FOR LEAD BASED PAINT CONSULTANT SERVICES THIS Agreement is made and entered into this 31st day of October 2001, by and between the City of Huntington Beach, a municipal corporation of the State of California, hereinafter referred to as "CITY," and BARR & CL_ARK ENVIRONMENTAL, INC., a California corporation, hereinafter referred to as "CONSULTAN°T." WHEREAS, CITY desires to engage the services of a consultant to provide lead based paint consultant services; and Pursuant to documentation on file in the office of the City Clerk, the provisions of the Huntington Beach Municipal Code, Chapter 3.03, relating to procurement of professional service contracts have been complied with; and CONSULTANT has been selected to perform said services, NOW, THEREFORE, it is agreed by CITY and CONSULTANT as follows: I. SCOPE OF SERVICES CONSULTANT shall provide all services as described in the Request for Proposal ("RFP"), and CONSULTANT'S Proposal dated April S, 2001, (both of which are hereinafter referred to as Exhibit "A"), which are attached hereto and incorporated into this Agreement by this reference. These services shall sometimes hereinafter be referred to as the "PROJECT." CONSULTANT hereby designates Matt Crochet who shall represent CONSULTANT and shall be CONSULTANT's primary contract person with CITY. 01 agrer-%arri81`15..01 2. CITY STAFF ASSISTAI`CE CITY shall assign a staff coordinator to work directly with CONSULTANT in the performance of this Agreement. 3. THE OF PERFORMANCE Time is of the essence of this Agreement. The services of CONSULTANT are to commence as soon as practicable after the execution of this Agreement and all tasks specified in Exhibit "A" shall be completed no later than one year from the date of this Agreement. These times maybe extended with the written permission of CITY. The time for performance of the tasks identified in Exhibit "A" are generally to be shown in the Scope of Services on the Work Program/Project Schedule. This schedule may be amended to benefit the PROJECT if mutually agreed by CITY and CONSULTANT. This Agreement shall terminate one year from the date of Agreement is approved by the City Council of CITY. 4. COMPENSATION In consideration of the performance of the services described herein, CITY agrees to pay CONSULTANT on a time and materials basis, at the rates described in Exhibit "A," a fee not to exceed Twenty Thousand Dollars and no!100 (S20,000.00). 5. PRIORITIES In the event there are any conflicts or inconsistencies between this Agreement, the CITY's RFP, or the CONSULTAN"T's Proposal, the follovOng order of precedence shall govern: (1) Agreement, (2) the CONISULTANT's Proposal, and (3) the CITY's RFP. 6. EXTRA WORK In the event CITY requires additional services not included in Exhibit "A." or changes in the scope of services described in Exhibit "A," CONSULTANT will undertake such 01 agreefbarr18l15M 2 work only after receiving written authorization from CITY. Additional compensation for such extra work shall be allowed only if the prior written approval of CITY is obtained. 7. METHOD OF PAYMENT A. CONSULTANT shall be entitled to progress payments toward the fixed fee set forth herein in accordance with the progress and payment schedules set forth in Exhibit "A." B. Delivery of work product: A copy of every memorandum, letter, report, calculation and other documentation prepared by CONSULTANT shall be submitted to CITY to demonstrate progress toward completion of tasks. In the event CITY rejects or has comments on any such product, CITY shall identify specific requirements for satisfactory completion. Any such product which has not been formally accepted or rejected by CITY shall be deemed accepted. C. CONSULTANT shall submit to CITY an invoice for each progress payment due. Such invoice shall: 1) Reference this Agreement; 2) Describe the services performed; 3) Show the total amount of the payinent due; 4) Include a certification by a principal member of CONSULTANT's firm that the work has been performed in accordance with the provisions of this Agreement; and 5) For all payments include an estimate of the percentage of work completed. Upon submission of any such invoice, if CITY is satisfied that CONSULTANT is making satisfactory progress toward completion of tasks in accordance with this Agreement, CITY shall promptly approve the invoice, in which event payment shall be made within thirty (30) days of receipt of the invoice by CITY. Such approval shall not be unreasonably withheld. If CITY does 01 agree'6arr/8.115/01 3 not approve an invoice, CITY shall notify CONSULTANT in writing of the reasons for non - approval within seven (7) calendar days of receipt of the invoice, and the schedule of performance set forth in Exhibit "A" shall be suspended until the parties agree that past performance by CONSULTANT is in, or has been brought into compliance, or until this Agreement is terminated as provided herein. D. Any billings for extra work or additional services authorized by CITY shall be invoiced separately to CITY. Such invoice shall contain all of the information required above, and in addition shall list the hours expended and hourly rate charged for such time. Such invoices shall be approved by CITY if the work performed is in accordance with the extra work or additional services requested, and if CITY is satisfied that the statement of hours worked and costs incurred is accurate. Such approval shall not be unreasonably withheld. Any dispute between the parties concerning payment of such an invoice shall be treated as separate and apart from the ongoing performance of the remainder of this Agreement. DISPOSITION OF PLANS. ESTLMATES AND OTHER DOCUMENTS CONSULTANT agrees that all materials prepared hereunder, including all original drawings, designs, reports, both field and office notices, calculations, maps, memoranda, letters and other documents, shall be turned over to CITY upon termination of this Agreement or upon PROJECT completion, whichever shall occur first. In the event this Agreement is terminated, said materials may be used by CITY in the completion of the PROJECT or as it otherwise sees fit. Title to said materials shall pass to CITY upon payment of fees determined to be earned by CONSULTANT to the point of termination or completion of the PROJECT, whichever is applicable. CONSULTANT shall be entitled to retain copies of all data prepared hereunder. 