Picard, Fire Chief Subject: EXPANDED AUTOMATIC AID FIRE PROTECTION AGRE IT � w � MTT1 Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions, Attachments'/ Statement of Issue: The cooperative automatic aid agreement between the Net 6 cities of Fountain Valley, Huntington Beach, Seal Beach and Westminster is being expanded to include the two unincorporated areas of Orange County known as Sunset Beach and Midway City. Reco=endation: Approve the expanded contract for the purpose of providing an improved consolidated emergency automatic aid response between the Net 6 agencies. Analysis: Not all of the territory laying within the operational boundaries of Net 6 (Fountain Valley, Huntington Beach, Westminster and Seal Beach) receive a unified single dispatch or deployment of fire equipment to reported emergencies. These excluded areas are the two communities in Orange County known as Sunset Beach and Midway City. It is the desire of the fire authorities in the Net 6 areas to functionally consolidate and include all territory within the Net 6 operational system. The agreement submitted has been agreed to both administratively and legally by all parties at the staff level. We now are requesting each City Council and the Board of Supervisors to ratify this contract for implementation. This act will functionally strengthen the fire defense system by operationally inte- grating all fire unit deployment within the Net 6 operational area. Funding Source: None required. Expenses are included in the regular fire department budget and no additional funds are being requested. Alternative Action: Do not ratify the agreement nor expand the Net 6 operational system to include Sunset Beach and Midway City. For convenience, Consolidated Fire Emergency Communications, Training and Reporting System shall be hereinafter referred to as "SYSTEM." RECITALS: WHEREAS, CITIES and COUNTY are expanding and increasing in population with the result that the demands placed upon such entities for emergency fire services has increased proportionately, thereby requiring expenditures of money by each for such fire services; and Studies by CITIES and COUNTY have disclosed that SYSTEM would greatly reduce the total cost of providing maximum emer- gency fire protection and would permit maximum use of equipment and manpower in cooperative ventures, thereby increasing fire emergency efficiency and defense capabilities of CITIES and COUNTY; and CITIES and COUNTY each have the power and authority to provide emergency fire services, facilities, equipment, personnel WSA:ahb 1/13/81 1. r �f and dispatching for their respective cities and are capable of providing such facilities and services at this time; and Government Code sections 6500 et seq. provide that two or more public agencies, by agreement, may jointly exercise any power common to the contracting parties; and CITIES and COUNTY now desire to enter such agreement for SYSTEM for fire services in the geographic area of each city and the unincorporated county area of Sunset Beach and 111dway City, and facilities for the reasons hereinafter specified, such facilities to be located at the Joint Powers Training Center, 18301 Gothard Street in and operated by the City of Huntington Beach. NOW, THEREFORE, CITIES and COUNTY do hereby mutually agree as follows: 1. The City of Huntington Beach shall provide to CITIES and COUNTY dispatch, training and fire -reporting services through a system to be located in and operated by said City of Huntington Beach. 2. The actual cost of installation, maintenance and operation of SYSTEM shall be distributed among CITIES and COUNTY based on the following formula for the period beginning July 1, 1980 through June 30, 1981, and such CITIES and COUNTY shall pay their share of such costs to the City of Huntington Beach as hereinafter provided: 2. ASSESSED CITY POPULATION VALUATION TOTAL PERCENTAGE (thousands) (millions) Fountain Valley 54.5 268 322.5 16.1 Huntington Beach 166 934 1100 54.7 Seal Beach 26.5 166 192.5 9.7 Westminster 70 286 356 17.8 County of Orange 6 28 34 1.7 The relative shares of cost for the fiscal period be- ginning July 1, 1981 through June 30, 1982, and each fiscal year thereafter, shall be computed by using the same method as used in the above chart provided that population and assessed valuation figures shall be adjusted as of January 1 of each year, commencing January 1, 1982. The population estimate issued by the state Department of Finance or successor agency shall be used for this purpose. Such costs shall be prorated for any city or county which executes this agreement during rather than at the commencement of any fiscal year. Such total costs shall not exceed $500,000 for fiscal year 1980-1981. If one or more parties withdraw from this agreement, as provided in paragraph 4, such costs shall be shared among the remaining parties as provided herein. The City of Huntington Beach shall notify each party of the estimated total cost of providing such services in each sub- sequent fiscal year by the February 1 immediately preceding. Such estimated costs shall be reviewed and estimated at the end of each fiscal quarter and adjusted as necessary to charge or reim- burse the CITIES and COUNTY for the actual costs incurred. 3• A total cost increase of over 10 percent in any year shall be specifically approved by each of the parties. The City of Huntington shall prepare and retain records of said actual costs and allow inspection thereof by the'other parties for a period of five (5) years following the fiscal year in question. 