perform necessary maintenance and bill TENANT for the cost of services rendered, and. TENANT shall reimburs4 CITY for the cost thereof within 10 days after receipt of billing. 6. INDEMNIFICATION: During the term of this tenancy , TENANT ,agrees to indemnify, defend, and save CITY harmless from any and all claims arising from any act, omission or negligence of TENANT or his agents or employees arising from any accident, injury or damage whatsoever caused to any person or property occuring in on or about the leased premises, and from any and all cost, expenses, or liability incurred in cciinection with any such claim or proceeding. 7. ALTERATIONS DURING TERM OF TENANCY: TENANT ,shall not make any alterations to the premises without the written con- sent of CITY, and shall use the premises for residence purposes only. 8 ASSIGNMENT, REENTRY: TENANT shall not asaign the lease or sublet the premises except with the written permission of the CITY, and CITY expressly reserves the right of reentry .for any violation of this section or other conditions of lease, and CITY reserves the right to reenter and inspect the premises at all r—sonable times 9 LIMITED DURATION OF TENANCY IN TERMINATION NOTICE: Either party may terminate this lease by 30 days written notice to the other party. In executing an(-' entering this tenancy, TENANT has been informed and is aware that said tenancy will only be for an interim period, and that the maximum duration of the lease will be until such time as CITY develops the subject property for park purposes . R Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions: �G STATEMENT OF ISSUE: The City of Huntington Beach recently purchased the 1 .1 acre Foxx parcel within the "Old Town" park site on Huntington Street south of Yorktown. The property contained a three bedroom home, which was vacant at the time of pure{lase. The house was inspected by Public Works staff and determiners it could be repaired, painted and landscaped at an estimated cost of $1 ,035. In that three parcels of property within"Old Town" park are under eminent domain proceedings and awaiting a court date for acquisition, staff recommends that the house be restored and a lease format be approved to allow the house to be occupied until the City is ready to develop the park. RECOMMENDATION: That City Council authorize the expenditure of 035 for restoration of the Silva House Th y p $1� and approve the attached rental/lease format: ANALYSIS: Having the house occupied would alleviate vandalism on the house and curtail it on the adjacent City property. The expenditure for repair, painting and landscaping would be recouped within 'Viree months and the remaining rental would provide income to the City at $425 per month until the park is devalopcd. FUNDING SOURCE: City General Fund, account number Z5144C. RECOMMENDATION: That City Council approve the attached lease agreement between the city and Sheryi Anne Long. ANALYSIS: The house was finally restored the middle of August 1979. We have tentatively rented the house subject to the City Council approval. It iS required that after a tenant is approved, the lease must be returned to City Council for final acceptance.
