V?HEREAS, CITY has `dcaermined that the public interest

and
WHEREAS, 'CITY has determined the public interest requires
the noise element of the General Plan'be firmly based on complete
noise data analyses, and
WHEREAS, CONSULTANT is qualified to undertake and complete
such analyses and is willing to undertake same;
NOW, THEREFORE, the.'CITY and CONSULTANT in consideration.
of the mutual covenants and agreements hereinafter contained, do
hereby agree, each with the other, as follows:
I. SCOPE OF STUDY
The work to be done by CONSULTMT in this study is
set out in Exhibit "A", attached hereto and by this reference made
a 'part hereof.
II. STUDY AREA
The study area will be defined.as all lands lying
within the corporate limits of the City.

be completed `and a draft report submitted to the City 'witliin
forty --five `(45) days following execution. CONSULTANT shall provide
additional services in -the form bf``assistance to CITY as defined
hereinafter for a period of riot 'rrlore than` sixty (60) da.ys after
'delivery of draft 'report. The final report shall be submitted
ten (10) days after- City approval of the draft report.
IV. MEETINGS
CONSULTANT further Agrees to provide oral public
presentations on said report to CITY'S Planning Commission and
City Council at such times and in such numbers as CITY'S repre-
sentative-deems"appropriate. Said oral presentations shall not
exceed'a total of four (4) in number. CITY agrees to'notify

consultant'of the time and place of said oral. presentations at
least ten (10) days prior to the date on which the presentations
are to take place.
Beyond these oral public presentations, CONSULTANT
will meet regularly • with authorized repressent.: +.ivies of the Planning
Department staff in order to .facilitate coordination and to .
dutifully carry out the study to completion.
V. BILLING AND PAYYXNT
For furnishing the services specified'under Exhibit
"A" of this Agreement, CITY agrees to pay CONSULTANT the sum of
Ten Thousand Three Hundred Dollars ($10,300.00). Partial payments
TOTAL
The total amount of Ten Thous'arid Three Hundred
Dollars (fi10,300 00) shall include all costs. incurred by CONSULTANT
for salary and out--of-pocket costs for travel and miscellaneous
expenses -necessary to perform the Scope of Services specified under
Exhibit "A" of.this agreement.
Any specific -additional assignments, salary expenses,
authorized travel and appearances not provided for in the scope.of
services set forth under Exhibit "A" must be approved by CITY;
payment for said approved and designated additional work and
reimbursable expenses shall be made on a calendar. month basis at
monthly intervals on the basis of the Consulting jute Schedule,
marked Exhibit "B" and attached hereto and by, reference made a

part hereof, and each payment shall be made within ten (10) days
after presentation to CITY of a statement setting forth in detail
the additional work performed and all costs,incurrecl,by CONSULTANT,
together with supporting vouchers, for the period covered by. each
said statement.
VI. DESIGNATION OF AUTHORIZED`REPRESENTATIVES
CONSULTANT hereby agrees, upon the signing of this
Agreement, 'to furnish the City in writing the name of an.individual
who will be authorized to act in'person or through his designee for

CITY agrees, upon"signing'this Agreement, to furnish

It is understood and -agreed by. said parties that.
the authorized representative may be changed, provided either
party,to this Agreement so desiring the change give at. least five
(5) days' prior notice in writing to the other, naming its new
authorized're'presentative, and that CONSULTANT'S said representative
'shall be acceptable to the CITY.
VII. COOPERATION
All departments of the.CITY will assist CONSULTANT
in the performance of this study, and CONSULTANT agrees'to provide
general guidance and direction to'CITY personnel that are to assist
CONSULTANT in the dolleation of data and the preparation of the
'report. CITY shall provide letters of introduction of CONSULTANT
to
such other persons,
firms, or.governmental
entities
as necessary
to
assist CONSULTANT in
obtaining
required data.
The use of CITY records and personnel by CONSULTANT
I hall be coordinated through the CITY'S representative.
VIII. OWNERSHIP OF REPORTS AND DATA
All reports, exhibits, data, and other work or
materials prepared in compliance with this Agreement shall be and
remain the property of the CITY, to be used by CITY as may be

