COST SERVICE CONTRACT AGREEMENT /1Z THIS AGREEMENT, made and entered into this & day of Pe 14 19 �� at Sacramento, Country of Sacramento, State of California, by and between the STATE PERSONNEL BOARD, through its duly appointed, qualified and acting Executive Officer or his authorized representative, hereinafter called the Board, and the —City of Huntington Beach , hereinafter called the Local Agency. . WITNESSETH That the parties, for and in consi-+:ration of the convenants, conditions, agreements, and stipulations expressed, and pursuant to authority contained in Section 18707, Government Code, hereby agree to the conditions as found in attached "Cost Services Contract Rules and Procedures" marked as Exhibit A and."Wrttten Examination Price List" marked as Exhibit 8 which are Incorporated herein by reference and Trade a part hereof. Exhibit 8 may be amended by the Board from time to time without renegotiating the contract. Further, the partias agree that the Board NSall, as a normal course of action, submit invoices covering those services rendered during a calendar month and the Local Agency agrees to pay such invoices within thirty days following receipt thereof. The provisions of the attached Fair Employment Practices Addendum, Standard Form 3 (8/77), are Incorporated by reference and made a part of this contract. The term of the contract commences and terminates March :31, 1987 This contract mad be terminated by either party u�%on giving the other party 30 days written notice of termination. Scheduling of Examinations. Whenever during the term of this agreement, the local Agency desires the services of the Board in the preparation of a written examination for a job classification, the Local Agency will submit to the Board a request for such services. This request shall include examination dates and closing dates for filing applications. 'These dates shall be set by the Local Agency vithin the guidelines of the Board to allow sufficient tide for examination scheduling and preparation. b. Info mption to be Furnished by Local A asp ncy. The local Agency shall supply the Board with a written descrip- tion of the work performed in the classes for which the Local Agency desires an examination prepared, including, a statement of the minimum and/or desirable qualification, and the salary of the class. C. Notification of Number of Competitors. Immediately after the closing date for filing, applications, but not less than 10 working Gays rrior to the examination date, the Local Agency will notify Cie Board of the total number of competitors in each classification. d. Preparation of Test Materials. The Board shall construct a written ex.Lmination, based on the information furnished by the local Agency, for e.;ch job classi- fication for which an examination has been requested by the Local Agency and agreed upon by the Board. C. Transmittal of Test Materials. The hoard shall transmit to the Local Agency sufficient exami- nation booklets, instructions for administering the examination and such ..ther material as the Poard may deem necessary. f. Administration of Test and [return of Test Materials. The Local Agency shall administer the examination in accordance with instructions provided by the Board anti immediately following the examination will return to the Board all used and unused examination booklets, keyed booklets, scoring keys, instructions, and any other materials furnished by the Board and not consumed (except that in such cases as provided in paragraphs I(1), 10), and I(m) time extensions may be granted by the Board). g. Re -Use of Test Material. The Local Agency requesting test ?r.;terial for use on a specific date will not be allowed to re -use the tests on another date without prior permission of the Board. h. Scoring of Tests. At the discretion of the Local Agency, the responsibility for the scoring of tests may be delegated to the Board. In such cases, the Board will score the answer sheets and report the results, together with a recommended qualifying; score, to the Local Agency within 14 working days aft--r the answ►.r sheets are returned to the Board, provided that in unusual circum- stances involving; large numbers of competitors or unforeseen difficulties in administration of the te-,t, the Board ra v extend the period for receipt sf results. i. Test Papers Inspection Under Local Agent; Policy. If the Local Agency has an officially adopted rule or esta-)lashed policy regarding candidates' privilege of inspecting a keyed copy of an examination or answer sheets follm-ing the examination, and this rule or policy has been submitted in writing to the Board at least 10 days prior to the first examination scheduler: under this agreement for garish such inspection is desired, the Board will comply with the inspection privilegte!; as officially recognized by the Local Agency except that no inspection shall be allowed for standardized test materials, or tests preduplicated as form tests or semi -form tests, or of questions not scored by an absolute standard. Upon request of the Local Agency and when sub- mitted in writing by a candidate wfin participated in the examina- tion, the Board will analyze protests resulting; from such review and recommend the action to be taken by the Local Agency. Test Papers Inspection Under Board Policy. If the Local Agency has no officially adopted rule or established policy regarding canditintes' privilege of inspecting a keyed copy of an examination_ or answer sheet(s) fallowing►, the examination and wishes to alloy such an inspection privilege, the following policy of the Board shall govern: -2- 1. j�tL Inspection. Inspection of a keyed ropy of the examination question book, winch is for the purpose of requesting a review of Stich items as the candidate may believe are incorrect or improperly keyed, will be allowed for the five working; days immediately following an examination, providing; this has been requested by the Local Agency at least 10 days prior to the examination. Tiic inspection time allowed a candidate will not exceed one-half the amount of time originally allowed to answer the question during; the administration of the examination. During, key inspec- tion a representati.v-. of the personnel or administra- tive office of the Local Agency krill be present to assure that the candidate tales no notes of any kind regarding any test materials. Upon request of the Local Agency and when submitted in writing by a candi- date wdio participated in the examination, the Board will analyze Protests resulting from such review and rwcommend the action to be taken by the Local Agency. 