01agree/barr/8/15r01 4 9. HOLD HARMLESS CONSULTANT shall protect, defend, indemnify, save and hold harmless CITY, its officers, officials, employees, and agents from and against any and all liability, loss, damage, expenses, costs (including without limitation, costs and fees of litigation of every nature) arising out of or in connection with CONSULTANT's performance of this Agreement or its failure to comply with any of its obligations contained in this Agreement by CONSULTANT, its officers, agents or employees except such loss or damage which was caused by the sole negligence or willful misconduct of CITY. CITY shall be reimbursed by CONSULTANT for all costs and attorney's fees incurred by CITY in enforcing this obligation. 10. WORKERS' COMPENSATION INSURANCE Pursuant to California Labor Code Section 1861, CONSULTANT acknowledges awareness of Section 3700 et seq. of said Code, which requires every employer to be insured against liability for workers' compensation; CONSULTANT covenants that it will comply with such provisions prior to commencing performance of the work hereunder; and shall indemnify, defend and hold harmless CITY from and against all claims, demands, payments, suit, actions, proceedings, and judgments of every nature and description, including attorneys fees and costs presented, brought or recovered against the CITY, for or on account of any liability under any of said acts which may be incurred by reason of any work to be performed by CONSULTANT under this Agreement. CONSULTANT shall maintain workers' compensation insurance in an amount of not less than One Hundred Thousand Dollars (S 100,000) bodily injury by accident, each occurrence, One Hundred Thousand Dollars ($100,000) bodily injury by disease, each employee, Two Hundred Fifty Thousand Dollars (S250,000) bodily injury by disease, policy limit. O 1 affrmbarr:8115101 5 CONSULTANT shall require all subcontractors to provide such workers' compensation insurance for all of the subcontractors' employees. CONSULTANT shall furnish to CITY a certificate of waiver of subrogation under the terms of the workers' compensation insurance and CONSULTANT shall similarly require all subcontractors to waive subrogation. 11. GENERAL LIABILITY INSURANCE In addition to the workers' compensation insurance and CONSULTANT's covenant to indemnify CITY, CONSULTANT shall obtain and furnish to CITY, a policy of general public liability insurance, including motor vehicle coverage covering the PROJECT. The policy shall indemnify CONSULTANT, its officers, agents and employees, while acting within the scope of 1. their duties, against any and all claims arising out of or in connection with the PROJECT, and shall Provide coverage in not less than the following amount: combined single limit bodily injury and property damage, including products/completed operations liability and blanket contractual liability, of $1,000,000 per occurrence. If coverage is provided under a form which includes a designated general aggregate limit, the aggregate limit must be no less than S1,000,000 for this PROJECT The policy shall name CITY, its agents, its officers, employees and volunteers as Additional Insureds, and shall specifically provide that any other insurance coverage which may be applicable to the PROJECT shall be deemed excess coverage and that CONSULTANT's insurance shall be primary. Under no circumstances shall the above -mentioned insurance contain a self -insured retention, or a "deductible" or any other similar form of limitation on the required coverage. 12. PROFESSIONAL LIABILITY INSURANCE CONSULTANT shall furnish a professional liability insurance policy covering the work performed by it hereunder. Said policy shall provide coverage for CONSULTANT's professional liability in an amount not less than S1,000,000 per occurrence and in the aggregate. 01 agreeibarrI& 15101 6 A claims -made policy shall be acceptable if the policy further provides that: A. The policy retroactive date coincides with or precedes the initiation of the scope of work (including subsequent policies purchased as renewals or replacements). B. CONSULTANT shall notify CITY of the reporting of any circumstances or incidents that might give rise to future claims. CONSULTANT will make every effort to maintain similar insurance during the required extended period of coverage following project completion, including the requirement of adding all additional insureds. If insurance is terminated for any reason, CONSULTANT agrees to purchase an extended reporting provision of at least two (2) years to report claims arising from work performed in connection with this Agreement. 