First Party will furnish all labor, materials, equipment, transportation and ser- vices for the waterline relocation in Edinger Street at the San Diego Freeway Crossing for. the City of Huntington Beach in accordance with the plans and specifications, bid form, notice in-.riting bids, wage scale and resolution of First Party, dated Janwiry 12.0 , 1964 , all of which are incor- porated herein and ma e a part hereof, as t ough set out in full. 2. This Contract is to include all of the work, materials, transpor- tation and services called for in the plans and specifications. 3. The Second Party agrees that he will pay to any laborer or mechanic employed by him, the prevailing rate of hourly wages and rates for legal holidays and overtime worn, which rates are shown and set forth in the NoticZ Tnviting Bids. The Second Party shall as a penalty forfeit to the First Party Tea Dollars ($10. 00) for each calendar day or portion there- of for each workman paid less than the prevailing wage under this Contract, by Second Party and by any Sub -Contractor under him. 4. Second Party agrees to commence construction of the work pro- vided fur herein within ten (10) days from the execution of this Contract and to continue in a due and diligent workmanlike manner without interruption and to complete construction thereof w-ithin the time limits specified (or approved extensions thereof). 5. First Party agrees to pay to Second Party and Second -Party agrees to accept as work progresses according to specifications, subject to additions and deductions provided therein, for the furnishing of all materials, equip- ment, transportation and services for said construction, all in accordance with the applicable provisions of Section 9, Measurement and Payment of the General Provisions of the Project Specifications, which sums shall be computed from the prices set forth in the bid submitted by Second Party. 6. Second Party agrees to use and supply only such unmanufactured materials as have been produced in the United States, and only such manu- factured materials as have been manufactured in the 'united States, substan- tially all from materials produced in the United States. - 1 - 7. Second Party shall forfeit as a penalty to the First Party, the sum of Ten Dollars ($10. 00) for each alien knowingly employed in the execu- tion of this Contract, for each calendar day or portion thereof during which such alien shall be permitted or required to labor, in violation of Section 1853 of the Labor Code of the State of California. In pursuance of a Resolution of the City Council of the City of Huntington Beach, California, adopted directing this notice, Notice is hereby given that the City Council o the City of Huntington Beach will receive at its Clerk's Office, in the City Hall at Huntington Beach bids for furnishing all labor, equipment, transportation, materials and such other facilities as may be required, and for constructing therewith a Water- line Relocation in Edinger Street at the San Diego Freeway Crossing. A-2. Copies of the Contract Documents may be examined at the office of J. A. WOOLLEY, CONSULTING ENGINEER AND ASSOCIATES, located at 308 West Fifth Street, Santa Ana, California. A set of the plans, specifica- tions and other contract documents may be obtained at the above mentioned office u:.on deposit of Fifteen Dollars ($15. 00). This deposit will be refunded upon return of such documents in good condition within ten (10) days after the opening of bids. Copies of the Standard Specifications, Rules and Codes of Public Agencies and Associations referred to in these plans and specifications shall be obtained by prospective bidders from the publishers thereof at their own expense. A-3. Each bid shall be made in accordance with terms set forth in Information to Bidders, and with due consideration to each provision of the contract documents, the plans and specifications, and all addenda setting forth any modifications or interpretations of any of said documents. A-4. Each bid shall be made on the form and in the manner provided in the contract documents, and shall be accompanied by a certified or cashier's check or bid bond for not less than ten (10) percent of the amount of the bid, made payable to The City Treasurer of the City of Huntington Beach, California, and shall be filed in a sealed envelope with the City Clerk at his office, at the City Hall in Huntington Beach, California, before the hour of , at which time bids will be opened in public and read aloud y the Merk of t e City of Huntington Beach, California.