2. Anr—er Sheet(s) Inspection. Inspection of .a candidate's answer sheet(s), which is for the purpose of detecting whether any clerical or ether error has been made in the scoring of the answer sheets, shall be allowed for a 14 -calendar-day Period immediately following the notification to the candidate of examination results. Upon request, the Board will return the candidate's answer sheet(s) after scoring and a copy of a keyed answer sheet(s) to the Local Agency. Candidates are not allowed to review the question booklet during this inspection period. Not more than one hour will normally be allowed for answer sheets) review, during which time a representative of the personnel or administrative office of the Local Agency shall be present to assure that no changes or marks of any kind ire =de by the candidate on his answer shot(s) or the keved answer sheet (s) . 3. Certain Testa Not- to be Omen for i'.ey Inspectien. Stan- dardized tests, and tests preduplicated as form tests and semi -form tests, and questions not scored by an absolute :standard will not be available for keyed ropy inspection nor may candidates be alloweu to review copies of thine tests at any time. k. Retention of Test Material by the Board. The Board shall, if requested by the Local. Agency, retain the completed question booklets or answer sheets) for such reasonable period of time as the- Local agency's pales may prescribe. •3- 1. Agency Responsibilities The Agency shall perform all parts of the examination procetis, the performance of which has not specifically been requested of and agreed to by the Board, and shall assume respor3ibility for the cor.A.ormity of the examination process to any applicable laws, rules, or ordinances and for the examination as a whole. Under the selection guidelines of the Equal Empinymut Opportunity Commission and the California pair Employment r•ractices Commission, the Agency as test user is responsible for the results of the selection process and must be prepared to demonstrate that the process is valid and meets other tasting standards if It adversely affects groups protected by fair employment laws. The Agency agrees to hold harmless the Board, its officers, agents, and its employees from, and to indemnify the Board, its officers, agents, and its employees from, any damages or liability which may arise from the use by the Agency of any examination or selection procedure which is the subject of this agreement. M. Extended Usage If the Local Agency wishes to administer examinations on a continuous basis for certain mutually agreed upon classes, the Board may, in its diacretion, supply the examination booklets, a scoring key and instruc- tions for extended usage. Extended usage is defined as the Local Agency's retention of examination booklets and instructions after their initial administration for the purpoHe of readminisrering them. The Local Agency will score such examinations. n, Security of Test uaterial All test materials supplied by the Board under this agreement shall be and remain the property o:: the Board, and shall be held and stored in a manner that will prevent unauthorized persons from having access to it. The Agency agrees lu be responsible for the security of all test materials supplied to the Agency and agrees to reimburse the Board for a portion or all of the replacement coati, as determined by the Board, for test materials that are lost or whose value for testing purposes, in the opinion of the Board, may have been destroyed -bile said test materials were subject to the custody of the Agency. If any test material obtained from the Board mould become involved in legal proceedings by a court or other body vested with legal authority, the Agency will take appropriate measures to safeguard the confidentiality of the test matey+.al including answer sheets such as by motion for protective order. -4- o. Examination Charges In consideration of the performance by the Board of the testing services specifically described in this Exhibit, the Agency agrees to reimburse the Eoard in accordance With "Written Examination Price List" (Exhibit B). p. Canceled or Pootponed Examinations Agencies tray be billed for work done on a canceled or postponed examination up to the tine the Board is notified of such action. Under certain circumstances, credit may be given for hark already performed if the test to rescheduled. q. Board agrees to provide Local Agency upon request with any or all information developed by or available to the Board related to the job relatedness of examinations furnished by it, including any data relating to validity, differential validity, construc'_ion an(! administration of the teats. -5- Section II - Special Services Upon the request of the Local Agency, the Board, in its discretion, shall supply any or all of the following special services: a. Advice and assistance on examining procedures and problems. b. Preparation and distribution of