WORK ON RArLROAD RIGHT OF WAY Where applicable, the City will apply for the permit or ease- ment to cross or parallel the tracks wi�:hin a railroad right of way. The contractor shall pay for any inspections by the railroad and shall furnish any bonds required by the railroad. work shall be done in conformance with thA directions from the railroad permit and job inspector. If a base is required, the Caging shall be of the size and type as called for on the plans and the pipe shall be installed in accordance with the pipe manufacturer ' s installation guide . SjCTION 3-14 WORK ON STATE HIGHWAY RIGHT Or WAX Where appl!.carble # the City of Huntington Beach will secure the permit for maintenance of the Water System from the State of Calif- ornia , Department of Transportation. The contractor will be required to apply for the actual permit to construct . Th© contractor shall submit to the Department of Transportatlon (along with the application) a duplicate copy of his performance bond to the City and duplicate certificated of insurance . The cons-- tractor will, be held responsible to pay for any and all tests or inspections required by the States. The requirements of the permit will be available to all bidding contractorm and P duplicate of the permit will bo furnished to the successful contrr-Mtor . The contractor shall be held responsible to follow each of t:he .;-ires:ctives of the permit and any instructions by they local State inspector . The local office of the Department of Transportation shall be notified by the contractor at least 24 hours prior to any construction . The contractor may expect the following -co be required s a . Examination of plans S ecifications S ecial Provisions and Sete o or The bidder shall. examine carefully the site of the work con- templated and the proposal , plane , specifications and ccntrart forms therefore . It will be assumed that the bidder has inves- tigated and is satisfied as to the general and local condativnd to be encountered; as to the character, quality and quantities of the work to be performed and materials to be furnishedt as to the character of equipment and facilities needed preliminary to and during the prosecution of the work; and as to the requirements of these sped f.ications . a It in mutually agreed that submission of a proposal shall be considered prima facie evidence that the bidder has made- such examination. No verbal agreement or conversation with any officer, agent or employee of the City wither before or after the execution of this contract shall effect or modify any of the terms or obligations herein contained. 2-b . Director of Public works at the Civic Center, H,,;ntington Beach, California. The bidder shall submit his proposal on the form furnished him. Proposals submitted on forms other than the one issued to the bidd:%V will be disregarded. All. proposals must give the prices proposed both in words and numbers , of which words will prevail. Gver numbers , and must be signod by the kidder with his address and telephone number . If the proposal is made by an individual , his name,post office address and telephone number must be shown. If made by o firm or partnership must be shown. If made by a corporat � fie proposal must show the name of the State under the I which the corporation was chartered,, the name of tl, jorationi and the names , titles, and business addesses anu ,_iephone numbers of the President, Secretary and Treasurer. 2-d . Prpaosal Guaranty All bids shall be presented under sealed cover and shall. be accompanied by cash, a cashier ' s check , certified check, or bidder ' s bond made payable to the City of Huntington Beach, for an amount equal to at least ten percent (10%) of the amount of said bid, and no bid will be considered unless such cash, cashier ' s check, certified check, or bidder' s � bond is enclosed therewith. 2-e . Withdrawal of Pro orals Any bid may be withdrawn at any time prior to the hour fixed in the notice to contractors for the opening of bids , A provided that a request in writing , executed by the bidder or his duly authorized representative , for the withdrawal of such bid, is filed with the City Clerk. The withdrawal of a kid shall not prejudice the right of a bidder to file a neat bid. 2-f . Public_ Opening of Proposals Proposals will be opened and read publicly at then time and place indicated in the notice to contractors . Bidders or their authorized agents are invited to be present. 2-9 . Rejection of Proposals Containing Alterations , Z asures or I_rrpqularities Proposals may be rejected if they show any alterations of form, additions not called for , conditional or altern&tive► bids, incomplete bids , erasures # or irregularities of! any kind. Any mistakes and their subsequent corrections shall � be initialed by the bidder . The right is reserved to reject any or all proposals. 2-h . nis ualification of eiddars More than one proposal from an individual , a firm, a partner- � ship, a corporation, or an association under the same of different na►n►tas will not be considered. Reasonable ground for believing that any bidder is interested in pore than one proposal for the work contgnplated will cause the rejection of all proposals in which such bidder in interested . If there is reason for believing that • collusion exists among any or all bidders , any or all .)roposals ray be rejected . Proposals in which the prices obviously are unbalanced may be rejected . 3 . Award and Execution of Contract 3-a . Award of Contract The right i� reserved g re�er.vEc, to reject any and all proposals . The award of the contract , if it be awardeel, will be to the lowest responsiblo bidder whose proposal complies with a13 the requirements prescribed. All bids will be compared on the Lasis of the C ity ' s estimate of the quantities of work to be done. 3-b. Return of Bidder ' s Guarantee Within ten ( 10) days after the award of the contract, the City of Huntington Beach will return the propo3al guarantee accompanying such of the pz'oposala which are not be be con- sidered in making the award. All other proposal guarantee will be held until the contract has been finally executed, after %hick they will be returned to &:he respective birlders whose proposal, they accompany. 