Beach; and In order for Signal_ to be able to service its walls, it is desirable that said fence be erected in a poz--- Lion of the st-•te right-of-way on the northeasterly side of Pacific Coast Highway aad The State of Ca-lifornia, Division of Highways has a consented to the above encroachment on certain conditions set out in Encroachment Permit #768-E-768449 which the Divi- sion of Highways issued to the City of Huntington Beach. NOW, THEREFORE, the parties hereto for the mutual covenants herein contained do hereby mutually agree as follows: 1. City of Huntington Beach hereby authorizes and directs Signal as its agent solely for the purposes of, and under, the Encroaclunent Permit, to erect a fence in that portion of the -.1acific Coast Highway described in Encrrachment Permit #768-E-768449, a copy of which is attached hereto and made a part hereof. 2. Signal agrees to erect said fence upon behE-f of the City of Huntington Beach at its own expense and to comply with all provisions and conditions including the time for performance, of the Encroachment Permit referred to in this agreement Signal further agrees to hold City harmless from all liability and costs which may be incurred by City i I i after the date of this agreement, as a result of Signal's erection or failure to erect said fence, or perform or failure to perform any and all provisions and conditions in the Encroachment Permit referred to herein. (2) All existing traffic; lanes in each direction along the State High- way shall be unobstructed and open to traffic . (3) It is understood that no improvements other than those covered under Items "A`-0 thru "D" of this permit are authorized to encroach into the Highway right of way. It is further understood that the area to be occupied by the fence and landscaping may be required for future lUghwray purposes and the Permittee hereby agrees to remove same at his expense, at such time as the area is so ndeded. It is State policy to not enter into such an agreement with individuals or private companies. In order to accomplish the project it was necessary for the State to enter into an agreement with. the City, making the City responsible for the work and the City in turn would enter into an agreement with Signal Oil and Gas Company transferring the obligations to that company. Accordingl , an agreement was prepared by the City Attorney s office authorizing and directhig Signal Oil and Gas Company to erect a fence and to install landscaping as prescribed in the Di, 'sion of Highways Encroachment -Permit No. 768-E-768449. If the City Council approves the agreement, it is suggested that. you authorize the Mayor and the City Clerk to execute same.
