HomeMy WebLinkAboutYouth Service Program - 1977-09-26SUPPLEMENTAL AGREEMENT NO. 3 TO LEASE AGREEMENT BETWEEN THE CITY OF HUNTINGTON BEACH AND YOUTH SERVICES PROGRAM DATED SEPTEMBER 263 1977 WHEREAS, the City of Huntington Beach and Y.S.P., Inc., also known as Youth Service Program, mutually desire to amend their agreement of September 26, 1977,:as amended November 20, w 1978, by deleting a portion of the leased premises, NOW, THEREFORE, the parties agree as follows: 1. Exhibit "A - Revision 2" is deleted and Exhibit "A - Revision 3" is substituted therefor. 2. Paragraph 3 of the lease is hereby amended from $53.63 to $34.10. 3. With reference to Exhibit "A - Revision 3," sixty- three (63) square feet is hereby deleted from the area east of tY.. remaining room. The LESSEE shall hereinafter be Y.S:P., `INC. YOUTH SERVICE PROGRAM legally changed its name to Y.S,P., INC. 2. Exhibit "A - Revision I" is dele,ed `and Exhibit "A Revision 2" is substituted therefor. 3. Paragraph 2 'f 'the lease is hereby deleted, and the term shall be month-try=month. 4. Paragraph 3 of the lease is . hereby deleted, and the `rent shall be $ �5. 39 per month payable on 'or before the 10th ddy of each month. Late rental payments • shall include a 10 percent penalty. S. The rent shall be the sum of $576.60 payable on or before the loth day' of each month, at the rate of $4$.05 per month. All rent not paid.within'ten (10) days of due date shall include.a 10% penalty. 4. CITY shall maintain the exterior of the structure, including th:;.grounds of the leased premises, and LESSEE shall maintain the interior of the leased premises. If LESSEE fails to maintai.'zi the interior of the leased premises, the CITY may, at its option, perform necessary maintenance and bill LESSEE for thr, cost of the service rendered. LESSEE shall reimburse CITY for the cost of the services within ten (10).days after receipt of billing. 5. During the term of this lease, LESSEE agrees to indem- nify and defend and save CITY harmless from any and all claims arising from any act, omission or negligence of LESSEE or its con- tractors, sublessees, licensees, agents, servants, or employees arising from any accident, injury, or damage whatsoever caused to any person or property occurring in, on, or about the leased premises, and from a,;d against all costs, expenses and liabilities incurred in or in connection with any such claim or proceeding brought thereon. LESSEE shall obtain for the entire term of this lease, minimum insurance liability limits as follows: Combined Single Limit Bodily Injury and/or Property Damage including Pro -- ducts Liability of Three Hundred Thousand Dollars ($300,000). 2. Sai� insurance shall include. the City Council, all City -appointed groups, committees, boards and cominissions, and all elective and appointive officers, servants or employees of CITY as named addi- tional insureds under such policy. LESSEE shall provide CITY with a certificate of insurance on a form approved and provided by CITY. Such insurance shall be primary to any insurance CITY has in effect. 6. During the term of this lease, LESSEE shall not make: any alterations to the leased premises without the written con- sent of CITY. 7. CITY agrees to pay all utility bills applicable to the leased premises during the term of the lease, except telephone service shall be separately charged to and the sole responsibility of LESSEE. $. LESSEE shall not assign the lease or sublet the premises except with the written permission of CITY, and CITY expressly reserves the right of re-entry for any violation of this section, or other condition of the lease. 9. CITY reserves the right to enter and inspect the pre- mises at all reasonable times. 10. LESSEE shall not permit any acts to be done on the leased premises which are in violation of any laws or ordinances. 11. LESSEE hereby accepts the premises in their present condition and hereby waives any claim against CITY for the pre- sent condition or the future condition of the leased premises. 3. 13. Either party may terminate this lease by giving thirty (30) days written notice to the other party. 14. LESSEE shall have the right of reasonable access of off-street � parking included with the leased premises. 15. CITY shall provide basic janitorial services during the term of said lease. ANALYSIS: Various social service agencies rent space at the old City Hall at 520 Pecan. The Youth, Service Program is moving some of its staff to the Santa Ana office, and a rearrangement of the Huntington Beach office space is therefore needed. The current rental rate will continue on a month to month basis until the' -results. of bids on a new maintenance -contract are obtained; the rental rate may have to be. raised at that time. This project is an extension of existing services to juveniles referred by police for diversion services. The Youth Service Program is supported by a Law"Enforcement Assistance Administration Grant to which the City of Hunt- ington Beach contributes' finaiicially. The Youth Service Program has been located in the Huntington -Beach Police Department for four years; however, additional housing for the employment pro- gram is not available at `this site. The Youth Employment Program is being initiated with the cooperation of the Huntington Beach Employment and Training Administration for referred juveniles requiring intense employment preparation, placement, and follow-up. Due to the small total amount of our grant, we cannot pay the estimated 40G square,foot rental at the'520.Pecan'Street center. We ask the Council to agree in. principle to the rental fee of 15� a square foot for. the 300 feet space, totalifig $540 annually. At the same.time, the'Prograia�provides local po]ace with a sense of cooperative accomplishment. The goal' of the Youth Service Program is to intervene at an ;. early point in the process of pxoblenr development, helping youths and their families 'achieve, a way 'of life which prevents; future contacts with the police and the 'courts. To. do this, Youth''Service 'Program staff use as many of the local community resources as nec- essary to provide the most satisfactory outcome. Referrals to the Youth Service Program. come from local police departments, and Program staff work very closely with the police in individual communities. Once a referral to the Program is made, a member of the staff conducts a problem -assessment interview with the youth and family. Based on the information shared in this assessment, a'variety of services are offered: family counseling; referral to appropriate community agencies; employment counseling; placement with a volunteer "special friend;" and case coordination of public and private services offered.by schools, recreation cen- ters, etc. After completion of the intervention program, each family receives Follow --up contact and they are encouraged to recontact their counselor if additional problems occur.
