1976 , by and between the CITY OF 0NTINGTON BEACH, a municipal corporation,
hereinafter referred to as THE CITY, and Spiniel.lo Construction Company
Coronado, California , hereinafter referred to as THE CONTRACTOR.

WHEREAS, in accordance with the provisions ons of Section 1770 of the Labor
Code, the City Council of the City of Huntington Beach, California, has

CONTRACTS .
WHEREAS, the City Coinicil of the City of Huntington Beach, County of
Orange, State of California, pursuant f.c, statutes in c-urh cases made and pro-
vided, dul%' and regularly caused a notice to be published, calling for bido
for lat.:r , material, tool: and equipment for the cle;.ning and cement-mortar
lining of in-place cast iron pipe water mains in Orange Avenue and in the
alley between 6th and 7th Street
in said City of Huntington Beach, California, said wor{. to be constructed
according to plans, specifications, general requirements, and special provision
for same on file in the office of the Director of Public Works and adopted by
the City Council of said City of Huntington Beach on the 1Sth (lay of
December , 1C '/6 , to which said plans, specifications, general_

requirements , and special provisions reference in hereby made , and by nuc-li

and
W1EERFAS , the City Council at a regular meeting thereof and at the time
and place appointed therefor received the report of the results of the bids
:submitted by the respective bidders for the construction and completion of
the above mentioned work, and after careful consideration of a.1.1 bids submitted
the City Council awarded the contract therefor to the CONTRACTOR therein named
at the prices set forth in his hid, it being the lowest and hest bid received
by the said City Council,
NOW, THEREFORE, in consideration of the covenants and agreements herein
contained, being done and performed by the parties hereto, it is hereby agreed
as follows:
I. By my sipature hereunder, as Contractor, I certify tbiat I am aware
of the provisions of Section 3700 of the Labor Code which require every employer
to be insured against liability for workmenlo comper sation or to undertake
self-insurance in accordance: with the provisions of that code, and 'I will comply
with such provisions before commencing the performance of the work of this
contract.
IT. Contractor agrees to receive and accept as full compensation for
furnishing all materials and for doing all the work contemplated and embraced
in this agreement, the total bid amount Contractor submitted in his Proposal
which was accepted by the City Council. A copy of said Proposal is attnched
hereto and incorporated herein by reference and made is part hereof. Contractor
furtl.,.�r agrees that said payment by City shall include all. payments for all
loss or damage arising out of the nature of the work aforesaid, or from the
action of the element;, or from any unforeseen difficulties or obstructions
which may arise or be encountered in the prosecution of the work until its
acceptance by the City, and for all risks of every description contiecteeL with
the work; also for all expenses incurred by or in consequence of the suspension
or discontinuance of wcrk and for well and faithfully completing the wcrk,
and the whole thereof, in the manner and according to the plans and specifica-
tions, and the requirements of the Engineer under them.
III. City agrees with the said Contractor to employ, and does hereby
employ, the said Contractor to provide the materials and to do the work
according to the terms and conditions herein contained and referred to, for
the prices aforesaid, and hereby contracts to pay the same at; the time, in
the manner and upon the conditions as set forth in the general requirements
and the said parties for themselves, their heirs, executors, administrators,
successors and assigns, do hereby agree to the full performance of the covenants
herein contained for a total bid amount of $54,64B.
IV. It is further expressly agreed by and between the parties hereto
that should there be any conflict between the terms of this instrument and
the bid or proposa;. of said Contractor, than this instrument. shall control
and nothing herein shall be considered as an acceptance of the said terms
of said proposal conflicting herewith.

fV. Bid Bond. The Contractor further agrees that his
proposal shall be accompanied by a bidder ' s security in an amount
equal to ten percent ( 10% ) of his bld in accordance with California
Government Code Section 37931 et seq .
VI . Performance Bond and Labor and Material Payment Bond .
The Contractor agrees to furnish, prior to the execution of the con-
tract , bonds covering the faithful performance of this contract- and
the payment C- f all obligations arising thereunder in such form and
amount as the City may prescribe .
VII . California Fair Employment Practice Act . The Contrac-
tor agrees to utilize fair employment practices in accordance with
California Labor Code Section 1410 et seq .
IN WITNESS WHEREOF, the City has caused its name and seal to
be hereunto annexed by its Mayor and City Clerk , thereto duly author-
ized and Contractor has set his hand hereto, the day and year in this
Agreement first above written.

Dear Council Members:
8 previous Council action t cash contracts , CC- 2 and C-343 y p C un ihe two rat , 33 C ,
were accepted by the City Council as complete .
Due to cost overruns on these projects the total cost of each job
exceeded the original bid amount originally approv. ' . The following is
a summary for each contract , giving the reasons for these overruns.
CC-332 — Slater Pum . Station

A change in bid quantities occurred for 't'f'iree concrete items of work ,
and were due to errors made by office staff in preparing the original bid
amounts.
Three cha orders were required to complete the project, two of
which require additional City expense . A change order for $13 , 588 . 74 was
required du to repair of existing channel lining which became a requirement
of the Or ge County Flood Control District and which was not known prior
to conrj '•ruction . Another change order for $3 , 577 . 50 was required to permit
the inbtallation of five flap gates of special manufacture on the new
discharge lines .

A change in bid quantities occurred in amount of pipe installed
(decrease of 9. 5 linear feet) and deletion of a bid item.
One change order was required to complete the project at a cost of
$1, 728 . 05 and was at the point of connection between the water systems .
Upon exposing the point of connection it was determined that the method
originally planned would not work , thus necessitating a change in the
project plans.
Recommendation
Since the above described extra work was authorized in accordance
to our understanding of the contract and was necessary to complete the
projects, it is requested that your Honorable Body authorize the payment
of the overages . Funds are available for CC-332 from Drainage fees and
for CC-343 tiom the Water Utility fund.
Rewording of the contract document, per the recommendation of the
City Attorney' s office, will preclude the necessity of burdening the City
Council of this procedure in the future .

Spiniello Construction Company for a final contract amount of

discussion of contract changes.

Total Contract Price 53 , 151 . 45
There were no change order required to complete the project.
The change in bid quantities was due to changes in the contract
quantities which were less than the original work items bid on in