3-c . Contract Bonds The contractor shall furnish the three good and sufficibnt bonds in accordance with the requirements of the State Contract Act , the Improvement Act of 1911 , or the Municipal Improvement Act of 1913 , whichever Act is applicable, Said bonds shall be cash , Cashier ' s Check, Certified Chsok, surety � bonds, subject to Stage or Federal regulation. One of the said bonds shall be executed in a sum equal to 1000 of the contract price to guarantee the faithful performance of said contrast by the contractor. . The second bond shall. be executed in a bum equal to at least; 50% of the contract price: to guarantee payment of the claims of laborers or mechanics who perform %%,rk under the contract, and the claims of persons who furnish materials, supplies , manufactured articles , equipment or machinery used or consumed by the contractor in the performance of the contract . The third bond shall be executed in accordance with Section 12 of these General Reau i r.a nents . Whenever the City of Huntington Beach has cause to believe that any such bond has become insufficient, a demand in � writing may be made of the contractor for such further or additional bond as is considered necessary, considering the extend of the work remaining to be done. Thereafter no payment shall be made upon such contract to the contractor or any assignee of the r..ontraetor until such further or additio+ial bond has been furnished . 3-d . Execution of a Cash Contract. The contract shall be signed b} the su..:cessful bidder within ten ( 10) working days after ter award and aturne=_d together with the contract t bonds, to the City Clerk ' :, office , Work shall commence within 20 working days, after Vie contract has been awarded . No proposal shall he considered binding upon tnc City until. the complete execution of the contract by the contractor and the City . Control of Materials 6-a . Qualit , of Material Materials shall be now, and of specified kind and quality and fully equal to samples when samples are required . When the quality or kind of material or- articles shown and required under the contract is not particularly specified, the contractor shall estimate that the City will require articles or materials representing the Ix--st of its class or kind or at least equal to the class or quality of similar articles or materials that are specified . Materials shall be furnished in ample quantities and at s;tch times to insure uninterrupted progress of the work . Same shall i be stowed properly and protected as required . The contractor shall be entirely responsible for damage or loss by weather or other. cause . 6-b . Trade Nacnes or liquaLs it: is the intent of theme specifications to permit the con- tractor to supply any of the materials specified or offer an equivalent . The engineer sh;.11 determine whether the material offered is equivalent to that specified . Adequate time shall be allowed for the engineer to make this determination . Whenever any particular material. , process , or equipment is * indicated by patent , proprietary or brand name, or by name of manufacturer. , such wording .is used for the purpose of facil- itating its description and shall be deemed to he followed by the words "Or approved equal " . A l.i.:it.ing of !,tawerials is not: intended to be comprehensive , or in order of prefer:c.r.re . The contractor may offer for approval any material , process , or equipment which he considers to be equivalent to that indicated . Unless otherwise authorized - uy the engineer the substantiation of offers must be sub- mitted within 35 days after award of contract . The contractor shall., at his expense., furnish data concerning .items offered by him as equivalent to those specified . fie � shall have the material tested as required by the engineer " to determine that the quality , strength , physical , chemical , or other characteristics , including durability , finish. , of f. Lciency , dititensions , service , and suitability are such that the item will fulfill its intended function. Test methods shall be subject. to the approval of the engineer . Test results shall be reported promptly to the engineer , who will evaluate tho results and determine if the s ubstitUt-A! item is equivalent. . His finuings shall be final . Installation and use of a substitute item shall not be made:: until approved by the engineer . � If a substitute offered by the contractor is found to be not equal to the specified material , the contractor shall furnish and install the specified material . The specifies contract , completion time :3hall not be affected � by any circumstance developing from the provisions of this " subsection . 6-c . Simples and Tests At the option of the Director , the source of supply of each of the rnate:rials shall be approved by the Director before _ delivery is started and before such material is used in the work . Upon request of the Director of Public Works , representative preliminary material samples of the character and duality prescribed shall be submitted , by the contractor producer or manufacturer of all materials to be used in the work , for such testing or examination deemed necessary by _ the Director of Public Works . Alltests of materials furnished by the contractor shall be made ir, accordance with commonly recognized standards of national organization , and such special methods and tests as are prescribed in these specifications . The contractor shall furnish , at no cost to the City , such samples of materials as are requested by the director of Public Works . No material shall be used until it has been approved by the Director of public Works , 0 materials requiring test shall be delivered in ample time before intended use to allow for testing, and noritt may be used before receipt of approval . All approvals or decisions will be rendered in writing . Samples that are of value after testing shall remain the property of t,ie contractor. 