13. CERTIFICATES OF INSURANCE Prior to commencing performance of the work hereunder, CONSULTA_INTT shall furnish to CITY certificates of insurance subject to approval of the City Attorney evidencing the foregoing insurance coverages as required by this Agreement; the certificates shall: A. provide the name and policy number of each carrier and policy; B. shall state that the policy is currently in force; and C. shall promise that such policies shall not be suspended, voided or canceled by either party, reduced in coverage or in limits except after thirty (30) days' prior written notice; however, ten (10) days' prior written notice in the event of cancellation for nonpayment of premium. CONSULTANT shall maintain the foregoing insurance coverages in force until the work under this Agreement is fully completed and accepted by CITY. O 1 ag eefbarv'8/ 1 Sio 1 7 The requirement for carrying the foregoing insurance coverages shall not derogate from the provisions for indemnification of CITY by CONSULTANT under the Agreement. CITY or its representative shall at all times have the right to demand the original or.a copy of all said policies of insurance. CONSULTANT shall pay, in a prompt and timely manner, the premiums on all insurance hereinabove required. 14. INDEPENDENT CONTRACTOR CONSULTANT is, and shall be, acting at all times in the performance of this Agreement as an independent contractor herein and not as an employee of the CITY. CONSULTANT shall secure at its expense, and be responsible for any and all payment of all taxes, social security, state disability insurance compensation, unemployment compensation and other payroll deductions for CONSULTANT and its officers, agents and employees and all business licenses, if any, in connection with the services to be performed hereunder. 15. TER-NMNATION OF AGREEMENT All work required hereunder shall be performed in a good and workmanlike manner. CITY may terminate CONSULTANT's services hereunder at any time with or without cause, and whether or not PROJECT is fully complete. Any termination of this Agreement by CITY shall be made in writing, notice of which shall be delivered to CONSULTANT as provided herein. In the event of termination, all finished and unfinished documents, exhibits, report, and evidence shall, at the option of the CITY, become its property and shall be delivered to it by CONSULTANT. 16. ASSIGNMENT AND SUBCONTRACTING This Agreement is a personal service contract and the supervisory work hereunder shall not be delegated by CONSULTANT to any other person or entity without the express written consent of CITY. 0l agreerbarri&'15/01 8 17. COPYRIGHTS/PATENTS CITY shall own all rights to any patent or copyright on any work,item or material produced as a result of this Agreement. 18. CITY EMPLOYEES AND OFFICLALS CONSULTANT shall employ no CITY official nor any regular CITY employee in the work performed pursuant to this Agreement. No officer or employee of CITY shall have any financial interest in this Agreement in violation of the applicable provisions of the California Government Code. 19. NOTICES Any notice or special instructions required to be given in writing under this Agreement shall be given either by personal delivery to CONSULTANT's agent (as designated in Section I hereinabove) or to CITY's Director of Economic Development as the situation shall warrant, or by enclosing the same in a sealed envelope, postage prepaid, and depositing the same in the United States Postal Service, addressed as follows: TO CITY: Director of Economic Development City of Huntington Beach 2000 Main Street Huntington Beach, CA 92648 20, MODIFICATION TO CONSULTANT: Matthew Crochet, Vice President Barr & Clark Environmental, Inc. 22850 Crenshaw Boulevard, Suite 200 Torrance, CA 90505 Phone (310) 517-0805 No waiver or modification of any language in this Agreement shall -be valid unless in writing and duly executed by both parties. 21. SECTION HEADINGS The titles, captions, section, paragraph, subject headings and descriptive phrases at the beginning of the various sections in this Agreement are merely descriptive and are included 01 agreeibarr.`8/ 15; 01 9 solely for convenience of reference only and are not representative of maters included or excluded from such provisions, and do not interpret, define, limit or describe, or construe the intent of the parties or affect the construction,or interpretation of any provision of this Agreement. 22. I_NTERPRETATION OF THIS AGREEMENT The language of all parts of this Agreement shall in all cases be construed as a whole, according to its fair meaning, and not strictly for or against any of the parties. If any provision of this Agreement is held by an arbitrator or court of competent jurisdiction to be unenforceable, void, illegal or invalid or affect the remaining covenants and provisions of this Agreement. No covenant or provision shall be deemed dependent upon any other unless so expressly provided here. As used in this Agreement, the masculine or neuter gender and singular or plural number shall be deemed to include the other whenever the context so indicates or requires. Nothing contained herein shall be construed so as to require the commission of any act contrary to law, and wherever there is any conflict between any provision contained herein and any present or future statute, law, ordinance or regulation contrary to which the parties have no right to contract, then the latter shall prevail, and the provision of this Agreement which is hereby affected shall be curtailed and limited only to the extent necessary to bring it within the requirements of the law. 23. DUPLICATE ORIGINAL The original of this Agreement and one or more copies hereto have been prepared and signed in counterparts as duplicate originals, each of which so executed shall, irrespective of the date of its execution and delivery, be deemed an original. Each of the parties hereto shall retain an originally signed copy hereof. Each duplicate original shall be deemed an original instrument as against any party who has signed it. 0l agre0barr/8/ i 5/Ol 10 24. IMMIGRATION CONSULTANT shall be responsible for full compliance Nvith the immigration and naturalization laws of the United States and shall, in particular, comply with the provisions of the United States Code regarding employment verification. 