PUBLIC WORKS CONTRACT
THIS :GREEMF.NT, Made and entered into on this 23rd day of
December, 1982 , by and between the CITY OF HUNTINC'TON BEACH . a
municipal corporation of the State of California, hereinafter
referred to as "CITY , " and STEINY & COMPANY, INCORPORATED, a
California corporation, hereinafter referred to as "CONTRACTOR. "
WHEREAS, CITY has solicited bids for a public works project
( herein as PROJECT) more fully described as the installation of
traffic signals and controllers at Main Street and Florida Street
and gain St::eet and Ellis Ave::ue , and the mod i f icatior, of traffic
signals at Beach Boulevard and Main Street along with street roadway
improvements, and
WHEREAS, CONTRACTOR has been selected and is to perforr,► said
work,
NOW, THEREFORE, in consideration of the promises and agreements
hereinafter made and exchanged , the parties covenant and agree as
follows :
1 . STATEMENT OF VIORi. , ACCEPTANCE OF RISK
CONTRACTOR shall furnish , at his own expen.:e , all labor $
plant, tools, equipment supplies, transportation, utilities and all
other items and facilities necessary to complete and construct , in a
good and workmanlike manner, PROJECT.
CONTRACTOR agrees to furnish all said services and
material contemplated and eribraced in this agreement ; ind angvie .
loss and damage arising out of the naturt of the aforesaid work
during its progress or prior to acceptance from the action of the
elements, and from any unforeseen difficulties which may arise or be
encountered in the prosecution of work and for all other risks of
description connected with the work; and all expenses incurred by or
in consequence of the suspension or discontinuance of work, except
such as are expressly stipulated to be borne by CITY, and for well
and faithfully completing the work within the stipulated time and in
the manner shown and described in this agreement and in accordance
with the requirements of CITY under them for the compensation set
forth in its accepted bid proposal .
However, the total compensation to be paid is to be
computed on the basis of the units of work as it is actually
performed in accordance with the stipulated prices named in the Bid
Sheet( s ) .
2. ACCEPTANCE OF CONDITIONS OF WORK, SPECIFICATIONS
CONTRACTOR acknowledges that he is fully familiar with all
the terms, conditions and obligations of the Contract Documents , as
hereinafter defined, the location of the jobsite, and the conditions
under which the work is to be performed , and that he enters into
this contract based upon his investigation of all such matters and
is in no way relying upon any opinions or representations of CITY.
It is further agreed that the Contract Documents are
incorporated in this contract by this reference, with the same force
and effect as if the same were set forth at length herein, and that
CONTRACTOR and its subcontractors, if any, will be and are bound by
any and a?1 of said Contract Documents ins_ far as they relate in any
part or in any way, directly or indirectly, to the work covered by
this contract.

"Contract Documents" as defined herein mean and include:
A. This contract agreement;
B. Bonds for the work covered by this contract;
C. The CITY' s standard plans and specification, and
special contractual provisions, including those on file in the
office of the Director of Public Works of CITY and adopted by the
City Council of CITY and any revisions , amendments or addenda
thereto, the 1982 edition of Standard Specifications for Public
Works Construction, published by Builder ' s News , Inc . , 3055 Overland
Avenue, Los Angeles, CA 90034 , and all amendments thereto, written
and promulgated by the Southern California chapter of the American
Public Works Association and the Southern California District Asso-
ciated General Con'.:ractors of the California Joint Cooperative
Committee;
D. Bid documents including the Nctice Inviting Bids , the
Special Instructions to Bidders, and the Contractual Proposal ;
E. The project plans , specifications , special provisions
ant; addenda applicable to the PROJECT. Anything mentioned in the
Specifications and not indicated in the Plans , or indicated in the
Plans and not mentioned in the Specifications, shall be of like
effect as if indicated and mentioned in both. In case of dispute or
inconsistency between any plan or specification, the matter shall be
immediately submitted to the Department of Public Works of CITY,
hereinafter referred to as "DPWI " without whose decision said dis-
crepancy shall no.. be adjusted by CONTRACTOR, save only at his own
risk and expense .

Should there be any conflict between the terms of this
agreement and the bid or proposal of CONTRACTOR, then this agreement
shall control and nothing herein shall be considered as an accept-
ance of the terms of said bid or proposal which is in conflict
herewith.
3 . COMMENCEMENT OF PROJECT
CONTRACTOR agrees to commence the project with 10 calendar
days after notice to proceed is issued and shall diligently prose-
cute it to the completion within 120 calendar days from the execu-
tion of this contract by CITY, excluding delays provided for in
Section 16 herein .
4 . TIME OF THE ESSENCE
Time is of the essence of this contract. CONTRACTOR shall
prepare and obtain approval as required by the Contract Documents
for all shop drawings, details , samples , and do all other things
necessary and incidental to the prosecution of his work in conform-
ance with the said progress schedule . He shall coordinate the work
covered by this contract with that of all other contractors, sub-
contractors and of the CITY, in a manner that will facilitate the
efficient completion of the project and in accordance with Section 3
herein . CITY shall have complete control of the premises on which
the work is to be performed and shall have the right to decide the
time or order in which the various portions of the work shall be
installed or the priority of the work of other subcontractors and ,
in general , all matters re.resenting the timely and orderly conduct
of the work of CONTRACTOR on the premises.