examination publicity. c. Distribution, receipt, and appraisal of applications. d. Preparation, administration and scoring of essay, problem and performance tests. e. Advice on and conduct of oral interviews. f. Preparation of eligible lists. g. Preparation of special information or affidavits regarding examinations provided, including giving of depositions and presenc.ations in court required by legal action arising from use of any Board examination. h. Other technical personnel services. FAIR EMPLOYMENT PRACTICES ADDENDUM 1. AgencyResponsibilities The Agency shall perform all parts of the examination process, the performance of which has not specifically been requested of and agreed to by the Board, and shall. assume responsibility for thk conformity of the examination process to any applicable laws, rules, or ordinances and for the examination as a whole. Under the selection guidelines of the Equal Employment Opportunity Commission and the California Fair Employment Practices Commission, the Agency as test user is responsible for the results of the selection process and must be prepared to demonstrate that the process is valid and meets other testing standards if it adversely affects groups protected by fair employment laws. Tlie Agency agrees to hold harmless the Board, its officers, agents, and its employees from, and to indemnify the Board, its officers, agents, and its employees from, any damages or liability which may arise from the use by the Agency of any examination or selection procedure which is the subject of this agreement. M. Extended Usage If the Local Agency wishes to administer examinations on a continuous basis for certain mutually agreed upon classes, the Board may, in its discretion, supply the examination booklets, a scoring key and instruc- tions for extended usage. Extended usage is defined as the Local Agency's retention of examination booklets and instructions after their initiv ! administration for the purpose of readministering them. The Local Agency will score such cxaminations. n. Security of Test Material All test materials supplied by the Board under this agreement shall be and remain the property of the i3oHrd, and shall- be held and stored in a manner that will prevent unauthorized person.; from having access to it. The Agency agrees to bn responsible for the security of all test materials supplied to the Agency .and agrees to reimburse the Board for a portion or all of the replacement costs, as determined by the aoard, for test materials that .-e lost or whose value for testing purposes, in the opinion of the Board, may have been destroyed while said test materials were subject to the custody of the Agency. Agency Responsibilities The Agency shall perform all parts of the examination process, the performance of which has not specifically been requested of and agreed to by the Board, and shall assume responsibility for the conformity of the examination process to any applicable laws, rules, or ordinances and for the examination as a whole. Under the selection guidelines of the Equal Employment Opportunity Commission and the California Fair Employment Practices Commission, the Agency as test user is responsible for the results of the selection process and must be prepared to demonstrate that the process is valid and meets other testing standards if it adversely affects groups protected by fair employment lawn. The Agency agrees to hold ~%armless the Board, its officers, agents, and its employees fror+, and to indemnify the board, its officers, agents, and its employees from, any damages or liability which may arise from the use by the Agency of any examination or selection procedure which is the subject of this .agreement. M. Extended Us e If the Local Agency wishes to adininister examinations on a continuous basis for certain mutually agreed upon classes, the Board tray, in its discretion, supply the examination booklets, a scoring key and instruc- tions for extended usage. rxtended usage is defined as the Local ".gency's retention of examination booklets and instructions after their initial administration for the purpose of readministering them. Thn Local Agency will score such examinarions. n. Security of Test Mnteriral All test. materials supplied by th.• Board under this agreement shall be and remain the property of the hoard, and shall be held and stored In a manner that will prevent. unauthorized persons from having access to it. Tile Agency agrees to hf,. responsible for the security of all test materials supplied to the Agency and agrees to reimburse the Board for a portion o: all of the replacement costs, as determined by the Board, for test materials that are lost or whose: value for testing purposes, in the opinion of the Board, may have been dentroved while Paid test :materials were subject to the custody of the Agency. Question booklets shall not be duplicated nor test questions copied by the Agency, under any circumstances. If any test material obtained from the Board should becomc involved in legal proceedings by a court or other body vested with legal authority, the Agency will take appropriate measures to safeguard the confidentiality of the test material including answer sheets such as by motion for protective order. -4- Section 11 - Special Services Upon the request of the Local Agency, the Board, in its a::,c.r�-tion, shall supply any or all of the follow-,'ng special services: a. M PR 11/74 lie r •. r Exhibit A COST SERVICES CONTRACT RULES MM PROCEDURES Section I -- General Conditions In performing the services incident to the planning, scheduling, preparation, construction and scoring of written examinations for classifications to be mutually agreed upon by the Local Agency and the Board, the following provi- sions shall govern: 6/73 a. Scheduling