25. LEGAL SERVICES SUBCONTRACTING PROHIBITED CONSULTANT and CITY agree that CITY is not liable for payment of any subcontractor work involving legal services, and that such legal services are expressly outside the scope of services contemplated hereunder. CONSULTANT understands that pursuant to Huntington Beach City Charter Section 309, the City Attorney is the exclusive legal counsel for CITY; and CITY shall not be liable for payment of any legal services expenses incurred by CONSULTANT. 26. ATTORNEY'S FEES In the event suit is brought by either party to enforce the terms and provisions of this Agreement or to secure the performance hereof, each party shall bear its own attorney's fees. ENTIRETY The Agreement contains the entire agreement between the parties respecting the subject matter of this Agreement and supercedes all prior understanding and agreements whether oral or in writing. Due to recent regulatory changes dealing with lead -based paint that affect federally funded housing programs, it has become necessary for the City to identify qualified consultants to provide the following services: • Inspection/Risk Assessment • Project Design • Project Monitoring • Clearance Testing The particular requirements for each of the above services are described in detail in the Scope of Work section of this request. Of particular interest to the City in evaluating the qualifications of each interested consultant will be the consultant's certification by the California Department of Health Services and the consultant's capacity to fully support the projected needs of the City's various housing programs. Among the housing programs that the City administers are the Single Family Housing Rehabilitation Loan Program, Multifamily Housing Rehabilitation Loan Program, Redevelopment Agency multifamily housing acquisition and rehabilitation projects, and City Block Grant housing projects. These programs are described in detail in the Huntington Beach Housing Programs section of this request. The City intends to implement a system -wide lead -based paint inspection and abatement program that satisfies the requirements of the Residential Lead -Based Hazard Reduction Act of 1992, Title X of the Housing and Community Development Act of 1992. The new regulation can be found in the Code of Federal Regulations at Title 24, Part 35 (24 CFR 35). The City of Huntington Beach is soliciting qualifications and proposals from interested consultants to provide lead -based paint services as described below. It is intended that applicants will consider each component individually when describing their qualifications and proposals, specifically for the purpose of determining fees. Upon selection of a firm, the City Council may elect to include all or a portion of the scope of work. INSPECTOR/RISK ASSESSOR The inspector/risk assessor will provide lead -based paint inspections and/or risk assessments for single family and/or multifamily residential properties as requested by the City of Huntington Beach. All subject properties will be located within the City of Huntington Beach and will require lead hazard evaluation as part of home improvement rehabilitation activities. Lead -based paint inspections and risk assessments must be performed so as to satisfy requirements of Title X of the Community and Development Act of 1992 and must be conducted in compliance with all relevant federal, state, and local laws. Prior to an inspection or risk assessment, the consultant will be given a scope of work for general home improvement rehabilitation activities. The consultant will be responsible for insuring that areas most likely to be impacted by the proposed activities are included in the inspection/risk assessment. The City prefers that inspectors use X-ray florescence (XRF) instruments in conducting inspections and will require that all equipment be calibrated and operated in compliance with the instrument's performance characteristic sheet and with applicable laws. As a final option to resolve inconclusive XRF test results, the consultant may use paint chip samples. In such a scenario, samples will be collected and evaluated in compliance with federal and state requirements. Whenever possible, samples will be collected from deteriorated paint in discrete locations. The consultant must be available to respond to lead -based paint inspection and risk assessment requests within 24 hours. The inspector will be given the name and telephone number of the responsible party; it will be the responsibility of the consultant to arrange a mutually convenient time for the inspection. The consultant will be expected to provide all instruments, tools, and supplies to complete the assignment and to submit to the City within seven business days of an inspection a report that contains the following: • Date of inspection/risk assessment. • Inspector's name and California DHS certification number. • Property description and accompanying floor plan. • Testing/assessment protocol used and a brief explanation of any variance from standard practices. • Summary of positive test results with a reference to the floor plan. • Any observations relative to positive test results that may affect the home improvement rehabilitation scope of work. • Field data for all test results showing relative location to the floor plan, the component, substrate, paint condition, and test result. PROJECT DESIGNER The project designer will review lead -based paint inspection report(s) and/or risk assessment report(s) to determine a lead hazard reduction or abatement strategy. The consultant will design a contractor scope of work addressing all affected building components and conforming to the City's determination of the proper threshold of lead hazard reduction or abatement. Written specifications shall be submitted by the consultant to the City for review within 14 calendar days after a completed inspection. The specifications will contain the following information: • Requirements for hazard containment. 