It was for the remodeling of the Edison Building into a manpower employment and training center in the City of Huntington Beach,, Californian 938 Main Street, Hatilington Beach, California. We have been requested to issue a 10% maintenance guarantee band. Please be advised that this performance bond automatically covers defective workmanship and materials for a period of one year subsequent to the acceptance date of the completed contract, There was also a 50% 'Labor and matbrial bond executed in the amount of $14,489. It is customary in the surety industry that all perf,xzmance bonda continue for one year after the completion and acceptance date of the contract with regard to defective workmanship and materials. It is not necessary to issue a sep- arate bond for this since i.t is already covered ur,.der the perf- ormance bond. Any maintenance guarantee beyond that of defective workmanship or materialss would require a separate bond and would not be covered automatically as'indicated. NOW, THEREpORE, in consideration of the covenants and agreements herein contained, being done and performed by the parties hereto, it r is hereby agreed as follows: I. By my signature hereunder, as Contractor, I certify that I am aware of the provisJ ons of Section 3700 of the Labor Code which require every employer to be insured against liability for workmen's compensation or to undertake self-insurance in accordance with the provisions of that code, and I will comply with such provisions before crinmencing the performance of the work of this contract. II. Contractor agrees to receive and accept as full compensa- tion for furnishing all materials and for doing all the work contemplated and embraced in this agreement, the unit prices Contractor submitted in his Proposal which was accepted by the City Council,, A copy of said Proposal is attached hereto and incorporated herein by reference and made a part hereof. Contractor further agrees that said payment by City shall incllude, all payments for all loss or damage arising out of the nature of the work aforesaid, or from the action of the elemental or from any unforeseen difficulties or obstructions which may arise o:r be encountered in they prosecution of the work until its aoceptancee by the City, and for all risks of f every description connected with the work; also for all expenses incurred by or in conaecrueynr�e of the suspension or discontinuance of work and for well and faithfully completing they work, and the whole thereof, in the manner and according to the plans and specifi-cations, and the requirements of the Engineer under therm. Temporary Offices - The contractor shall have the option of estab- lishing a temporary office either in the parking lot oil within the building.