of Examinations. Whenever during the term of this agreement, the Local Agency desires the services of the Board in the preparation of a written examination for a job classification, the Local Agency will submit to the Board a request for such services. This request shall include examination dates and closing dates for filing applications. These dates shall be set by the Local Agency within the guidelines of the Board to allow sufficient time for examination scheduling and preparation. b. Information to be Furnished by Local Agency. The Local Agency shall supply the Board with a written descrip- tion of the work performed in the clauses for which the Local Agency desires an examination prepared, including a statement of the minimum and/or desirable qualifications and the salary of the class. C. Notification of Number of Competitors. Immediately after the closing date for filing applications, but not less than 10 working days prior to the examination date, the Local Agency will not:_ the Board of the total number of competitors in each classification. d. Preparation of Test Materials. The Board shall construct a written examination, based on the information furnished by the Local Agency, for each job classi- fication for which an examination has been requested by the Local Agency and agreed upon by the Board. e. Transmittal of Teat Materials. The Board shall transmit to the Local Agency sufficient exami- nation booklets, instructions for administering the examination and such other material as the Board may deem necessary. r f. Administration of Test And Return of Test Materials. The Local Agency shall administer the examination in accordance with instructions provided by the Board and immediately following the examination will return to the Board all used and unused examination booklets, E-,,!yed booklets, scoring keys, instructions, and any other materials furnished by the Board and not consumed (except that in such eases as provided in paragraphs I(i), I(j), and I(m) time extensions may be granted by the Board). g. Re -Use of Test Material. The Local Agency requesting test material for use on a specific date will not be allowed to re -use the tests on a: -other date without prier permission of the Board. h. Scoring of Tests. At the EF-scretion of the Local Agency, the responsibility for the scoring of tests may be delegatesto the Board. In such cases, the Board will score the answer sheets and report the results, together with a recommended qualifying score, to the Local Agency within 14 working; days after the answer sleets are returned to the Board, provided that in unusual circum- stances involving large numbers of competitors or unforeseen difficulties in administration of the test, the Board m.ay extend the period for receipt of results. i. "rest Papers Inspection UnOer Local- Agency Policy_. If the Local Agency has an officially adopted rule or established policy regarding, candidates' privilege of inspecting a keyed copy of an examination or answer sheets following; the examination, and this rule or policy has heen submitted in :rrit{ng to the Hoard at least 10 days prior to the first examination scheduled under this agreement for which such inspection is desired, the Board will comply with the inspection privilteges as officially recognized by the I.ocal Agency except that no inspection shall be allowed for standardized test materials, or tests preduplicated as form tests or semi -form testti, or of questions not scored by an absolute standard. During Frey inspection a representative: of the Local Agency personnel or administrative office will be present to assure that no candidate takes away with him any notes regarding a test question. Upon request of the Local Agency and when sub- mitted in writing; by a candidate who participated in the examina- tion, the Beard will analyze protests resulting, from such review and recmnmend the action to be taken by the Local Agency. j. Test Papers Inspection Ender Hoard Policy. If the Local Agency has no officiary adopted rule or established policy regarding candidates' privilege of inspecting a keyed copy of an examination or answer sheet(s) following the examination and wishes to allow nuch an inspection privilege, the following; policy of the Hoard shall govern: -2- • 1. Key Inspection. Inspection of a keyed copy of the examination question book, which is for the purpose of requesting a review of such items as the candidate may believe are incorrect or improperly keyed, will be allowed for the five working, days immediately following, an examination, providing this has been requested by the Local Agency at least 10 days prior to the examination. The inspection tine allowed a candidate will not exceed one-half the amount of time originally allowed to answer the question during; the administration of the examination. During key inspec- tion a representative of the personnel or administra- tive office of the Local Agency will be present to assure that the candidate takes no notes of any kind regarding any test materials. Upon request of the Local Agency and when submitted in writing by a candi- date who participated in the examination, the Board will analyze protests resulting from such review and recommend the action to be taken by the Local Agency. 2. Answer Stieet (s) Ins2ection. :nspection of a candidate's answer sheet(s), which is for the purpose of detecting whether any clerical or other error tins been made in the scoring of the answer sheets, shall be allowed for a 14-calendar-day period immediately following the notification to the candidate of examination results. Upon request, the Board will return the candidate's answer sheet(s) after scoring and a copy of a keyed answer sheet(s) to the Local Agency. Candidates are not allor►,ed to review the question booklet during this inspection period. Not more than one hour will normally be allowed for answer sheet(s) review, during which time a representative of the personnel or administrative office of the Local Agency shall be present to assure that no changes or marks of any kind are ma0 a by the candidate on his answer sheet (s) or the I -eyed answer sheet (s) . 