4 • Requirements for resident and worker protection. • Contractor scope of work addressing each identified lead hazard component. • Lead hazard control methods to be used. • Clean-up methods and requirements. • Waste disposal requirements. • Unit clearance examination requirements. The project designer will review and approve abatement contractor proposals and attend pre - construction meetings. The consultant will be expected to notify the City of any potential regulatory or specification violations by the selected contractor that become evident prior to the commencement of lead hazard reduction activities. For this reason, the consultant must be familiar with and abide by all applicable federal, state, and local laws, including the Residential Lead -Based Hazard Reduction Act of 1992, Title X of the Housing and Community Development Act of 1992. PROJECT MONITOR The project monitor will conduct site visits before, during, and after lead -based paint abatement activities as directed by the City in order to ensure compliance with all applicable federal, state, and local laws. The consultant will monitor contractor work quality and evaluate the completeness of abatement activities. The project monitor will be responsible for periodically surveying the regulated area from inside and outside the isolation barriers and immediately notifying the contractor of indications of breaches in containment. The consultant will additionally be responsible for monitoring storage and supervising disposal of hazardous waste. The City will expect to be notified by the consultant of any potential regulatory or specification violations that become evident through such monitoring activities. The consultant will maintain a dedicated site -specific field log for all project activities. Entries will be made for every day that monitoring activities take place and should contain sufficient notes to enable the City to understand conversations, instructions, and other activities that took place at the work site. The project monitor will submit to the City a close-out report certifying that the project complied with all applicable federal, state, and local laws. The closeout report shall, at a minimum, include the following: • Summary of construction activities completed. • Project -related paperwork (logs, air/wipe sample data, laboratory reports, hazardous waste manifests, and correspondence). • Conclusions and recommendations. • Certification that the project complied with federal, state, and local lead -based paint requirements. 3 CLEARANCE TESTER Clearance sampling will occur in two phases: visual examination and environmental sampling (dust wipe clearance sampling). Upon completion of lead abatement activities, the clearance tester will require a one -hour settling period to allow any airborne lead -contaminated particles to settle. If dust is observed during the course of the visual inspection, the contractor will be required to repeat the cleaning process. An inspection will be performed in each room. Once each area has been visually inspected, the clearance tester will collect dust samples. Dust samples will be obtained from areas where lead abatement was performed. Either single surface sampling or composite sampling may be utilized at the discretion of the clearance tester based on the professional judgment of the inspector and the type of abatement activity that was performed. If exterior lead abatement reduction has been performed, the clearance tester will collect soil samples around the foundation of the property where activities occurred. In addition, any nearby play areas for children should also be tested. All dust and soil samples collected will be evaluated for lead hazards as set forth by federal and state law. Clearance samples must be analyzed by an accredited laboratory as selected by the consultant, and sample results should be made available to the City within 24 hours of submission to the laboratory for analysis. It also has several fine expansive parks, equestrian trails, and recreational facilities. A variety of 4 cultural opportunities exist within Huntington Beach, including the Art Center and the School District's School of Performing Arts. Boasting the nation's second largest children's library and designated bike routes on 75% of the major City streets, Huntington Beach was recently ranked as the top city for children in Southern California. The City has other noteworthy accomplishments such as ranking among the safest in the nation with populations over 100,000, it has one of the lowest unemployment rates, and has been honored as the State's best big city in which to do business. The City has grown quite a bit since its beginnings in 1909. Yet today, with a population approaching 200,000, and a growing commercial and industrial base, Huntington Beach still maintains itself as a great city in which to live, work, and play. At this time, the City intends to use lead -based paint consultant services for -the housing programs described below. The information provided herein about these programs is intended to assist applicants better understand the City's particular needs and to assist with developing fee schedules. The information is not necessarily guaranteed, as number of loan applicants to the City and numbers related to other housing programs are driven by market conditions and are not controlled by the City. SINGLE