12 The terms and conditions upon which said franchise is to be
13 granted are as follows:
14 1. (a) The word "Grantee" wherever used herein shall mean and
15 include Grantee and its successors and assigns.
16 (b) The word "County" wherever used herein shall mean the
17 County of Urange.
18 (c) The words "franchise property" as used herein shall
19 mean, all property constructed, installed, operated or maintained, in any
20 public highway pursuant to any right or privilege 91,an ted by this fran--
21 chise.
22 2. The pipes, pipe lines, attachments, appurtenances and
23 appliances constructed, erected or maintained and operated under -this
24 franchise shall be built and constructed in a good and workmanlike
25 manner and of first class mate-ial, and any and all pipe lines located
26 or maintained under this franchise shall be so placed as not to inter-
27 fere with the use of said public s-fseets, alleys, highways and other
28 public places by the traveling public or for public purposes; and in:
29 laying said pipe lines, the Grantee shall. make and backf: ll all excava-
30 tions in such manner and way as to leave the surface of the public
31 street, alley, highway or public place :Ln as good a cond.i : on as it was
32 prior to said excavation, as well as to conform to the s'.ato;:es of the

1 State of California and County Ordinances of the County of Orange, in-
2 eluding Ordinance No. 563 of the County of Orange, as amended, or any
3 ordinance which may supersede said ordinance, relating to the excava-
4 Lion of and obstruc-F.ion in County highways, and such instructions and
5 directions as the Board o- supervisors may, by ordinance or resolution
6 require. The work to erect or lay said system shall be commenced in
7 good faith within not, more .han four (4) months from the granting of

10 3. The Grantee shall have the right to construct, repair, enlarge
11 and renew the pipe lines when and after: they areinscalled but only
12 when and after such construction, renewal, enlarginti or repair plans
13 shall first have been submitted to the road Commissioner of the County
14 of Orange pursuant to Ordinance No. 563, as amended, or any ordinance
15 which may supersede said ordinance, and been approved by the Road
16 Commissioner.
17 4. The County of. Orange reserves the right to improve any high
18 way or portion thereof over and within which this franchise is granted,
19 including the widen.Lng, change of grade, repair, construction or recon-
20 struction of such highways, or arty portion thereof, and it is further
21 reserved to the County of Orange and any municipal corporation, political
22 subdivision, or public district within the County of Orange; the right to
23 construct, reconstruct, install, repair and maintain in any such high-
24 ways, or portion thereof, any public improvement. Within thirty (30)
25 days afrer receipt of a notice in writing by the Grantee of the fact
26 that work is to be dune pursuant to any right reserved above in this
27 Paragraph, specifying the general nature of the work and the area in
28 which the same is to be performed, the Grantee shall do all things neces-
29 sary to protect., its franchise property during the progress of such work,
30 and if ordered by the Board of Supervisors of the County of Orange, or
31 by the governing body of the agency perform:"._ng ,,uch work, the Grantee
32 shall disconnect, remove, or relocate its franchise property within the

highway to such extent, insuch manner, and for such period as shall be
2
necessary to permit the performance of such.work in an economical
3
manner, and in accordance with the generally recognized engineering and
4
construction methods, and to permit the maintenance, operation and use
5
of such public improvement or of the highway as so improved. All of
6
such things to be done and work to be performed by the Grantee shall be
7 at the sole cost and expense of the Grantee.

In the event that the County or any gc:vernniental agency or
9
instrumentality mentioned in this section shall hereafter construct,
10
install, reconstruct or repair any bridge or artificial support in or
11
underlying any highway in which Grantee's franchise property is located,
12
or which is prescribed as the location for any of Grantee's franchise
13
property, and in the event that the cost thereof be increased in order
14 to provide for the installation, maintenance or .operation of Grantee's
15 franchise property in or on the highway area covered or underlied by
16 said bridge or other artificial support, then the Grantee shall pay to
17 the County or such governmental agency or instrumentality doing such
18 work the full amount of such increase of cost, upon completion of such
19 construction, installation or repair.
20 Any damage done directly or indirectly to any public improvement
21 by the Grantee, in exercising directly o indirectly any ri t power

22 or privilege under this franchise, or in performing any duty under or
23 pursuant tc the provisions of this Ordinance, shall be promptly re-
24 paired by said Grantee, at its sole cost and. expense.

