The present drainage fee for this acreage is $1Q.342.50 . The legal description of the boundary of this property is as follows: Parcels 2 and 3 of a Parcel Map, recorded in Book 95 at pages 2 and 29 records of Orange County. The develo*nmenL ..escribed above is: (check one) Open space development Industrial development X For Open Space Development: A cash deposit of $ N/A , representing 10 percent of the drainage fee required as of this date, is hereby paid and receipt acknowledged.. An additional 25 percent of the drainage fee required shall be paid five (5) years from this date. The remaining 65 percent shall be paid ten (10) years from this date. These deposits shall be retained by the City and applied to the total drainage fee in effect at the expiration of this deferment This deferment expires NIA or sooner in the event fees are not paid when due. For industrial Development: A cash deposit of $3,868.50 representing 20 percent of the drainage fee required as of this date is hereby paid and receipt acknowledged. The remaining 80_percent shall be paid at the rate of 20 percent per year for the following four (4) years on the anniversary date of this JG:cs agreement. In the event this agreement conflicts with or contra- dicts any city ordinance, the ordinance provisions shall prevail over the terms of this agreement. Agreement for Drainage Fee Deferment m77-1 Northwest Corner of Slater and Nichols Dear Council Members: Transmitted herewith is an agreement for drainage fee defer- ment between the City and Walter A. Frome, Jr. for his industrial development at the northwest corner of Slater and Nichols. Mr. Frome is developing 7.7 acres of property and has applied for deferment of a portion of the drainage fees required for his industrial development in accordance with Section 14.48.080 .of the Huntington Beach Municipal Code. The current drainage fees required for the subject develop- ment is $19,342.50. Mr. Frome has paid a cash deposit for $3,868.50 which represents 20 percent of the required drainage fees. The remaining 80 percent will be paid at,a. rate of ::Q percent- per year for the following four (4) years on the anniversary date of the deferment.