3. Determination of the total cost for communication, training and reporting personnel and equipment shall be limited to the following items: (a) Telephone (1) Two (2) fire --reporting trunk lines from each city. (2) One (1) station telephone plus line charges to each fire station. (3) Rental of "Emergency Reporting Board" and equipment directly related to its function. (b) Vocal Alarm System One (1) vocal -alarm speaker plus line charges to each fire station. (c) Personnel Two (2) qualified fire dispatchers con- tinuously on duty in the communications center. (d) One radio -paging system (e) Other personnel, components or equipment agreed to by CITIES and COUNTY. u. 4. The term of this agreement shall be for ten (10) years subject to prior withdrawal of any of CITIES or COU14TY as herein provided. If any CITY or COUNTY chooses to withdraw from this agreement, it shall give notice in writing to each other contracting CITY and COUNTY on or before January 1 of any year, and such withdrawal shall become effective the following July 1. If such notice is given, any remaining party may withdraw by giving similar notice on or before the following January 30. Any withdrawal notice by Huntington Beach shall serve to terminate this agreement on the effective date. 5. Each of CITIES and COUNTY shall install the fol- lowing minimum communication equipment for each fire station: (a) Direct telephone line with handset terminating at the communication center in Huntington Beach. (b) Vocal or paging line and speaker terminating at the communication center in Huntington Beach. (c) A station radio teleprinter. 6. CITIES shall install two (2) emergency--reporting- trunk lines terminating at the communication center in Huntington Beach. 7. CITIES or COUNTY may have installed, special or extra telephone equipment or electronic equipment in addition to the standard equipment required by this agreement, provided that the installing CITY or COUNTY shall pay for all such special or extra equipment. 5. 8. All installation, maintenance and repair orders for any communication equipment shall be directed through the City of Huntington Beach. 9. The City of Huntington Beach shall bill each of the CITIES and COUNTY quarterly for their share of the costs as determined under this agreement and each CITY and COUNTY shall pay the billed amount within thirty (30) days after such billing. 10. The responsible authorities for this agreement shall be the fire chiefs and city managers, city administrators or county administrator. Operational procedure shall be agreed upon by a majority of CITIES and COUNTY fire chiefs and each CITY and COUNTY shall be responsible for the proper disposition of its business telephone calls. 11. CITIES and COUNTY shall provide and maintain ac- curate mapping and related fire protection information necessary for efficient fire dispatching. This information and all subse- quent information shall be the responsibility of CITIES and COUNTY and all changes shall be sent to the communications center. 12. Title to all property acquired hereunder shall be in the City of Huntington Beach and shall so remain following termination of this agreement. 13. No party, nor any of its officers, agents or employees shall assume any liability by reason of anything done or omitted to be done by the remaining parties or any of there or by their officers, agents and employees under or in connection 6. with any work performed pursuant to this agreement. Each party shall fully indemnify, save, hold harmless and defend the other parties, their officers, agents and employees from any and all liability, losses and costs imposed for injury occurring by reason of anything done or omitted to be done by said party, its officers, agents and employees. Recommendation: Approve the new contract between the Net 6 cities for the purpose of providing a functionally consolidated emergency fire communications, fire training, incident reporting and fire investigation system. Analysis: he unctionally consolidated emergency communications, training reporting and fire investigation system has been in effect for ten years and has expired. The current operation has been very satisfactory, cost effective and should be updated to include current activities and renewed. This agreement is between the same parties as before. This includes the cities of Fountain Valley, Huntington Beach, Seal Beach and Westminster. There is a move by the four city fire chiefs to expand this contract to Include the unincorporated areas of Sunset Beach and Midway City. This expanded contract is currently being reviewed by the County and hopefully will come before the Council within the next three months. The conditions and elements and this agreement are essentially the same as the last contract. The electrowriter system has been replaced with a radio teleprinter. Also, the contract has been expanded to include those functions currently being performed such as training, records and fire Investigations. Funding Source: The JOINT POWEF15 BUDGET approved by the City Council on June 23, 1980 Includes all costs covered in this contract. The City of Huntington Beach is responsible for 55.8 percent of the budgeted $402,415. Alternative Action: Eliminate the functional consolidated activities