FAMILY HOUSING REHABILITATION LOAN PROGRAM The City contemplates providing home improvement loans to at least 40 homeowners per year. This program is available to eligible owners of single family homes, mobile homes, condos, and townhomes, and all of these are covered by the new lead -based paint regulation. Loans are typically between $5,000 and $25,000 and may be used for general home improvement projects. Should lead paint hazards be found in a property assisted by the City, remediation activities will be required as specified by law. MULTIFAMILY HOUSING REHABILITATION LOAN PROGRAM The City offers a multifamily housing rehabilitation loan program similar to its single family program. Owners of apartment properties in Huntington Beach, which are occupied by low- income tenants, may be eligible to borrow funds for general property rehabilitation projects. The City anticipates administering up to five such loans per year for apartment properties ranging in size from four to twelve units. REDEVELOPMENT AGENCY MULTIFAMILY HOUSING ACQUISITION AND REHABILITATION PROJECTS The Redevelopment Agency of the City of Huntington Beach administers various types of housing projects in partnership with nonprofit and for -profit housing developers whereby apartment properties are purchased and substantially rehabilitated. The Redevelopment Agency anticipates initiating at least six projects per year for properties ranging in size from four to over 100 units. 5 CITY BLOCK GRANT HOUSING PROJECTS From time to time the City's Block Grant program funds rehabilitation or other services related to housing. Such assistance is typically provided for single family homes, group homes, or multifamily properties. Depending on the particular program and the level of funding, lead - based paint activities may be required. Because the Block Grant program funds projects through applications submitted to the City, the number and type of future projects has not been estimated. The purpose was to conduct a Lead Based Paint clearance inspection after the completion of ALL lead -related construction activities. Specialized was the abatement contractor for this job. On November 6, 2000, Robert Clark visually inspected the work and collected two dust wipe samples from the exterior of the residence (window well and threshold). All samples were submitted to the Long Beach Department of Health and Human Services - Laboratory Division, an NVLAP accredited laboratory, to be analyzed for lead content. All work appeared to be completed and no visible dust or paint chips were present at the property. The results from the wipe samples indicated that any residual lead dust that was present after abatement and clean up were below the accepted HTJD/DHS clearance levels (400ml-fil for window wells and exterior surfaces). El Monte, California (Subject Property). This document is prepared for the sole use of Community Development Commission, and any regulatory agencies that are directly involved in this project. No other party should rely on the information contained herein without prior written consent of Community Development Commission. The scope of services, inspection methodology, and results are presented below. 2.0 SCOPE OF WORK The purpose of this risk assessment is to identify and assess potential lead -based paint (LBP) hazards currently present at the subject property. On 10/17/00, Barr & Clark performed a risk assessment for Iead-based paint at the subject property in S. El Monte, California. Deteriorated paint surfaces, visible dust accumulation, and bare soil were sampled for the presence of lead -based paint (LBP) or Iead dust. The intent was to identify any potential lead - based paint (LBP) hazards currently present at the subject property. If lead -based paint (LBP) hazards were found, the risk assessment would identify individual architectural components or areas of the structure that contribute to the risk. The results can then be used to minimize potential exposure to occupants and manage the risks over time. 3.0 PROPERTY DESCRIPTION The subject property is a single family residence that was built circa 1945. It is a one-story building that is constructed over a raised foundation: The exterior walls are covered with stucco and the windows are a combination of double -hung sash, fixed, and aluminum -framed types. The home consists of three bedrooms, one bathrooms and a detached garage. At the time of this limited inspection, most of the painted surfaces were in fair condition. 4.0 INSPECTOR'S QUALIFICATIONS Robert Clark and Matt Crochet of Barr & Clark performed the limited inspection at the site using an RMD LPA-1 XRF spectrum analyzer instrument. Both have attended the radiation safety course for handling the instrument, and completed an EPA approved curriculum in Lead in Construction Inspector / Risk Assessor Training.. To further complicate matters, some of the established "levels" are quantified in different units of measurement. Testing is in compliance with Federal Regulations 24CFR Part 35, Subpart J for rehabilitation activities. In recognition of the various action levels the testing results are classified as follows for this report: • Painted surfaces with readings at or above 0.7 mg / cm2 are considered - Positive • Painted surfaces with readings at or below 0.6 mg / cm' are considered - Negative The individual readings have been provided on all field data sheets. Any future change in action levels by one of the regulating agencies may affect the classification of results. Soil Sampling: The California DHS action level for le -ad in soil is 400 parts per million (ppm) for bare soil and 1000 ppm for soil covered with vegetation (ground cover, grass, etc.). 