3. Certain Tests Not to be Open for Key inspection_. Stan- dardized tests, and tests preduplicated as form tests and sem:-form tests, and questions not scored by an absolute standard will not be available for keyed copy inspection nor may candidates be allowed to review copies of the^e tests at nnv time. k. Retention of Teat Material by the Board. The Local Agency shall perform all parts of the examination process the performance of which has not specifically been requested of and agreed to by the Board and shall assume responsibility for the conformity of the examination process to any applicable laws, rubs, or ordinances and for the examination as a whole. M. Extended Usage. I£ the Local Agency wishes to administer examinations on a continuous basis for certain mutually agreed upon classes, the Board mav, in its discretion, supply the examination booklets, a scoring Ivey and instructions for extended usage. Extended usage is defined as the Local Agency's retention of examination booklets and instructions after their initial administration for the purpose of readministering them. The Local Agency will score such examinations. n. Security of Test 1'.aterial. All test materials supplied by the Board under this agreement shall be and remain thn property of the Board, and shall be kept confidential. Exhibit H to Cost Service Effective Contract Agreement October 1, 1981 SPECIAL. SERVICES Listed examination prices cover the cost of normal consultation and exami- nation preparation services. Additional services beyond normal will be charged at the appropriate billing rate or fee. Examples of such services include: 1. Preparation of special material or revision of existing mate- rials which can be utilized in one agency only; for example, material covering local building codes, and individual depart- ment rules and regulations. 2. Research and analysis of candidate appeals, at a cost of $45 for each appeal denied. (If an item is found to be faulty, Cooperative Personnel Services will absorb the cost of analyz- ing and responding to the appeal.) 3. An unusually high amount of technical or clerical staff time being spent to meet an agency's examining need. Several exam- ple2 are: a. Agencies requesting, they be sent review copies of custom test segments will be charged $3.00 per 15-item segment. The ct.a.ge can be waived for agencies making significant contributions to t:,e quality of the custom test item-9 sent for the test, by sourcing items, rewrit- ing outdated items, or by writing new test items. b. Agencies requesting a length; custom written test (120 or more test items) will hp charged for actual costs for- typing time exceeding four (4) hours. c. Agencies which call in higher candidate counts after the originally estimated number of test booklets has been duplicated and assembled, will be charged for actual costs for any additional press work required to meet the higher candidate count. 4. Proctor services and arrangements for test adminis'ration arranged for or provided by Cooperative Personnel Services. 5. General consultation on selection systems and other Services not directly related to a specific examination. 6. Scoring or problem and essay type questions. 7. Preparation of special information regarding the content, coverage, or validity of the provided examination, preparation of' affidavits, giving of depositions and preparation for an Exhibit B to Cost Service Effective Contract Agreement October 1, 1981 appearance in court which is required in connection with any legal action pertaining to the use of any examination provided by the Board. RESPONSIBILITY FOR SELECTION PROCESS State and Federal selection guidelines indicate the employer is responsible for the rrsults of the selection process and must be prepared to demonstrate that the process is validated for their specific jobs and meet other selec- tion standards if it adversely affects minority or women applicants protected by EEO laws and guidelines. Consequently, CPS cannot assume either the legal ,responsibility or the cost for litigation or substantive complaints arising from local agency use of CPS test materials. CANCELLED OR POSTPONED EXAMINATIONS Agencies will be bided for work done on a cancelled or postponed examina- tion up to the time we are notified of such action. Under certain circum- stances, coedit may be given for worn already performed it' the test is re- ^chedueled. PERFORMANCE TENS An additional charge of $5.50 per candidate is assesse.i for scorirg either typing or stenographic performance tests. The EEO laws impose the burden to demonstrate by validation the relationship between the test and the job if the test admini- stration has adverse effect upon any protected class (i.e., race, religion, sex, color and national origins). Therefore, it is dangerous to utilize unvalidated tests. Under this agreement, we will have to make our own determiration of the job -relatedness of the tests ind ne solely responsible for the consequences. This contract should be approved by the Council. Obviously, the use of the testing services will oe limited by the amounts annually allocated in the budget. The City Clerk will need to certify the minutes approving the agreement. It is intended only as a general guide and check list. 1. When a Vacancy Occurs When a department he.:d anticipates a vacancy, he should submit a request for replacement to the