S. CHANGES
CONTRACTOR hereby agrees to make any and all changes,
furnish the materials and perform the work the DPW may require
without nullifying this contract. CONTRACTOR shall adhere strictly
to the Plans and Specifications unless a change therefrom is author-
ized in writing by the DPW. Under no condition shall CONTRACTOR
make any changes, either in additions or deductions, without the
written order of the DPW and CITY shall not pay any extra charges
made by CONTRACTOR that have not been agreed upon in writing by the
DPW. CONTRACTOR shall submit immediately to the DPW written
copies of its firm' s cost or credit proposal for changes in the
work . Disputed work shall be performed as ordered in writing by the
DPW and the proper cost or credit breakdowns therefor shall be
submitted without delay by CONTRACTOR to DPW.
6 . NOTICE TO PROCEED
No work, services , material , or equipment shall be
performed or furnished under this agreement unless and until a
notice to proceed has been given to the CONTRACTOR by CITY . CITY
does not warrant that the work site will be available on the date
the Notice to Proceed is issued . In event of a delay in commence-
ment due to such unavailability, relief to the CONTRACTOR shall be
limited to a time extension equal to the delay due to such avail-
ability.
7 . BONDS
CONTRACTOR shall , prior to entering upon the performance
of this contract, furnish bonds approved by the City Attorney: one
in the amount of one huiia'red percent ( 100% ) of the contract price ,
to guarantee the CONTRACTOR' s faithful performance of the work and

`,labor and materials furnished . Such warranty shall apply to all
work 'done under this agreement, including but not limited to any
workmanship, installation, fabrication, maLarial or structural
facilities constructed . CONTRACTOR, within ten ( 10) days after
notification by CITY of any defect wzrra„ted hereunder, may at its
option make appropriate repairs or replace the defective item or
items.
8 . CALIFORNIA FAIR EMPLOYMENT PRACTICES ACT
CONTRACTOR agrees to comply with all requirements and
utilize Fair employment practices in accordance with California
Labor Code Sections 1410, et seq.
9 . CALIFOR14IA PREVAILING WAGE LAW
The CITY has ascertained from the Director of Industrial
Relations of the State of California the general prevailing rate of
per diem wages and the general prevailing rate for legal holiday and
overt4.me work in the locality in which the work is to be performed
for each craft or type of work needed to execute this contract, and
the -same has been set forth by resolution on file in the office of
the City Clerk of CITY. CONTRACTOR agrees that not less than said
prevailing rates shall be paid to workers employed on this public
works contrac� as required by Labor Code Sections 1771 and 1774 of
the State of California . In accordance with the provisions of
'Section 3700 of the .Labor Code,, - CONTRACTOR further agrees to secure
payment of compensation to -every employee .

10 . ' CALIFORNIA PREVAILING WAGE LAW - PENALTY
CONTRACTOR shall , as a penalty to CITY, forfeit twenty-
five 'dollars ( $25) for each calendar day or portion thereof for each
worker paid ( either by him or any subcontractor under him) less than
the prevailing rate set forth herein on the work provided for in
this contract, all in accordance with Sections 1774 and 1775 of the
Labor Code of the State of California .
11 . PAYMENT OF TRAVEL AND SUBSISTENCE ALLOWANCE
Section 1773. 8 of the Labor Code of the State of Cali-
fornia, regarding the payment of travel and subsistence payments, is
applicable to this contract.
12. EMPLOYMENT OF APPRENTICES
Section 1777 . 5 of the Labor Code of the State of Cali-
fornia, regarding the employment of apprentices, is applicable to
this contract.
13 . EIGHT HOUR LAW
In performance of this contract, not more than eight ( 8 )
hours shall constitute a day' s work and CONTRACTOR shall not require
more than eight ( 8 ) hours of labor in a day from any person employed
by him hereunder except as provided in paragraph 9 above .
CONTRACTOR shall conform to Article 3, Chapter 1, part 7 (Sections
1810, et seq. ) of the Labor Code of the State of California, and
shall forfeit to CITY as a penalty, the sum of twenty-five dollars
( $25 ) for each worker employed in the execution of the contract by
CONTRACTOR or any subcontractor for each calendar day during which
any worker is required or permitted to labor more than eight ( 8 )
huurs in any one calendar day and forty ( 40 ) hours in any one week
in violation of said article . CONTRACTOR shall keep an accurate

