Also an addendum has been made to the previously approved Negative Declaration 78-112. Recommended Action: Execute the Indenture with thle Southern Pacific Transportation Company per- mitting the City to construct a storm drain through their right of way and approve the "ddendum to Negative Declaration 78-112. Analysis: On November 19, 1979, the City Council authorized the call for bids and ap- proved Negative Declaration 78-112 for the construction of the Gothard/Ta1' ert storm drain, Phase I. This drainage facility is needed to provide a master planned underground systet:, in an area that presently surface drains. A por- tion of the storm drain extends under the railroad tracks; therefore, i�equirin the agreement between the City and Southern Pacific Transportation Company. It was necessary to revise the Negative Declaration in order to mitigate the removal of four trees in the City's Central Park. The City's Environmental Review Committee has approved the addendum (see a.ttacbment) . Alternative: Do not execute the agreement or approve the addendum to Negative Declaration 78-112. therefore, postponing portions of the master planned storm drain. Funding: ;' Na cost. This Negative Declaration did not include a portion of the project west of Gothard Street ir. Central City Park. The approved plans include the construction of a 30" diameter pipe line replacing an existing deficient line. During this construction process, four trees will hatre to be removed which includes: 2- California Pepper, 6" diameter 1- California Toyvn, 6" diaF ater 1- Eucalyptus Lehmann, 18" diameter Mitigating b3easures. The following mitigating measures are proposed: 1. The pipeline alignment was carefully chosen to minimize disturbing the trees within the park. 2. Trees within the construction zone will be protected and carefully tri mod. 3. Two of the four trees being removed trill be replaced with 24 inch box trees. Due to the existing overcrowding in the area the two trees will be sufficient. 4. The new trees will be replaced at locations determined by iie Community Services Department and the Park Tree Superintendent. S. While the storm drain construction is taking place in this area the appropriate park personnel will 'inspect the contractor's cperation so that the least amount of disturbance is done to the park landscaping.
