AGREEMENT'
THIS AGREEMENT, made and entered into as of this ,y
day of October, 1948, by and

a Municipal Corporation,
hereinafter designated as
CARL R . STEVERS ON and
J . I,. ST EWERS CN ,
doing business as
STEVERSON BROTHERS,
hereinafter designated as
W ITHESSETH t
CITY,
PERMITTEE .
That in consideration of the performance of the
covenant:v and conditions herein contained and agreed by Permittee
to be done and performed, the City does hereby grant a permit to
Permittee a right to cross over certain property situate in the
City of Huntington Bosch, County of Orange, State of California,
and owned by said City as more particularly marked in 'red' on
the map attached hereto, narked Exhibit "A" and made a part
hereof. Being over and across the northwesterly corner of the
following described property.
All that certain real property situate in the City of
Huntington Beach, County of Orange, State of California,
described as folloust
Beginning at a point in the Northeasterly line of the right
of way of the Southern Pacific Railroad Company, as granted
by deed recorded December 20, 1905 in Book 123, page 96 of
Deeds, which point is 20 chains South of the North line of
Section Fourteen, Township Six South Range Eleven West,
S. B. B. & M.; thence Fast along a line which intersects the

Last Line of said Section Fourteen at a point 20 chains South
of the Northeast corner of said Section Fourteen, a distance
of 2426.53 feet, more or less to a point on said East line;
thence South along the East line of said Section Fourteen to
a point in the Northeasterly line of the right of way of the
Southern Pacific Railroad Company; thence Northwesterly along
said Northeasterly line of said right of way to the point of
beginning.
Permittee dons hereby accept said permit and agrees
that he will construct and maintain a road way for the purpose
of crossing said property at said location at his own cost and
expense, provided, said road way shall not be constructed in
excess of 16 feet in width, and that said road way shall be
used by said permittee, his agents, employees, and others seeking
ingress and egress to said property under his direction and
control, for the purpose of ingress and egress to and from
certain property owned by one T. B. Talbert and located northerly
of said City property herein describcad and easterly of Huntington
Avenue, and only for said purpose.
That this permit may be terminated upon sixty days
Written notice given by either party to the other party, and at
the said termination Permittee shall cease to use said road way.
Nothing in this permit shall be construed as a grant of a
right of way to the public or to any private person over saint
property, and the Permittee may maintain signs to that effect,
and the City .reserves the right to construct, install and main-
tain signs substantially in the following form:
Private property. Permission to pass over revocable
at any time. By order of the City Council.

The Permittee does hereby agree to indemnify and hold
the City harmless of any liability of any kind or nature what-

and property damage insurance in such sum as the City Council

may ri!rquire, said insurance policy shall inure to the benefit
of the City.
IN WITNESS W2IL4'R.EOF, the City has caused its corporate
name and seal to be hereunto annexed by its Mayor and attested
by its City Clerk, thereto duly authorized, and Permittee has
set his hand as of the day and year in this agreement first
above written.