record showing the name and actual hours worked each calendar day
.' - a'n- ,each calendar week by each worker employed by CONTRACTOR in
connection with the project.
14 . PAYROLL RECORDS
CONTRACTOR agrees to keep accurate payroll records showing
the name, address, social security number, work classification,
straight time and overtime hours worked each day and week, and the
actual per diem wages paid to each journeyman, apprentice or worker
employed by him in connection with the project, and agrees to insist
that Each of his subcontractors do the same. CONTRACTOR further
agrees that his payroll records and those c-•f his subcontractors, if
any, shall be available to the employee or his .epresentative, the
Division of Labor Standards Enforcement, and the Division of, Appren-
ticeship Standards, and shall comply with all of the provisions of
Laboc Code Section 1776, in general .
15. INDEPENDENT CONTRACTOR
It in further understood and agreed that the CONTRACTOR
is, and shall be, acting at all times as an independent contractor
herein, and not as an employee of CITY. CONTRACTOR shall secure , at
its expense, and be responsible for any and all payment of income
tax , social security, state disability insurance compensation,
unemployment compensation and other payroll deductions for
CONTRACTOR and its officers, agents and employees, and all business
11c:enses, if any, in connection with the services to be performed
hereunder.
16. LIQUIDATED DAMAGES
It is agreed by the parties hereto that in case the total
work called for hereunder in all parts and requirements is not
finished or completed within the number of calendar clays as set
for 'in Section 3 herein, damage will be sustained by CITY and that
it is and %iill be impractical and extremely difficult to ascertain
and determine the actual damage which CITY will sustain in the event
of and by reason of such delay; dnd it is, therefore , agreed that
CONTRACTOR will pay to CITY the sum of two hundred dollars ( $200. 00)
per day for each and every working day ' s delay in finishing the work
in excess of the number of working days prescribed; and CONTRACTOR
agrees to pay said damages herein provided for, and further agrees
that CITY may deduct the amount thereof From any monies due or that
may become cue to CONTRACTOR hereunder.
CONTRACTOR will be granted an extension of time and will
not be assessed with damages for any portion of the delay in com-
pletion of the work due to unforeseeable causes beyond the control
and without the fault or negligence of CONTRACTOR, including but not
restricted acts of God or of the public enemy, fire, floods, epi-
demics, quarantine restrictions, strikes, and unsuitable weather, or
delays of subcontractors due to such causes.
CONTRACTOR shall within fifteen ( 15 ) days from the begin-
ning of any such delay ( unless the DPW shall grant a further period
of time prior to the date of final settlement of the contract)
notify the DPW in writing of the cause of the delay, and CITY shall
extend the time for completing the work if, in its judgment, the
findings of fact thereon justify the delay, and its decision is
conclusive on the parties hereto.

pletion of the work by the act, neglect or default of CITY, or
should CONTRACTOR be delayed waiting for ma',erials, if said

materials are required by this contract to be furnished by CITY, or
by damage caused by fire or other casualty for which CONTRACTOR is
not responsible, or by the combined action of the workmen, in nowise
caused by or resulting from default or collusion on the part of
CONTRACTOR, in the event of a lockout by CITY, then the time herein
fixed for the completion of the work shall be extended the number of
days the CONTRACTOR has thus been delayed , but no allowance or
extension shall be made unless a claim therefor is presented in
writing to CITY within fifteen ( 15 ) days of the commencement of such
delay.
No claims for additional compensation or damages for
delays, irrespective of the cause thereof and including without
limitation, the furnishing of material by CITY, or delays by other
contractors, subcontractors or CITY will be allowed and said
extension of time for the completion shall be the sole remedy of
CONTRACTOR.
16 . DIFFERING SITE CONDITIONS
( 1 ) Notice . The contractor shall promptly, and
before such conditions are disturbed , notify the DPW, in writing of :
(a ) subsurface or latent physical conditions at the
site differing materially from those indicated in this agreement; or
(b) unknown physical conditions at the site, of an
unusual nature , differing materially from those ordinarily en-
countered and generally recognized as inherent in work of the
character provided for in this agreement. The DPW shall promptly
investigate the conditions, and if it finds that such conditions do
materially so differ and cause an increase or decrease in the time
required for performance of any Dart of the work under this

agreement, whether or not changed as a result of such conditions, an
equitable adjustment shall be made and the agreement modified in
writing accordingly.
( 2) Time Extension. No claim of the contractor under
this clause shall he allowed unless the contractor teas given the
notice required in this clause; provided , however, the time pre-
scribed therefor may be extended by CITY.
17 . COMPENSATION
CITY agrees to pay and CONTRACTOR agrees to ac^.ept as full
compensation for the faithful performance of this contract, subject
to any additions or deductions as provided in the Contract
Documents , the sum of One Hundred Eighty-Three Thousand..
Dollars, and no cents ( $183, 000. 00 ) , as set forth in the Contract
Documents and provided for, in Section 1 herein .
18 . VARIATIONS IN ESTIMATED QUANTITIES
The quantities listed in the bid schedule will not govern
final payment. Payment to the CONTRACTOR will be made only for the
actual quantities of contract items constructed in accordance with
the plans and specifications . ' pon completion of the construction,
if the actual quantities show either an increase or decrease from
the quantities given in the bid schedule , the contract bid pric,n
will prevail subject to 1-he provisions of this Article . Equitable
adjustment in payment will be made upon increases or dec.-eases in
costs due solely to the variation in quantity above or below the
estimated quantity when warranted by the facts and circumstances.
If the quantity variation is such as to cause an increase in the
time necessary for completion, the DPV1 sti.J1 ascertain the facts and

