New Policy or Excapti Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Proposals were requested from qualified engineering firms to prepare street and storm drain improvement plans, specifications, and estimates for the Oakview, North Half Redevelopment area. RECOMMENDATi .Ne 1. Approve the selection of Walden and Associates to prepare plans, specifications, and cost a-timates for the subject project. 2. Establish a design budget of.411S,000 (this will include the consultant agreement of $104,300 and $10,700 for anticipated Change Orders). 3. Authorize the Agency CImIrman and Agency Clerk to execute the attached consultant agreement with Walden r.nd Associates for a fee not to exceed $104,300. ANALYSIS: The Oakview, North Half area is a t 70 acre section of Huntington Beach, located southwest of the intersection of Beach Boulevard and Warner Avenue. (See Vicinity Map attached). The region is part of the Oakview Redevelopment Project Area as defined in the Redevelopment Plan for the area adopted in September, 1992. Existing streets in the area are without curb, putter, and sidewalk in most locations of the project. Street pavement is in bad repair, needing major improvement or actual replacement. Storm drains need to be extended and upgraded to eliminate local flooding. This project will correct these deficienc9es and also provide improvement plans for the Keelson Lane, Elm Street interface. Proposal. to perfo; m this work were received :'rom seven engineering firms. Four of these firms were planed on the short list and interviewed by a committee of three staff people from the Public Works Department. The services of the COAT►AACTOR are to commence as soon as practicable after the execution of this Agreement and all tanks specified in Exhibit »A" shall be completed as soon as possible after the date of this Agreement. This schedule may be.amended to benefit the PROJECT if nrstually agreed by that CITY and CONTRACTOR. 4. COMPENSATION in consideration of the performance of the sorvicea described in Section 1 above, AGENCY. agrees to pay CONTRACTOR a fee not to exceed One Hundred Four Thousend Threo Hundred Dollars ($104,30J), plus all expenses reflected in Exhibit "A". 5. EXTRA WORK In the event AGENCY requires additional services not ,';icluded in Exhibit "A," or changes in the scope of services described in Exhibit "A," CONTRACTOR will undertake such work after receiving written authorisation from AGENCY. I Upon submission of any such invoice, if AGENCY is satisfiel that CONTRACTOR is making satisfactory progress toward completion of tasks in accordance with this Agreement, AGENCY shall promptly approve the invoice, in which event payment shall be made within thirty (30) days' of receipt of the invoice by AGENCY. Such approval shell not be unreasonably withheld. If the AGENCY does not approve an invoice, AGENCY shall notify CONTRACTOR in writing of the reasons for non -approval, within 3oven'(7) calendar days of receipt of the invoice, and the schedule of pr*formance set forth in Exhibit "A" aha11 be suspended until the parties agree that past performance by CONTRACTOR is in, or has been brought into compliance, or until this Agreement is terminated pursuant to Section 12 hereof. DISPOSITION OF DOCUMENTS CONTRACTOR agrees thct all material's prepared hereunder shall be turned over to AGENCY upon termination of this Agreement or upon PROJECT completion, whichever shall oarur first. In the event this Agreement is terminated, said materials may be used by AGENCY in the completion of PROJECT or as it otherwise sees fit. Based on �• the "Scope of Work' referenced in the 'Request for Proposal" and onsite visits there appear to be a number of issuts 'hat could significantly impact this project from a design and �;f;�.,.►rj` " timing point of view. Cur Scope of Services and Proposed Schedule will address these in more detail but generally we see the following major issues: 1. .be majority of the site appears to have been developed many years ago under criteria different than today. The most significant problem seems to be many areas of nnsite drainage from lot to lot and from lots to streets. The garage and house finish floors appear to be marginal for drainage not taking into 300ount a future curb and sidewalk build-up. We see the unsite drainage issue for a large number of lots as a major challenge to this project. We do not know at this time the Ci 's intent on the Elm Street/Keelson Street cul- 3 t de -sacs. Our proposal addresses either a cul-de-sac or through street alternative- r� Hrmrnr, we see the potential for a schedule concern because the Precise Plan of Alignment must be processed through the various City departments and governing agencies for appro%AL 'Iris approval could have an impact on the timing of design and construction plan completion and approval. Our Proposed Schedule has trade an allowance for seven (7) week City processing cycle before it would interfere with wr design schedule. The Precise Plan approval needs to come at, or before, t,Se end of the City first plan check of our plans. 3. With the City furnishing the required title information and reports for those parcels needing to dedicate land, we will prepare the neceARry documents, legal% sketches �.t and coordinate with the City's Real Estate Services Department. However, we see the potential for construction delay based on negotiations and acquisition o: property by the City, Our recent experience with the R.E. Services Department tells us that ibis process is not time>y and should be made a priority item by both the consultam and the City in order not to delay construction. Our schedule indicates this is one of our first orders of business. 4. 'rbe City's ticsired schedule of four months for design completion and approval tnay be impactel by Cal -Trans in obtaining an Encroachment Permit. Our schedule indicates s0mittal to them at the same time we submit out plans to the City for checking. We have gi%vn them 6 weeks to respond in a manner that can keep the desired schedule. We will provide for separate plans and documentation to qualify for the CDBG program fundw Task 7: For any work done under Twk 4 and 6 that is within CaMans rigbt-of-way, we will submit and process plans and catulations for an Encroachment Permit. Again, as noted in the Section I, we see a negative impact to our schedule if these plans aren't developed, prczessed and app shred in a timely manner. The schedule makes it very clear that if we don't restive Carlhas wmments within sit weeks after submittal, there will be a delay in the design of this project. The City will be the applicant for the Encroachment Permit and will pay all fees and bonds. We will r-ibmit all plans and process with Ca1TYans for a pumit. Task : Based on title reports and documents furnished by the City, we will prepare the required right-of-way dedication plats and legal description for those parcels required to make a street dedication. We wilt coordinate with tLe City's Real Estate Senice Department by providing documentation. The previous section highlighted 3 potential delay in this project if the required right-of-way is not negotiated for and obtained by the City prior to start of I construction. Based on our working relationship with the R.E. Service Department on other proj-cts in the City we. can provide the appropriate plats and legals in accordance with our aggressive schedule. TAILQ: Based on information furnished by the City and the Orange County Wate: District, WE will prepare the studies and exhibits to assist the City Staff in i' their presentations to the public for the abandonment of the existing water wcu. a71 - ft, r�l �k 100: Using the studies and exhibits approved in Task R, we will prepare the construction plans for abandoning the existing water well and the existing ptiva'e water rystems.