6-d. Defective Materials All materials not conforming to the requirements of these .specifications shall be considered as defective , and all materials , whether in place or not, shall be rejected and s. sl: be removed immediately from the site of the work unless otherwise permitted by the Director of Public Works. No re.jccted material , the defects of which have been sub- sequently corrected, shall be used until approved in writing ;ay the Director of Public Works . Upon failure on the part of the contractor to comply with any crder of. the Director of Public Works made ender the provisions of:this article , the Director of Public Works shall have authority to remove and replace defective material and to deduct the cost of removal and replacement from any monies due or Lo become due the contractor . 7 . Legal Relations and Res`unsibilities 7-a . General Compliance with. Law i The contractor shall keep .informed and observe , and comply with , and cause all of his agents and employees to observe and comply with , all prevailing Federal , State and Municipal Laws, Ordinances , Rules and Regulations which in any way affect the conduct of the work of this contract. 1£ any conflict arises between provisions of the plans and specific- ations and any such law above referred to , then the contractor .. shall notify the City at once in writing . The contractor shall protect and indemnify the City or any of its officers , agents , and employees against any clam or liability arising from or based on the violation of any such law-, ordinance , rule or regulation , whether by himself or his agents employees . 7-b. �Uistration of ,Contractor Prior to the award of contract, the contractor shall be lit.ensed in accordance with the provisions of Article 1 to 9 inclusive of Chapter 9 , Division 3 of the business and Professions Coda of M the State of California and Amendments thereof , providing for the registration of contractors, and defining the term con- tractor; providing a method of obtaining licenses to engage in the business of contracting and fixing the fees for such licenses ; and prescribing the punishment for violation of provisions thereof , as amended. i 7-c . Permits and Licenses 'rho contractor shall, procure all permits and lAcansee , pay all charges and fees , and give all notices necessary and incidental to the due and lawful prosecution and completion of the work. i 7-d . Patents The contractor shall Lassume all. liability arising from the use of patented materials , equipment , devices , or processes used on or incorporated in the work . 7-e . California Fair Dmployment• Practice Act The contractor shall utilize fair employment practices in accordance with California La'Dor 4ode Section 14-10 et seg. 7- f . Prevailing Wage The contractor shall forfeit as penalty twenty-.five dollars � ($25. 00) for each laborer , workman or mechanic employed for each calendar day or portion thereof, such laborer , workman or mechanic is paid less than thy, general prevailing rate of wages stipulated for any work gone by him, or by any subcontractor: under him in violation of the provisions of the Labor Coda . t-)articularly Section 1770 to 1781 thereof , both inclusive , providing for the payment of not less than the general prevailing rate of wages for legal holiday and overtime work on public work , providing for the ascertain- ment ut: such general prevailing rate by the public body awarding the contract , providing for the keeping of records � I of the wages paid all workers engaged in public work and the inspection of such records by the proper officials , providing for forfeiture for each calendar day, or portion thereof, any worker is paid less than the said rate and for a stipulation to this effect in the contract , and providing other penalties for violation of the provisions . � 7-9 . flours of Labor The contractor shall forfeit , as penalty , twenty--five dollars ( $25 . 00) for each laborer , workman , or mechanic employed in the execution of the Contract by him, or by any subcontractor under him for each calendar day during which said laborer , workman, or mechanic is required or permitted to labor more than eight ( 8 ) hours in violation of the provisions of the Labor Code, particularly Section 1810 to 1816 thereof , both inclusive , relating to the hours of labor on public works , by recpiir. ing contractors to file with the awarding body a verified report as to the nature of any extraordinary emergency when their employees are permitted to work over eight (8) hours per day, together with the dames of the said employees , and the hours worked per day making failure to file said report within thirty ( 30) days prima facie proof that no extraordinary emergency axi:aged, also making it a misdemeanor for any contractor or subcontractor on public work, or agent thereof , to fail to keep an accurate record showing the name of and the actual hours worked by each workman employed by him in connection with public work. 7-h. Apprentice on Public Works The contractor shall utilize apprentices on public works in accordance with California Labor Code Section 1777 . 5 . 7-i . Public Convenience_ and Safes The contractor shall so conduct his operations as to cause the least possible obstruction and inconvenience to public traffic. Residents alone the roads street , or other alignment of improvements shall be provided convenient access to driveways , houses , and buildings along the road or street, and temporary crossings shall be provided and maintained in good condition . Not more than one cross street or intersecting street or road shall be closed at any one time without the approval of the Director of Public Works . The contractor shall furnish, erect, and maintain such fences , barriers , lights , and signs as are necessary to give adequate warning to the public at all times that the road or street is under construction and of any dangerous conditions to be encountered as a result- thereof , and he shall also erect and maintain such warning and directional signs as may be furnished by the City . strict prohibition against counitting any nuisance in or about the work must be maintained . Coveni.ences shall be provided for employees and maintained in sanitary conditions. At street crossings and where existing driv^ways occur, the contractor shell make provision for ditch crossings at these � points either by means of backfills or temporary bridges as the Director of Public Works may direct . Free access must be provided to all fire hydrants , water gates , meters and private drives, and means shall be provided whereby all storm - and waste wn::er can flow in the gutters uninterrupted. 