5. If any nc::tlon of any highway shall be damaged by reason of
26 breaks or leaks in any pipe, pipe lines, attachments, appurtenances or
27 appliances laid or constructed under said franchis.e, The +:grantee shall
28 at his own expense repair any such damage and put such highway in as
29 good a condition; as it was before such break or leak, to the satisfac-
30 tion of the Board of Supervisors of the County of Orange.

I.
By this Application, Southern California Water
Company (hereinafter called "Applicant") seeks an order of the Public
Utilities Commission of the State of California (hereinafter called the
"Commission") authorizing the extension of its system to areas contiguous
to and outside of the area certificated to Applicant in Decision No.
53856 of the Commission. The areas herein requested were included in the
original of Application No. 37172 and are shown on Exhibit A attached
hereto and made a part hereof.
II.
Applicant has been requested by subdividers to provide water
service for subdivision development in three separate areas contiguous
to its present certificated area and partially to its present service
areas. The subdividers desire water service at the earliest possible
time in order that they may not incur severe economic hardship.

III.
Applicant believes that Public Convenience and Necessity requires
Applicant be permitted to render water service in said areas shown in Ex-
hibit A. Any delay in rendering water service will result in a severe
economic and physical hardship for the subdividers and the buyers of the
houses in said subdivisions. Water service is required immediately for
construction purposes. Applicant is ready, willing and able to render such
water service effectively, economically and immediately. Applicant will
render said water service to the above mentioned Areas B and C at existing
rates in its Cypress-Los Alamitos-Stanton District and in Area A at exist-
ing rates in its Huntington Beach District. There is no other public utility
or other entity, legally rendering or in a position to render water service
in said areas.
IV.
Construction by Applicant for the areas shown on Exhibit A herein
will consist of distribution facilities, transite or cast iron mains, cop-
per services and appropriate fire hydrants. All services will be metered.
Applicant has adequate water supply in its contiguous service areas. The

Amendment to Application
Subsequent to filing Application No. 42076, it was determined that
the original Application was deficient in certain items in order that it con-
form to the Commission's Rules and Procedures.
This amendment is being filed pursuant to Sections 1001, 1003 and
1005 of the Public Utilities Code..
Applicant hereby amends the original Application by amending Sec-
tions II, III, IV and V to read as follows:
II.
Applicant has been requested by subdividers to provide water service
for subdivision development in three separate areas contiguous to its present
certificated area and partially to its present service area. These three par-
cels are identified as Area A shown on Page 1 of Exhibit B and Areas B and C
shown on Page 2 of Exhibit B attached hereto and made a part hereof. The sub-
dividers desire water service at the earliest possible time in order that they
may not incur severe economic hardship.
A copy of the amended articles of incorporation of Southern California
Water Company was filed with the Commission pursuant to Decision No. 51119 (Appli-
cation No. 36690).

Public Convenience and Necessity requires that Applicant be per-
mitted to render water service in said areas shown in Exhibit B. Any delay
in rendering water service will result in a severe economic and physical
hardship for the subdividers and the buyers of the houses in said subdivision.
Water service is required immediately for construction purposes. Applicant
is ready, willing and able to render such water service effectively, economi-
cally and immediately. Applicant will render said water service to the above
mentioned Areas B and C at existing rates in its Cypress-Los Alamitos-Stanton
District and in Area A at existing rates in its Huntington Beach District.
There are no other public utilities, corporations, persons or
other entities, public or private, with which the proposed construction is
likely to compete. The political subdivisions within which service will be
rendered are the City of Huntington Beach and the County of Orange.
IV.
Construction by Applicant for the areas shown in Exhibit B herein
will consist of the following:
(a) For the above mentioned Area A, the construction will
consist of connecting new distribution facilities to the
present distribution system of Applicant's Huntington
Beach District and is shown in Exhibit C attached hereto
and made a part hereof.
The estimated cost of constructing the above mentioned
facilities is:

