[j] Yes [ j New Policy or Exception i !tor ql0 Statement of Issue, Recommendation, Analysis, Funding Scurce, Alternative Actions, A chments: Statement of Issue Industrial Motivation Incorporated provides a productivity improvement program which city staff is requesting City Council to authorize. Recommendation Authorize the Mayor and City Clerk to execute the contract between the City of Huntington Beach and Industrial Motivation Incorporated for a productivity improvement program and authorize the expenditure of $14,000. Analysis The city of Huntington Beach has an on -going productivity program designed to work closely with all levels of management to bring about improvements in the methods used in providing services to the citizens of Huntington Beach. As part of this commitment to excellence, the staff believes a packaged productivity program offered by the Industrial Motivation Incorporated will supplement the city's current program and has the potential of saving the city significant amounts of money. At the minimum, the contract provides a guarantee that the company will refund the difference to the city. Funding Source Miscellaneous Contingency Account 101593 - $14,000. Alternatives Action 1. Do not authorize the execution of the contract and forego the productivity improvement program. '-WT/RB:paj Attachment Pio elm F F AGREEMENT FOR PRODUCTIVE IMPROVEMENT, PROGRAM RELATIONSHIPS THIS AGREEMENT, made and entered into this _ 4 �44 day of , 19 , by and between the CITY OF HUNTINGTON BEACH, a municipal corporation, hereinafter referred to as "CITY," and ADVANCED MANAGEMENT GROUP, A DIVISION OF INDUSTRIAL MOTIVATION INC., hereinafter referred to as "CONSULTANT." RECITALS WHEREAS, the CITY OF HUNTINGTON BEACH desires to engage the services of consultant for the purpose of providing a Productivity Improvement Program for personnel of the City of Huntington Beac., and CONSULTANT has been selected to provide said services, NOW, THEREFORE, it is agreed by CITY and CONSULTANT as follows: 1. WORK STATEMENT CONSULTANT hereby agrees to conduct on a citvwide basis a Productivity Improvement Program as described in the letter from CONSULTANT incorporated herein by this reference (hereinafter referred to as Exhibit "A.") 2. FEES AND EXP ES (a) The fee for the Productivity Program is fourteen thousand ($14,000). Payment in full shall be made at the conclusion of the program. 3, CONSULTANT GUARANTEE The consultant guarantees that cost saving derived from the program based upon the city calculation shall be equal to or greater than the actual cost of the program. Any difference shall be returned to the city by the consultant. 4. MISCELLANEOUS PROVISIONS (a). The CITY agrees to provide a video tape of the Productivity Improvement Program for airing on cable TV and shall provide a copy of said video to the consultant. (b) CONSULTANT shall obtain approval from CITY prior to publication of any endorsement. (c) Speeches and articles that are based upon t;,,e Productivity Program, for other than internal CITY use, require prior approval by CONSULTANT. (d) CITY shall assign a staff coordinator to work directly with CONSULTANT in connection with the work of this agreement. 2 _ i 5. INDEMNIFICATION, DEFENSE, HOLD HARMLESS CONSULTANT hereby agrees to defend, indemnify and hold harmless CITY, its officers, agents and employees, from and against any and all liability, damages, costs, losses, claims and expenses, however caused, resulting directly or indirectly from or connected with CONSULTANT'S performance of this agreement (including, but not limited to such liability, cost, damage, loss, claim, or e<.pense arising from the death or injury to an agent or employee of CONSULTANT, a subcontractor, or of CITY or damage to the property of CONSULTANT, subcontractor, or of CITY or of any agent or employee of CONSULTANT, subcontractor, or of CITY) except where such liability, damages, costs, losses, claims or expenses are caused solely by the negligent or wrongful acts of CITY or any of its agents or employees including negligent omissions or commissions of CITY, its agents or employees, in connection with the general supervision or direction of the work to be performed hereunder. 6. INSURANCE In addition to the Workers' Compensation insurance and CONSULTANT'S agreement to indemnify CITY, CONSULTANT shall furnish to CITY, and maintain in force until the completion of this agreement, a policy of general liability insurance in which CITY is named as an additional insured. The policy shall indemnify CITY, its officers and employees, while acting within the scope of their duties, against any and all claims arising out of or in connection with this agreement. The policy shall provide covera not less --than the following amounts: Combined single limit jodily injury and/or property dantage of $300,000 per oceurre, Such policy insurance shall specifically provide that .any other insurance coverage vhich may be applicable to the loss shall be deemed excess coverage and CONSULTANT'S insurance shall be primary. A certificate of ail. such insurance policies required by this agreement shall be delivered to the City Attorney prier to the commencement of any s :k and shall be approved by her in writing. No such insurance sha_,. be cancelled or modified without thirty (30) days' prior written not.Lce to CITY. 7. INDEPENDENT CONTRACTOR CONSULTANT is, and shall be, acting at all times in the performance of this agreement as an independent contractor. CONSULTANT shall secure at its expense, and be responsible for any and all payments of all taxes, social security, state disability insurance compensation, unemployment compensation and other payroll deductions for CONSULTANT and its officers, agents and employees and all business licenses, if any, in connection with the services to be performed hereunder. 8. SUBCONTRACTORS This agreement is a personal service contract and the supervisory work hereunder shall not be delegated to any person or entitv without the consent of CITY. -4 - CONSULTANT agrees that no regular employe of CITY shall be employed by its firm during the time that this agreement is in effect. Box 190 Huntington Beach, CA 92648 Dear Rich: The following is an overview of the Buck -A -Day Program. Buck -A -Day emphasizes employee participation and individual recognition. While the Buck-A-D.y Program focuses on cost reduction, the positive employee attitudes that BAD produces are also important to the City. This improves not only employee morale, but also the services delivered to the public. "There are five (5) phases to the 30 day Program: Interest, Awar_ness, Participation, Recognition, and Follow -Through. 1. Interest: X "Teaser Week" sets the stage for the program. Graphics carrying the theme "Join the BAD Guys" tease the employee interest level so they want to know what BAD is all about. 2. Awareness: The :idea is to make the employee aware that he/she does have an impact on costs in his/her own work area. 3. Participation: While the program is completely voluntary, the key objective is to instill a cost consciousness within all city employees. Nationally, the average participation rate of BAD is 600 - 800. 4. Recognition: BAD lets employees know their ideas are important. Those who participate will receive symbolic awards to show they have joined the campaign against rising costs. Posters and newsletters are used to publicize individual effort. 5. Follow -Through: A detailed implementation plan is included in the BAU Program to make sure all ideas are acted on. You choose the individuals who will run the program internally and I will train him/her and act as an advisor during the course of the campaign. Industrial Motivation will guarantee a minimum 1:1 annualized Return - on -Investment by the City's own evaluation. Anything less and we will return the difference.
