PROFESSIONAL SERVICES CONTRACT
The BIOME Company, Incorporated hereby agrees to provide the following services
to the City of Huntington Beach, California in accordance with the terms as
specified.
(1) Thy preparation and submittal, to parties which may be designated, of
a completed Draft Environmental Impact•. Report cone ning Zone Case #
72-39. -
(2) Tiie subsequent preparation and submittal of a completed Final Environ-
mental Impact wort for Zone Case #72-39.
The Draft Report and the Final Report will be, prepared in accordance with the
Guidelines fcr Implementation of the California Environmental Quality Act of
1970 (California Administrative Code, Title 14, Division b, Chapter 3) adopted
by the Resources Agency, State of California on lebruary 3, 1973; and. in accord-
ance with the Guidelines provided by the City of Huntington Beach.
A total of twenty five (25) copies of the Draft Report will be delivered to the
Environmental Resources Section of the City of Huntington Beach Planning Depart-
ment and to other parties which may be designated no later than Wednesday,
February 28, 1973.
Additional services required to prepare and submit the Final Report will be pro-
vided by the Company as requested by the City, in accordance with a schedule to
be established by the City.
The Company will provide representation at any and all hearings concerning Zone
Case 72-39, as may be required by the City.
In preparing the reports the Company will utilize information and data which is
deemed to be the most current, most accurate, and most complete available.
Where necessary and wherf within the technical and financial constraints of the
Contract the Company will derive originr,:l data and information. The Company
will be solely responsible for all analyses and cont-lusions based on available
and derived data and information.
Fur the above services the City of Huntington Beaelk agrees to pay the BICNtE
Company, Inc. the total agreed sum of Two Thousand D,!I,.rs ($2000.00). The
payment conditions are that Seventy Five Per Cent (75%) of the total is due
and payable on the date of delivery of pie Draft Report to the designated
recipients. The remaining Twenty Five Per Cent (25%) is due and payable upon
acceptance by the City of the Final Report.

Services-reouested :by the City which are not reasonably included in the scope
of the work previously describcd shall be seperately negotiated. The City may
termi,,'dte this Contract upon written notice to the Company, in which case the ,
Company is entitled to be fully compensated for serrices performed to the date
of termination. All work accomplished will remain the property of the City.
In the ev&at an action is taken. for recovery of monies due or to becci.e due
under the Coricract or by reason of any breach of any covenant hei.:ir, r—twined ,
the prevailing parry shall be entitled to all of the costs ,.} -gin tLere-
with exclusive: of attorney's fees.

The BIOME Company, Incorporated hereby agrees to provide the following services
to the City of Huntington Beach, California in accordance with the terms
