Funding Source. Recommended Action, Alternative Action, Analysts, Environmental Status, Attachment(s) Statement of Issue: The attached cooperative agreement between the City Of Huntington Beach and State of California, defines the terms and conditions for project cost sharing for the rehabilitation of Beach Boulevard between Pacific Coast Highway and Ellis Avenue. The City's share of this project costs is $42,000. Fundinq Source: Funds are available and budgeted for this project in Account No. E-SF- PW-984-6-43-00. Recommended Action: Approve the attached cooperative agreement for the rehabilitation of Beach Boulevard between Pacific Coast Highway and Ellis Avenue, and authorize the Mayor and the City Clerk to execute the cooperative agreement. Alternative Action(s): Do not approve the Cooperative Agreement and direct staff to take another action. Not approving the subject agreement would jeopardize future construction for the subject project. REQUEST FOR COUNCILIREDEVELOPMENT kGENCY ACTION MEETING DATE: March 20, '1995 DEPARTMENT 1D NUMBER: PW 95-012 Analysis The State of California Department of Transportation (Caltrans) is preparing to repave Beach Boulevard between Pacific Coast Highway and Ellis Avenue. Caltrans has requested the City to participate in the modification of the existing traffic signals at the intersections of Beach Boulevard at Garfield Avenue and Yorktown Avenue. The traffic signals will be modified to provide left turn arrows for traffic turning from Garfield or Yorktown Avenues onto Beach Boulevard. These modifications would take place during the roadway rehabilitation project. The existing traffic signals were installed and are currently maintained and operated by Caltrans via a cooperative agreement. The State of California requires that a cooperative agreement between the City and State be executed by both parties, prior to the award of the construction contract. The attached Cooperative Agreement defines City and State responsibilities pertaining to the modification of the traffic signals and the project cost sharing arrangements. Huntington Beach will be responsible for $42,000 of the traffic signal modification costs. Environmental Status: This project is covered by the Determination to the California Environmental Quality Ac January 14, 1994. Caltrans has prepared and processed required for this project. State and CITY, pursuant to Streets and Highways Code Section 130, are authorized to enter into a Cooperative Agreement for improvements to State highways within CITY. 2. STATE contemplates the construction of a roadway rehabilitation project in the City of Huntington Beach from PCH to Ellis Ave. , referred to herein as "PROJECT". 3. CITY desires and has requested STATE to install left turn phasing signal (s) on Route 39 at Yorktown Avenue and Route 39 at Garfield Avenue on PROJECT, referred to herein as "IMPROVEMENTS". 4. The parties hereto intend to define herein the terms and conditions under which IMPROVEMENTS are to be constructed, financed, and maintained. District Agreement No. 12-239 SECTION I STATE AGREES: g9719 1. To administer the construction contract for PROJECT and have the PROJECT construction contractor furnish and install IMPROVEMENTS as requested by CITY. SECTIOm II CITY AGREES- 1. To deposit with STATE within twenty-five (25) days of receipt of billing therefor (which billing will be forwarded 15 days prior to STATE's bid advertising date of a construction contract for PROJECT), the amount of $42,000, which figure represents the lump sum total amount of CITY's agreed to share of the cost of work to be performed by STATE on CITY's behalf pursuant to this Agreement. 2. To make all arrangements to provide the construction contractor with permits to enter and construct on lands outside of STATE's right of way in the event that such permits are necessary to accommodate construction of IMPROVEMENTS, and 3 District Agreement No. 12-239 to certify in a -form satisfactory to STATE, prior to STATE's advertising date of a construction contract for PROJECT, that such permits have been obtained. 3. To maintain IMPROVEMENTS installed pursuant to this gglg Agreement which lie outside the State highway right of way. SECTION III IT IS MUTUALLY AGREEDz 1. All obligations of STATE under the terms of this Agreement are subject to the appropriation of resources by the Legislature and the allocation of resources by the California Transportation Commission. 2. Upon completion of all work under this Agreement, ownership and title to materials, equipment and appurtenances installed will automatically be vested in STATE and no further agreement will be necessary to transfer ownership to STATE. 4 0 District Agreement No. 12-239 3. Neither STATE nor any officer or employee thereof is responsible for any damage or liability occurring by reason of anything done or omitted to be done by CITY under or in connection with any work, authority or jurisdiction delegated to CITY under this Agreement. It is understood and agreed rip that, pursuant to Government Code Section 895.4, CITY sha119� !!1 fully defend, indemnify and save harmless the State of California, all officers and employees from all claims, suits or actions of every name, kind and description brought for or on account of injury (as defined in Government Code Section 810.8) occurring by reason of anything done or omitted to be done by CITY under or in connection with any work, authority or jurisdiction delegated to CITY under this Agreement. 5 4. ,— .
