L4L _ '• "'r•J �1 ♦ __,a '�x ;•' t 1� �•�. �+•/r •�+•.1 �• '� :Y' 3 + 'I 1 i • a SPECIAL CONDITIONS In addition to the terms of the grant agreement'as specified in the body of the contract (CCCJ Form 502, Application for Grant for Lair Enforcennnt Purposes),,the grant award is also subject to compliance with the following special condition(s): Project Reporting Requirements: In addition to a final, technical report and an abstract of that report of approximately 200 words, there is a requirement for quarterly progress reports during the period of the grant project. These reports are due 30 days after the end of the grant period or 30 days at the end of the quarter. The content of these reports will be as follows. Reports should be currulative, i.e., describe progress from the beginning of the project to the report date. They should describe activities and acco'-rplishments during the report perind with specific attention to protect phases or stages coy-:pleted (e.g., initial planning stage, completion of preliminary survey effort, purchase of required equipment staging of pilot training programs, etc.). Reports should be concrete and specific concernirr acc ,mplishrrents, e.g., number of people trained, volume of correctional services provided, extent of equip:^ent usage, etc. Special reports, should be attached, and major ad:,rinistrative or design developments should be attached, and major administrative or design, improvements or new methods introduced). Problem areas and critical observations should be mentioned and frankly discussed, as well as project successes. Requirement Be inserted in the proposal contract stipulating that the regional office be provided with quarterly reports and the final report including the project evaluation. Fiscal Requirenle!O[s: Purchase of EDP equipment must have LEAA approval. Approval of the grant budget and its cost estimates shall not relieve the applicant from seeking to secure maximum savings cn equipment purchases through competitive bidding or other negotiations in accordance with State and local law, regulations, and rules and to have all purchases well documented. Applicant agrees to maintain detailed documentation of cost expended for matching contributions relative to personal services reflecting definite cost for tine expended and to maintain time- distribution records (functional time reports) for all pro a ct related personnel. Approval of this grant award in no way ccriits CCCJ to future funding. The value of matching contributions shall be based on actual cost incurred by the subgrantee and small be supported by detailed documentation. The attached "Applicability of Hatch Act Provisions to local Agency Officers and Employees" is hereby made a part of this contract. Subgraiitee agrees and understands that this grant award is subject to and incorporates the attached standard grant conditions. Any unexpended balance of Federal funds reemaining at the time of submission of the final project report should be returned with the final report by check payable to the California Council on Criminal Justice. "The contractor shall comply with the Presidential Executive Order No. 11627, dated October 15, 1971, and all guidelines, rules, and regulations of the Cost of Living Council, Pay Board and Price Corani ss i on implementing it. The contractor warrants that no wages, prices or salaries to be paid under this contract will be in excess of the maximum legally allowable pursuant to the ft,regoing order, rules and regulations." Within 60 days after acceptance of the grant contract, the subgrantee will report by letter, to CCCJ the steps taken to initiate the project. If the project siart has been delayed, the reasons for the delay and the expected starting date will be required. If 90 days after signing the grant contract, the project is not operational, a further state.ment explaining implementation delay will be submitted to CCCJ. Upon rec^ipt of the 90-day letter, CCCJ may cancel the project and redistribute the funds to oth, r grant projects if justification for the delay is not acceptable. If the justification is acceptable, LEAA approval to implement the project beyond the 90-day period is required. CCCJ ,-ill secure the LEAA approval in those instances. No part of the funds appropriated under the Omnibus Crime Control and Safe Streets Act shall be used to provide a loan, a grant, the salary of, or any remuneration whatever to any individual applying for admission, attending, employed by, teaching at or doing research a': an institution of higher education who has engaged in condo ct on or after August- 1, 1969, which involves the use of (or the assistance of others in the use of) force or the threat of force of the seizure of property under the control of an institution of higher education to require or prevent the availability of certain curriculum, or to prevent the faculty, administrative ;officials or students in such institution from engaging in their duties or pursuing their studies at such institution. Applicant agrees that control of grant funds and title of property purchased from grant funds will not be transferred to private agencies, profit making or otherdise, even though thestc may be utilized in the implementation of the grant efforts, including purchase of services. Z r.,,. t SPECIAL C011DITIONS TO BE INCLUDED IN GRANTS FOR COMPUTERIZED SYSTEMS 1. Grantee agrees to ensure that adequate provisions ar6 made fo►r system security, the protection of individual privacy and the insurance of the integrity and accuracy of data collection; 2. Grantee agrees to co,,rdi"hate deviilopment of the program with any compatible multi -state effort to secure the benefits of ex0ange of data and the use of standard reporting formats and definition, to enhance the benefits and potentials of its information systems facilities and provide ,seeded interface with National Criminal Justice Informiition Systems; 3. Grantee agrees that all computer :software produced under this grant will be made available to the Law Enforcement Assistance Administration fur transfer to authorized users in the criminal justice ccnmunity without cost other than that directly associated with the transfer. Systems will be documented in sufficient detail to enable a competent data processing st,%ff to adapt the system, or portions thereof, to usage can a computer of similar size and configuration, of any r�anufacturer. 4. Grantee further agrees to provide a complete copy of documentation to the applicable Regional Office* and a complete copy to the Systems Oevelnpment Division, Office of Criminal Justice Assistance, LEAA. Documentation will include, but not be limited to System Description, Operating Instructions, User Instructions, Program Maintenance lastructions,, input form, file des- criptions, report formats, program listings and flog charts for the system and programs. 5. Grantee agrees that whenever possible all application programs will be written in tliS COBOL in order that they may be transferred readily to another authorized user. Where the nature of the: task requires a scientific programming language, ANS FORTRAN may be used. 6. Grantee agrees to avail himself, to the maxim m extent practicable, of computer software already produced and available;,kithout charge. Tr insure that reasonable effort is extended in this area, LEAA publications and Regional S;•s tems Specialists should be copsul ted. 7. A revised budget will be presented within 60 days of project award. Approval of submitted budget and its cost estimate shall not relieve subgrantee from seeking to secure maximum savings on consultant services through competitive bidding or other negotiations in accordance with applicable state and local law and administrative regulations.
