CITY OF HUNTINGTON BEACH
REQUEST FOR. CITY COUNCIL ACTION
MEETING DATE: 6/16/2014
SUBMITTED TO: Honorable Mayor and City Council Members
SUBMITTED BY: Fred A. Wilson, City Manager
PREPARED BY: Patrick McIntosh, Fire Chief
SUBJECT: Approve and authorize execution of an Agreement for Temporary Assignment of
State of California Office of Emergency Services (Cal OES) Fire Engine to the
Huntington Beach Fire Department
}
Statement of Issue:
An agreement for temporary assignment of a State of California Office of Emergency Services (CAL
OES) fire engine to the Huntington Beach Fire Department (HBFD) is presented for City Council
consideration. Approval of this agreement assists in strengthening the state-wide emergency
response system, as well as providing additional emergency response capability for the City of
Huntington Beach.
Financial Impact:
Minimal costs related to maintenance as the State is responsible for all maintenance over $100 in
value. Costs related to personnel and response for state-wide mutual aide are reimbursed by the
state.
Recommended Action:
Approve and authorize the Fire Chief to execute the "State of California Office of Emergency
Services Fire and Rescue Division Agreement for Temporary Assignment of Vehicular Equipment."
Alternative Action(s):
Do not approve the agreement and direct staff accordingly.
Analysis:
The State of California Governor's Office of Emergency Services has responsibility for
administering the California Fire Service and Rescue Emergency Mutual Aid Plan. This plan, in
which the City of Huntington Beach participates, provides for emergency resources to be shared
throughout the state during major emergencies which exceed the capability of a local jurisdiction to
mitigate on their own. This includes emergencies such as major earthquakes, wildfires, and floods.
As part of the state-wide mutual aid system, CAL OES has purchased fire apparatus and
equipment for the purpose of responding to incidents in furtherance of the California Fire and
Rescue Mutual Aid Plan. These fire apparatus are assigned, through agreement, to fire
departments throughout the state to be staged for CAL OES purposes and for use by local
jurisdictions.
In Orange County, CAL OES fire engines are currently assigned to the Anaheim Fire Department,
Fountain Valley Fire Department, Garden Grove Fire Department, Laguna Beach Fire Department,
and the Orange County Fire Authority (OCFA). The OCFA has recently notified CAL OES of their
Item 15. - 1 HB -320-
Dept. ID FD14 004 Page 2 of 2
Meeting Date: 6/16/2014
desire to reassign the assigned fire engine to another city fire department. The HBFD was
contacted by the CAL OES Fire and Rescue Chief and been afforded the opportunity to staff this
fire engine.
In accepting responsibility for the Cal OES fire engine, the HBFD would be responsible to staff and
respond the engine when requested by the State. In the majority of all instances, reimbursement for
personnel costs associated with staffing and responding the fire engine would be provided by the
State, along with a City administrative fee, which is currently 16%. In addition to supporting the
state-wide mutual aid system and providing valuable experience for our firefighters, the City also
would gain the benefit of having the ability to place the fire engine into service within Huntington
Beach if needed due to an emergency, or as a result of multiple City fire engines being out of
service.
City maintenance costs of this fire apparatus are minimal when compared against the benefit of
having an extra fire engine available locally. Repairs with a cost under $100 would be the
responsibility of the City. Any repairs over $100 would be paid for by the State.
Environmental Status:
None.
Strategic Plan Goal:
Enhance and maintain public safety.

ASSIGNEE agrees to adequately house in an enclosed secure structure, staff, operate, maintain
and repair (consistent with section 4b) said fire apparatus and equipment (hereinafter collectively

above $100.00 shall also be the responsibility of ASSIGNEE. In no event shall ASSIGNEE
arrange for repairs costing over $100.00 for any item of repair, whether.it is the responsibility of
CAL OES or ASSIGNEE, without first obtaining written authorization from the Cal OES Fire
and Rescue Division.
C. Notwithstanding the foregoing, replacement of hose, batteries and tires shall be

thereto is the result of negligence or misuse on the part of ASSIGNEE, in which event
ASSIGNEE will bear such portion of the replacement cost thereof as the CAL OES deems
equitable. Procurement of tires, hose and batteries is subject to State fiscal policies and
procedures, and written approval must be obtained from the Cal OES Fire and Rescue Division

government personnel, staffing Cal OES Apparatus, are committed to extended assignments
there may be a need to replace or rotate personnel. Personnel rotation will follow the direction
outlined in the California Fire Assistance Agreement when assigned to an incident within
California. Crew rotation for incidents outside of California shall be consistent with the
appropriate forest's agencies policy and coordinated by Cal OES.
7. PERSONAL PROTECTIVE EQUIPMENT (PPE) AND SPECIALIZED EQUIPMENT. In addition to

upon like notice to the other party, except that CAL OES may repossess any portion thereof
without written notice whenever it deems the same is not being maintained in accordance with
this Agreement.
b. Upon the termination of this Agreement, ASSIGNEE agrees to return said
Apparatus in the same condition as received, reasonable wear and tear, acts of God, and
conditions over which it has no control excepted.
C. As inventory changes occur, or items of equipment are replaced, deleted or added