between the fire services of the four cities. r10 Wil AN AGREEMENT FOR CONSOLIDATED ENFERGENCY COMMUNICATIONS - TRAINING AND REPORTING SYSTEM THIS AGREEMENT is made and entered into by and between the City of Huntington Beach, City of Westminster, City of Fountain Valley and City of Seat Beach, each a corporation of the State of Ca1fomia, hereinafter referred to jointly and severally as "CITIES". For convenience, Consolidated Fire Emergency Communications, Training and Reporting System shall be hereinafter referred to as "SYSTEM". WWEREAS, CITIES are expanding and increasing in population with the result that the demands placed upon such entities for emergency fire services has increased proportionately, thereby 'requiring expenditures of money by each for such fire services; and Studies by CITIES have disclosed that SYSTEM would greatly reduce the total cost of providing maximum emergency fire protectioi and would permit maximum use of equipment and manpower in cooperative ventures, thereby increasing fire emergency efficiency and defense capabilities of CITIES; and CITIES each have the power and authority to provide emergency fire services, facilities, equipment, personnel and dispatching for their respective cities and are capable of providing such facilities and services at this time; and Government Code Sections 6500 et seq. provide that two or more public agencies, by agreement, may jointly exercise any power common to the controctimI parties; and CITIES, having heretofore entered into a joint powers agreement for this purpose, they now desire to extend such agreement for SYSTEM for fire services and facilities for the reasons hereinafter specified, such facilities to be located at the Joint Powers Training Center, 18301 Gothord Street in and operated by the City of Huntington Beach. The City of Huntington Beach shall continue to provide to CITIES dispatching, training and fire -reporting services ' through a system to be located in and operated by said City of Huntington Beach. 2. ' Determination of the total cost for communication, training and reporting personnel and equipment shall be limited to the following items: (a) Telephone I. Two (2) fire -reporting -trunk lines from each city. •2. One (I) station telephone plus line charges to each fire station. 3. Rental of "Emergency Reporting Board" and equipment directly related to its function. (b) Vocal Alarm System One (1) vocal -alarm speaker plus line charges to each fire station. (c) Personnel. Two (2) qualified fire dispatchers continuously on duty at the communications center. (d) One Rodio-paging System (e) Other personnel, components or equipment agreed to by CITIES. 4. The term of this agreement shall be for ten (10) years subject to prior withdrawal of any of CITIES as herein provided. If any CITY Chooses to withdraw from this agreement, it shall give notice in writing to each other contracting CITY on or before January I of any year, and such withdrawal shall become effective the following July 1. . 5. Each of CITIES shall install the following minimum communication equipment for each fire station: (a) Direct telephone line with handset terminating at the communi- cation tenter in Huntington Beach. 3. (b) Vocal or paging line and speaker terminating at the communication center in Huntington Beach. (c) A station radio teleprinter. 6. CITIES shall install two (2) emergency -reporting -trunk lines terminating at the communication center in Huntington Beach. 7. CITIES may have installed, special or extra telephone equipment or electronic equipment in addition to the standard equipment required by this agreement, provided that the installing CITY shall pay for all such special or extra equipment. 8. All installation, maintenance and repair orders for any 'communication equipment shall be directed through the City of Huntington Beach. 9. The City of Huntington Beach shall bill each of the CITIES quarterly for their share of the costs as determined under this agreement and each CITY shall pay the billed amount within thirty (30) days after such billing, 10. The responsible authorities for this agreement shall be the fire chiefs and city managers or city administrators. Operational procedure shall be agreed upon by a majority 'of CITIES fire chiefs and each CITY shall be responsible for the proper disposition of its business telephone calls. 11. CITIES shall provide and maintain accurate mapping and related fire protection information necessary for efficient fire dispatching. This information and all subsequent information shall be the responsibility of CITIES and all changes shall be sent to the communications center. (rest of page not used) C 4. 12. Neither the City of Huntington Beach nor any of its officers, agents or employees shall assume any liability by reason of anything done or omitted to be done by CITIES or any of them or by CITIES officers, agents and employees under or in connection with any work performed pursuant to this agreement. CITIES and each of them shall fully indemnify and save and hold harmless the City of Huntington Beach, its officers, agents and employees from any and all liability, losses and costs imposed for injury occurring by -reason of anything done or omitted to be done by them, and they agree to enter and defend any suit or action brought or arising out of this agreement against the City of Huntington Beach, its officers, agents or employees.