X; TERMINATION
This agreement is subject. to termination by the
:CITY at'any time upon serving written notice to CONSULTANT, and
the CITY shall thereafter be liable to CONSULTANT only ' for fees
and costs accrued to the date of receipt by CONSULTANT of such
notice. 'All completed'`paper work and accumulated data shall
became the property of the CITY.
XI. °NOTICES
All notices to CONSULTANT under this Agreement shall
be deemed .valid and effective upon deposit in the United States
Mail, postage prepaid, by certified and/or registered mail,
addressed to WYLE LABORATORIES, 128 Maryland Street, El Segundo,
California, 90245.

EXHIBIT A
SCOPE OF STUDY
TASK 1 - SOUND 'SURVEY
Field'data shall,be collected at approximately'50 sites
selected jointly'by city and consultants. These sites will
include representative Examples of both mobile and stationary
'noise sources within 'the City, `as well as typical residential
locations.
Field data wilt he oriented towards satisfaction of three
objectives:
Verification of analytical noise source strength
predictions.
Development of descriptive data on unique stationary
community noise sources.
Definition of typical noise environments at residential
locations throughout the City.
To accomplish these objectives, sound level measurements will
be made at standard reference distances from definable noise
sources at sufficient times and for sufficient durations to assess
the time variant nature of the noise emitted. For 'environmental
noise assessments, a sufficient number. of readings at varying times
during the day and night will be conducted to*defi:ne the typical
day and night ambient noise levels.
Data reportin.'T will include .(but not be limited to) dates and
times of day of measurements, specific location, proximity to major
sources, A peak noise levels. Additionally, mean energy levels
and residual levels will be reported. The standard units for
measurement will be A --weighted decibels.
TASK 2 --'DEVELOPMENT OF NOISE CONTOURS
Wyle personnel will meet with Department of Planning personnel
to review and.to obtain final approval of the specific noise sources
to be included in the study. These will include freeways and mayor
arterials, Meadowlark'Airport, rail operations, and major industrial
sites.
Existing data will:be.collected on traffic mix densities for
highways, on flight operations at the airport, on railroad schedules
and train types, and on other activities as required for evaluation
of major- noise sources. Sources for these data are expected to be
the Planning Department, airport and railroad authorities, the State
Department of Transportation, and Wyle files.
TASK 2.1 -- HIGHWAY NOISE CONTOURS
During an initial meeting, the methodology for drawing r:ighway
noise contours will be ?resented to Planning Department personnel.
This 'methodology willbe based on Wyle traffic noise model. Noise
contour generation methods and nomography for various highway traffic
conditions will be demonstrated to familiarize City personnel with
their use. This technique will then be applied to compute CNEL
contours along 1405, Beach Boulevard, and major arterials'in the
City of Huntington'Beach. In addition, freeways and major arterials
will be spot checked by field measurements to verify the accuracy
of traffic predictions.
TASK 2.2 - RAILROAD NOISE'CONTOURS
Similarly, the Glyle methodology for development of railroad
noise contours will. be presented to City personnel for demonstration
and subsequent application to rail lines within Huntington.Beach.
TASK 2.3 -- AIRPORT NOISE CONTOURS
CNEL 65 contours will be established for operations at Meadow-
lark Airport. These. contours will utilize flight pattern data
provided by airport personnel and base noise data in the Wyle..t_les.
Also, the potential effect of the U.,S. Marine Corps emergency
landing field (Mile Square) within the City of Huntington Beach
iaill be analyzed.
TASK 2.4 - INDUSTRIAL SITES CONTOURS
Noise survey data collected during the 50 site 1;ionitoring
phase will be utilized -14.-o generate noise level contours around
`prominent industrial sources, including oil drilling pumps.
TASK'3 - ANALYSIS OF MEASUREMENT AND CON buRS
Upon completion of Task 1 and 2, the measurements and contours
will be analyzed with respect to the implications that noise levels
have on land use. A review will be made of published criteria for
maximum allowable noise levels for various land use categories. A
map overlay(s) will be generated to graphically present land use
versus noise environment conditions. These overlays will include
latest EPA noise standards and limits as they apply to the present
and projected land use and zoning patterns in Huntington Beach.