6.0 METHOD OF TESTING Paint Testing: The method employed was X-ray fluorescence (XRF) using a Radiation Monitoring Device Lead Paint Analyzer (RMD LPA-1). The instrument's calibration was verified according to the manufacturer's specifications in compliance with the Performance Characteristic Sheet (PCS) developed for this instrument. Laboratory Sample Analysis: Soil and dust samples were collected from this property and analyzed for lead content by the Long Beach Health Department — Laboratory Division, which is accredited by the American Industrial Association (AIHA), the National Institute for Standards and Technology (NVL.AP) and the California Department of Health Services (FLAP). The samples were analyzed as follows: • Dust Wipe Sampling - The method of analysis was Flame Atomic Absorption Spectroscopy (OSHA ID-121, Flame AA) performed on samples collected from measured areas. • Soil Samplint; - The method of analysis was Flame Atomic Absorption Spectroscopy (SW-486, flame AA) performed on samples collected from the top VY' of bare soil areas (drip line. etc.). 7.0 SUMMARY OF RESULTS Paint Sampling: Throughout the subject property, the test results indicated the presence of lead -based paint (LBP) related hazards. The following summary lists the locations of these hazards: Exterior • Door frame and threshold to the living room • Wooden window components on the west side of the home The XRF field data and results for paint sampling may be found in Appendix A. Dust/Soil Sampling: None of the laboratory samples were above the respective action levels. The dust wipe and soil sampling results may be found in Appendix B. Sampling for this risk assessment was based on the condition of the individual building components at the time of this inspection. 8.0 RECOMMENDATIONS The greatest potential for lead exposure from lead painted architectural components occurs when: • the paint has become defective; or • when the paint is applied to a friction / impact component where the paint is continually disturbed; or • when the paint is disturbed through routine maintenance or renovation activities. It is encoura ed to utilize professionals that have experience working with LBP. • If renovation is scheduled in the near future (less than three months), all lead painted components that have been previously targeted for replacement should be replaced utilizing "lead safe" containment and work practices. • ALL components that have been identified with defective lead paint should have the paint repaired as soon as possible. Any paint repair should be done utilizing "lead safe" containment, work practices, and clean-up techniques. • All components with lead painted friction 1 impact surfaces should be treated to minimize the friction or impact as necessary. • Lead painted components that have not been targeted for replacement should either be considered for abatement (replacement, enclosure, encapsulation, etc.) or included in an Operations & Management (O & M) Plan that will help to minimize exposures to lead hazards. • All lead painted surfaces that are not expected to be impacted in the near future (less than three months) should also be included the O & M plan. • In addition, the tenants or occupants of the dwelling should be notified of the test results and instructed in actions that they may perform to keep the living areas "lead safe." Reevaluation: Standard Reevaluation Schedule 3 contained in the HUD Guidelines applies to this property, since several exterior components had XRF lead levels greater than the standard. Therefore, the dwelling should be reevaluated in October 2001 (12 months from now). If no lead -based paint hazards are identified at that time, another reevaluation should be conducted in October 2002 (2 years later). If no lead -based paint hazards are identified at that time, no further reevaluations are needed. However, since lead -based paint may be present in the dwelling, the owner should monitor the condition of all painted surfaces at least annually or whenever other information indicates a potential problem. 9.0 TITLE X REQUIREMENTS A copy (or summary) of this report must be provided to new lessees (tenants) and purchasers of this property under Federal law (24 CFR part 35 and 40 CFR part 745) before they become obligated under a lease or sales contract. The complete report must also be provided to new purchasers and it must be made available to new tenants. Landlords (lessors) and sellers are also required to distribute an educational pamphlet approved by the U.S. Environmental Protection Agency and include standard warming language in their leases or sales contracts to ensure that parents have the information they need to protect their children from lead -based paint hazards. No other party should rely on the information contained herein without prior written consent of Community Development Commission. The scope of services, inspection methodology, and results are presented below. 2.0 SCOPE OF WORK The purpose of this inspection is to identify and assess the Lead -Based Paint (LBP) present on painted components at the subject property. On November 27, 2000, Barr & Clark performed an inspection for lead -based paint at the subject property in Los Angeles, California. To comply with EPA and HUD guidelines, painted and varnished surfaces in every accessible "room equivalent" were sampled for the presence of LBP. The intent was to ascertain the presence of lead -based paint above the federal action level. If LBP was found, the inspection would identify individual architectural components and their respective concentrations of lead in such a manner that this report would be used to characterize the presence of LBP at this property. 