circumstances and make such adjustment for extending the completion
date as in its judgment the findings justify. No claim by
CONTRACTOR for an equitable adjustment in price or time for
completion shall be allowed if asserted after final payment under
this agreement.
i.9 . PROGRESS PAYMENTS
Each month, the DPW will make an estimate in writing of
the work perforrrad and the value thereof . From Each progress
estimate , ten percent ( 10% ) will be deducted and retained by CITY,
and the remainder, less the amount of all previous payments since
commencement of the work , will be paid to CONTRACTOR.
If: CONTRACTOR has , in the judgment of the DPW, faithfully
executed fifty percent ( 50% ) or more of the value of the work as
determi.ned from the bid schedule , and if the DPW finds that satis-
factory progress has been and is being made , the CONTRACTOR may
be paid such sum as will bring the payments of each month up to one
hundred percent ( 100% ) of the value of the work completed since the
commencement of: the work, as determined by DPW, less all previous
payments and less all previous retained amounts. The :Final payment,
if unencumbered , or any part thereof unencumbered , shall be made
to iz ty-five ( 35 ) days after the accc: pta.ice of the work and the
filing of a Notice of: Com :11Q t i oc, by CITY. Payments shall be made on
demands drawn in the manner r�-quired by law, accompanied by a certi-
ficate signed by the DPW, stating that the work for which payment is
demanded has been performed in accordance with the terms of the
contract , and that the amount stateci in the/ certificate is due under
the: terms of: tt-e cc ,tact . Partial payments on the contract price
shall not be considerecd as an acceptance of any part of the work .

20 . WITHHELD CONTRACT FUNDS, SUBSTITUTION OF SECURITIES
At the request and expense of CONTRACTOR, who shall retain
beneficial ownership and receive interest, if any thereon , CITY
shall permit the substitution and deposit therewith of seccrities
equivalent to the amount of any monies withheld by CITY to ensure
performance under Section 20 of this contract.
21 . P.FFInPVITS OF SATISFACTION OF CLAIMS
After the completion of the wore: contemplated by this
contract, CONTRACTOR shall file with the DPW its affidavit stating
that all workmen and persons employed , all firms supplying mater-
ials, and all subcontractors upon PROJECT have been paid in full ,
and that there are no claims outstanding against PROJECT for either
labor or material , except certain items, if an,y, to be set fora; in
an affidavit covering disputed claims, or items in connection with
Notices to Withhold which have been Filed under the provisions of
the statutes of the State of California .
22. WAIVER OF CLAIMS
The acceptance by CONTRACTOR of the payment of the final
certificate shall constitute a waiver of all claims against CITY
under or arising out of this contract.
:3 . INDEMNIFICATION; HOLD HARMLESS ; DEFENSE
CONTRACTOR agrees to protect, defend , indemnify and hold
and save harmless CITY, its officers, agents and employees against
any and all liability, Plaims, judgments, costs and remands, in-
cludi.ng death or injury to CONTRACTOR' s employees, and damage to
property, arising directly or indirectly out of the obligations
herein undertaken by CONTRACTOR or out of the operations conducted
by CONTRACTOR, save and except those which arise out of the sole

negligence or sole willful misconduct of CITY. CONTRACTOR will
defend any such suits at the sole cost and expense of CONTRACTOR
when requested by CITY, and any costs of defense or attorney' s fees
incurred by CITY in enforcing this obligation will be reimbursed to
CITY or may be awarded to CITY by a court of competent jurisdiction .
24 . WORKERS ' COMPENSATION
CONTRACTOR acknowledges and undertakes its duty under the
provisions of Section 3700 et seq. of the Labor Code to insure
against liability for Workers ' Compensation and covenants to comply
with such provisions prior to commencing the performance of the work
hereunder.
CONTRACTOR shall maintain Workers ' Compensation Insurance
and otherwise comply with all of the provisions of the Workers '
Compensation and Safety Acts of the State of California , the appli-
cable provisions of Divisions 4 and 5 of the California Labor Code
and all amendments thereto; and all similar State or Federal acts or
laws applicable and shall furnish to CITY a certificate of Workers '
Compensation Insurance evidencing such compliance . The insurer
shall furnish to CITY a certificate of Workers ' Compensation
Insurance . The provider of insurance shall not cancel or modify any
such policy so provided without thirty ( 30 ) days ' prior written
notice to CITY.
CONTRACTOR shall further require all subcontractors to
similarly provide such workers ' compensation insurance for all of
s..he subcontractors ' employees. CONTRACTOR shall furnish a certi-
ficate of waiver of subrogation under the terms of the workers'
compensation insurance, and CONTRACTCR .shall similarly require all
subcontractors to waive subrogation .