person designated as the personnel officer or personnel clerk. The request for replacement form might include such information as department, title of position to be filled, earliest date position is to be filled, whether a temporary appointment would be acceptable, and whether a promotional appointment is desired. Usually a form for this purpose also gives address of employment, dULies to be assigned, and any special requirements, such as the shift, hours of work, etc. 2. Is an Examination Necessary? When tie receives the request for replacement, the personnel officer should first determine if there is an eligible list for the class and whether the eligibles are interested in considering the current vacancy. The personnel officer should also determine whether a substantial number of present employees are qualified for the position. If an, it would probably be in the bent interez;t of the agency to hold the examination on a promotional basis, only. Planning an Examination If the personnel officer believes that new recruitment and an examination are recessary to fill the vacancy, he must consider several factors before publishing a too announcement or bulletin: A. For many classes the use of '.roth written and oral examinations is beneficial, and a typical weighting is 60% on the written and 10% on the oral. In general, greater weight is given to the oral interview in examining for higher level supervisory and administra- tive classes. Some classes that involve considerable contact with the public also are weighted heavier on the oral. Additional selection devices, such as physical fitness testa or performance tests, m©V be given on a qualifying basis, (i.e., the candidate either passes or fails) or they may be graded and weighted. Usually a passing score is required on each separate part of an examination. C. Deadline dates must be set for cacti part of the exami_nnt- ion. Recruitment The recruitme;it process will usually include the construction and distribution of bulletins and the placement of dvertisements. In today's labor market, recruitment is often the most important step in the selection process. A. The up rpose of your examination announcement or bulletin is to attract, qualified applicants and interent theca in applying for your vacancy. With ©any public agencies competing for job applicant attention on bulletin boards, it is highly ?esirable to devise a colorful and interesting masthead and format to announce al). of your agency's examinations. Specific information about the examination would include job title and a brief description of duties; salary range; final filing date; the dates and weights of each part of the exami- nation; a general idea of the Acope of the written and oral examinations; medical, physical or age requirements; education and experience requirements of position; and required licenses or certi- ficates of proficiency. Your lob announcement should include standard information about retirement plan, vacation and sic1 leave provisions, how to file, where to obtain application forms, and other general information appropriate for all or most of your agency's job classes. This type of information is usun)ly given on ths, hack side of the bulletin. Advertising in publications like Western City, the Public Administration Recruiter, the Job Finder (University of California - Western Governmental Research Association) and specialized professional journals should be considered for department head and certain other professional positions. 5. Accepting and Reviewing Applications Ae they are received, .ipplications should be time -stamped, and then reviewed to determine -nether the applicant meets the education, experience and other requirements, as stated in the bulletin. Persons whose appli- cations are not acceptable should be notified by form letter with the reason for rejection indicated. Candidates Whose applications are acceptaf•,le should be given advance notice of the time, place and date of the examination, what materialq they should bring, and the amount of time the test will. take. 6. Administering the Written Test Candidates appearing; for written or oral a xe.minntlons may be nervous. Obtain quiet, well lighted and pleasant rooms in which to administer the tests. Provide ample room; avoid crowding; of candidates. Ii typewriters are to be used, they should be checked to see that they are in working order. When phynicnl fitness tests are to be administered, athletic facilities should be inspected for safety, and arranged, before the events. This type of teat is usually rime consuraing and is normally given only to persons who have passed the Written tent. The proctor of the written exanination should be thoroughly acquainted with the proctor's instructions and the fo nas to be used for the test. A driver's license or other means of identification is sometimes matched againbt a candidate's signature before the examination begins. MM S Rules should be established and followed by the agency regarding the review of written examination booklets or answer sheets by candidates. Candidates who receive a failing score on the written examination should be notified by nail, immediately after the results of the written test are known, 7. Oral Interview Boards When an oral examination is to be given, candidates wbo have passed the written teat should be notified in advance of the tirue, date, and place they are to appear for interview. High standards should be followed in selecting interview panel members. It is highly desirable to provide rating forms, designed to draw attention to job requirements or personal traits that are important for the job in question. A minimum of 20 minutes per candidate should be allowed for each interview. After the interviews have been complered, written test scores and interview scores should be combined into one final grade, and the candidates should be placed on art eligible list in the order of these final scores. 