3.0 PROPERTY DESCRIPTION The subject property is a single family residence that was built circa 1925. It is a one-story building that is constructed over a raised foundation. The exterior walls are covered with wood siding and the windows are a combination of double -hung sash and casement types. The home consists of three bedrooms, one bathroom, and a detached garage. At the time of this inspection, all of the painted surfaces were in vvr poor condition. 4.0 INSPECTOR'S QUALIFICATIONS Matt Crochet of Barr & Clark performed the inspection at the site using an RMD LPA-1 XRF spectrum analyzer instrument. He has attended the radiation safety course for handling the instrument, and completed an EPA approved curriculum in Lead in Construction Inspector / Risk Assessor Training. At the time of this report, the California Department of Health Services, Childhood Lead Poisoning Branch, has implemented a State Certification Model Accreditation Plan adopted from the EPA. In every "room equivalent" within the tested property, one representative surface of each "testing combination" was tested. Multiple readings were collected to resolve inconsistencies in the test results. Regulatory Compliance: Several public (government) agencies have a published "regulatory action level" to classify LBP. To further complicate matters, some of the established `'levels" are quantified in different units of measurement. The instrument was operated in "Quick Mode." where the duration for each test result is determined by a combination of • the actual reading relative to the designated action level; • the age of the radioactive source; and • the substrate on which the test was taken. The instrument's calibration was verified according to the manufacturer's specifications in compliance with the Performance Characteristic Sheet (PCS) developed for this instrument. The readings from this instrument produce a 95% confidence level that the "lead" reading accurately reflects the actual level of lead in the tested surfaces, relative to the federal action Ievel. All information regarding the specific instrument used may be found in Appendix C. Laboratory Sam le Analysis: Soil and dust samples were collected from this property and analyzed for lead content by the Long Beach Health Department — Laboratory Division which is accredited by the American Industrial Association (AIHA), the National Institute for Standards and Technology (AIVLAP) and the California Department of Health Services (ELAP). The samples were analyzed as follows: • Dust Wipe Spmpling - The method of analysis was Flame Atomic Absorption Spectroscopy (OSHA ID- 121, Flame AA) performed on samples collected from measured areas. • Soil Sampling - The method of analysis was Flame Atomic Absorption Spectroscopy (SW-486, flame AA) performed on samples collected from the top '/z" of bare soil areas (drip line, etc.). 7.0 SUMMARY OF RESULTS Paint Sampling: Throughout the subject property, several of the painted components indicated the presence of lead -based paint (LBP) at or above the federal action level. These surfaces were not painted and the lead is most likely in the glazing or the matrix of the tile itself. Exterior • All painted wooden components Sampling for this inspection was representative and any components that were not tested but similar to those components that tested positive for LBP should be considered and treated as lead laden. The field data and results for paint sampling may be found in Appendices A - B. Dust and Soil Sampling: All of the tested items indicated a level of lead above the specified regulatory limit. Both of the dust wipes samples indicated elevated levels of lead, but the sample adjacent to the front door was significantly above the action level. The soil sample from the perimeter of the house was exceptionally high in lead content. A copy of the laboratory manifest and results may be found in Appendix E. 8.0 RECOMMENDATIONS ,The greatest potential for lead exposure from lead painted architectural components occurs when: the paint has become defective; or when the paint is applied to a friction / impact component where the paint is continually disturbed; or when the paint is disturbed through routine maintenance or renovation activities. With this in mind, the following are our recommendations for this property: • The results from this inspection should be provided to any individuals that may disturb the painted surfaces. It is encouraged to utilize professionals that have experience working with LBP^ • Further testing of the soil should be completed prior to any abatement or renovation. It is important to determine the surface area and the depth of the soil contamination and integrate these findings with any abatement strategy. • If renovation is scheduled in the near future (less than three months), all lead painted components that have been previously targeted for replacement should be replaced utilizing `'lead safe" containment and work practices. • ALL components that have been identified with defective lead paint should have the paint repaired as soon as possible. Any paint repair should be done utilizing "lead safe" containment, work practices, and clean-up techniques. • All components with lead painted friction / impact surfaces should be treated to minimize the friction or impact as necessary. If future renovation or repair activities require that the tile be removed, or the surfaces disturbed, it should be done in a manner that does not break the tiles. If this is not feasible, this task should be assigned to a lead certified contractor. 9.0 TITLE X REQUIREMENTS A copy (or summary) of this report must be provided to new lessees (tenants) and purchasers of this property under Federal law (24 CFR part 35 and 40 CFR part 745) before they become obligated under a lease or sales contract.