CONTRACTOR'S Workers ' Compensation Insurance shall be in
forms and underwritten by insurance companies satisfactory to CITY.
Said insurance shall remain in force until the work under this
contract is fully completed and accepted by CITY. Said insurance
shall not derogate from the provisions for indemnification of CITY
by CONTRACTOR under section 24 of this contract. CONTRACTOR shall,
notwithstanding nor diminishing the Foregoing obligations, subscribe
for and maintain in full force and effect during the life of this
contract a workers ' compensation liability policy, in accordance
with the Workers ' Compensation Act or the State of California , of
not less than One Hundred Thousand dollars ( $100, 000) .
25. INSURANCE
CONTRACTOR shall at all times carry on all operations
hereunder, bodily injury and property damage liability insurance,
including automotive bodily injury and property damage liability
insurance, in forms and underwritten by insurance companies
satisfactory to CITY for: all operations, subcontract work, con-
tractual obligations, product or completed operation, all owned
vehicles and non-owned vehicles. Said insurance coverage obtained
by the CONTRACTOR shall name the CITY , its officers, agents and
employees and all public agencies as determined by the CITY as
additional insureds on said policies. CONTRACTOR shall. require its
insurer to waive its subrogation rights against CITY and agrees to
provide certificates evidencing the same .
Before CONTRACTOR performs any work at, or prepares or
delivers :materials to the site of construction, CONTRACTOR shall
furnish to CITY certificates oi: insurance subject to approval of the
City Attorney evidencing. the. foregoing insurance coverages and such

certificates shall provide the name and policy number of each
carrier and policy and that the insurance is in force and will not
be cancelled without thirty ( 30 ) days ' written notice to CITY.
CONTRACTOR shall maintain all of the foregoing insurance coverages
in force until the work under this contract is fully completed and
accepted by CITY.
The requirement for carrying the foregoing insurance shall
not derogate from the provisions for indemnification of CITY by
CONTRACTOR under Section 24 of this contract . Notwithstanding or
diminishing the obligations of CONTRACTOR with respect to the
foregoing , CONTRACTOR shall subscribe for and maintain in full force
and effect during the life of this contract the following insurance
amounts : not less than Three Hundred Thousand Dollars ( $300 , 000 )
combined single limit coverage for Items A and B.
A. Bodily Injury Liability
and Automotive Bodily Injury
Liability ( including non--
ownership and hired cars)
B. Property Damage Liability
and Automotive Property Damage
Liability
CITY or its representative stall at all times have the
right to demai.d the original or a copy of all said policies of
insurance . CONTRACTOR shall pay the premiums on all insurance
hereinabove required .
26 . DEFAULT AND TERMINATION
If CONTRACTOR fails or refuses to prosecute the work with
diligence , or fails to complete the work within the time specified,
or is adjudged a bankrupt, or makes an assignment for the benefit of
creditors, or becomes insolvent, or violates any provision of the
Contract Documents, CITY may give notice in writing of its intention
to terminate the contract. Unless the violation is cured within ten
( 10 ) days after said notice of intention has been served on CON-
TRACTOR, CITY may terminate this agreement upon the expiration of
that time .
27 . DISPOSITION OF PLANS, ESTIMATES AND OTHER DOCUMENTS
CONTRACTOR agrees that upon completion of the work to be
performed hereunder or upon earlier termination of this agreement,
all original drawings, reports, calculations, maps and other docu-
ments, pertaining to s,: '.d contract, shall be delivered to CITY and
become its sole property at no further. cost.
28 . DISSATISFACTION WITH PERFORMANCE
In the event that CITY is dissatisfied with performance of
CONTRACTOR and the procedures for termination set forth in Section
27 are followed, CITY may elect to assume complete control over
PROTECT.
29 . NON-ASSIGNABILITY
No assignment or delegation by the CONTRACTOR of this
contract or any part hereof, or of funds to be received hereunder,
will be recognized by CITY unless such assignment or delegation has
had prior written approval of consent of CITY and the surety.
30 . CITY EMPLOYEES
CONTRACTOR shall employ no regular employee of CITY in the
.work performed pursuant to this contract.

31. ATTORNEYS ' FEES
If any action at law or in equity is necessary to enforce
or interpret the terms of this agreement , the prevailing party shall
be entitled to reasonable attorney' s fees, costs and necessary dis-
bursem-nts in addition to any other relief to which he may be
entitled . If any action is brought against CONTPACTOR or any sub-
contractor to enforce a Stop Notice or Notice to Withhold , which
names CITY as a party to said action, or by reason of which CITY
incurs expenses, CITY shall be entitled to reasonable administrative
and attorney' s fees, costs and necessary disbursements arising out
of the processing of Stop Notices or :Notices to Withhold or any

Recent design additions to this project have caused change orders to be issued. The cost
of these change orders for the Main Street Signals Project will exceed 19 -' of the
approved contr3et amount.
Recommendation;
Authorize The Director of Public Works to approve change order costs up to $34,504.34.
Analysis:
In accordance with Resolution 4B96, the Director of Ilublic Works is authorizer] to approve
contract. change orders to an accumulated total of ten (10) percent of the project contract
amount, not to cxceed 4,150,000.
Due to unexpected problems and construction additions to this project, construction
extras for the Main Street Signals Project will approach $34,504.34.
The majority of the extra monies requested pertain to the widening of Ellis Avenue, west
of Mein Street, to its u;cimate street width. This coat is approximately $33,000. The
remaining monies relate to the relocation of water lines and nearby utility facilitil's

STATEMENT OF ISSUE:
e City Council s previously approved the selection of a consultant to design plans and
specifications for these two locations. The plans and specifications have been completed and
the project is ready to be advertised.
RECOMMENDATION:
That the Mty ouncrl approve the plans and specifications for this project and authorize the
Department of Public Works to advertise for bids for construction of traffic signals al
these two sites.
ANALYSIS:
Plans and specifications have been reviewed by the staff and are (eady for bid. The designs
included plans and specifications for the intersections of Main/Elils, Main/Florida and
Main/Delaware. Due to current traffic demands, the intersection of Main and Delaware does
not require a traffic signal installation at this time. The estimated project cost for the
construction of these two signals is $185,000.00.

