SERVICES -ENGINEERING GEOLOGIST CA 76-77 From Floyd G. - Bels.ito,; Acting City Administrator Date June 1, 1976 Attached is ;a;, proposed contract. be"twcen• the County of .Orange and the ttuntington,Beach .under which the County, , through its Environmental hlana'gement,Agency, would make available to the City the s"ervice5 of the engineering Geologist in.their Department of Building and Safety. The.City Council has previously. authorized the City to negotiate with the County for the preparation of this contract. The reason for the contract is contained in, the Alquist-Priolo Act. This Act requires that: development within certain portions of''the City, as mapped by the State Department of Mines and Geology, be investigated.by a.regi.stered engineering geologist for potential surface rupture because of seismic activity. The Act further pro- vides" that such investigation and the resultant report be reviewed and checked by a registered engineering geologist. The City does not have such a position on its staff. In addition, the need for 'these. services wi11be occasional and is not sufficient to justify the City's hiring an engineering geologist. The attached proposed contract sets forth the conditions upon which the County will provide the subject services to the City. With res- pect to its technical content, it is quite satisfactory. Normally, the rate of-compensat-ion referred to in Paragraph B should be more specifically defined either by a dollar amount or by a formula to be used to determine the dollar amount. However, attached as Exhibit A is a statement of -the billing rates utilized by the County. We are told that these rates have been in effect for some time and will probably continue to be used for the next few years. it is our opin- ion that the rates contained in this report are quite reasonable for such professional services. We feel thin because. of the manner in which this contract wi 11. operate, the treatment of the question of billing rates is satisfactory. We base this. on the fact that the City will be in complete control of the work done under the contract in that no work will be done unless and untI. requested by.the City. Secondly,.the contract provides that. the agreenen' may be terminated by either party upon ten days written no- tice. CA '7677 - 2- June 11 1976 AD. . About 9C% of total costs are for salaries. (2) These rates include Genera] County Overhead of 6.04% (3) An alternate method was used to test the validity of those rates. The ,-lternate method used salary increases, increases in the consumer price index, and the most current information on Fringe Benefits, Use Allowances and General County Overhead. Section 895.4, hold each other harmless for liability for injuries as defined in Government Code Section 810.8, caused by the acts or omissions of the other or its officers, employees or agents in the performance of this agreement. E. CITY shall not be liable for the direct payment of any salaries, wages or other compensation to any COUNTY officer or employee, whether a full-time or temporary employee, performing any services hereunder for CITY. F. Except as herein otherwise specified, CITY shall not be liable for compensation or indemnity to any such COUNTY offices- or employee for any injury or sickness arising out of his employment. G.
