NOTICE IS HEREBY GIVEN that the City Council of the City of Huntington Beach - and the Redevelopment Agency of. the City of Huntington Beach will hold a joint public hearing on August 15, 1988, at 7: 00 p.m. , in the Council Chambers, City Hall, 2000 Main Street, Huntington Beach, California,. to consider and act upon an Disposition and Development Agreement between the Redevelopment Agency of the City of Huntington Beach and the Robert Mayer Corporation. The agreement provides for the development of a mixed use project on 44 acres of land fronting the inland side of Pacific Coast Highway between Huntington Street and Beach Boulevard. The proposed project will feature 4 hotels with approximately 1500 rooms . Commercial -uses will include a health and tennis club, retail plaza with restaurants, and a shopping plaza . The development will also feature a residential component. The proposed project is covered by Final Environmental Impact Report and Supplemental Environmental. Impact Report 82-2. The City Council/Redevelopment Agency will consider certification of said Environmental Impact Report and Supplemental Environmental Impact Report No. 82-2 . [X] Yes [ ] New Policy or Exception Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions,Attachments: �l STATEMENT OF ISSUE: Attached for the Council's review and action is Code Amendment No. 88-2, a request to permit the keeping of one goose, rabbit or duck subject to the approval of a Residential Animal Permit from the Director of Community Development. RECOMMENDATION: Staff is recommending approval of Code Amendment No. 88-2 attached ordinance and a resolution adopting a $10.00 processing fee for a Residential animal Permit. ANALYSIS: At the City Council's request, the staff has prepared an ordinance permitting the keeping of one goose, duck or rabbit subject to approval of a Residential Animal Permit from the Director of Community Development. As written, the Ordinance would permit one of the above—listed animals subject to the following conditions: (a) A Residential Animal Permit shall be required for the keeping of one goose, rabbit, or duck subject to the review and approval of the Director of Community Development. (b) At the time the application is made for a Residential Animal Permit, the applicant shall pay a fee established by resolution of the City Council and sign an affidavit that he understands all of the conditions of approval for a Residential Animal Permit. (c) Premises shall be kept clean and free of all matter which may create odors or attract rodents. (d) The animal shall comply with all applicable sections of Chapter 8.40, Noise Control of the Municipal Code. PI O 5/85 (e) Any violation of any of the above conditions or other conditions of approval imposed by the Director of Community Development shall be cause for revocation of the Residential Animal Permit. (f) Any authorized City employee may inspect the premises for which an application has been granted for a Residential Animal Permit at any reasonable time. (g) Prior to issuance of a Residential Animal Permit, notices shall be sent to all abutting property owner and tenants notifying them of the pending application for said permit. As stated above, the proposed ordinance allows for review by the Director of Community Development, or his duly authorized representative. The ordinance also requires notification to abutting residents and requires compliance with all applicable codes including noise and health codes. The ordinance also permits inspection by an authorized City employee and revocation of the Residential Animal permit if any violations of the conditions of approval are violated. FUNDING SOURCE: A ten (10) dollar filing fee shall be charged at such time that the Residential Animal Permit is submitted to the Department of Community Development. s ALTERNATIVE ACTION: Deny Code Amendment No. 88-2 and retain the current law regarding the keeping of geese, ducks, and rabbits.