The. Traffic Engineering Section of the Departinent of Public Works for the City. of
Huntington Beech has been directed to conduct a detailed analysis to determine the priority
listing for the. construction of three traffic signal Installations. The Intersections which are
encompassed In this study are as follows:
1. Main Street at Ellis
2. Main Street at Florida
3. Main Street at Delaware
During the process of evaluating these locations, it was determined that the Intersection of
Main and Ellis will have to be equipped with a traffic signal in the, near future. This
intersection is currently operating at unsafe levels and is a potential accident hazard. All
counts and surveys conducted showed that this intersection experiences the greatest level of
vehicular traffic among the locations in question.
One method used by Traffic Engineers to determine the priority order of 'constructing
traffic signal installations Is the Delay Accumulation Method. This method was developed
by the FHWA in the early 1960's when money was plentiful and when the drive behind the
FHWA was to increase traffic control facilities rather than maximizing existing traffic
control facilities. Although the method was developed in the early 1960's, it has been
revised, updated and reworked to become a very helpful tool to traffic engineers of the
1980's.
Based on the findings of the Delay Accumulation Method (DAM) study, the interractiurr of
Main and Ellis experiences 379b more vehicle delay than the other two locations. A brief
summary of the DAM study follows in Table I.

The remainder of the studies dealt with comparing the two remaining Intersections. Many
factors end methods were used to determine which of the two Intersections would benefit
most from a traffic signal Installation. It is important to point out that hoth Intersections
would benefit considerably by a traffic signal installation; however; if both locations were
,equipped with traffic signal installations, it is quite feasible Lh at one of the locations and
posuibly both of the locatior. -vould not function or operuto to the levels which are
required for this project.

One.-of the. major points to" support this reasoning"Is that if a traffic'slgnalls;installer: at
tilili : and."Fldrlda, most of: the Five .points Shcpping Center's traffic will utilize .this
intersection rather than Main and Delaware. It is the 'opinion of the Traffic Engineering
Sect ion'that a possible traffic signal installation at Main and Delmiare at this. tlme'wauld
be more of':a convenience than c necessity. This viewpoint is further. supported by the
padestriert "osage study which was conducted to aid in the selection of a single traffic
signal installation locatiun.
The .Traffic Engineering Section believes that a major concern to the evaluation process
for this project is the pedestrian input and usage characteristics. The Traffic Engineering
Section conducted a pedestrian usage study to further develop realistic data which would
enable the City to decide the matter at hand.
The pedestrian study was conducted over a two week period and encompasand all areas
surrounding the project site. The areas surveyed are shown on Figure L
irr brief, the study questioned and interviewed all persons affected which would possibly
use pedestrian crossings at Main and Florida or Main and Delaware. The study surveyed
all of the senior citizen facilities, the hospital, medical offices, conference centers,
shopping centers, apartments and the commerical developments in the area. The total
number of responses to the questions and interviews was approximately 1,126 pedestrians.
The ages of the pedestrians surveyed ranged from 14 to 86. The following is the
breakdown of the ages of all persons surveyed.

interviews conducted, 82% of persons polled indicated that they would rather use a
crossing at Main and Florida than a e;ossing at Msin and Delaware.
Another point to consider 'is that most of the stores in the Five Points Center are
accessible easier from Main at Florida rather than Main and Delaware. If peestrians are
forced to divert to Main Pod Delaware to cross Main Street, It in only a matter of tithe
before these pedestrians get tired or just do not care and start crossing wherever they
wish. - It Is a reasonable assumpti:,n that If a traffic signal Is Installed at Florida,
pedestrians 'will use this direct path to the Center. Furthermore, pedestrians will
continue to use a crossing at a signal for it provides them with a feeling of security rather
than using a unprotected crossing.
Another area concerning crosswalks which was investigated dealt with the amounts of
time used to traverse separate crosswalks. Crosswalks at both Main and Delaware and
Main and Florida were reviewed to determine which location would provide pedestrir-is
with the safest crossing.
Based on a study which was conducted by the Federal Highway Administration In 1979, it
was calculated that an average physically adequate parson walks at a rate of 3.8 feet per
second. This rate Is based on a pe.son walking at a normal or comfortable rate. Using
these figures, it would take a person approximately 27 seconds to walk across the
proposed crosswalks at Main and Florida. Using the same figures, it would take
approximately 51.seconds to cross in the proposed crosswalk at Main and Delaware. The
results that were derived from these calculations clearly illustrate that a person crossing
et Main and Delaware is exposed to traffic for an additional 24 seconds.
The amount of additional crossing time (24 seconds) will have to be made up somewhere.
Most likely this timing will be mado up in the controller. The controller will have to be
programmed to provide pedestrians with the necessary pedestrian clearance time which
will enable safe passage. This method for adding the 24 seconds !s great for the
pedestrians, but will be a problem for vehicles.
The addition of pedestrian clearance timing will cause motorists to be delayed for
approximately 24 to 30 seconds. Based on tha four way ADT for the intersection of Main
and Delaware, the amount of energy spent because of the added delay will run between
$235,000 and $317,000 yearly. However, the timing addition will save lives or is intended
to save lives and all they energy spent is not worth the possibility of someone losing their
li fe.
There Is an alternative to the situation at Main and Delaware. This solution Is to not
Install a signal at this location and to divert all efforts to designing an efficient and
effective traffic signal at Main and Florida. This location will not be affected by
additional pedestrian clearance tine and therefore will not cause excessive vehicular
delays. Furthermore, the Installation of a traffic signal at Main and Florida will function
as a controlled access to and from the Five Points Center.

