FORD Ass stant District Engineer Attach. r SAMPLE RESOLUTION OF PROPOSED DESIGN CHANGES FROM THE EXECUTED FREEWAY AGREEMENT RESOLUTION OF THE City Council of City of Huntington Beach Date WHEREAS, the City of Huntington Beach and the State of California have heretofore entered into a Freeway Agreement dated February 1, 1960, relating to the portion of the San Diego Freeway, State Highway Road VII-ORA-158-HntB, between Huntington Beach -Fountain Valley city limits at Cannery Street and Huntington Beach -Westminster city limits of the S.P.R.R.; and WHEREAS, further engineering studies indicate that the following revisions are desirable, to Wit; Provide a pedestrian overcrossing from Heil Avenue to Savoy Circle as shown on attached print labeled Exhibit A, dated March 27, 1962, And made a part hereof. NOW, THEREFORE, be it resolved and ordered that this City Council of City of Huntington Beach hereby concurs and approves the proposed revision as set forth hereinabove, it being under- stood that a revised freeway agreement incorporating said revision is to be entered into at some future date. However there is a policy =tLtter that your.honorable body should decide. Specifically 1 call your attention to the second para- graph of the letter, where it says "Transporting these children ..,,... would cost the School District ... 08,200 annually." and to the last paragraph of the sample resolution where it is stated ....... the City will accept and maintain said pedestrian overcrossing... �t ....... The council will have to determine that it is in the best interest of the City to accept the maintenance of this structure. Actually the costs of maintenance will be negligible and should not be given a great weight in your considerations, but rather you should decide whether or not we will accept responsibility for some- thing that is of benefit to the School District only. The Ocean View School District has requested a pedestrian crossing over the proposed San Diego Freeway in the vicinity of Heil Avenue for school children required to cross the freeway from the resi- dential area on the northerly side of Heil Avenue and the freeway to school site No. 20 on the southerly side of Heil Avenue and the freeway. The School District has informed us that with completion of the undeveloped land in the area northerly of the freeway there will be in excess of 400 children from this area attending school at school site No. 20. Transporting these children to school would cost the School District approximately $8,200 annually, In reviewing the proposed pedestrian overcrossing we are of the opinion that the best location for the structure is in the City of Huntington Beach between Heil Avenue, near the intersection of Venus Drive and Galaxy Drive, and Savoy Circle. This location was discussed between yourself and representatives of this office on March 12, 1962. If the proposed pedestrian overcrossing, as requested by the Ocean View School District, meets with the City's approval, we will appreciate receiving in duplicate a certified copy of a resolution by the City Council approving the pedestrian overcrossing. The resolution is necessary in order that we may obtain approval to include the pedestrian Structure in the freeway design. To: James R. DMIN� STIISST LOD AN4 ELSE lit, CALIF. rNONsI MADISON 4-2215 PLEADS REFER TO FILE No. VII-Ora-158-HntB 7QV91S.5 Freeway Agreement Transmitted herewith are triplicate counterparts of a proposed freeway agreement between the State and the City of Huntington Beach covering the San Diego Freeway, Road VII-Ora- 158-HntB, between the Huntington Beach -Fountain Valley city limit at Cannery Street and the Huntington Beach -Westminster city limit at the Southern Pacific Railroad. This proposed freeway agreement supersedes thoseportions of the freeway agreement dated February 8, 1956, between the County of Orange and the State insofar as it pertains to the por- tion of said freeway within the present limits of the City of Huntington Beach. The freeway plan is in accordance with plans previously presented to you and understood to have your concur- rence. If this agreement meets with your approval, please arrange for its formal execution by the City of Huntington Beach, after which please return the original and one signed counterpart to this office together with two certified copies of the City Council's resolution authorizing execution of the agreement. The third copy is for your files pending return to you of one fully executed counterpart of the agreement. Your cooperation in facilitating the execution of this document will be appreciated.
