HomeMy WebLinkAboutSIGNAL LANDMARK, INC. - 1973-06-12 Y� AGREEMENT This Agreement is made between the CITY OF HUNTINGTON BEACH, hereinafter referred to as "CITY", and SIGNAL LANDMARK, INC. , hereinafter referred to as "SIGNAL" . WHEREAS, SIGNAL has a leasehold interest and option to purchase in and to certain real. property, more fully described in EXHIBIT A attached hereto and by reference made a part hereof, and CITY desires to acquire the same, NOW, THEREFORE, IT IS AGREED that SIGNAL will sell and CITY will buy the real property set forth in EXHIBIT A attached hereto upon the following terms and conditions : 1. The value of the property shall be mutually agreed upon by the parties. If they cannot agree, they may agree t to mutually appoint an independent appraiser. If the parties cannot agree upon an independent appraiser, each party will appoint an appraiser, and if the two appointed appraisers cannot agree, they will appoint a third independent appraiser and the parties hereto agree to be bound by their decision. 2. The consideration by the CITY will be by credits to SIGNAL for drainage fees . The credit shall be applicable to land of SIGNAL: adjacent to the subject property and within the same quarter section Drainage fees to SIGNAL on said property shall not exceed Three Thousand Dollars ($3,000) per acre . 1. On motion by Green, the following items were approved as recommended by the following roll call. voter ' AYES: Councilmen: Shipley, Bartlett, Gibbs, Greela, Coen, Duke, Matney NOES: Councilmen: None ABSENT: Councilmen: None AGREDH•;JT - SIGXAL LANDMARK : APPROVED The City Clerk presented an agreement between the City of Huntington Beach and Signal Landmark Company for the acquisition of a 10 to 11 acre parcel at the base of the. bluff north of Adams Avenue, east of Beach Boulevard for a drainage retention basin and marsh. Councilman Shipley inquired as to when the rest of the property would be deeded to the City and whether the Newland ranch house would be moved from the site, an4 the City Administrator informed him that plans were to relocate the house in the same area, unless other a.riaagements are made. The Recreation and Parks Director reported on the proposed development for the area stating that it was the developer's intention to develop the area without damaging the appearance of the hill. He stated that the developer had indicated that they would like the house moved approximately 150 feet to the southeast of its present location, however, no decision had been reached, but when the committee reaches a final endorsement of the plan, it will be presented to the Council. On motion by Shipley, Council approved the agreement between the City and Signal. Landmark Company for the acquisition of 10 to 11 acre parcel of land a,t the base of the bluff ;:orth of Adams Avenue, east of Beach Boulevard for a drainage retention basin and marsh, and authorized the Mayor and City Clerk to execute same on behalf of the City. The value of the land will be applied as credit towards future drainage fees of the adjacent property upon its development. Transmitted herewith is art agx,:�Qment whereby Signal agrees to dedicate their leasehold interezt with the establishment of a trust fund to guarantee the City a fee ownership at a later data. This is the manner in which the City is acquiring right of way for public streets in this area. This agreement, tv .th a follow-up execution of a deed, will fulfill a condition between the City and Orange County Flood Control District whereby the District will construct a $700, 000 storm drain and pump station if the City will acquire the 10 plus acres. it is recommended that your Honorable Body approve the agreement and authorize the Mayor and City Clerk to execute same.