8. Other Requiments Before a candidate on an eligible list is considered for appointment, he may be required to meet certain additional standards. These additional requirements should be specified is the examination announcement. A. A medical examination may be mede part of the selection process, and candidates may be rejected on the basis of a doctor's report. This can be done at either the agency's or candidate's expense. If the employee is required to pay for this test, this shouie be specified an the job announcement. B. Former rmployer reference checks, FRt reports, Department of Motor Vehicle Reports and Retail Credit Association reports are several other sources of information which might be considered before considering an eligible for appointment. 9. Eligible Lists After an eligible list has been established, names can be submitted to the department head concerned, who would then make his selection. Cooperative Personnel Services entry-level police and fire tests, Forms 51X and 45, were included in the statewide, criterion-relAted validity studies conducted by the Selection Consulting Center. It is critical that all agencies using these tests be aware of 1) the specific findings and conclusions of the validity studies, and 2) other important issues pertaining to their proper use. This state- ment briefly discusses these points and is intended to assist local agencies in their efforts to achieve their personnel selection objec- tives and comply with testing laws and guidelines. As you are probably already aware, the Equal Employment Opportunity Commission guidelines indicate that the employer is responsible for the results of the selection process and must be prepared to demon- strate that the entire process {. valid anh has been utilized in a reasonable manner if it adversely effects groups protected by Fair Employment Law. The section below contains rezo=endations for the proper use of the tests designated above. The remaining sections of this statement briefly discuss the validity study results and other factors pertain- ing to the proper use of these tests. Recommendations The State Personnel Board recomrends that local agencies operate within the following guidelines when using CPS Forms 51X and 45, and their alternate forms: 1. Do not give these tests more than a 50X weighting :n the examina- tion process. Be aware of how different pass point and test weighting decisions incrense or diminish adverse effec.r. You may also wish to discuss the rollection of specific racial information on candidate groups with your state Fair Employment Practices Cor"ission. 4. Do not set pass points so high that they are not supported by reasonable expectations of job performance. In our experience with a wide variety of tests, pass points in the fifty to seventy percent range have enabled employers to hire reasonably qualified employees. Of courne, every pass point decision should be based on a thorough evaluation of the scores resulting from the test administration in question. 5. Whenever feasible, use technically sound selection procedures which minimize adverse effect. Validity Stud_ Results The validity study conducted by the Selection Consulting Center has shown that Forms 51X and 45 are significantly correlated with "major, critical zuid important" elements of job success for entry-level law enforcement and fire positions. These tests also demonstrate an acceptable degree of utility (practical significance). Analysis of covariance fer differential validity indicates that sores on both tests have common meaning for all racial groups included in the studies (Black, Caucasian, and -oanish-surnaned) and that, therefore, the same pass point should be used for these groups. The Selection Consulting Center concluded that the exa-mInntions are ;ob- related and that their proper use conforms with governmental guidelines on testing and eeleLtion. Considerations for Proper Test Use In the past, most public agencies have based their test weighting and pass point setting decisions on: 1) administrative considerations, such as time, cost, and the number of vacant positions to be filled and 2) certain basic technical factors, such as test difficulty level and the particular way in which tLac scores were dispersed. Vhile these factors remain important, they can no longer completely control decisions on the application and use of tests. Recent developments have given rise to several additional areas of concern, including: 1) selection laws an(, guidelines, 2) affirmative action, and 3) the need for a more com- prehensive evaluation of job applicants. These factors are discussed below with specific reference to pass points and test weighting. From a legal point of view, there is no single, clear-cut standard for pass point setting. The Civil Rights Act of 1964 which requires that tests be job -related does not specifically d^.