" WHEREAS, the City Council of the City of Huntington Beach, County of Orange, State of California,.pursuant to statutes in such cases made and provided, duly and regularly caused a notice. to be published, calling for bidsfor labor, material, tools and equipment for the construction of vitrified clay pipe sewer main and appurtenances in Rail Avenue and Bolas Chica Street in the Citq of Matington Beach, CC-392. in said City of Huntington Beach, California, said work to be constructed :, ccording to plans, specifications, general requirements, and special N I ovisions for same on file in the office of the Director of public rks and adopted by the City Council of Raid City of Huntington Beach the 6rh day of. NOWT THEREFORE, in consideration of the convenants and agreements herein contained, being done and performed by t6o parties hereto, it is hereby agreed as follows: I. By icy signature hereunder, as Contractor, I certify that I am aware of the provisions of Segtion 3700 of the Labor Cole which require every employer to be insured against liability for workmen's compensation or to undertake self-insurance in accordance with the provisions of that code, and l will comply with such provisions before commencing the performance of the work of this contract. lI . Contractor agrees to receive and accept as f all 'compensa- tion for furnishing all materials and for doing all. tree work contemplated and embraced in this agreement, the unit prices Con- tractr.-r submitted in his Proposal which was accepted by the City Coun��:1. A copy of said Proposal is attached hereto and incorporated herein by reference and made a part hereof. Contractor further agrees that said payment by City shall include all payments for all lass or damage arising out of the nature of. the work aforesaid, or from the action of the elemental or from any unforeseen difficulties or obstructions which may arise or be encountered in the prosecution or the work until its acceptance by the City, and for all risks of every description connected with the workf also for all expenses incurred by or in consequence of the suspension or discontinuance of work and for well and faithfully completing the work, and the whole thereof, in the manner and according to the plans and specifi- cations, and the requirements of the Engineer under them. III. City agrees with the said Contractor to employ, and does hereby employ, the said Contractor to provide the materials and to do the work according to the terms and conditions herein contained and referred to, for the prices aforesaid, and hereby contracts to pay the same at the time, in the manner and,upon the conditions set forth in the general requirements and the said parties for themselves, their heirs, executers, administrators, successors and assigns, do hereby agree to the full performance of the convenants herein contained for the contract bid amount of . 81g3.g11.qft which amount in subject to adjustment upward or ownwar `"maceepe�n't upon inplace quantity were applicable.