The final report will contain a discussion of the potential for
improvement in the noise environment,considering' current `City
policies and the reasonable limits` of, rioise `suppression tecYinology,
TASK 4 EXAMINAiftON. OF COMMUNITY ORDINANCES
After examining the City Building COQ"C� Zcming Ordinance and -
General Pilan with regard to their implications for noise production
and control, Wyle staff members will, in conjunction with City
personnel, write a draft'of a new noise ordinance. The draft
ordinance will comply with the jurisdictional authority of the
City. In addition, simple procedures will be recommended so that
City personnel will be able to monitor the community and enforce
noise ordinances.
TASK 5 - DOCUMENTATION
A final report describing the work performed and the results
obtained will be prepared, delivered and discussed. The format of
this report will be
such that it
will be easily
understood
by the
general public, and
yet provide
a comprehensive
discussion
of
community noise in the Citlr of Huntington Beach. The final report.
will include:
The noise element for .the City, in proper format to..
satisfy the requirements of California.Government.Code
65302(g), and ready for inclusion in the.General Plan.
A draft of a noise'ordinance for the City, prepared in
conjunction with the Planning Department staff.
An analysis -of present and future land use compatible
with�the noise environment, including zoning implicatilis,
presented'in a map overlay format.

policies, noise measurement.methodologies, avid noise abatetrent
techniques. 'Furthermore, assistance at -up to four (4) public
meetings will be provided as needed.

CONTRACT FOR FORMULATION OF THE NOISE ELEMENT OF THE
GENERAT., PLAN
Attached for your approval and signature is a contract for consult-
ant services with Wyle Laboratories for preparation of the State -
mandated Noise Element of the General Plan.
This contract will provide the City with detailed noise information,
a Noise Element as defined by California Government Code 65302(g),
a draft noise ordinance, an analysis of present and future land
use compatible with the noise environment, and a projection system
to calculate future noise contours. These services will be performed
in 115 days .for $10,300. Halfof the costs will be allocated from
Planning Department Account Number 230390 and half from Environmental
Resources. Department Account Number 231408.
Approved as to form by the City Attorney, this contract concludes
a 2�-month effort to select a consultant. On April 15, 1974, the
Planning Department sent out a Request for Proposal to seven
notable firms. Seven proposa.s were received and reviewed by an
interdepartmental team from Planning, Environmental Resources,
Building, and Harbors and Beaches. Representatives from Wyle
Laboratories were interviewed by this same team, and a contract
was negotiated.

RESOLUTION NO. 3924
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF "HUNTINGTON ;BEACH, AUTHORIZING THE MAYOR TO
EXECUTE A CONTRACT WITH WYLE LABORATORIES
WHEREAS, Section 65302 of the California Government Code
requires that a Noise Element be added to the city's General
Plan; and
City desires to have such Noise Element prepared by a con-
sulting service; and
Wyle Laboratories have submitted a contract to perform such
service at a total coat of $10,300;.and r
The Planning and Environmental Resources Departments are able
to fund such total cost from Accounts No. 230390 and 2311108
respectively,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Huntington Beach that it does authorize and direct the Mayor
and City Clerk to execute said contract, a copy of which is attached
hereto and by reference made a part hereof, wit'ti Wyle Laboratories
for the preparcation of a Noise Element to city's General Plan, for
the total sum of $10,-,'00.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beaca at a regular meeting thereof held on the 5th