The cost of operating the facilities mentioned above
is estimated on the basis of the operating cost in the
Huntington Beach system of Applicant for the calendar
year 1959 and amounts to $1,235 on an annual basis,
but excludes depreciation and federal income taxes.
(b) For the above mentioned Area B, the construction will
consist of connecting new distribution facilities to
the present distribution system of the Los Alamitos
area of Applicant's West Orange District and is shown
in Exhibit D attached hereto and made a part hereof.
The estimated cost of constructing the above mentioned
facilities is:

Services . . . . . . . . . . . . . . . . 5,200
Hydrants . . . . . . . . . . . . . . . . 5,900

Total $47,400
The cost of operating the facilities mentioned in the
paragraph above is estimated on the basis of operating
cost in the West Orange District of Applicant for the
calendar year 1959 and amounts to $1,850 on an annual
basis, but excludes depreciation and federal income
taxes.
The above construction will cover approximately 25% of
said Area B and the remaining 75% will be a multiple
housing development, plans for which are not complete,
but Applicant has been requested to provide water service
in the near future.

(c) For the above mentioned Area C, the construction will
consist of new water supply and distribution facilities.
The development is approximately 20% of a large develop-
ment, the remaining 80% is covered by Certificate granted
Applicant by Commission Decision No. 53856. At the present
time, Applicant does not have a subdivision map for this
development, consequently construction plans have not been
prepared.
The estimated cost of constructing facilities to render
water service in said Area C is as follows:

The cost of operating the facilities mentioned above is
estimated on the basis of operating cost in the West Orange
District of Applicant for the calendar year 1959 and amounts
to $5,600 on an annual basis, but excludes depreciation and
federal income taxes.
(d) The above mentioned additions and extensions to Applicant's
facilities will be financed in the following manner:
(1) The distribution facilities consisting of mains, services
and hydrants will be financed in accordance with the ex-
tension rule of Applicant on file with the Commission.

(2) The water supply facilities and meters will be
financed from the sale of $3,000,000 First
Mortgage Bonds, 5.40% Series due 1990, as
authorized by the Commission in Decision No.
59534, or from bank credit now established but
not used in the amount of $2,0001000.
Attached hereto and made a part hereof is Exhibit E, the balance sheet
and income statement of Applicant for the month of February, 1960.
Applicant has franchise rights covering the areas herein requested
as granted by Ordinance No. 767 of the County of Orange. A copy of said
ordinance is attached hereto as Exhibit F.
V.
Applicant is mailing a copy of Application 40276 and a copy of this
amendment to County of Orange and City of Huntington Beach and an affidavit
of such mailing is being filed herewith.
Correspondence and communications to Southern California Water
Company with regard to this Application should be address R. L. Gresham, Manager
of Rate and Valuation Department, 11911 South Vermont Avenue, Los Angeles 44,
California.
WHEREFORE, Applicant respectfully prays that the Commission issue
its order granting Applicant permission to extend its plant or system in and
to the areas shown in said Exhibit B and render service therein as a public
utility water company and for order preliminary to issuance of Certificate
of Public Convenience and Necessity for exercise of franchise rights, or that
such other different relief be granted as the Commission may deem to be neces-
sary or appropriate in the premises.

Reference is made to discussion some time ago between your
Mr. Hoyt Vicini and our Mr. Fred Griffith relative to payment by
your company of city and county taxes since 1931 on your reservoir
on our land at Huntington Beach.
Pursuant to such discussion we have had a calculation made of
Huntington Beach City taxes and Orange County taxes which have been paid
by us on the reservoir improvements from 1930 through 1954. The total
amounts to $2,990.51.
Enclosed in duplicate, is a statement showing a breakdown of
the taxes for each year and our invoice for the above amount. If you
find this in order kindly remit your check therefor to this office.
It is our thought that the tax assessment should continue to
be made to Huntington Beach Company, and that we should invoice Southern
California hater Company for the amount of such tax each year.