-1 with the issue of pass points. In- deed, there is some support for the p*:uposition that employers may set the pass point on job -relaters tests as high as they desire without regard to the effect of such an action on the employment opportunities of minority group members. This interpretation is based primarily on a memorandum prepared by Senators Clark and Case during the debates on the Civil Rights Act. In their memorandum, the Senators stated that the Act was not inten- ded to restrict the level at. which an employer could set his qualifications so tonF, as those qualifications were ,job -related. This memorandum received further significance when it was qurted by ty,e United States Supreme CourL in the case of Gres vs. Duke Power. However, the Equal Employment Opportunity Commission .and the Fair Employ- ment Practices Commission have recognized that the use of unreasonably high pass points, even for valid tests, may result in an inordinate degrce of adverse effect. Thus, compliance agencies have issued guidelines which restrict the right of employers to set unreasonably high pass points for examinations. This is based primarily on the fact that the setting of unreasonably high pass points for otherwise valid examinations cin result in the exclusion of all or substantially all minority group competitors. Thus, Section 1607.6 of' the Equal Employment Opportunity Commission Guide- lines and Section 20 of the Pair Employment Practices Commission Guidelines require that pass points be reasonable and consistent with normal expecta- tions of proficiency on the job. ii se factors make it extremely desirable for employers to be aware of the effects of various pass points on the passing rates for minority and non - minority groups. This is best accomplished if each agency using a test gathers data on the relative test performance of ,Minorities and nonminori- ties in its particular administration. Data gathered from several early administrations of CPS Form 51X shows that when the pass point is lowered Memo re: CPS Fortes 51X, 45 and their alternates. -4- from the seventy percent level (raw score -. 42) to sixty percent (rhv score = 36) that the acceptance rate for Blacks increases from twelve to forty-one percent while that for Spanish -surnamed persons rises from twenty-six to fifty-six percent.* (Preliminary data suggests that a similar pattern of results may exist for Form 45.) While these figures are meaningful, they should be interpreted cautiously, since they come from a limited sample and are probably not representative of all situa- tions. he most „eaningful data on the relative performance of different groups of candidates will be that which is obtained from your own test administration. Pass point setting and test weighting are deeply involved in the concept of total assessment. The Selection Consulting Center is currently develop- ing a total assessment system for the selection of entry-level law enforce- ment officers. The Center also has tentative plans to develop a total assessment syster: for entry-level fire positions. Two basic principles underlying this selection concept are: 1) within ceitain limits, candi- dates should be assessed in all aspects of their fitness for law enforce- ment work before being accepted o: rejected and Z) a candidate's weakness in some areas may be "balanced out" by strength, in other areas. Total assessment also requires that each selection cool be given a weight based on the proportion of the total group of measurable job performance factors to which it is related. For example, a test which measures two out of a total of ten equally critical aspects of job performance should be assigned a weight of twenty percent, provided that it is the only selection instru- ment that measures those two perfor-mance dimensions. The Selection Consulting Center's validity study identified 13 pe iormance dimensions for entry-level police jobs. Form 51X is significantly corre- lated with G of them for l,'hites and with 3 of them for Blacks and Spanish- surnan.ed persons. Form, 45 ccrrelates significantly with factors falling within three of the six performance dimensions identified for entry-level fire jobs. These results are outlined in detail in the Center's validity reports. To illustrate the total assessment concept, suppose that a lc:al agency determine6 that Form 51,: measured 2 out of a total of 6 equally critical performance dimensions covered in their selection process. This would suggest a weighting, of about 25Z for the test. If another agency deter- mined that Forr. 45 was measuring 3 out of a total of 6 factors they were measuring, they should consider giving it a 50Z weighting. These examples do not include all of the technical considerations involved In test weighting. They point out, however, that a test's weight should be based on the actual contribution it makes to the particular selection process in which it is used, rather than on traditional or generally pre- vailing practice. Regardless of the weighting given, the pass point should be sufficiently log: to allow for the assenstrent of a substantial number of candidates in performance areas not covered by the test. t Of course, it should he realized that with a pass pnint of 15, only 25" of the candidates are elininnted, .1nd more pressure Is pinced on furthrr selection methnds. Consulting Center, are currently working on a validity study of the process used to select entry-level law enforcement officers. The study, which is being funded by the Commission on Pence Officer Standards and Training (P.O.S.T.), includes the oral interview, physical agility test and background check, and is scheduled for comple- tion later in the 1974 Calendar Year. The Selection Consulting Center has conducted a comparable study for entry-level fire positions. As a general practice, local agencies should attempt to tie all aspects of their own selection process, as closely as possible, to the performance dimensions ije.-fified in the Selection Consulting Center's validity studies or their own locally conducted studies. Agencies not included in these studies should evaluate the comparability between their positions and those included in the studies before attempting this. Conclusion As noted above, this statement is only a brief discussion of the many involved issues pertaining to the proper use of CPS Form 51X and 45. Before making final decisions on these matters, local agencies should thoroughly review and consider these issues.