As,' con�.Iriued,to study these locations, 1 cond6ci6d field observations to acquire 7data
concerning vehicle gaps, The results were tabulated and :,summarized so that averages
could lee obtained for both' locations. During the actual observations It woo clearly visible
that .the existing gaps'were 'not sufficient enough 't& provide safe crossing times at these
!orations. The field investlgatinns showed that the average sufficient gap At
Main/Delaware and Mairi/Florida was 19.3 and 18:7 seconds, respectively. These gaps
differed from time to', time due .to peak hour tralfic. During AM and PM peak hour
traffic, the.gaps were found to be 10.1 and 9.6 seconds, respectively. Also, tha noon time
traffic (11:00 a.m. to 1:00 p.m.) altered the gaps by about 37%.
Based on the. results received from field observations, it is clearly evident that these
times are Inadequate to service pedestrians at these locations. Under existing conditions
it is impossible zo cross the whole street at one time without being in danger of being
picked off by unattentive motorists. Currently, the raised median serves as a midway
point where pedesl:-Ians can wait until the second part of their journey is clear. As you
and I both know, allowing pedestrians to oecLpy medians while motorists pass by at high or
Iow speeds is an unwanted practice which this city tries to discourage.
It has been determined that the conditions mentioned herein concerning these two
locations can be remedied by a traffic signal installation st Main and Florida. The zignal
will provide motorists with protected turning movements and %%,ill aid in clearly defining
traffic patterns through the intersection. The Installation will also provide pedestrians
with a "protect crossing". The timing used for the pedestrian clearances will correspond
to the vehicle timing and will eliminate any need for additional pedestrian clearance
time. Another benefit which will to brought about because of this installation is Lhe
Increase in vehicle gaps for pedestrian crossings. Based on a 60 or a 90 second cycle
length at Main -and Florida, coordinated feedback into Main and Ellis and signal
coordination at Mair,/Garfield/Gothard, the gaps at Main and Delaware could be Increased
by as much a:, 165%. As hard as it is to believe, gaps of up to 51 seconds could be
achieved during off peak hours. The gaps during peak hours will also be Inc►eased 5y
approximately 85% to 121%).

At their meeting of March 2, 1981, the City Council requested information on the relative
priority of traffic signals at the intersection of Florida and Main and the feasibility
of financing a project to install these signals as soon as possible.
Reondation:
It Is iii= nded -gat the City Council take the following actions:
1. Authorize the preparation of plans and specifications for traffic signals at the
intersections of Main & Ellis, Main & Florida, and Main & Delaware. The estimated

2. Authorize the allocation of 7th Year H.C.D. funds estimated at $95,000 for the con-
struction of traffic signals at Main & Florida. 1 -1 -

traffic signals at the intersections of Main & Ellis ats well as Main & Delaware if
it. can be demonstrated rated that a significant cast savings can be realized by constructing
signals at all three of these intersections under one contract.

` traffic signals, at that intersection. Attached' is a preliminary 1981-82 traffic s1 bal
priority list: showing a three year accident history. As can be seen, the three inter
- sections along Main St. south of Beach Blvd. rate highly on this list. It is anticipated
that the accident rate at Florida and at Ellis will rise at an even W-her rate for t,m
'reasons:
1. The Wycliffe Ztwers is. now fully inhabited and additional vehicular and pedestrian
traffic has been generated in 1981 .
2. The extension of Ellis from Got hard to Main has born conpleted, which is generatingr
higher traffic volutes at Main & Ellis in 1981.
The three top ranked priority inter fi,,Jons on Beach Blvd. have been submitted to CALTRANS