7-J . Accident Prevention Precaution shall bn exercised at all times for the protection of persons (including employees) and property. The safety provisions of applicable laws , building and construction codes shall be observed . Machinery equipment , and other hazards shall be guarded or eliminated in accordance with the safety provisions of the California industrial Accident Commission# Federal and California OSHA, State Industrial Safety and tha "Manual of Accident Prevention in Construction" published by the Associated General Contractors of America, to the extent that such provisions are not in contravention of applicable law. 7-k . Preservation and Cleaning The contractor shall properly preserve and clean the work as it progresses . At regular intervals , cr when directed , rubbish shall be collected and removed , and at completion the whole work shall be cleaned and all tools , false work , equipmenk and rubbish shall be removed from the site, which shall be ` left in clean and proper condition as directed . 8-m. Acceptance Should it become necessary, due to developed condition, to occupy any portion of the work before contract is fully com- pleted , such occupancy shall not constitute acceptance. 9 . Measurement and PaMe n for a Cash Contract 9-a, Extra and Force Account Work Extra work as defined, when ordered and accepted shall be paid for cinder a written change order in accordance with the terms therein provided. Prugrc�ss Ua;ements- The City shall , once in each month , cause an estiinat e .icy writing to be made by the Director of Public, Works of the � total amount of work done and the acceptaLle materials furnished] and delivered by the contractor to the job site and not used as of the time of sv.ch estimate and the value thereof. The City shall retain money ir. the amount of ten percent (10%) of the progress payment unless approval of Director for greater percent of such estimated value of the work done. The City shall retain money in the amount of � fifty percent ( 50%) of the value of the materials so estimated to have been furnished and delivered and unused provided the materials were fabricated specifically for the project . No payment will be made for standard stock items that have not been incorporated in the work . The Ci'.y shall monthly pay � to the contractor while performing the work , the progress payment balance , after deducting therefrom all previous payments and ail sums to be kept or retained under the provisions of the contract . No estimate of payment shall be required to be made when in the judgement of the director of Public Works , the work is not proceeding in accordance with the provisions of the contract or when in his judgment the total value of the work done since the last estimate amounts to less than three hundred dollars ( $300) . Progress payments shall be st.bmitted to the Department of Public Works on the Monday before each City Council meeting � for monthly progress payment or final payment. City Council meetings are held on the first and third Monday of each month. Progress payment shall also be typed written on form furnished by the City ( see forms) . 9-.c. Final FeXment The Director of Public Wo;7ks shell , after completion of the contract, make a final estimate of the amount of work done thereunder and thu value of such work # and the City of Huntington Beach shall pay the entire oum found to be due after deducting therefrom all previous payments and all amounts to he kept and all amounts to be retained under the provisions of the contract. All prior partial ast mates and payments shall be subject to correction in the fia;ai estimates and payment. Payments for a Special Assussmr nt District Contract Final Payment The Streat Superintendent, af':or the completion of all work to be done under the contract , shall forthwith make an assess- ment to cover the gum due for the work performed and specified in said contract (including all incidental expenses chargeable to the proceedings) in conformity with the provisions of the "Improvement Act of 1911" , Division 7 , of the Streets and Highway Code of .the State of California . Note This paragraph is not applicable when other methods for pay- ments are stated in the contract. 11 . Bid Price The contractor shall for the price bid , furnish all equipment, labor and materials and do all incidental work necessary to deliver all of the improvements complete in place in accord- ance with the specifications, special provisions , Grdinarces, plans , cross erections detail drawings and City standard plans . 12. Guarantee The contractor, by submission of a bid for this project, expressly agrees to the herein stipulated guarantee of materials, products, workmanship, and installations incorporated Into this project. All work performed in accordance with these general require- ments , special provisions, specifications, and plane, including , but not limited to, workmanship, installation, fabrications, i;;aterials, and structural, mechanical, or electrical facilities shall be guaranteed for a period of one year , commencing at the recorded date of filing the notice of completion of the contract by the City. Unless specific areas are to be guaranteed longer as provided in special provisions . Security of this guarantee shall be .furnished to the City in the form of a bond in favor of the City for an aieount equal to 10% of the final adjusted and agreed upon contract: price. Notification will be given to the contractor of the date of anticipated Council acceptance and the expected date of filing of Notice of Completton in order that he may airange for the bond.
