3 . 'TERM: The term of this letting shall be for a period (
not more than three ( 3 ) years commencing February 1 , 1983 , and
ending on January 31 , 1986 . 'Ibis lease is subject to prior
termination at the option of tither, party upon six ( 6 ) mc,nths '
written notice to the other Marty . TENANT shall surrender the
demised premises to CITY immediately upon expiration of the term

`_i. ADJUSTMENT TO RENT: Beginning on February 1 , 19841 and
each subsequent year , the monthly rent for. the subsequent year
shall be increased by five percent ( 5% ) per annum based upon the
annual rent for the previous year .
6. USE OF THE LEASED PREMISES : TENANT may use the .leased
premises as storage for broken concrete and asphalt , as well as
crushing the broken concrete and asphalt materials into a usable

orderly condition .

8. COMPLIANCE. 'TENANT shall comply with all Federal ,
State , County and City regulations pertaining to air pollution,
including, but riot limited to, dust control . Among other methods
the contractor may use to control dust, it is mandatory that he
provide a complete water sprinkler system for dust control .
9 . U'rILITIE.S : Any and all utilities provided to the
TENANT shall be at TENAt4v S cost: and TENANT shall be required to
use sufficient water to handle the dust Londiti.ons .

make any alterations to the premises without the written consent
of CITY .

assigned or the premises sublet or licensed for use by others
exce;:t with the prior written permission of city , and CITY
expressly reserves the right of re-entry for any violation of

the right to re-enter and inspect the premises at all reasonable
times .
13 . INSURANC'::
In addition to the. Workers ' Compensation insurance, and
TENANT' 'S agreement to indemnify CITY , 'I'ENAN'T shall turnish to
CITY and maintain in force_ until the termination of its tenancy ,
a policy of general liability insurance in Jhich CITY ,,s named as
an additional insured . The policy shall indemnity CITY, its
Officers and employees , while acting within the Scope <.t their
duties , against any :end all c1aimy arising nut c?f or in

without thirty ( 30 ) days ' prior written notice to C1TY.

14 . WAIVER OF rONUITION CP PREMISE.,
TENANT warrants that he has inspected the premises and
is aware of the condition thereok and accepts same "as is .

of its recycling; operation for crushed miscellanuot-s matt-rial (G MI) . C`M is manu-
factured by crushing, salvaged asphalt concr:•te, clonc-:rete and rack by portable rrut.I;tng
equipment.

ANALYSIS:

The terms of the Sully-`tiller .lease provide for a 15' discount on City purchased 01M
and for the free disposal of materials removed from the strk-et and demolition projects.
The availability of (DLH locally reducen sub contractors ' bids; on City projects and it
also eliminates long, haul r.ost:;. The I'ubl ic. Work!i I eparttrwnt has estimated that these
Savings to the City amount to over S100,000 per annum.
The lease addresses Sully-Millc!r's environmental impact by calling; for an adequate
sprinkler system for dust control and inspection provisions to monitor the operations.
CONCLUSION:
The Sully-Miller lease would be revenue producing, cost affective and environmentally
acceptable.