intersections on Main St. should be highly considered for signalization because the
type of accidents there are more severe than at the 4th and 5th ranked intersections.
Staff has L-an turned down in a request for County A:H:F.P. assistance' to finance
the signals on Main Street. This leaves funding saarces limited to City Gas Tax or
H.C.D. funds. The attached memo from Steve Kohler states that the City's HUD repre-
sentative feels that the intersection of Main & Florida would be eligible for H.C.D.
funds. Staff is recamvmxling that 7th Year H.C.D. Lwal Option funds be used to
finance the estimated cost of $95,000 for signals at Main & Florida. $104,000 has
been allocated for Kcal Option in the 7th Year.
Because eraffic signals are also necessary on Main at Ellis & Delaware, staff feels
that the three signals should be designed in one consultant contract estimated at
$7r500 to be financed fran *Gas Tax funds. Staff also feels that the signals at Ellis
& Delaware should be constructed in the same project as the Florida signals if signifi-
cant cost savings can be realized from the larger contract. The design consultant
would advise the City on this option. The estimated cost of $200,000 for the other
two intersections could be financed from an unbudgeted anticipated balance of $325,359
in the Gas Tax fund.
Alternatives:
1. Authorize design and construction of no additional signals at this time.
2. Authorize design and construction of signals at only the Main & Florida intersection
at this time with consideration for the other intersections in the 81-82 budget.
3. Authorize design and construction of signals at Main & Florida as well as Main &
Ellis at this time with Main & Delaware being held to a future time.

We are planning to submit a project application Linder the AHFP
Program to reconstruct the northwest corrwer. of Beach Blvd. and !fain
Street and install a traffic signal at Main and Lllis that would be
coordinated with the signal at Beach Blvd . and Main/Ellis intersection .
This project application will be submitted before the erid of December
1980 . Under A11FP rweguletLions , the installation of traffic signals is
approved only if its in conjunction with a roadway project . Therefore ,
the two intersections on !-lain Street at Delaware and at Florida would
not be eligible for AHFP funding . on the other hand , the developer
of the northwesterly corner of Main and Delaware is required to
participate in the constructi.op of that signal to the ^xtand of 25 of
the total cost. It is also possible that the owners and/or merchants ,
of the Five-Points Shopping Center could be convinced to participate
in the cost of the traf. is signal at Main and Florida si.nco that signal
would definetely benefit the Shopping Center.
Based on this supplemental information , it appears that the recommend-
ations in the July 11 , 1980 report are still valid . However , with tho
passage of time, Main and Ellis will increase in importance and re-
cognizing that fact, we should apply for A11FP funds to de the work
described previously.

A comparison of accident history and traffic volumes for the intersections of
hiain and Delaware and t•tuin at Florida . indicates that the latter intersection should
receive a slightly higher priority ( see attachments ) . Although a pedestrian count
was riot made , it was observed , during the placing of the traffic counters , that a
significant number of pedestrians use the crosswalk at Florida and Main. This
pedestrian traffic is generated by a number of existing convalescent hospitals and
senior citizen living facilities which are located along Florida Street . The
trtycliff Gardens retirement apartment complex will add to this pedestrian traffic .
According to the attached letter, approximately 215 residents will start moving
into the complex in August 1980.

_.1 . It is recommended that we consider construction of a traffic signal at +•lain
and Florida as a first priority and at f•lain and Delaware as a second priority.
2. It is also recornimnded that the managers of Wyciiff Gardens employ. the use of
a van or ofre►• Vehicle to provide transportation for it ' s citizens until the
traffic signal is installed at t•lain and Florida .

use of the Florida crosswalk. In any event, crossing} Main Street is only one
obstacle to pedestrian traffic. The parking area at Five Points Shopping Center
can also be considered a potcntial location for a pedestrian accident.
Tile opening of Ellis revenue east of Gothard will probably change the traffic
patterns along I-lain Street be6-4,een Delaware and Ellis . A general increase in
traffic is expected oil Hain Street particularly at the intersection with Ellis.

In response to the request of the Public Works Department , I am hereby submitting
a Financial Impact Report relative to the funding for the three traffic signals
In Huntington Beach that have been ascertained by the requesting department as being
heavily frequented high accident intersections. Should the City Council be desirous
of approving all three of the installations at this time, Gas Tax funds are available
In the respective amounts of $7,500 and $200,000 to fund the anticipated costs for
purposes of plans and specification preparation for the three installations , as well
as the estimated expense of actual construction of the signals at the corner of
Main and Ellis and Main and Delaware. Seventh Year HCD funds are available for
the actual construction of the third traffic signal at Main and Florida which has
*been estimated at $95,000. Appropriation in the above mentioned configurations
will be required should the City Council choose to approve all three of the
installations.

the signals on Main Street:. This leaves funding sources limited to City Gas Tax or
H.C.D. fronds. The attached nano fran Steve Kohler states that the City's HUD repre-
sentative feels that the intersection of Main & Florida would be eligible for H.C.D.
funds. Staff is reconmcndinq that 7th Year H.C.D. Local Option funds be used to
finance the estbii-ited cost of $95,000 for signals at Main & Florida. $104,000 has
tx-cn allocated for Local Option in the 7th Year.
Iocause traffic signals are also necessary on Main at Ellis & Delaware, staff feels
Uiat +-.hn tierce signals should lx_ designed in one consultant contract estimated at
$7,500 to be financed frut,t Gas 'fa--. funds. Staff also feels that the signals at Ellis
& Iklaware should be constructed in the same project as the Florida signals if signifi-
cant: ccst savings can be realized fran the larger contract. The design consultant
would advise the City on this option. The estimated cost of $200,000 for the other
bv:o intersections could be financcri fran an unbudgeted anticipated balance of $325,359
in the Gas Ta:.c fund.
